<official-title display="yes">To amend the Save Our Seas 2.0 Act to improve the administration of the Marine Debris Foundation, to amend the Marine Debris Act to improve the administration of the Marine Debris Program of the National Oceanic and Atmospheric Administration, and for other purposes.</official-title>

<section id="H14ADE673BFD84FAA8AB218C71A80C6F1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Save Our Seas 2.0 Amendments Act</short-title></quote>.</text></section> <section id="H40886EDC669046A4A879E113A65CE0C6"><enum>2.</enum><header>Modifications to the Marine Debris Program of the National Oceanic and Atmospheric Administration</header> <subsection id="HD0CE089DB2A8417A962FFF1EFE369796"><enum>(a)</enum><header>In general</header><text>The Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>) is amended by inserting before section 3 the following:</text> 
<quoted-block style="OLC" id="H79F53347922640AD8D0A8DDFD0452E40" display-inline="no-display-inline"> 
<subtitle id="H6F4CECB3E235440589D9B3AE2CBC8E61"><enum>A</enum><header>NOAA And Coast Guard Programs</header></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD0FB0F5B9AED4CBFBBC974EFB76D090C"><enum>(b)</enum><header>Grants, cooperative agreements, contracts, and other agreements</header><text>Section 3(d) of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952(d)</external-xref>) is amended—</text> <paragraph id="H38D9AD98937047E58F65ADFF6EF8562B"><enum>(1)</enum><text>in the subsection heading by striking <quote><header-in-text level="subsection" style="OLC">and contracts</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">contracts, and other agreements</header-in-text></quote>;</text></paragraph> 
<paragraph id="H76EE4D7851724779A904B0BE304A11DA"><enum>(2)</enum><text>in paragraph (1) by striking <quote>and contracts</quote> and inserting <quote>, contracts, and other agreements</quote>;</text></paragraph> <paragraph id="HEFEBD08117544154902344535E2B48AE"><enum>(3)</enum><text>in paragraph (2)—</text> 
<subparagraph id="H4CD47EEF488A4A96A7E982BEF117613A"><enum>(A)</enum><text>in subparagraph (B)—</text> <clause id="H42141F5A909140A893D73A2C8CDE17C2"><enum>(i)</enum><text>by striking <quote>part of the</quote> and inserting <quote>part of a</quote>; and</text></clause> 
<clause id="HD245EC0ED03E43B29C5D8D0C12081752"><enum>(ii)</enum><text>by inserting <quote>or (C)</quote> after <quote>subparagraph (A)</quote>; and</text></clause></subparagraph> <subparagraph id="HF44898DE2111477F964E5E04ADA6C5F1"><enum>(B)</enum><text>in subparagraph (C) in the matter preceding clause (i) by inserting <quote>and except as provided in subparagraph (B)</quote> after <quote>subparagraph (A)</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H3995877144CC4DD292B9457933365AB0"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block id="H3C890A7E35484BDAAD4D6E74912A64B4" style="OLC"> <paragraph id="HCE47AF53641E45A495B593706D0BB239"><enum>(7)</enum><header>In-kind contributions</header><text>With respect to any project carried out pursuant to a contract or other agreement entered into under paragraph (1) that is not a cooperative agreement or an agreement to provide financial assistance in the form of a grant, the Under Secretary may contribute on an in-kind basis the portion of the costs of the project that the Under Secretary determines represents the amount of benefit the National Oceanic and Atmospheric Administration derives from the project.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H1B0DB6169A784F82A93B04CA673BB6D4"><enum>(c)</enum><header>Receipt and expenditure of funds; use of resources</header><text>Section 3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H2AD4331CA3854FE5A3DDC3A0A32B0873" style="OLC"> <subsection id="HDB5E6D43227C461EA0FA13E065991071"><enum>(e)</enum><header>Receipt and expenditure of funds</header><text>In order to accomplish the purpose set forth in section 2, the Under Secretary, acting through the Program, may receive and, only to the extent provided in advance in appropriations Acts, expend funds made available by—</text> 
