R. 8747</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240613">June 13, 2024</action-date><action-desc><sponsor name-id="T000474">Mrs. Torres of California</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require disclosure of asbestos hazards in the sale and lease of residential dwellings, and for other purposes.</official-title></form><legis-body id="H961BDDC01BA843DEB7D2FEE3287D6D9A" style="OLC"><section id="HA8038A1A816D4A47901B9F260E29D666" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Asbestos Exposure in Housing Reduction Act of 2024</short-title></quote>.</text></section><section id="H79444EAA583D48E19881702669A173B3"><enum>2.</enum><header>Disclosure in sale or lease of housing</header><subsection id="H5FEF69D07F694801B158A9EA7E9F7DCB"><enum>(a)</enum><header>Required disclosure</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development and the Administrator of the Environmental Protection Agency shall, not later than the expiration of the 2-year period beginning on the date of the enactment of this Act, jointly issue regulations under this section requiring the disclosure of asbestos hazards in dwellings that are offered for sale or lease. Such regulations shall require that, before the purchaser or lessee is obligated under any contract to purchase or lease the dwelling, the seller or lessor shall—</text><paragraph id="H89D62857BB6B4AF28AA4BD362B482512"><enum>(1)</enum><text>disclose to the purchaser or lessee the presence of any known asbestos, and any known asbestos-based hazards, in such dwelling and provide to the purchaser or lessee any asbestos hazard evaluation report available to the seller or lessor; and</text></paragraph><paragraph id="HFE7AAAD1A493447D9478B831F9246FC6"><enum>(2)</enum><text>permit the purchaser a 10-day period (unless the parties mutually agree upon a different period of time) to conduct a risk assessment or inspection for the presence of asbestos hazards. </text></paragraph></subsection><subsection id="HE5415AE538594F718EE7B3A7C1C98C8F"><enum>(b)</enum><header>Asbestos Warning Statement</header><text display-inline="yes-display-inline">The regulations issued under this section shall provide that every contract for the purchase and sale of any interest in a dwelling, and every contract for lease of a dwelling, shall contain an Asbestos Warning Statement and a statement signed by the purchaser or lessee that the purchaser has—</text><paragraph id="HF7E26A9B76A841DEABF2F3B232C7B78A"><enum>(1)</enum><text>read the Asbestos Warning Statement and understands its contents; and</text></paragraph><paragraph id="H02B6A88C43704FB09C6545EAD6221001"><enum>(2)</enum><text>had a 10-day opportunity (unless the parties mutually agreed upon a different period of time) before becoming obligated under the contract to purchase the dwelling to conduct a risk assessment or inspection for the presence of asbestos-based hazards.</text></paragraph></subsection><subsection id="H4F62029BD1E4402CB717D8855B8F69AF"><enum>(c)</enum><header>Contents of asbestos warning statement</header><text>The Asbestos Warning Statement shall contain the following text printed in large type on a separate sheet of paper attached to the contract: <quote>Every purchaser of any interest in residential real property on which a dwelling is located, and every lessee of a dwelling, is notified that such property may present exposure to asbestos that may place occupants at risk of lung disease and mesothelioma—a form of cancer. The seller of any interest in residential real property, and the lessor of a dwelling, is required to provide the buyer or lessee, respectively, with any information on asbestos-based hazards from risk assessments or inspections in the seller's or lessor’s possession and notify the buyer or lessee of any known asbestos-based hazards. A risk assessment or inspection for possible asbestos-based hazards is recommended prior to purchase or lease.</quote>.</text></subsection><subsection id="H92DBA66761894BB6BDBB0F5776B65A89"><enum>(d)</enum><header>Compliance assurance</header><text>Whenever a seller or lessor has entered into a contract with an agent for the purpose of selling or leasing a dwelling, the regulations issued under this section shall require the agent, on behalf of the seller or lessor, to ensure compliance with the requirements of this section.</text></subsection><subsection id="H2E7F12FA0B5E4932B9A7340B383DA707"><enum>(e)</enum><header>Penalties for violations</header><paragraph id="HF0701CA2CCF845BEA6DAC30BE6AFDDB8"><enum>(1)</enum><header>Monetary penalty</header><text display-inline="yes-display-inline">Any person who knowingly violates any provision of this section shall be subject to civil money penalties in accordance with the provisions of section 102 of the Department of Housing and Urban Development Reform Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/42/3545">42 U.S.C. 3545</external-xref>).</text></paragraph><paragraph id="H2EC70CD4378C417DB9BB3CEF9C14E7D3"><enum>(2)</enum><header>Injunction authority</header><text>The Secretary is authorized to take such lawful action as may be necessary to enjoin any violation of this section.