<section id="H126D1DA30BCA41E481EE30D36A4EC33C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Health Preceptor Tax Fairness Act</short-title></quote>.</text></section> <section id="H2EB1E50CAF604C13A906767618AF6DF9"><enum>2.</enum><header>Tax credit for eligible health professionals providing covered clinical supervision to qualified students</header> <subsection id="HC852DE6E2D8443DEA52C2016B6511A89"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart A of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 25E the following new section:</text>

<section id="H527B8B030C4B468A9B27C2193C13F616"><enum>25F.</enum><header>Credit for eligible health professionals providing covered clinical supervision to qualified students</header> 
<subsection id="H3D514124FB1A4653ACA34C8E15170A24"><enum>(a)</enum><header>Allowance of credit</header><text display-inline="yes-display-inline">In the case of an eligible health professional who provides clinical supervision to a qualified student in a rural health professional shortage area or covered rural area, there shall be allowed as a credit against the tax imposed by this chapter an amount equal to $1,000 for a taxable year in which the fourth week of such supervision ends.</text></subsection> <subsection id="HF74E5C505EB14FA5870538BB9CB7635C"><enum>(b)</enum><header>Limitation</header><text>The credit allowed under subsection (a) shall not exceed $1,000 with respect to any eligible health professional for any taxable year.</text></subsection> 
<subsection id="H87F0FABAB92348DEB26485D4434B4BB7"><enum>(c)</enum><header>Eligible health professional</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>eligible health professional</term> means, with respect to any clinical supervision, an individual who, at all times during such supervision, is licensed to provide health care services by the State in which such individual provides such supervision, and who is—</text> <paragraph id="H7831D6B3E1794806B226DD8500188DF6"><enum>(1)</enum><text>an advanced practice nurse,</text></paragraph> 
<paragraph id="HBC04A76724004FF788EC84A44AAA046D"><enum>(2)</enum><text>a certified addiction counselor who provides outpatient clinical care,</text></paragraph> <paragraph id="H55B9D5EA318F4E0FA78CC8070B4AA798"><enum>(3)</enum><text display-inline="yes-display-inline">a doctor of dental medicine,</text></paragraph> 
<paragraph id="H6A140F03281645C9BB978FF75B8FF463"><enum>(4)</enum><text display-inline="yes-display-inline">a doctor of dental surgery,</text></paragraph> <paragraph id="HADE96E69D024437B93A14E821083C04D"><enum>(5)</enum><text>a doctor of osteopathy,</text></paragraph> 
<paragraph id="HE5D471444D22411FB6697684E1BA3776"><enum>(6)</enum><text>a licensed clinical or counseling psychologist,</text></paragraph> <paragraph id="HBECC5406A6CC447BABEC2787671DF4A1"><enum>(7)</enum><text>a licensed clinical social worker,</text></paragraph> 
<paragraph id="HDBCC3B2CBD3747D291D987E4D0A400DC"><enum>(8)</enum><text>a licensed professional counselor,</text></paragraph> <paragraph id="HDDA498878EDF4B598703BED6147C13DB"><enum>(9)</enum><text>a licensed marriage and family therapist,</text></paragraph> 
<paragraph id="H2AF0FDC5CA1B4495ADD050E09FDA0B76"><enum>(10)</enum><text>a licensed addiction counselor, </text></paragraph> <paragraph id="HD1280B28EC9A43698ED147B7906BCBDE"><enum>(11)</enum><text>a doctor of medicine,</text></paragraph> 
<paragraph id="H9FE3663CD72948059694ED79EEA00E76"><enum>(12)</enum><text>a pharmacist,</text></paragraph> <paragraph id="HF087B19FAA024ED78622A1E920B1C1B1"><enum>(13)</enum><text>a physician assistant,</text></paragraph> 
<paragraph id="H98A81D785D0847B388A54A60961B6BE7"><enum>(14)</enum><text>a psychiatric nurse specialist,</text></paragraph> <paragraph id="H1A554012A71240D79EF32586BE0F8E45"><enum>(15)</enum><text>a registered dental hygienist, or</text></paragraph> 
<paragraph id="HF5C88849E02F4104A4439FEED4DC85C3"><enum>(16)</enum><text>a registered nurse.</text></paragraph></subsection> <subsection id="H61913CBFE9F84BBC8FE19835DF0A35BD"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text> 
<paragraph id="HC609B3C083FD4A6082A081BDD3BD138E"><enum>(1)</enum><header>Qualified student</header><text display-inline="yes-display-inline">The term <term>qualified student</term> means, with respect to any clinical supervision, a student who, at all times during the supervision, is enrolled in an eligible educational institution in a course of study or program leading to—</text> <subparagraph id="H09D4F7CE71994F6D876C2186F986C609"><enum>(A)</enum><text>a degree in a health profession; or</text></subparagraph> 
<subparagraph id="HEDFE7C4743D346359F52024EF7193BFA"><enum>(B)</enum><text>licensure as a health professional.</text></subparagraph></paragraph> <paragraph id="H8D11A939DBCB489F9C1647657CE88E43"><enum>(2)</enum><header>Eligible educational institution</header><text display-inline="yes-display-inline">The term <term>eligible educational institution</term> has the meaning given such term in section 25A(f)(2).</text> </paragraph> 
<paragraph id="H82C235245100440C9DB0808C2A7B2825"><enum>(3)</enum><header>Rural health professional shortage area</header><text>The term <term>rural health professional shortage area</term> means any portion of a health professional shortage area (as defined in section 332 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254e">42 U.S.C. 254e</external-xref>)) that is outside of a metropolitan statistical area (within the meaning of section 143(k)(2)(B)).</text></paragraph> <paragraph id="H9C0A01A8E42D44F3BFD77AFC23A16C60" commented="no"><enum>(4)</enum><header>Covered rural area</header><text display-inline="yes-display-inline">The term <term>covered rural area</term> means an area defined as rural by the Administrator of the Health Resources and Services Administration for purposes of rural health funding eligibility.</text></paragraph> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB25AC7201E704CA2A99D3FAD9550BD34"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subpart A of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 25E the following new item:</text> <quoted-block style="OLC" id="HF7CE21B8AB7741FA9B602EDF72EEF659" display-inline="no-display-inline"> <toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="H0CD507F55A2648FAAA98693EAD137806" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"> <toc-entry idref="H527B8B030C4B468A9B27C2193C13F616" level="section">Sec. 25F. Credit for eligible health professionals providing covered clinical supervision to qualified students.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H106F47CDF35645D9AEF14E3916A2E35E"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall apply to taxable years beginning on the date after the enactment of this Act.</text></subsection></section>