<paragraph id="H338C243317B64F05B2FD6DEF7246F85D"><enum>(1)</enum><text>any department, agency, or instrumentality of the United States;</text></paragraph> <paragraph id="HB98A89EB87C24D2FB996AFDFF96DDFB1"><enum>(2)</enum><text>any State or local government (or any political subdivision thereof);</text></paragraph> 
<paragraph id="HE7ACDC35CF484A90BEAB5AA6E694B6CC"><enum>(3)</enum><text>any Indian tribe;</text></paragraph> <paragraph id="HE8F78158D5944435A978F32494AAAED3"><enum>(4)</enum><text>any foreign government or international organization;</text></paragraph> 
<paragraph id="HA044ACC767D645C4ADF246E74A8C13A5"><enum>(5)</enum><text>any public or private organization; or</text></paragraph> <paragraph id="HC8B801D0B0E64FD2996FF734D798254D"><enum>(6)</enum><text>any individual.</text></paragraph></subsection> 
<subsection id="HB1D6D8E7BC65459A9DA8D5A934F02017"><enum>(f)</enum><header>Use of resources</header><text>In order to accomplish the purpose set forth in section 2, the Under Secretary, acting through the Program, may use, with consent, with reimbursement, and subject to the availability of appropriations, the land, services, equipment, personnel, and facilities of—</text> <paragraph id="H6CB87AE1D46B46AA8CE19710A774CA87"><enum>(1)</enum><text>any department, agency, or instrumentality of the United States;</text></paragraph> 
<paragraph id="H1374F25EC0F14626B16179BC747A9463"><enum>(2)</enum><text>any State or local government (or any political subdivision thereof);</text></paragraph> <paragraph id="H32684225A3C842DC932E1903C2DCBC28"><enum>(3)</enum><text>any Indian tribe;</text></paragraph> 
<paragraph id="H5B6C66B46D9E4F1A9E5879ED702BBE7A"><enum>(4)</enum><text>any foreign government or international organization;</text></paragraph> <paragraph id="H48CFAD56E7FE4E56BE021F59CFBB703A"><enum>(5)</enum><text>any public or private organization; or</text></paragraph> 
<paragraph id="H8D0790C8EBDB436BBE236D013E011697"><enum>(6)</enum><text>any individual.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H42D24AFB383C41809484922B4141CA21"><enum>3.</enum><header>Modifications to the Marine Debris Foundation</header> <subsection id="H62CDF4CD8E8A42B283F63AEADA6A6FEC"><enum>(a)</enum><header>In general</header><text>Subtitle B of title I of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>) is transferred to appear after section 6 of the Marine Debris Act (P.L. 109-449).</text></subsection> 
<subsection id="H8E2ECBB4145B470294782A01A023B52E"><enum>(b)</enum><header>Status of foundation</header><text>Section 111(a) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended, in the second sentence, by striking <quote>organization</quote> and inserting <quote>corporation</quote>.</text></subsection> <subsection id="H621061D1B76D4CC2BA661C1DAC1C8C0D"><enum>(c)</enum><header>Board of directors</header> <paragraph id="H049572E119BC4BBD9E00CD0C6720CEB6"><enum>(1)</enum><header>Appointment, vacancies, and removal</header><text>Section 112(b) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended—</text> 
<subparagraph id="H9CB349C5F42346CDB5AB04AC18347246"><enum>(A)</enum><text>by redesignating paragraphs (1) through (5) as paragraphs (2) through (6) respectively;</text></subparagraph> <subparagraph id="HB2D375394E074A8CB31400C05BCACFFC"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting before paragraph (2), as redesignated, the following:</text>