</text></paragraph><paragraph id="H1795D18EEA1C4AB38CE9DAE90754A1C4"><enum>(3)</enum><header>Civil liability</header><subparagraph id="H111CA29C112747678B79C96A4C7F29B5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any person who knowingly violates the provisions of this section shall be jointly and severally liable to the purchaser or lessee in an amount equal to 3 times the amount of damages incurred by such individual.</text></subparagraph><subparagraph id="HE632751579F14F0085251CB013C78076"><enum>(B)</enum><header>Costs</header><text>In any civil action brought for damages pursuant to this paragraph, the appropriate court may award court costs to the party commencing such action, together with reasonable attorney fees and any expert witness fees, if that party prevails.</text></subparagraph></paragraph><paragraph id="H1FBFE217CE3447D6A71B9C81C61B679D"><enum>(4)</enum><header>Prohibited act</header><text>It shall be a prohibited act under sections 15 and 409 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2614">15 U.S.C. 2614</external-xref>, 2689) for any person to fail or refuse to comply with a provision of this section or with any rule or order issued under this section. For purposes of enforcing this section under the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601 et seq.</external-xref>), the penalty for each violation applicable under section 16 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2615">15 U.S.C. 2615</external-xref>) shall not be more than $10,000.</text></paragraph></subsection><subsection id="H912F8B2C436245B1B37E3AB6A48A131F"><enum>(f)</enum><header>Validity of contracts and liens</header><text>Nothing in this section shall affect the validity or enforceability of any sale or contract for the purchase and sale or lease of any interest in residential real property or any loan, loan agreement, mortgage, or lien made or arising in connection with a mortgage loan, nor shall anything in this section create a defect in title.</text></subsection><subsection id="H65686D3D3A0A463E859A3499AA039C87"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the following definitions shall apply:</text><paragraph id="H746477F171DF47118F8CAD42538B08A4"><enum>(1)</enum><header>Asbestos</header><text display-inline="yes-display-inline">The term <quote>asbestos</quote> has the meaning given such term in section 202 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2642">15 U.S.C. 2642</external-xref>).</text></paragraph><paragraph id="H89B64B68E1C24F12B0F5E3889E61D3D3"><enum>(2)</enum><header>Asbestos-based hazard</header><text display-inline="yes-display-inline">The term <quote>asbestos-based hazard</quote> means any condition that causes exposure to asbestos that would result in adverse human health effects as established by the appropriate Federal agency.</text></paragraph><paragraph id="HC781D814C3314BB6B9BDAFE79452AD3E"><enum>(3)</enum><header>Dwelling</header><text display-inline="yes-display-inline">The term <quote>dwelling</quote> means any dwelling, as such term is defined in section 802 of the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3602">42 U.S.C. 3602</external-xref>) that was constructed prior to 2019. The exemptions under section 803(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3603">42 U.S.C. 3603</external-xref>) shall not apply for purposes of this Act.</text></paragraph><paragraph id="HF58C831AE9D2419DB85A89307F79DF6C"><enum>(4)</enum><header>Inspection</header><text display-inline="yes-display-inline">The term <quote>inspection</quote> means an on-site investigation to determine the presence of asbestos and the provision of a report explaining the results of the investigation.</text></paragraph><paragraph id="H26874528BE3946A58D5D1C312D57796C"><enum>(5)</enum><header>Risk assessment</header><text display-inline="yes-display-inline">The term <quote>risk assessment</quote> means an on-site investigation to determine and report the existence, nature, severity and location of asbestos-based hazards in dwellings, including—</text><subparagraph id="H5EC3A6D22A1D4CE39353F9F8ED2366CB"><enum>(A)</enum><text>information gathering regarding the age and history of the housing;</text></subparagraph><subparagraph id="H4F0C0EBCA99F46A385A8002DC8A57507"><enum>(B)</enum><text>visual inspection;</text></subparagraph><subparagraph id="H68850EE095204E73A48728B3911C93DF"><enum>(C)</enum><text>sampling or other environmental sampling techniques;</text></subparagraph><subparagraph id="H748FB90B60FD460EB190CD4ED3428F11"><enum>(D)</enum><text>other activity as may be appropriate; and</text></subparagraph><subparagraph id="HA440E2D762474CA4B4BC8980FC1FDA5A"><enum>(E)</enum><text>provision of a report explaining the results of the investigation.</text></subparagraph></paragraph></subsection><subsection id="H2B7C5426AB54404FA2AE6FB5E02A87FC"><enum>(h)</enum><header>Effective date</header><text display-inline="yes-display-inline">The regulations issued under this section shall take effect upon the expiration of the 2-year period beginning on the date of the enactment of this Act.</text></subsection><subsection id="HC818031241A545D5B6F1BC94792CC7FE"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated for each fiscal year such sums as may be necessary to carry out this section.</text></subsection></section></legis-body></bill>
