Environmental Protection Agency to carry out further improvement of Onondaga Lake, New York, and for the purposes of integrating research, education, planning and restoration of the watershed.</official-title></form><legis-body id="H246E710347364CEB98AFC8B468B1C9BC" style="OLC"><section id="HD22D99BD5A8C457FA74E86FAF43CBE14" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Onondaga Lake Watershed Improvement Act</short-title></quote>.</text></section><section id="HA86F911D47594A3DBA4151C2F31F8803"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the recovery of Onondaga Lake is of National importance.</text></section><section id="H5FAEE729FFC8433E9A2D8D4AF1B7216B"><enum>3.</enum><header>Onondaga Lake, New York</header><subsection id="HD35D0CFEE9F54D8A98C23671656E0F97"><enum>(a)</enum><header>Management activities</header><text>Title I of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H92E29FEB6D4A443D8520BA7535031F0E" style="OLC"><section id="H7E652CCDABA14F7097A741EED50893C7"><enum>127.</enum><header>Onondaga Lake, New York</header><subsection id="HF93D4304406246EBA1543B3F92827D5C"><enum>(a)</enum><header>Management activities</header><paragraph id="H968082B33A0C4C3CAAAFF8E43E3D816B"><enum>(1)</enum><header>Establishment of onondaga lake watershed council</header><text>The Administrator shall establish a council, to be known as the <quote>Onondaga Lake Watershed Council</quote>, to develop a plan, to be known as the <quote>Adaptive Management Plan</quote>, consistent with the Onondaga Lake Management Plan, for further improvement of Onondaga Lake.</text></paragraph><paragraph id="H0BADFDB51D8E4364BC2CD898EA08FDD8"><enum>(2)</enum><header>Implementation of adaptive management plan</header><text>The Administrator shall cooperate with Federal and State agencies to carry out the recommendations of the Adaptive Management Plan, and such recommendations shall be carried out—</text><subparagraph id="H7305813E58734E5B8FD87769EA8320B5"><enum>(A)</enum><text>in consultation with the Onondaga Lake Watershed Council; and</text></subparagraph><subparagraph id="H56FC29658B224BB085A57B2888A633C4"><enum>(B)</enum><text display-inline="yes-display-inline">with the participation of the public, including the Onondaga Nation, Federal, State, and local governmental entities, and any other entities that may be affected by activities carried out under this section.</text></subparagraph></paragraph></subsection><subsection id="HA5FA7F2C99C24A149849889FF933AE04"><enum>(b)</enum><header>Onondaga lake watershed council</header><paragraph id="H3C50A471878D4F7DA2501AB3AEF8454A"><enum>(1)</enum><header>Duties</header><subparagraph id="H7B12914A09D94A22ADC8E696F12BE084"><enum>(A)</enum><header>Development of adaptive management plan</header><text>The Onondaga Lake Watershed Council shall develop and periodically revise the Adaptive Management Plan in consultation with the Onondaga Lake Scientific Center established under subsection (d).</text></subparagraph><subparagraph id="H30C522FF955A42169899D7FD6838561F"><enum>(B)</enum><header>Establishment of program for public participation</header><text>The Onondaga Lake Watershed Council shall establish and carry out a comprehensive, inclusive, and ongoing program for participation of the public, including the Onondaga Nation, Federal, State, and local governmental entities, and any other entities that may be affected by activities under this section, in the development and revision of the Adaptive Management Plan under subparagraph (A).</text></subparagraph></paragraph><paragraph id="HFC579F297537443EA6FCF500CDC74008"><enum>(2)</enum><header>Membership</header><subparagraph id="H7BC2F32CCE6441238591D39DA9F90465"><enum>(A)</enum><header>In general</header><text>The Onondaga Lake Watershed Council shall consist of the following members:</text><clause id="H6856D4F36B3A49A59DB62FFFCFDCC142"><enum>(i)</enum><text>The Administrator.</text></clause><clause id="H05C05F0729034AB09D6D895D5ED2487F"><enum>(ii)</enum><text>The Secretary of the Army.</text></clause><clause id="HE69DC155EB9B4EA4B42EF90811319177"><enum>(iii)</enum><text>The head of any other interested Federal department of agency, as determined by the Administrator.</text></clause><clause id="HEF3ED3929F7D4F0D949AF31853A773F4"><enum>(iv)</enum><text>A representative of the Governor of the State of New York.</text></clause><clause id="H47A9EDF64C3046FF9DE03B768599EFDB"><enum>(v)</enum><text>A representative of the Attorney General.