<paragraph id="H20AD87C47F5848DBA66AFB8CD15F4F35"><enum>(1)</enum><header>Recommendations of board regarding appointments</header><text display-inline="yes-display-inline">For appointments made under paragraph (2), the Board shall submit to the Under Secretary recommendations on candidates for appointment.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H69500BFA16714375B7B308BDFEFB960F"><enum>(C)</enum><text>in paragraph (2), as redesignated, in the matter preceding subparagraph (A)—</text>

<clause id="H95746712BFFE47FEAC4949D2B10A8860"><enum>(i)</enum><text>by inserting <quote>the Administrator of the United States Agency for International Development,</quote> after <quote>Service,</quote>; and</text></clause> <clause id="HDE9A44E0CDBB43C78CC2987568F3052B"><enum>(ii)</enum><text>by inserting <quote>and with the approval of the Secretary of Commerce</quote> after <quote>EPA Administrator</quote>. </text></clause></subparagraph> </paragraph> 
<paragraph id="H3F31CBEA12A246BCAB16D93B98F790C0"><enum>(2)</enum><header>General powers</header><text>Section 112(g) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended—</text> <subparagraph id="H9E09676F8CE94073A2EEA678D5F71D9F"><enum>(A)</enum><text>in paragraph (1)(A) by striking <quote>officers and employees</quote> and inserting <quote>the initial officers and employees</quote>; and</text></subparagraph> 
<subparagraph id="HC7473B55CAE94243AE54D192386F9373"><enum>(B)</enum><text>in paragraph (2)(B)(i) by striking <quote>its chief operating officer</quote> and inserting <quote>the chief executive officer of the Foundation</quote>.</text></subparagraph></paragraph> <paragraph id="H51892D537F324ACFB7D41937C8C641AD"><enum>(3)</enum><header>Chief executive officer</header><text>Section 112 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended by adding at the end the following:</text>

<paragraph id="HF14A37DD70EE486B8E69DEEFA6319A45"><enum>(1)</enum><header>Appointment; removal; review</header><text>The Board may appoint, remove, and review the performance of the chief executive officer of the Foundation.</text></paragraph> <paragraph id="H442BABBE412C4F448266487A5A35C457"><enum>(2)</enum><header>Powers</header><text>The chief executive officer of the Foundation may appoint, remove, and review the performance of any officer or employee of the Foundation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H73B5010D3AF4461E9B895432D855F5B2"><enum>(d)</enum><header>Powers of foundation</header><text>Section 113(c)(1) of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended in the matter preceding subparagraph (A)—</text> <paragraph id="H812956FEEF664DFFA4EE424B718C36F4"><enum>(1)</enum><text>by inserting <quote>nonprofit</quote> before <quote>corporation</quote>; and</text></paragraph> 
<paragraph id="H73F295B99236425EB6EC858A7E1ABCE4"><enum>(2)</enum><text>by striking <quote>acting as a trustee</quote> and inserting <quote>formed</quote>.</text></paragraph></subsection> <subsection id="H2FA757B7293B41CB92195EA033E25268"><enum>(e)</enum><header>Principal office</header><text>Section 113 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended by adding at the end the following:</text>

<subsection id="H0384B433D0634BDC98FCE0C7A26A4D0D"><enum>(g)</enum><header>Principal office</header><text>The Board shall locate the principal office of the Foundation in the National Capital Region, as such term is defined in section 2674(f)(2) of title 10, United States Code, or a coastal shoreline community.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HA0E5B5D20C96460DBEED85C9416EF4F2"><enum>(f)</enum><header>Best practices</header><text>Section 113 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act and amended by subsection (e), is further amended by adding at the end the following:</text>

