which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To mend the Agricultural Marketing Act of 1946 to direct the Secretary of Agriculture to establish and maintain Regional Food and Supply Chain Resource Centers, and for other purposes.</official-title></form><legis-body id="HF023A7456D154D43878978025CC34A8C" style="OLC"><section id="H32A7020BAFC44C2B9C2C01D5E5B585AB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>American Food Supply Chain Resiliency Act of 2023</short-title></quote>. </text></section><section id="H46650EE0889E4850892C13D4D46B67A5"><enum>2.</enum><header>Regional Food and Supply Chain Resource Centers</header><text display-inline="no-display-inline">The Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5396A1E14A6E417A9F07E5FCB0561906"><subtitle id="H9E970E18D3064BE5B62F626C060B8AE5"><enum>H</enum><header>Food Supply Chain Resiliency</header><section id="H01A0F66103214743835998CD454F69AE"><enum>298.</enum><header>Regional Food and Supply Chain Resource Centers</header><subsection id="H7075866E30554A3A9FAAA0E45B6DA9B3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator of the Agricultural Marketing Service, shall enter into competitively awarded cooperative agreements with eligible entities to establish or continue the operations of not fewer than 12 Regional Food and Supply Chain Regional Resource Centers to support small-sized and medium-sized producers of agricultural products and small-sized and medium-sized agricultural businesses through activities, which may include—</text><paragraph id="H8A10BA0EA88845EE8A3EDAAD2AE24A5B"><enum>(1)</enum><text display-inline="yes-display-inline">offering coordination, technical assistance, and capacity building support to small-sized and medium-sized producers of agricultural products and agricultural businesses; </text></paragraph><paragraph id="HFEA04C073F724C708F51DAEA30E130B5"><enum>(2)</enum><text display-inline="yes-display-inline"><italic></italic>supporting supply chain and value chain coordination—</text><subparagraph id="HAA660927885045169CCD799EA7168593"><enum>(A)</enum><text>in the region in which such producers or businesses are located; and</text></subparagraph><subparagraph id="H3B733DFDE58444AC9C84EB1763BB1589"><enum>(B)</enum><text>with the Department of Agriculture, other Federal, State, and Tribal agencies with relevant resources, regional commissions, and other Regional Food and Supply Chain Resource Centers;</text></subparagraph></paragraph><paragraph id="H93207344915D4FEA96A2A6A0DAD9F9DF"><enum>(3)</enum><text display-inline="yes-display-inline">providing technical assistance to such producers and businesses; </text></paragraph><paragraph id="HA3CFEA6082404916AEE1059F57DC8173"><enum>(4)</enum><text display-inline="yes-display-inline">providing grants or other financial assistance to such producers and businesses looking to expand production or a business or start production or a business in such region; and</text></paragraph><paragraph id="HCB474D32DF9D4CF992231E74B3891168"><enum>(5)</enum><text>carrying out such other activities as may be specified by the Secretary. </text></paragraph></subsection><subsection id="H9D98B96947904CEDA59E0C1CE52B41AD"><enum>(b)</enum><header>Focus on Tribal supply chain issues</header><text display-inline="yes-display-inline">At least one Regional Food and Supply Chain Resource Center established pursuant to subsection (a) shall provide coordination, assistance, and capacity building support to address supply chain issues faced by Indian tribes and Tribal organizations (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text></subsection><subsection id="HBC8C15617D1E4EC19FA71414E87533FE"><enum>(c)</enum><header>Application</header><paragraph id="H1CF078E06BFF4ED8B85F6047246247B5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity (including an entity representing a partnership) seeking to enter into a cooperative agreement under this section shall submit to the Secretary an application, at such time, in such manner, and containing such information as the Secretary may require, including how the Regional Food and Supply Chain Resource Centers established by such entity will address food and agricultural supply chain issues faced by underserved communities.</text></paragraph><paragraph id="H21AF88519FFC4BE29DC026C1EE0E5735"><enum>(2)</enum><header>Regional diversity</header><text display-inline="yes-display-inline">In selecting eligible entities to enter into a cooperative agreement under this section, the Secretary shall ensure the regional diversity of such entities.</text></paragraph></subsection><subsection id="H35F6BC8632944AE49F96B058399BFC41"><enum>(d)</enum><header>Term</header><text>The term of a cooperative agreement entered into under this section shall be not less than 4 years.