</text></clause><clause id="H9EAADA1AC16846748199984A61873CF4"><enum>(vi)</enum><text>A representative designated by the Onondaga Nation Council of Chiefs.</text></clause><clause id="H665C99C4CB534BA0A75CB65E764D78DD"><enum>(vii)</enum><text>A representative designated by the County Executive of Onondaga County, New York.</text></clause><clause id="H770384DE27C248F4BFC8BDCD6F193096"><enum>(viii)</enum><text>A representative designated by the mayor of the City of Syracuse, New York.</text></clause></subparagraph><subparagraph id="HF3FA1306C8DC49E5A8365B97FBF65E41"><enum>(B)</enum><header>Ex officio membership</header><text>The Onondaga Lake Watershed Council shall consist of the following ex officio, nonvoting members:</text><clause id="H2550F521BD9A4A3A978F92A96FD626ED"><enum>(i)</enum><text>The Senators from the State of New York.</text></clause><clause id="H2EE956F0A5EB4708815F3628ED4E6EFB"><enum>(ii)</enum><text>Each Member of the House of Representatives whose congressional district is located all or partially within the Onondaga Lake watershed.</text></clause><clause id="H6454345E3DFB4561B6B90C49100B58D4"><enum>(iii)</enum><text>Each member of the New York State Legislature whose district is located all or partially within the Onondaga Lake watershed.</text></clause><clause id="HADC832CEA5714C66B5329395E454BC63"><enum>(iv)</enum><text>Other members as the Administrator determines appropriate.</text></clause></subparagraph><subparagraph id="H7147784DFD244FE6A3901F668164A395"><enum>(C)</enum><header>Designees</header><text>Any member of the Onondaga Lake Watershed Council specified in clauses (i) through (iv) of subparagraph (A) or in subparagraph (B) may appoint a designee to serve in place of the member on the Council.</text></subparagraph></paragraph><paragraph id="H6DEE40D16A6A43E994A3A565EE0F24B0"><enum>(3)</enum><header>Committees</header><subparagraph id="H733B673063D047E1A691463217A375AE"><enum>(A)</enum><header>Establishment</header><text>The Onondaga Lake Watershed Council shall adopt bylaws providing for the establishment of standing committees including the following:</text><clause id="HDFACC87E3D414520A6DB29FC96ADB248"><enum>(i)</enum><text>A Public Participation Committee.</text></clause><clause id="H8A2C95C701E04B5B958C7F517E5D493D"><enum>(ii)</enum><text>A Science and Engineering Committee, which shall include representatives of the member institutions of the Onondaga Lake Science Center established under subsection (d).</text></clause></subparagraph><subparagraph id="HE1182E05C20E4EBFA23113A011B1B1CA"><enum>(B)</enum><header>Appointment</header><text>The Onondaga Lake Watershed Council shall appoint members to each committee described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="HD5CC1A705C744ECC83AFF8AD7D4DA98A"><enum>(c)</enum><header>Adaptive management plan</header><paragraph id="HC6E9B15832454689B47B0472E1304E19"><enum>(1)</enum><header>Identification of goals</header><text>In developing the Adaptive Management Plan under this section, the Onondaga Lake Watershed Council shall identify measurable goals for—</text><subparagraph id="HDA03ED8EB8294DE88C07FF60A334C721"><enum>(A)</enum><text>the further restoration, conservation, and management of Onondaga Lake; and</text></subparagraph><subparagraph id="HEEE145865948487BB4B6F7EF08CC038B"><enum>(B)</enum><text>compliance with all provisions of law affecting the further restoration and conservation of Onondaga Lake, including the water quality standards established for Onondaga Lake (including total maximum daily loads established under section 303(d)(C)) and the Amended Consent Judgment and all effluent limitations therein (or otherwise promulgated under this Act).</text></subparagraph></paragraph><paragraph id="HDE4E017E323943EB8FC1C68D6815D345"><enum>(2)</enum><header>Recommendation of strategies</header><text>To achieve the goals identified under paragraph (1), the Onondaga Lake Watershed Council shall incorporate and specify the recommendations of the Onondaga Lake Management Plan in the Adaptive Management Plan and recommend strategies for management of—</text><subparagraph id="H88A9BF0F154E42DA864A3103636C43A8"><enum>(A)</enum><text>the biological and chemical makeup and structural attributes of Onondaga Lake; and</text></subparagraph><subparagraph id="H302DD144313645AABE08A367E5D6FB84"><enum>(B)</enum><text>the use of Onondaga Lake for educational, recreational, and other purposes.