and</text></subparagraph></paragraph><paragraph id="HF54AADD7C7E345F0B79E179EC9E656AF"><enum>(4)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H3599145855A64F2FAA8C4BC5D06B9B7B" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="H8E1D66C7AC014021B54EA89106F6227E"><enum>(7)</enum><header>In-kind contributions</header><text display-inline="yes-display-inline">With respect to any project carried out pursuant to a contract or other agreement entered into under paragraph (1) that is not a cooperative agreement or an agreement to provide financial assistance in the form of a grant, the Administrator may contribute on an in-kind basis the portion of the costs of the project that the Administrator determines represents the amount of benefit the National Oceanic and Atmospheric Administration derives from the project.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H189A0A1683F04906A0C5F1A280B7F02C"><enum>(c)</enum><header>Receipt and expenditure of funds; use of resources</header><text display-inline="yes-display-inline">Section 3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952</external-xref>) is amended by adding at the end the following:</text><quoted-block style="USC" id="H8280B7A3940D4637ADB5291B6664A324" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H6F4BF9FBC75841E9A200B22F27C95555"><enum>(e)</enum><header>Receipt and expenditure of funds</header><text display-inline="yes-display-inline">In order to accomplish the purpose set forth in section 2, the Administrator, acting through the Program, may receive and, only to the extent provided in advance in appropriations Acts, expend funds made available by—</text><paragraph id="HA27FC7CAFCAD47D396CFC3657A58EBF6"><enum>(1)</enum><text>any department, agency, or instrumentality of the United States;</text></paragraph><paragraph id="H93A5E954B7374E87BD4E134B55E78B1A"><enum>(2)</enum><text>any State or local government (or any political subdivision thereof);</text></paragraph><paragraph id="HE8D802A5B48C4326897D556F76BB7D19"><enum>(3)</enum><text>any Indian tribe;</text></paragraph><paragraph id="H88A28F3AAA7F4AC5A7AD3F9ABA6DF742"><enum>(4)</enum><text>any foreign government or international organization;</text></paragraph><paragraph id="H686EE76D6F5C44A5B80818558BB0EEDC"><enum>(5)</enum><text>any public or private organization; or</text></paragraph><paragraph id="H33E67AEC0DFC464DAD8F11CA1F2DB297"><enum>(6)</enum><text>any individual.</text></paragraph></subsection><subsection id="HEDE009A5142F47E695A341777FA67DC9"><enum>(f)</enum><header>Use of resources</header><text display-inline="yes-display-inline">In order to accomplish the purpose set forth in section 2, the Administrator, acting through the Program, may use, with consent, with reimbursement, and subject to the availability of appropriations, the land, services, equipment, personnel, and facilities of—</text><paragraph id="H2F2DC779883B4029953209FD78BA1D78"><enum>(1)</enum><text>any department, agency, or instrumentality of the United States;</text></paragraph><paragraph id="H8F670BDBE31B4C39B400AFF6E1EDE7F5"><enum>(2)</enum><text>any State or local government (or any political subdivision thereof);</text></paragraph><paragraph id="HB9EFF7F8916C4176A6F43F3F6ADC8632"><enum>(3)</enum><text>any Indian tribe;</text></paragraph><paragraph id="H231ADD26010540DA885C93C7ECBEB9C5"><enum>(4)</enum><text>any foreign government or international organization;</text></paragraph><paragraph id="HE62705BD26E749B0B4672F7473C528B8"><enum>(5)</enum><text>any public or private organization; or</text></paragraph><paragraph id="HF9EA0F071B44468695B06458A9ED3B0E"><enum>(6)</enum><text>any individual.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HB142CAF9E9484362893AE5623481EEA8"><enum>3.</enum><header>Modifications to the Marine Debris Foundation</header><subsection id="HBF9E15DA86644497BA912EB5FADDBA9D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle B of title I of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>) is transferred to appear after section 6 of the Marine Debris Act (P.L. 109-449). </text></subsection><subsection id="HEE6AB26EDB9F43159362208F0B224C3E" commented="no"><enum>(b)</enum><header>Status of foundation</header><text>Section 111(a) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended, in the second sentence, by striking <quote>organization</quote> and inserting <quote>corporation</quote>.