R. 8409</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240515">May 15, 2024</action-date><action-desc><sponsor name-id="N000194">Mr. Nickel</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To assist parents in locating and utilizing child care that meets individual family needs.</official-title></form><legis-body id="H8800BA4EDA034D9698740B9F63C53119" style="OLC"><section id="H227FC85BE5E54DF9B7191EDE440FEC85" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Our Parents Enroll (HOPE) in Child Care Act</short-title></quote>.</text></section><section id="H809DCFD655324E819D324990565568BF"><enum>2.</enum><header>National Child Care Navigator Grants</header><subsection id="H43351E0E95E745D7AB3EE325D8438D69"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title XX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397">42 U.S.C. 1397 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HF2A57E7F79204237B1BBB2B5DB7628A1" display-inline="no-display-inline"><subtitle id="H418890CC9D4247DBA8E13DE594E882D1"><enum>D</enum><header>National Child Care Navigator Grant Program</header><section id="H703530FB42B9475B8BF37FB94951C8BE"><enum>2071.</enum><header>Grants</header><text display-inline="no-display-inline">The Secretary may make grants to eligible local partners for the purpose of providing free access to information, counseling, and assistance with respect to locating, enrolling in, and paying for child care, including through programs funded under section 418 of this Act or the Child Care and Development Block Grant of 1990, and through the provisions of the Internal Revenue Code of 1986 under which child care expenditures may be subsidized.</text></section><section id="HBC0569D278784AF69E2861CC19D44FD0"><enum>2072.</enum><header>Grant application and plan requirements</header><subsection id="H03154881B5D34A72AAAB6CEB9EEDCB1B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To be eligible for a grant under this subtitle, an eligible local partner shall submit an application to the Secretary, at such time and in such manner as the Secretary may provide, that includes a plan to establish a program to provide free access to the information, counseling, and assistance referred to in section 2071. As a condition of the grant, the eligible local partner must demonstrate, to the satisfaction of the Secretary—</text><paragraph id="H9E183700D6834694ACF6D35749AC7E9A"><enum>(1)</enum><text>an ability to adequately provide the information, counseling, and assistance; and</text></paragraph><paragraph id="HF24937C560A1447AA83BD1D94084CA26"><enum>(2)</enum><text display-inline="yes-display-inline">commitment to operating a program that satisfies the requirements of subsection (d).</text></paragraph></subsection><subsection id="H05638F32467C4A79AA77B7F93ACE03B5"><enum>(b)</enum><header>Duration</header><text display-inline="yes-display-inline">Each grant under this subtitle shall be awarded for a period of 5 years, except that the grantee may reapply for another 5-year period at the end of each grant period, and the Secretary may terminate such a grant for noncompliance with data reporting requirements or failure to provide promised services or comply with any grant condition.</text></subsection><subsection id="H197F7C51EFE748D0940551B5FD15C711"><enum>(c)</enum><header>Amount</header><text display-inline="yes-display-inline">The Secretary shall determine the amount of any grant under this subtitle so as to maximize the number of parents with access to navigators referred to in subsection (d)(1).</text></subsection><subsection id="H12F4E64155954DE7BDC8642D57832236"><enum>(d)</enum><header>Program requirements</header><text display-inline="yes-display-inline">A program satisfies the requirements of this subsection if the program—</text><paragraph id="H45F2107F3D384313A7D8BE6D37882FEC"><enum>(1)</enum><text>establishes a system of staff members, including navigators, to provide information on—</text><subparagraph id="H13B2BDCAF8C74977BE858A4FE467B281" commented="no"><enum>(A)</enum><text>navigating child care systems, including information on—</text><clause id="HE574889EC5C04AD29E770F5801CAEA91" commented="no"><enum>(i)</enum><text>applying for subsidized child care;</text></clause><clause id="H6ABED6071EDC4B769368AD178CBCD0B3" commented="no"><enum>(ii)</enum><text>consumer education and information about types of child care settings;</text></clause><clause id="HB60FB09C2BE24772BEC4B2A822259182" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">navigating the child care resource and referral system funded under the Child Care and Development Block Grant Act of 1990; and</text></clause><clause id="HDC6629F4541E411AB96FDD104BAECF42"><enum>(iv)</enum><text>center-based and home based child care;</text></clause></subparagraph><subparagraph