which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit and establish penalties for the use of the identity of another, without authorization, to make available certain information, and for other purposes.</official-title></form><legis-body id="H11E6FEED51724267A8B41C822F0E7985" style="OLC"><section id="HB0235FB0F3084FC4BCDF6DAC53AA178C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Hijacking of Identity Expressly for Libel on Domains Act </short-title></quote> or the <quote><short-title>SHIELD Act</short-title></quote>.</text></section><section id="H9E7861827246401F81B9381484BA5C74"><enum>2.</enum><header>Prohibition on using identity of another to make available certain information</header><subsection id="H2ADB947D956D4044919D49D979CE40EB"><enum>(a)</enum><header>Prohibition</header><paragraph id="H4CBF11D77B3B47C981B1346D5C812213"><enum>(1)</enum><header>In general</header><text>A person may not make available covered information on an interactive computer service.</text></paragraph><paragraph id="H9F430CB5ABD3452CBB27A6B5AD946C00"><enum>(2)</enum><header>Applicability to certain providers</header><text display-inline="yes-display-inline">Notwithstanding section 230(c)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(c)(1)</external-xref>), paragraph (1) of this subsection applies to a provider of an interactive computer service with respect to information provided by another information content provider on the interactive computer service.</text></paragraph></subsection><subsection id="H0DEBE53962F2439688FB36E66F5BAA24"><enum>(b)</enum><header>Civil action</header><paragraph id="HF55DE3BD14D74932843BCD4C0B6876BB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An individual may bring a civil action against a person for a violation of subsection (a) in an appropriate district court of the United States.</text></paragraph><paragraph id="HD055AE5707E442ADBDCC5D76B962D7F7"><enum>(2)</enum><header>Relief</header><text display-inline="yes-display-inline">In a civil action brought under paragraph (1) in which the plaintiff prevails, the court may award the plaintiff—</text><subparagraph id="H166607C5171748D799E7FA512D28468B"><enum>(A)</enum><text>an amount equal to the sum of any actual damages;</text></subparagraph><subparagraph id="HB1CAD91987A1463DBF659AF6544E8F87"><enum>(B)</enum><text display-inline="yes-display-inline">injunctive relief, including, with respect to a provider of an interactive computer service, that such provider may be required to make publicly available a notice explaining that the source of the applicable covered information was a person other than the plaintiff; and</text></subparagraph><subparagraph id="H0EDD3ABE34C74010A738A715829A71B6"><enum>(C)</enum><text>reasonable attorney fees and litigation costs.</text></subparagraph></paragraph></subsection><subsection id="HE6AFF46B76244A3E9BDB72D36180560F"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H9084249FD3BA4443AA8BE2FA4312E02F"><enum>(1)</enum><header>Covered information</header><text>The term <term>covered information</term> means information that is—</text><subparagraph id="H1CBE71C3328D4768886EF7C8439AB0D3"><enum>(A)</enum><text>libelous, slanderous, or criminal; and</text></subparagraph><subparagraph id="HE5B1C442CDF8411E94A6A65B44819EC7"><enum>(B)</enum><text display-inline="yes-display-inline">presented by a person using the identity of an individual (who is not such person)—</text><clause id="HB4B81838125149309AC6E60892AFDFCA"><enum>(i)</enum><text>without the authorization of such individual; and</text></clause><clause id="H0159C724615E4F459D2C5349EC7EAA65"><enum>(ii)</enum><text>in a manner that suggests such individual is the source of such information.</text></clause></subparagraph></paragraph><paragraph id="HBAFA46FB37E44131B17C1AC883746265"><enum>(2)</enum><header>Information content provider</header><text>The term <term>information content provider</term> has the meaning given that term in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>).</text></paragraph><paragraph id="HAA10912FA1194C8FB1CD8EDF84ED747E"><enum>(3)</enum><header>Interactive computer service</header><text display-inline="yes-display-inline">The term <term>interactive computer service</term> has the meaning given that term in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