</text></subsection><subsection id="H9DD91E88CCDA49AAA78F0F46F239E328"><enum>(c)</enum><header>Board of directors</header><paragraph id="H48376174EE424ADBB8BC73336C96B7E2"><enum>(1)</enum><header>Appointment, vacancies, and removal</header><text display-inline="yes-display-inline">Section 112(b) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended—</text><subparagraph id="HF3F6B287EC654E2CBCBE9422BB110979"><enum>(A)</enum><text>in paragraph (1) in the matter preceding subparagraph (A)—</text><clause id="H6459A7DE1FF946C39FA1BDE031B27E75"><enum>(i)</enum><text>by striking <quote>and considering</quote> and inserting <quote>considering</quote>; and</text></subparagraph><subparagraph id="H048FA7BCEDB8464486C8AF675C4878B1"><enum>(E)</enum><text>by inserting after paragraph (1) the following: </text><quoted-block style="OLC" id="HA9272939DFFA4C369F5A999ACD29EAD0" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="HA4EEA7B04295497BB6C68EE7E4D86363"><enum>(2)</enum><header>Recommendations of Board regarding appointments</header><text display-inline="yes-display-inline">For appointments made under paragraph (1) other than the initial appointments, the Board shall submit to the Under Secretary recommendations on candidates for appointment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H71B7C1D39D744A0FAD59C6E2C648F204"><enum>(2)</enum><header>General powers</header><text>Section 112(g) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended—</text><subparagraph id="HB970CB43E2CC4671BF7484E675166348"><enum>(A)</enum><text>in paragraph (1)(A) by striking <quote>officers and employees</quote> and inserting <quote>the initial officers and employees</quote>; and</text></subparagraph><subparagraph id="H4A2C6DBC34F9469981C97888757F8A36"><enum>(B)</enum><text>in paragraph (2)(B)(i) by striking <quote>its chief operating officer</quote> and inserting <quote>the chief executive officer of the Foundation</quote>.</text></subparagraph></paragraph><paragraph id="H8EB24CBA1C214B0EA339D554438E1D3B"><enum>(3)</enum><header>Chief executive officer</header><text display-inline="yes-display-inline">Section 112 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended by adding at the end the following: </text><quoted-block style="OLC" id="H1A7E06A4E419401D94CD93BA74EFD158" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H4FB7FCA00F6D47728D323AABE7F98559"><enum>(h)</enum><header>Chief executive officer</header><paragraph id="H174605A7482F4B7CA2A5C1F238B6F006"><enum>(1)</enum><header>Appointment; removal; review</header><text display-inline="yes-display-inline">The Board shall appoint and may remove and review the performance of the chief executive officer of the Foundation.</text></paragraph><paragraph id="H60334318E63044449555B5BB139145CD"><enum>(2)</enum><header>Powers</header><text display-inline="yes-display-inline">The chief executive officer of the Foundation may appoint, remove, and review the performance of any officer or employee of the Foundation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7F16C793D8824A429487862D02676798"><enum>(d)</enum><header>Powers of foundation</header><text>Section 113(c)(1) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended in the matter preceding subparagraph (A)—</text><paragraph id="HCCF3C502AB034528A2D0808EBA1EE553"><enum>(1)</enum><text>by inserting <quote>nonprofit</quote> before <quote>corporation</quote>; and</text></paragraph><paragraph id="HCB8603B310294B8EBDA3AED027413095"><enum>(2)</enum><text>by striking <quote>acting as a trustee</quote> and inserting <quote>formed</quote>.</text></paragraph></subsection><subsection id="H24FEA08ABC174FEEB30CC687526A53DB"><enum>(e)</enum><header>Principal office</header><text>Section 113 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended by adding at the end the following: </text><quoted-block style="OLC" id="H1125225A3A75434C8045B284321EE1A0" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H2E0F9DCB5CA14C95A15747D717A376D1"><enum>(g)</enum><header>Principal office</header><text display-inline="yes-display-inline">The Board may locate the principal office of the Foundation outside the District of Columbia and is encouraged to locate that office in a coastal shoreline community.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H87F4537913284B24B3F6C57A150880A2"><enum>(f)</enum><header>Best practices</header><text display-inline="yes-display-inline">Section 113 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act and amended by subsection (e), is further amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HA51E21F6B12540338E71CE6FEFD3D735" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="HBE45F53D00D24A13B6326239410A2CEB"><enum>(h)</enum><header>Best practices</header><paragraph id="HA76691E92FD34ACC8EDBC099D4F0A75C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Foundation shall develop and implement best practices for conducting outreach to Indian Tribes.