</text></subsection><subsection id="H272818F003F7415DB60FB565D6F25D26"><enum>(e)</enum><header>Coordination</header><text display-inline="yes-display-inline">A Regional Food and Supply Chain Resource Center shall, as a condition on entering into a cooperative agreement under this section, agree to coordinate with other Regional Food and Supply Chain Resource Centers, when appropriate.</text></subsection><subsection id="H8788332BF55B494B93012422E1A434A4"><enum>(f)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Beginning not later than 2 years after the date of the enactment of the <short-title>American Food Supply Chain Resiliency Act of 2023</short-title>, and every 2 years thereafter, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report on—</text><paragraph id="H35719C26FB404F1B828F111103EB603C"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to the activities carried out by the Secretary under this section—</text><subparagraph id="H546A85F2B91442EFAEC95F3BA25C0A16"><enum>(A)</enum><text>a description of such activities; and</text></subparagraph><subparagraph id="H29412F19F8D64E589712B9AD5A8457C9"><enum>(B)</enum><text>the impact of such activities on supply chain issues faced by small-sized and medium-sized producers of agricultural products; and</text></subparagraph></paragraph><paragraph id="H2A935111A8A8423093DBF6A95D1F24F7"><enum>(2)</enum><text>with respect to the activities carried out by the Regional Food and Supply Chain Resource Centers under this section—</text><subparagraph id="H3D19D8739DCD4366A7329F682215D72E"><enum>(A)</enum><text>a description of such activities;</text></subparagraph><subparagraph id="H10320BB3961049E19A2A7B13999AE7CD"><enum>(B)</enum><text>the impact of such activities on supply chain issues faced by small-sized and medium-sized producers of agricultural products and agricultural businesses; and</text></subparagraph><subparagraph id="HD21C6F725ABC4139AD08A5FAD8F8ECAF"><enum>(C)</enum><text display-inline="yes-display-inline">any grants awarded by Regional Food and Supply Chain Resource Centers to such producers and businesses.</text></subparagraph></paragraph></subsection><subsection id="HB588EFF902AA4B0CAE828C49E5A9A804"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H1059F2FB4A6E47FDBF94008113841408" commented="no"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="HE332005CD95F4ECC8A396B3471D6D866" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a producer network or association;</text></subparagraph><subparagraph id="H6A3E92F0568F48C4BCA030D643CFD420"><enum>(B)</enum><text>a food council;</text></subparagraph><subparagraph id="H3290CB0E88AA4C25B382B50F354890B3"><enum>(C)</enum><text display-inline="yes-display-inline">a federally recognized Indian Tribe (as determined pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>)); </text></subparagraph><subparagraph id="H07833ED188394C078A74C74865BF1B6A"><enum>(D)</enum><text>a State government or regional authority;</text></subparagraph><subparagraph id="H004991C56BB04CBA8CD3BB5536D1DB17" commented="no"><enum>(E)</enum><text>an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>); </text></subparagraph><subparagraph id="H85395BFB439B4CB3886097A7581A7B82" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">a nonprofit organization; </text></subparagraph><subparagraph id="H23DEB86D7DD9417F93D599C28A4E6FB7"><enum>(G)</enum><text display-inline="yes-display-inline">an economic development corporation; and</text></subparagraph><subparagraph id="H1409353A526449CAAB0FC09B83AA7530"><enum>(H)</enum><text display-inline="yes-display-inline">such other entities the Secretary determines appropriate. </text></subparagraph></paragraph><paragraph id="H46FE31617D504A24A1F3619D453A6801"><enum>(2)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> has the meaning given such term in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>).</text></paragraph></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HB3E46C3E8EEA414CB58EA31395B655C9"><enum>3.</enum><header>Agriculture Innovation Centers Program</header><text display-inline="no-display-inline">Section 6402(a) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/1632b">7 U.S.C. 1632b(a)</external-xref>) is amended—</text><paragraph id="HA8A6BB872A9A47689EE4A506A691B08E"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H90FAED97120D412BAB7E2B4AA2BEE0E9"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H71CAFD11574C4F5ABAC7FADFA25999DC"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H082EEFB7F0074F28AF43079429B3E8C5"><paragraph id="H5D9072EB3B1D4D5F8AD56B96806EB90D"><enum>(4)</enum><text display-inline="yes-display-inline">research, technical assistance, support services, outreach, and other services to strengthen, maintain, and secure supply chains related to agricultural inputs and agricultural products produced in the United States. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
