Edgar Hoover F.B.I. Building, and for other purposes.</official-title></form><legis-body id="HAEE7981534BF4266B09B7334FBB037A4" style="OLC"><section id="H0544CC8D10D3410D8049466D1D23A147" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Commission on Renaming the J. Edgar Hoover FBI Headquarters Building Act of 2023</short-title></quote>.</text></section><section id="HC1C7553AFDBC42B3A60D7B551695CB3A" section-type="subsequent-section"><enum>2.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established a commission to be known as the <quote>National Commission on Renaming the J. Edgar Hoover FBI Headquarters Building</quote> (in this Act referred to as the <quote>Commission</quote>).</text></section><section id="HD016E900C94242EAA39792E736EFE875"><enum>3.</enum><header>Duties of Commission</header><subsection id="HC9BEA3901C3F400596F8487D7145ECEA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall review the designation of the J. Edgar Hoover F.B.I. Building, located at 935 Pennsylvania Avenue Northwest in the District of Columbia, and provide recommendations on the redesignation of such building.</text></subsection><subsection id="H7C75AC45C8654B699BA1F37FBB6F836F"><enum>(b)</enum><header>Scope of review</header><text display-inline="yes-display-inline">In conducting the review and developing the recommendations required by subsection (a), the Commission shall consider the following:</text><paragraph id="H65AE3EC2C679475F84977A23CC333944"><enum>(1)</enum><text display-inline="yes-display-inline">The criteria for any redesignation of the J. Edgar Hoover F.B.I. Building, including—</text><subparagraph id="H1273F85D4D4646D1AF7ED47DE329C262" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">ensuring that such redesignation reflects—</text><clause id="HE09444BA5EBA4829B78920A72F679155"><enum>(i)</enum><text>the mission and values of the Federal Bureau of Investigation (in this Act referred to as the <quote>FBI</quote>);</text></clause><clause id="HAF5F1CCCFBC54A928ACF933685E23B6C"><enum>(ii)</enum><text>racial, ethnic, and gender diversity; and</text></clause><clause id="H661902D8B9C64304BD183E6EA78A8F3E"><enum>(iii)</enum><text>the values of the United States Constitution;</text></clause></subparagraph><subparagraph id="H603E609D06344A108CC43BAA7A36873A"><enum>(B)</enum><text display-inline="yes-display-inline">serving as an inspiration to FBI employees and citizens of the United States; and</text></subparagraph><subparagraph id="H0946E86CCAC24EAD90F3AEA1DDCE8922"><enum>(C)</enum><text>honoring living persons when appropriate and in exceptional cases.</text></subparagraph></paragraph><paragraph id="H8842D0209F9742BEA2D0B997D79A8E3B"><enum>(2)</enum><text>The rules, regulations, and procedures for the designation of Federal buildings.</text></paragraph><paragraph id="HCB4C1BA6CE704C10ABD056CCCB786E95"><enum>(3)</enum><text>Any other criteria that the Commission determines are relevant.</text></paragraph></subsection></section><section id="H5AE0F636547C43D7BD12C835C4E06B95"><enum>4.</enum><header>Membership</header><subsection id="H8A22C6897F73445DA098C72AEBA0D205"><enum>(a)</enum><header>Number and appointment</header><text display-inline="yes-display-inline">The Commission shall be composed of 8 members appointed as follows:</text><paragraph id="HE975167D27FF4F2C821FC65D1B2B6EBC"><enum>(1)</enum><text display-inline="yes-display-inline">2 members appointed by the President, in consultation with the Attorney General and Director of the FBI.</text></paragraph><paragraph id="H12A267F327E44FB9BADC9AAE9C5F7BE8"><enum>(2)</enum><text display-inline="yes-display-inline">2 members appointed by the majority leader of the Senate.</text></paragraph><paragraph id="HDC3409D76EF64A1FB4AA75CEF2B30DE9"><enum>(3)</enum><text>1 member appointed by the minority leader of the Senate.</text></paragraph><paragraph id="HCC0070D21F87492AB2B4C3B600A5062B"><enum>(4)</enum><text>2 members appointed by the Speaker of the House of Representatives.</text></paragraph><paragraph id="H82EA8933C7364E9AA0B4EC629E9A2831"><enum>(5)</enum><text>1 member appointed by the minority leader of the House of Representatives.