</text></paragraph><paragraph id="HD936E586965943B484994C3B900F9D63"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The best practices developed under paragraph (1) shall—</text><subparagraph id="H0912DEF149F1435AAC89CD9EF5C4F3EB"><enum>(A)</enum><text display-inline="yes-display-inline">include a process to support technical assistance and capacity building to improve outcomes; and</text></subparagraph><subparagraph id="H44F1BF2A501A43A6AFC47271ABA89021"><enum>(B)</enum><text display-inline="yes-display-inline">promote an awareness of programs and grants available under this Act. </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9B6D50222BEF4FBAA2610B91C7A64F7F"><enum>(g)</enum><header>Use of funds</header><text>Section 118 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended—</text><paragraph id="H9DBB78BEF2A447299FE5A968918679A4"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H88307E13346343DF8A3A5691ACB818ED"><enum>(A)</enum><text>in paragraph (1) by striking <quote>2024</quote> and inserting <quote>2025</quote>;</text></subparagraph><subparagraph id="H1E7605022EF6499B84FA3451D8412B90"><enum>(B)</enum><text>in paragraph (2) by striking <quote>and State and local government agencies</quote> and inserting <quote>, State and local government agencies, United States and international nongovernmental organizations, regional organizations, Indian Tribes, Tribal organizations, and foreign government entities</quote>; Inhofe National Defense Authorization Act for Fiscal Year 2023 (P.L. 117–263) is amended by striking “Maritime” and inserting “Marine”. </text></subsection><subsection id="H0DA39CDBD21F4AA4AA797DEC29A75D81"><enum>(i)</enum><header>Authorization</header><text>Section 9(a) of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1958">33 U.S.C. 1958</external-xref>) is amended by striking <quote>fiscal year 2023</quote> and inserting <quote>each of fiscal years 2024 and 2025</quote>.</text></subsection></section><section id="HD69687CBEB66437EB83B3EB35E0950E6"><enum>4.</enum><header>Transfers</header><subsection id="H5A63F15AAC934E288E1D97E20FD19411"><enum>(a)</enum><header>Save Our Seas 2.0 Act</header><text display-inline="yes-display-inline">Subtitle C of title I of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>) is transferred to appear after section 119 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>) as transferred and redesignated by this Act.</text></subsection><subsection id="HB7E3DAABA47742AC9BDC88944DA50EA1"><enum>(b)</enum><header>Marine Debris Act</header><text>The Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>) is amended—</text><paragraph id="H3FA0AC566C7F49369EDA32A165137923"><enum>(1)</enum><text>by transferring sections 7, 8, and 9 to appear after section 127, as transferred by this Act, and redesignated as sections 131, 132, and 133, respectively; and</text></subparagraph><subparagraph id="H0FEB8EA8BE004A909534A3FE0BA92352"><enum>(B)</enum><text>promote an awareness of programs and grants available under this Act.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8BBFE8D9C99C4BEFB7581C24258B2824"><enum>(g)</enum><header>Use of funds</header><text>Section 118 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4218">33 U.S.C. 4218</external-xref>) is amended—</text><paragraph id="HD7FD500B0AA848B8A0314991A635E94F"><enum>(1)</enum><text>in subsection (a)(2), by striking <quote>and State and local government agencies</quote> and inserting <quote>, State and local government agencies, United States and international nongovernmental organizations, regional organizations, Indian tribes, Tribal organizations, and foreign government entities</quote>; or</text></paragraph><paragraph id="H352594A4738E4036AC27033753E1C9F1"><enum>(6)</enum><text>any individual.</text></paragraph></subsection><subsection id="HEC780A1B494B497EA21ED7D78DD6FB19"><enum>(f)</enum><header>Use of resources</header><text>In order to accomplish the purpose set forth in section 2, the Administrator, acting through the Program, may use, with consent, with reimbursement, and subject to the availability of appropriations, the land, services, equipment, personnel, and facilities of—</text><paragraph id="H699581FC4C2B4F74A555CF537D87998C"><enum>(1)</enum><text>any department, agency, or instrumentality of the United States;</text></paragraph><paragraph id="H88119FB9488B4DBEB15655657B511223"><enum>(2)</enum><text>any State or local government (or any political subdivision thereof);</text></paragraph><paragraph id="HBEB454D5E00B475EB3453FF311AEA545"><enum>(3)</enum><text>any Indian tribe;</text></paragraph><paragraph id="H50B20FFC553E4FAF93B4384588AE9ED1"><enum>(4)</enum><text>any foreign government or international organization;</text></paragraph><paragraph id="H20EC3165929447209EB7BFB879B8F15D"><enum>(5)</enum><text>any public or private organization;
