Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to require a Federal firearms licensee to provide secure firearms storage information to a prospective firearm transferee, and to amend the Internal Revenue Code of 1986 to provide a gun safe credit, and for other purposes.</official-title></form><legis-body id="H17EEE912321E47D9A2D4446D233A1A63" style="OLC"><section id="H59C01F8F8CB04E709CE054A6462327C2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Storage Information Act of 2024</short-title></quote>.</text></section><section id="H13FE77FA94FD4F6987B8583E8C687B1C"><enum>2.</enum><header>Requirement that a Federal firearms licensee provide secure firearms storage information to a prospective firearm transferee</header><subsection id="HD66D9589F707471E99DBD8B79D6CD9EF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 922(z) of title 18, United States Code, is amended—</text><paragraph id="HDAA5F8C0C6604FA68D394B829AA50A83"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HB33E7BE9ACC84957A3A4B9A9F9EA0578"><enum>(A)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC"><enum-in-header>(1)</enum-in-header> In general.—</header-in-text>Except</quote> and inserting the following:</text><quoted-block style="OLC" id="HA60277242BDF4EEAA190B0309B5253DA" display-inline="no-display-inline"><paragraph id="H8C96284A3EB24C1E82BF82BE0605182C"><enum>(1)</enum><header>Requirement that device be provided with handgun</header><subparagraph id="H9F194DBEE1464606A7FBB8078261B5B1"><enum>(A)</enum><header>In general</header><text>Except</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H21C6BE1FF4234F619B89F921B65147DC"><enum>(B)</enum><text>by adding after and below the end the following:</text><quoted-block style="OLC" id="H879E7855E30B49578C285350E2619906" display-inline="no-display-inline"><subparagraph id="H8B31141A39344D03942D3364B80A612F"><enum>(B)</enum><header>Requirement to provide secure storage information with any firearm</header><text display-inline="yes-display-inline">It shall be unlawful for any licensed importer, licensed manufacturer, or licensed dealer to sell, deliver, or transfer a firearm to any person other than a person licensed under this chapter, unless the transferee is provided with such information about the secure storage of firearms as the Attorney General shall prescribe.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3C656229DF3D424285F9C01B86340356"><enum>(2)</enum><text>in paragraph (2), by striking <quote>(1)</quote> and inserting <quote>(1)(A)</quote>. </text></paragraph></subsection><subsection id="H49F09957A5E84B67BB044FD33D7CFF5E"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Within 6 months after the date of the enactment of this Act, the Attorney General shall prescribe, by regulation, the secure firearms storage information required to be provided by a Federal firearms licensee to a prospective firearm transferee, and ensure that the information includes—</text><paragraph id="H224BBE94882644D786E7E20551303060"><enum>(1)</enum><text display-inline="yes-display-inline">that firearms should be stored unloaded, out of the reach of children and other persons without authorized access, and separately from ammunition;</text></paragraph><paragraph id="HCBC71ADA576643E4A4163092015EA840"><enum>(2)</enum><text>that stored firearms should be secured with a locking device;</text></paragraph><paragraph id="H449E2F8467A14EF8B37A07082846F3DC"><enum>(3)</enum><text>a statement as to the importance of secure storage, including data on the risks of unsecured firearms and benefits of securely stored firearms in relation to firearm suicide, firearm homicide and assault, school firearm violence, unintentional shootings, and theft; and</text></paragraph><paragraph id="H404B6C03CB3A4A0B8CE0BE24D307E5D9"><enum>(4)</enum><text>guidance on the most secure types of devices, including the advantages of gun safes and lock boxes compared to trigger and cable locks.</text></paragraph></subsection></section><section id="H4C24431B71D6478491B3619E7501A7C8"><enum>3.</enum><header>Requirement that certain Federal firearms licensees have a variety of secure gun storage or safety devices available for purchase in their stores</header><text display-inline="no-display-inline">Section 923 of title 18, United States Code, is amended in each of subsections (d)(1)(G) and (e)—</text><paragraph id="H48F1FD80F7A34949988694F00BE15F6A" display-inline="no-display-inline"><enum>(1)</enum><text>by striking <quote>secure gun storage or safety devices</quote> and inserting <quote>a variety of secure gun storage or safety devices, including full-size gun safes, lock boxes and lockers, gun cases, or cable and trigger locks,</quote>;</text></paragraph><paragraph id="H435E57F1D9F9459F980F9FFF1233606B"><enum>(2)</enum><text>by striking <quote>a secure gun storage or safety device</quote> and inserting <quote>secure gun storage or safety devices</quote>; and</text></paragraph><paragraph id="H5680E5C2ADC1474C98EC7880DDEECD2A"><enum>(3)</enum><text>by striking <quote>a device</quote> and inserting <quote>devices</quote>.