</text></subparagraph></paragraph><paragraph id="H283112237E054774B429B466185F28C5"><enum>(3)</enum><header>Coordination with other activities</header><text>The strategies recommended under paragraph (2) shall provide for coordination with all other activities to further restore or conserve, or otherwise affecting the restoration or conservation of, Onondaga Lake, including ongoing public participation activities, scientific and engineering activities, and other activities carried out under Federal, State, or local law.</text></paragraph><paragraph id="H9C660A506022498FA7B4CA722457D7B0"><enum>(4)</enum><header>Ongoing evaluation of strategies</header><text>To evaluate the effectiveness of the strategies recommended under paragraph (2) in achieving the goals identified under paragraph (1), the Onondaga Lake Watershed Council shall—</text><subparagraph id="HB48C2AB1A3674378B4E53EB4AD3D50FA"><enum>(A)</enum><text>identify a specific, integrated scientific and engineering program, which may include monitoring, process studies, and modeling, by which the Council may make such evaluation, and provide for the periodic revision of such program to achieve such goals;</text></subparagraph><subparagraph id="H2CC778E6F9D84883B38FBAC7AE439B71"><enum>(B)</enum><text>establish and implement the integrated scientific and engineering program identified under subparagraph (A); and</text></subparagraph><subparagraph id="HA8C46046132A40CA947476A506BD71AC"><enum>(C)</enum><text>provide for the periodic evaluation of the information provided by such program.</text></subparagraph></paragraph><paragraph id="HC8E05B4F913D4A4B8824487B14DF581D"><enum>(5)</enum><header>Approval</header><subparagraph id="H7BE8FF637C684755B93F2DB75EC6BB5C"><enum>(A)</enum><header>In general</header><text>The recommendations of the Adaptive Management Plan shall not be implemented under subsection (a)(2) before the date on which the plan is approved by the Administrator, in consultation with the Governor of the State of New York.</text></subparagraph><subparagraph id="HD142FC83DEE74A5CA6C270F3EF580AD9"><enum>(B)</enum><header>Timeline</header><text>The Administrator, after providing an opportunity for public review and comment, shall approve the Adaptive Management Plan not later than 120 days after the date on which such plan is developed if the Adaptive Management Plan meets the requirements of this section.</text></subparagraph></paragraph><paragraph id="H2ACF830E18C34AE0B9B7D584187935CE" commented="no"><enum>(6)</enum><header>Effect on onondaga lake management plan</header><text>This section shall not be construed to interfere with any activity carried out under the Onondaga Lake Management Plan, or any other activity affecting the further restoration, conservation or management of Onondaga Lake.</text></paragraph></subsection><subsection id="H4E9C1033E3CE43BD8EF4A90A67AC3B6D"><enum>(d)</enum><header>Onondaga lake scientific center</header><paragraph id="H541B1A9F316C42DDB775F2355AE5E562"><enum>(1)</enum><header>Establishment</header><text>The Onondaga Lake Watershed Council shall establish and direct a center to be known as the <quote>Onondaga Lake Scientific Center</quote>.</text></paragraph><paragraph id="H9C7F3070814B499CB98D2412A8CCB7AE"><enum>(2)</enum><header>Duties</header><text>The Onondaga Lake Scientific Center shall advise the Onondaga Lake Watershed Council on—</text><subparagraph id="HF8A82D2613C84069A212770028808F06"><enum>(A)</enum><text>development of benchmarks to accomplish the goals identified under subsection (c)(1);</text></subparagraph><subparagraph id="HF355590FEB164C49ABCA0014C7F97331"><enum>(B)</enum><text>implementation of the strategies recommended under subsection (c)(2);</text></subparagraph><subparagraph id="H2EC8011E05574C58909840D406598481"><enum>(C)</enum><text>implementation of the integrated scientific and engineering program under subsection (c)(4);</text></subparagraph><subparagraph id="H5765852774124B48A1ECB5F6D1BF573C"><enum>(D)</enum><text>establishment of the program for public participation described in subsection (b)(1)(B); and</text></subparagraph><subparagraph id="H8C9B3FA554704BAAB4E495EDE3DBADC5"><enum>(E)</enum><text>other matters concerning the development and implementation of the Adaptive Management Plan under this section.