</text></paragraph></subsection><subsection id="H8FE48656E19945159EEED6F3F7B9DAE0"><enum>(b)</enum><header>Criteria</header><text>Each member of the Commission shall have expertise in the history of the Federal Government or social justice issues.</text></subsection><subsection id="H6D3EDC829BBA4CFB9B567B644D664229"><enum>(c)</enum><header>Chair and vice chair</header><text>The Chair and Vice Chair of the Commission shall be elected by the members of the Commission.</text></subsection><subsection id="H3B2CE5BA86524C9EA866902B93EDA8E3"><enum>(d)</enum><header>Appointment</header><paragraph id="HEB678FC71F5048CEABD1C2BF09EEB525"><enum>(1)</enum><header>Deadline for initial appointment</header><text display-inline="yes-display-inline">Each member of the Commission shall be appointed not later than 30 days after the date of enactment of this Act. </text></paragraph><paragraph id="HF1F462D77D474E0AB07DC0B08A8E8D29"><enum>(2)</enum><header>Effect of lack of appointment</header><text>If the appointment for a membership position described in subsection (a) is not made by the appointment deadline described under paragraph (1), or if a membership position described in subsection (a) is vacant for more than 90 days, the authority to make an appointment for such position shall transfer to the Chair.</text></paragraph></subsection><subsection id="HCDD4E394C6FF4E3EAB5CADF0DB5E0D6F"><enum>(e)</enum><header>Terms</header><text display-inline="yes-display-inline">Each member shall be appointed for the life of the Commission.</text></subsection><subsection id="H5485AB7910E04BB0983C50F9EE93DB6B"><enum>(f)</enum><header>Vacancy</header><text display-inline="yes-display-inline">A vacancy in the Commission shall—</text><paragraph id="H456C0D65B88F47D1B4045942CFF01D30"><enum>(1)</enum><text>not affect the powers of the Commission; and</text></paragraph><paragraph id="HE7A2E5F18F2249FEA414AB3F98C38EC8"><enum>(2)</enum><text>be filled in the manner in which the original appointment was made.</text></paragraph></subsection></section><section id="H1E9E653B4F884356BA1ED72EF00D0CF4"><enum>5.</enum><header>Reports</header><subsection id="HFBFB91819C62452DAA2120C85D3B0BE6"><enum>(a)</enum><header>Interim report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Commission shall submit to the President and Congress an interim report on the activities of the Commission related to the redesignation of the J. Edgar Hoover F.B.I. Building.</text></subsection><subsection id="H58463C1B7D0749F3B925574E007E3E1D"><enum>(b)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Commission shall submit to the President and Congress a report on the results of the review carried out pursuant to section 3(a) and any recommendations related to the redesignation of the J. Edgar Hoover F.B.I. Building.</text></subsection></section><section id="H8460648F85804EF5B2197EE5A95B9376"><enum>6.</enum><header>Redesignation</header><subsection id="HF59D03571D7C4D98A0D26FB3165531F4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the Commission submits the final report pursuant to section 5(b), the Director of the FBI shall determine whether to redesignate the J. Edgar Hoover F.B.I. Building in accordance with the recommendations of the Commission. </text></subsection><subsection id="HD15E1B5CEB484FFB978094507AACAC87"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">If the Director of the FBI makes a determination that the J. Edgar Hoover F.B.I. Building should not be redesignated in accordance with the recommendations of the Commission, the Director shall submit to Congress a report explaining the reason for such determination.</text></subsection><subsection id="HFB1BA5E4974B4C4AABC5E336EC476B15"><enum>(c)</enum><header>Building relocation</header><text display-inline="yes-display-inline">If the headquarters of the FBI holds a designation provided under this Act and such headquarters is moved to a different facility, such facility shall hold the same such designation.</text></subsection></section><section id="HD66F507E7B374CDEB626573BF66D9909"><enum>7.</enum><header>Termination</header><text display-inline="no-display-inline">The Commission shall terminate on the date that is not later than 30 days after the Commission submits the final report pursuant to section 5(b).</text></section></legis-body></bill>
