which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><action display="yes"><action-date date="20240718">July 18, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on June 7, 2024</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To increase the transparency of colleges and universities in carrying out their civil rights responsibilities, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HED00" reported-display-style="italic" id="H6F4088173FAB4ED0B5423336A91E9D52"><section id="HEBB04925E1B449ABAC91860B034ECB06" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Civil Rights Protection Act of 2024</short-title></quote>.</text></section><section id="HE03517C0760A4A35A2A9A5DB51E49E8A"><enum>2.</enum><header>Compliance and transparency related to title vi of the civil rights act of 1964</header><subsection id="H5D2B8D3A8A59430BA43B2CC30B34C0E1"><enum>(a)</enum><header>Program participation agreement requirement</header><text>Section 487 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094</external-xref>) is amended—</text><paragraph id="H2203755B2F094DF196CE5AA455A541BB"><enum>(1)</enum><text>in subsection (a), by adding at the end the following new paragraph:</text><quoted-block id="HF0E9407ED88A4CE1810178A8C188B08D" style="OLC" changed="added" reported-display-style="italic" committee-id="HED00"><paragraph id="H64F2F11265FC409BB3AC367B5290963B"><enum>(30)</enum><text>The institution will comply with the provisions of subsection (i) and provide to the Secretary an annual attestation of such compliance.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H928D1A1DEE34419386A5C1A335682B42"><enum>(2)</enum><text>by redesignating subsections (i) and (j) as subsections (j) and (k), respectively; and</text></paragraph><paragraph id="H010A7A6140004109AB7F6A3B1E32A48A"><enum>(3)</enum><text>by inserting after subsection (h) the following new subsection:</text><quoted-block id="H49223108F95140CB87BEFF62F3565263" style="OLC" changed="added" reported-display-style="italic" committee-id="HED00"><subsection id="H4857076BF7F0418FA1AEDFA514971AF1"><enum>(i)</enum><header>Compliance and transparency related to complaints under title VI of the Civil Rights Act of 1964</header><paragraph id="HF1F4BAB263E849DA9EBB341A6F6CCA33"><enum>(1)</enum><header>Compliance and transparency</header><text>With respect to complaints received by an institution related to alleged violations of title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>), the institution will—</text><subparagraph id="HAA001BE764AF4596985ABDBFD035B6D3"><enum>(A)</enum><text>have in effect, make publicly available (including on the website of the institution), and widely distribute to students and their families (including in student orientation materials) a description of the investigative processes of the institution related to such complaints; </text></subparagraph><subparagraph id="HD1C1003B625F437D971679E733A01185"><enum>(B)</enum><text>include in the description of investigative processes described in subparagraph (A) at least the following:</text><clause id="HAF777F5A4A864AD0A320DEC8B8CF621E"><enum>(i)</enum><text>The processes and factors used to determine whether such a complaint will be investigated and how the outcome of an investigation will be determined.</text></clause><clause id="HCA4EE0130BA64E0EADE69E78785FCB15"><enum>(ii)</enum><text>A designation of at least one employee to coordinate its efforts to comply with title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>), including any investigation of any complaint alleging the noncompliance of the institution with requirements under the Act.</text></clause><clause id="H8A13541EA26742B3B9B0F9A644ED5743"><enum>(iii)</enum><text>The contact information and necessary steps for reporting such a complaint to the institution.</text></clause><clause id="HC1643AA2D96E43F0A44D7842181B5451"><enum>(iv)</enum><text>A procedure to ensure that, for each such complaint received by the institution, the complainant will receive from the institution timely notification of each of the following:</text><subclause id="H7D1BB2F3765240478252DF3A2BF0BDF2"><enum>(I)</enum><text>Confirmation of receipt of the complaint.</text></subclause><subclause id="HC16D8757DB5D44519EF59DBCAE399F74"><enum>(II)</enum><text>Notification of whether or not an investigation has been opened in response to the complaint.