</text></subparagraph></paragraph><paragraph id="HA8AC4D9AF3244636B52561198FCD611B"><enum>(3)</enum><header>Membership</header><text>The Onondaga Lake Scientific Center shall consist of the following members:</text><subparagraph id="HC73B6D617C0A4111ACD038A5EE82AC50"><enum>(A)</enum><text>The Administrator.</text></subparagraph><subparagraph id="HDC59DBBCCA5C4DFDB8596D52D11D52AA"><enum>(B)</enum><text>Non-Federal entities appointed by the Onondaga Lake Watershed Council, including—</text><clause id="HFA4B67C5F3F149DA8D25CD511E7E2476"><enum>(i)</enum><text>Syracuse University;</text></clause><clause id="H363E104C06814217A947A2B43C2B810D"><enum>(ii)</enum><text>the State University of New York College of Environmental Science and Forestry;</text></clause><clause id="H4DBD9079F0F843398090028C2C321F9B"><enum>(iii)</enum><text>the Onondaga Environmental Institute; and</text></clause><clause id="HC31323AB555E475B87249F6A90D15338"><enum>(iv)</enum><text display-inline="yes-display-inline">other members as the Onondaga Lake Watershed Council determines appropriate.</text></clause></subparagraph></paragraph><paragraph id="HC668DFF4FC1043658B426412F74E6E4B"><enum>(4)</enum><header>Reporting</header><text>The Onondaga Lake Scientific Center shall submit to the Onondaga Lake Watershed Council an annual report—</text><subparagraph id="H003325571C41456C8817ECFF281B5E5E"><enum>(A)</enum><text>assessing the effectiveness of the strategies recommended under subsection (c)(2) in accomplishing the goals identified under subsection (c)(1);</text></subparagraph><subparagraph id="HFB880D08293143A1BD3B34FA3B2C2C94"><enum>(B)</enum><text>recommending changes to management and activities of the integrated scientific and engineering program to accomplish the goals identified under subsection (c)(1); and</text></subparagraph><subparagraph id="H2068AE907DFD4E5886150736126B93CD"><enum>(C)</enum><text>recommending means for implementation of such changes.</text></subparagraph></paragraph></subsection><subsection id="H8FC677EC245448CD93072BA962054CD3"><enum>(e)</enum><header>Grants</header><paragraph id="H6D6AED77A5A84918B4DD0663FC127230"><enum>(1)</enum><header>In general</header><text>The Administrator, in consultation with the Onondaga Lake Watershed Council, may make grants to the State of New York, the City of Syracuse, New York, Onondaga County, New York, and the Onondaga Environmental Institute—</text><subparagraph id="HF147F992455D4D17B8138B02401AFE23"><enum>(A)</enum><text>to implement the strategies recommended under section (c)(2);</text></subparagraph><subparagraph id="H4AC0BC53D25E4E3E9DC2DB6CA785731B"><enum>(B)</enum><text>for research, surveys, administrative services, studies and elements of the integrated scientific program; and</text></subparagraph><subparagraph id="H6DA7213133D2461A8DBFED2C787EC29C"><enum>(C)</enum><text>to gather data necessary to carry out the objectives of this section.</text></subparagraph></paragraph><paragraph id="H0F5A6F416BBF4EF7B91A785CD3B0026A"><enum>(2)</enum><header>Conditions</header><text display-inline="yes-display-inline">As a condition of receiving a grant under this subsection, the Onondaga Environmental Institute shall provide administrative services for the development and implementation of the Onondaga Lake Science Center and the Adaptive Management Plan.</text></paragraph><paragraph id="H35854EFB77E04713BA15A3333B815274"><enum>(3)</enum><header>Matching requirement</header><subparagraph id="H08DC4F6C25B54437909BC50D5BD3F747"><enum>(A)</enum><header>In general</header><text>The non-Federal share of the cost of an activity carried out with a grant under this subsection may not exceed 35 percent of the cost of such activity. </text></subparagraph><subparagraph id="HDD2E13B2E5E84E3B970985B3297E80B2"><enum>(B)</enum><header>In-kind contribution</header><text display-inline="yes-display-inline">The non-Federal share required under this paragraph shall be provided from non-Federal sources, and may be satisfied through the provision of in-kind services. </text></subparagraph></paragraph><paragraph id="H174C77D540B64F74A1D8E29CDC7DF4A1"><enum>(4)</enum><header>No relief from liability</header><text>Grants made under this subsection shall not relieve from liability any person that would otherwise be liable under Federal or State law for damages, response costs, natural resource damages, restitution, equitable relief, or any other relief.