</text></paragraph></section><section id="H4DC6E6C6CF46494C9CE3717E86C606EF"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by sections 2 and 3 shall take effect on the date that is 6 months after the date of the enactment of this Act.</text></section><section id="H76774392F37A437B854969CCF948487A" section-type="subsequent-section"><enum>5.</enum><header>Gun safe credit</header><subsection id="HB9433B783C1D420CAEC49EFB0D571E8C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart A of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before section 26 the following new section:</text><quoted-block style="OLC" id="H2717BAD8C4AD4FC18002EA709048DB4C" display-inline="no-display-inline"><section id="H7E178A0BA76F47ABAE510872D3EC4BC7"><enum>25F.</enum><header>Gun safe credit</header><subsection id="H435AFF1E4EAD4EB28521F5EC22B2DBA8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of an individual, there shall be allowed as a credit against the tax imposed by this chapter for the taxable year an amount equal to the amounts paid or incurred by the taxpayer for the taxable year for the purchase of a qualified gun safe.</text></subsection><subsection id="H44F3B5C0B8704D89A60F792E9E32C266"><enum>(b)</enum><header>Limitation</header><text>The credit allowed under this section with respect to any taxpayer for any taxable year shall not exceed the excess (if any) of $500 over the aggregate credits allowed under this section with respect to such taxpayer for all prior taxable years.</text></subsection><subsection id="HB11FD0333DFC48EAA71E6E754A79240E"><enum>(c)</enum><header>Qualified gun safe</header><text>For purposes of this section, the term <quote>qualified gun safe</quote> means any safe, gun safe, gun case, lock box, or other device—</text><paragraph id="H0E6478F3E98C448286AF2B6D073DF5AE"><enum>(1)</enum><text>the original use of which commences with the taxpayer,</text></paragraph><paragraph id="HC7800B949C164170AEC743B6F6858D72"><enum>(2)</enum><text>which is acquired by the taxpayer—</text><subparagraph id="HDC97233A3C94491BB61F5F0192B82DCA"><enum>(A)</enum><text>to store one or more firearms, and</text></subparagraph><subparagraph id="H168BA7127ACE4CAC9EA1773B7D5854E2"><enum>(B)</enum><text>not for resale,</text></subparagraph></paragraph><paragraph id="HAE2BD973FFC942CFBE1A1120920D4D13"><enum>(3)</enum><text>which is designed, or can be used, for the secure and fully-contained storage of one or more firearms, and</text></paragraph><paragraph id="H1BA40F5BB58E4C1A91ECE7497878CD63"><enum>(4)</enum><text display-inline="yes-display-inline">which is designed to be unlocked only by authorized users by means of a key, a combination, biometric credentials, or other similar means.</text></paragraph></subsection><subsection id="H5185892A6BBF4451AF44045CA61B0E41"><enum>(d)</enum><header>Reduction in basis</header><text>For purposes of this subtitle, the basis of any property for which a credit is allowable under subsection (a) shall be reduced by the amount of such credit so allowed.</text></subsection><subsection id="HEB74A1D5D0FF4E39888B0B0ECC25BF79"><enum>(e)</enum><header>No double benefit</header><text>The amount of any deduction allowable under this chapter with respect to a property for which a credit is allowable under subsection (a) shall be reduced by the amount of such credit so allowed.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H68C0944E8F354C658563F0EE46AB5B9D"><enum>(b)</enum><header>Conforming amendment</header><text>Section 1016(a) of such Code is amended by striking <quote>and</quote> at the end of paragraph (37), by striking the period at the end of paragraph (38) and inserting <quote>, and</quote>, and by adding at the end the following new paragraph: </text><quoted-block style="OLC" id="H2ED276B963A3446BA81076D016611237" display-inline="no-display-inline"><paragraph id="H84A56D395D26443AAFABED762E97A13A"><enum>(39)</enum><text display-inline="yes-display-inline">to the extent provided in section 25F(d).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HAD6EDC98FB2049B5B01DDDEBFE87C72C"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subpart A of part IV of subchapter A of chapter 1 of such Code is amended by inserting before the item relating to section 26 the following new item:</text><quoted-block style="OLC" id="HA933A687C05F46049B48898333F4643A" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 25F. Gun safe credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF8214B4BC5BF4F62B739AD54E0137820"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