</text></subclause><subclause id="HF7A72F26D7F94B0594AEAFA7D9403F02"><enum>(III)</enum><text>In the case that an investigation was not opened in response to the complaint, an explanation of why an investigation was not opened including a summary of the information that was used to determine that an investigation should not be opened.</text></subclause><subclause id="H6F85E083FD82499288B0EA129D2FDAE1"><enum>(IV)</enum><text>In the case that an investigation was opened—</text><item id="H4A8EA0D77CBF4B94B3C068F86C9B2CF7"><enum>(aa)</enum><text>notification that an investigation of the complaint will be carried out, and that the complainant will be notified of the outcome of the investigation; and</text></item><item id="HFF594FE691C74A92AFAD1EA8175C3C73"><enum>(bb)</enum><text>notification of the outcome of the investigation, including an explanation of how the outcome was reached, and any remedial actions taken in response to the complaint.</text></item></subclause></clause><clause id="HB6AF956F09514315A79C74521143DE94"><enum>(v)</enum><text>A system for keeping and maintaining records of such complaints, including the determination and reasoning for whether or not an investigation into a complaint was opened, notifications to and communications with the complainant and, if applicable, the respondent, a record of the investigation (including the outcome thereof), and a record of any remedial actions taken in response to the complaint.</text></clause><clause id="HD04AB991714E46EF8DA2D7F8FA2277E8"><enum>(vi)</enum><text>The contact information and necessary steps for reporting a complaint related to an alleged violation of title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>) to the Office for Civil Rights of the Department of Education, including the hyperlink to the electronic complaint form of the Office for Civil Rights for an alleged violation of such title VI; and</text></clause></subparagraph><subparagraph id="H613FF082BCE84DCF834CDB1138C9A7E3"><enum>(C)</enum><text>with respect to public awareness campaign materials created and distributed by the Office for Civil Rights of the Department relating to protections for individuals under title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>), display and publish such materials, as applicable—</text><clause id="H81CDE04660E8484F8D3AC7E1B0BAB7C7"><enum>(i)</enum><text>not later than 30 days after such materials are distributed;</text></clause><clause id="H141E6812C33A477B91868487F7D73532"><enum>(ii)</enum><text>for not less than 1 year or until new such materials are distributed, whichever is later;</text></clause><clause id="H07442A59082B4E6182A5732E358990FE"><enum>(iii)</enum><text>in high traffic, public places on the campus of the institution; and</text></clause><clause id="HD923EF0A9E314C78B1B95301ACFDA69A"><enum>(iv)</enum><text>on publicly available websites of the institution.</text></clause></subparagraph></paragraph><paragraph id="H332FDB9BA5494E48834B21260A2E4AEB"><enum>(2)</enum><header>Enforcement</header><text>An institution of higher education that fails to comply with any provision of subsection (a)(30) for two consecutive award years shall be ineligible to participate in the programs authorized by this title for a period of not less than two years. To regain eligibility to participate in the programs authorized by this title, an institution of higher education shall demonstrate compliance with paragraph (1) prior to the completion of the period during which the institution is ineligible due to failure to comply with such paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB8668B25B8E64DC0942816B38A80A100"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the first day of the first award year beginning after the date of enactment of this Act.</text></subsection></section><section id="H59710E34A343414D9646F25ED7EF0DA8"><enum>3.