<subsection id="H00FFAE4982D64802B3254340BCE84050"><enum>(h)</enum><header>Best practices</header> 
<paragraph id="HF4586B37E38C4FD6B9473308C3F4E3F0"><enum>(1)</enum><header>In general</header><text>The Foundation shall develop and implement best practices for conducting outreach to Indian Tribes.</text></paragraph> <paragraph id="H3E6AA7785C4446F78BA9BAD27025147F"><enum>(2)</enum><header>Requirements</header><text>The best practices developed under paragraph (1) shall—</text> 
<subparagraph id="H89F7DFD734E44713BE7327B333AD7DC9"><enum>(A)</enum><text>include a process to support technical assistance and capacity building to improve outcomes; and</text></subparagraph> <subparagraph id="H8EE099FD570B4F67B57E4F50DE946EF8"><enum>(B)</enum><text>promote an awareness of programs and grants available under this Act.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE84B05C386BE41D581B7EB43ADAC85DB"><enum>(g)</enum><header>Use of funds</header><text>Section 118 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred by this Act, is amended—</text> <paragraph id="HCDA94401719B446BA2CA9ABD0F7C85CB"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H8305872EFCFD439A8FB1BAFAFC7161E8"><enum>(A)</enum><text>in paragraph (1) by striking <quote>2024</quote> and inserting <quote>2025</quote> and</text></subparagraph> <subparagraph id="H4844D09CADBD42A2B4B948B4980C8572"><enum>(B)</enum><text>in paragraph (2) by striking <quote>and State and local government agencies</quote> and inserting <quote>, State and local government agencies, United States and international nongovernmental organizations, regional organizations, Indian Tribes, Tribal organizations, and foreign government entities</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H0208E93C5BAE45238D7251C917BA4CBE"><enum>(2)</enum><text>in subsection (b)(2) by striking <quote>and State and local government agencies</quote> and inserting <quote>, State and local government agencies, United States and international nongovernmental organizations, regional organizations, Indian Tribes, Tribal organizations, and foreign government entities</quote>.</text></paragraph></subsection> <subsection id="H7C3DC86951E04543970D23F86DDC42A4"><enum>(i)</enum><header>Authorization</header><text>Section 9(a) of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1958">33 U.S.C. 1958</external-xref>) is amended by striking <quote>fiscal year 2023</quote> and inserting <quote>each of fiscal years 2024 and 2025</quote>.</text></subsection></section> 
<section id="HF461AF822DEF423EA73BCE12FCB2376D"><enum>4.</enum><header>Transfers</header> 
<subsection id="HF9987CE446634A73829156C211E2F991"><enum>(a)</enum><header>Save our seas 2.0 act</header><text>Subtitle C of title I of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>) is transferred to appear after section 119 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>) as transferred and redesignated by this Act.</text></subsection> <subsection id="HC603FCCB9846476FABCEE10128943366"><enum>(b)</enum><header>Marine debris act</header><text>The Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>) is amended—</text> 
<paragraph id="HD055883BBCAB411592C7CC8D9D4D02DF"><enum>(1)</enum><text>by transferring sections 7, 8, and 9 to appear after section 127, as transferred by this Act, and redesignated as sections 131, 132, and 133, respectively; and</text></paragraph> <paragraph id="H41CAF00D82DE45BFA7149A998DC591F0"><enum>(2)</enum><text>by inserting before section 131, as so transferred and redesignated, the following:</text>

<subsection id="H71BB41417E344CF5A8C2288408971AA1"><enum>(a)</enum><header>In general</header><text>Section 131 of the Marine Debris Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/449">Public Law 109–449</external-xref>), as transferred and redesignated by this Act, is amended—</text> <paragraph id="H9E77B9B7296A4A2B92B6F45D874A483E"><enum>(1)</enum><text>by striking paragraph (1);</text></paragraph> 
<paragraph id="H0316ACF9E0734732A02ABADD4AD7256B"><enum>(2)</enum><text>by redesignating paragraphs (2), (3), (4), (5), (6), and (7) as paragraphs (5), (6), (7), (11), (12), and (13), respectively;</text></paragraph> <paragraph id="HA5A7F3DFC03A4557AC3D6E1A59DDA244"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text>

<paragraph id="HA534F216B81B48AFA5215DBA71EF5D90"><enum>(1)</enum><header>Circular economy</header><text>The term <quote>circular economy</quote> has the meaning given such term in section 2 of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>).</text></paragraph> <paragraph id="H61BC513E92514F879770A59FDA0748E0"><enum>(2)</enum><header>Coastal shoreline community</header><text>The term <quote>coastal shoreline community</quote> means a city or county directly adjacent to the open ocean, major estuaries, or the Great Lakes.</text></paragraph> 
<paragraph id="HEF004B85312744E1A0214AC0E380EDDB"><enum>(3)</enum><header>EPA administrator</header><text>The term <quote>EPA Administrator</quote> has the meaning given such term in section 2 of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>).</text></paragraph> <paragraph id="H5E2E203FE8A643CAA0482F860A4BA501"><enum>(4)</enum><header>Indian tribe</header><text>The term <quote>Indian tribe</quote> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