</text></paragraph></subsection><subsection id="H8147BBC516F14778BECC426E8469BE6B"><enum>(f)</enum><header>Relationship to other laws</header><paragraph id="H488A424BA0F94E03BCA9E3BDADDAA30B"><enum>(1)</enum><header>No effect on Federal or State law</header><text>This section shall not be construed to alter, modify, or otherwise affect any other provision of Federal or State law or any responsibility assigned thereunder, including—</text><subparagraph id="HBCB80ABD4C304B0FB92200B031A6B7D6"><enum>(A)</enum><text display-inline="yes-display-inline">this Act; or</text></subparagraph><subparagraph id="HCE69D068CEDF4EFA9E3282E725E39D0D"><enum>(B)</enum><text>a provision of law (including a provision of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>) or the New York State Environmental Conservation Law) that requires, and assigns responsibility for, the performance of cleanup activities (including response and removal activities) or other activities affecting the restoration or conservation of Onondaga Lake.</text></subparagraph></paragraph><paragraph id="H09F7BD0746544B75BFFCBB978D280748"><enum>(2)</enum><header>No effect on existing liabilities</header><text>This section shall not be construed to create or enlarge any liability that any party may have for natural resource damages under any provision of law.</text></paragraph></subsection><subsection id="HB60425FB34AC4CF18F92BD998251AFB9"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H6A36A279113C469B9BB5173511B4F5B8"><enum>(1)</enum><header>Amended consent judgment</header><text>The term <quote>Amended Consent Judgment</quote> means the Amended Consent Judgment entered January 20, 1998, in the case of Atlantic States Legal Foundation<quote> v. </quote>The Onondaga County Department of Drainage and Sanitation, Civil Action No. 88–CV–0066, in the United States District Court for the Northern District of New York, as amended.</text></paragraph><paragraph id="H210FF2EA723A405D8FA5DC64C3A3F0BC"><enum>(2)</enum><header>Onondaga environmental institute</header><text>The term <quote>Onondaga Environmental Institute</quote> means the not-for-profit corporation established pursuant to section 401(d)(1) of the Great Lakes Critical Programs Act of 1990 (104 Stat. 3010) and section 411(d)(1) of the Water Resources Development Act of 1990 (104 Stat. 4648). </text></paragraph><paragraph id="H6B14D99040794558A74AA06BD6EBA0B4"><enum>(3)</enum><header>Onondaga lake</header><text>The term <quote>Onondaga Lake</quote> means Onondaga Lake, New York and its watershed and tributaries.</text></paragraph><paragraph id="HD72A7A87ECEC4EA08195933240708717"><enum>(4)</enum><header>Onondaga lake management plan</header><text>The term <quote>Onondaga Lake Management Plan</quote> means the plan—</text><subparagraph id="H4B6DBF3CE99C47B4829B52A325AA02BD" commented="no"><enum>(A)</enum><text>developed pursuant to section 401(a)(1) of the Great Lakes Critical Programs Act of 1990 (104 Stat. 3010) and 411(a)(1) of the Water Resources Development Act of 1990 (104 Stat. 4648); </text></subparagraph><subparagraph id="HE9EFB1F3A8E54C9C8924677318BC0C28"><enum>(B)</enum><text>modified by the Amended Consent Judgment; and</text></subparagraph><subparagraph id="H43F610DE4D0A4CDB85F209F37051EFCC"><enum>(C)</enum><text>revised under section 573(c)(1) of the Water Resources Development Act of 1999 (113 Stat. 372), as in effect on the day before the date of the enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="H90262C0BF76F4D75A47D7FF1F54FB9EC"><enum>(h)</enum><header>Authorization of Appropriations</header><paragraph id="H2723422F418646249B48062D3AFBDAB0"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to the Administrator to carry out this section $10,000,000 each fiscal year, to remain available until expended.</text></paragraph><paragraph id="H8690A318D4B64FFB98D34E56AC667A54"><enum>(2)</enum><header>Administrative expenses</header><text>The Administrator may use amounts made available under paragraph (1) for administrative expenses associated with carrying out this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3B74D3C95A464447A076D0EDA4CDC36B"><enum>(b)</enum><header>Water Resources Development Act of 1999</header><text>Section 573 of the Water Resources Development Act of 1999 (113 Stat. 372) is repealed. Such section 573, as in effect on the day before the date of the enactment of this Act, shall continue to apply to amounts appropriated before such date and made available to carry out such section.</text></subsection></section></legis-body></bill>