</enum><header>Office for civil rights requirements</header><subsection id="HAD75D23E5CFE4235A67E3D729DBBC6ED"><enum>(a)</enum><header>Congressional briefings</header><paragraph id="H33CDEBA0C3884F2594C8A229D462A890"><enum>(1)</enum><header>In general</header><text>Beginning not later than 30 days after the date of the enactment of this Act and ending 2 years after such date of enactment, the Assistant Secretary for Civil Rights of the Department of Education shall give a monthly briefing to the Committee on Education and the Workforce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate regarding discrimination on the basis of race, color, or national origin in violation of title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>), disaggregated by the basis of discrimination, including shared ancestry, that—</text><subparagraph id="HAEE1B48A484245A78193A3B1574F5307"><enum>(A)</enum><text>explains the number of complaints alleging such discrimination that the Office for Civil Rights of the Department of Education (referred to in this section as the <quote>Office</quote>)—</text><clause id="HB048C50FA3434349AAF2EAF1BA18F430"><enum>(i)</enum><text>is investigating; and</text></clause><clause id="H3EC6016DC1C54CE0B78D935987BB4714"><enum>(ii)</enum><text>has received in the preceding month;</text></clause></subparagraph><subparagraph id="H75A7C14D1CDB41DE8257E03BCA3CF881"><enum>(B)</enum><text>describes—</text><clause id="HA50CF933194B42DD84E14885F67322B9"><enum>(i)</enum><text>how the Office plans to address those complaints; and</text></clause><clause id="H91705FD9597240DD9E12537959F52422"><enum>(ii)</enum><text>the investigations being carried out in response to those complaints, as applicable; and</text></clause></subparagraph><subparagraph id="H37D0E32F5E014C9C81F0AF01950508C5"><enum>(C)</enum><text>provides data about the length of time that those complaints are pending after being received by the Office.</text></subparagraph></paragraph><paragraph id="HDCD938D3C0FA45748D6F615620A6E91E"><enum>(2)</enum><header>Report</header><text>Not later than 48 hours prior to each briefing required under paragraph (1), the Assistant Secretary for Civil Rights of the Department of Education shall provide a written report to the Committee on Education and the Workforce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate that contains the information that will be presented at such briefing, in a manner that protects personally identifiable information in accordance with applicable privacy laws.</text></paragraph></subsection><subsection id="HC4318CF4B59F4C4F961308C88E137228"><enum>(b)</enum><header>OCR process reforms</header><paragraph id="HE9C243B20A224B22B04E8E5A0799C7D9"><enum>(1)</enum><header>Dismissals</header><text>The Office shall not close or dismiss any complaint regarding discrimination on the basis of race, color, or national origin in violation of title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>) due to the filing of a complaint involving the same allegations against the same recipient—</text><subparagraph id="H8401F1EB987A4F28898285EA535E1FF6"><enum>(A)</enum><text>by an individual other than the complainant with another Federal, State, or local agency, a court, or the recipient, unless the Office determines that—</text><clause id="HFF2D089F34214407ABAF574D6EC04434" commented="no"><enum>(i)</enum><text>a court has certified a class action with respect to the alleged violation of such other individual’s complaint;</text></clause><clause id="H3BDF0236094843C39059D364175D2CEC"><enum>(ii)</enum><text>such other individual is a member of such class; and</text></clause><clause id="H2FA09FD92AF94308BE1C4D08856543E6"><enum>(iii)</enum><text>the complainant is a member of such class; or</text></clause></subparagraph><subparagraph id="HF3FDD980A5AF4A318B4643482E885D96"><enum>(B)</enum><text>by the complainant with another Federal, State, or local agency, a court, or the recipient.</text></subparagraph></paragraph><paragraph id="HF3C0874CC2E140BA9C27AEF74F86A4FF"><enum>(2)</enum><header>Investigations</header><text>The Office shall not delay an investigation of a complaint due to the filing of a complaint involving the same allegations against the same recipient with another Federal, State, or local agency or the recipient.</text></paragraph><paragraph id="H3EFF1D57AD4144ED8B9F8D752927BC98"><enum>(3)</enum><header>Recipient defined</header><text>For purposes of this subsection, the term <quote>recipient</quote> means an institution of higher education (as such term is defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)) that receives funds under an applicable program (as such term is defined in section 400 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1221">20 U.S.C. 1221</external-xref>)).</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date date="20240718">July 18, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