id="H83FE64ADD34C43129E3333B78AD1D768" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">accessing such systems in languages other than English and protections against non-discrimination on the basis of limited English proficiency under title VI of the Civil Rights Act, accommodations and protections against non-discrimination under the Americans with Disabilities Act and section 504 of the Rehabilitation Act of 1973, and protections against non-discrimination under other Federal civil rights laws in child care settings; and</text></subparagraph><subparagraph id="HC8DC5DCA53DD4BA4A55F7A17DE067982"><enum>(C)</enum><text display-inline="yes-display-inline">any other information specified by the Secretary;</text></subparagraph></paragraph><paragraph id="HBE6A323742E7496A8DDE9C52EA0DED3C"><enum>(2)</enum><text display-inline="yes-display-inline">in conjunction with the system established under paragraph (1), establishes a system of referral to appropriate departments or agencies within the State in which the eligible local partner is located and, when appropriate, the Federal Government, for other issues related to obtaining assistance (including legal aid), as determined by the Secretary; and</text></paragraph><paragraph id="H267693B6B9CC4578B4191032D4EAD152"><enum>(3)</enum><text>establishes a community-based system of education and outreach to raise public awareness of and increase access to the resources described in section 2071 and the availability of information, counseling, and assistance provided by the system of staff members described in paragraph (1) and the system of referrals described in paragraph (2), including by—</text><subparagraph id="HD32F0A3E3CD340E1BAF8C7831E584A6D"><enum>(A)</enum><text>engaging in a robust program of culturally and linguistically competent education and outreach;</text></subparagraph><subparagraph id="HF8ADB7F1733E457DBFF170965E3622E0"><enum>(B)</enum><text>creating visual and written content using clear and plain language;</text></subparagraph><subparagraph id="H26283F3A2DD14452A7549A3A62FE7E46"><enum>(C)</enum><text>tailoring materials to members of underserved areas or populations;</text></subparagraph><subparagraph id="H94752BBFF0224AC48315D83DBB0D4550"><enum>(D)</enum><text>working with employers and child care providers to promote the awareness and distribution of information to employees and parents in the community; and</text></subparagraph><subparagraph id="H221840C2168C4842856BB9AD6EA6DC56"><enum>(E)</enum><text display-inline="yes-display-inline">partnering with governmental and non-governmental organizations serving working parents or child care providers;</text></subparagraph></paragraph><paragraph id="H5C70A832D1474A158CCE8C86314C24A2"><enum>(4)</enum><text display-inline="yes-display-inline">provides for a sufficient number of staff positions (which may include but may not consist entirely of volunteer positions) necessary to provide the services of the program;</text></paragraph><paragraph id="HFF7681AD2E5C4E34AF40B2FE2C431E30"><enum>(5)</enum><text>provides for training programs for staff members (including volunteer staff members) and allows for continuous improvement processes for community-based strategies to ensure maximum outreach and engagement with underserved areas or populations;</text></paragraph><paragraph id="H0E6CC5A68881458BBF1A364820E66989"><enum>(6)</enum><text display-inline="yes-display-inline">provides for the collection and dissemination of timely, impartial, and accurate programmatic information to staff members (including volunteer staff members);</text></paragraph><paragraph id="H0215413A2AF149379C0264CDF954A4EE" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">maintains confidentiality of all personal information provided to navigators or program staff (including volunteer staff), including by following procedures set by the Secretary for destroying personally identifiable information and preventing it from being shared with any other government entity;</text></paragraph><paragraph id="H41931479189C4FD3A9FF74E140924E31"><enum>(8)</enum><text display-inline="yes-display-inline">collects non-personally identifiable data to measure equitable access to the program, as described in section 2073(2); and</text></paragraph><paragraph id="H897AA5D3A6574A988C63D67FE40D2D2E"><enum>(9)</enum><text>provides data to the Secretary, upon request, regarding how individuals are being served by the program, including—</text><subparagraph id="H18FD0C8445E94C7885B79936C6D479ED"><enum>(A)</enum><text display-inline="yes-display-inline">data and details on the number of individuals served, as well as the type and number of services such individuals are receiving;</text></subparagraph><subparagraph id="H99A5451C8FDC44BCB314D6733FB7012B"><enum>(B)</enum><text>data and details on the problems that individuals may encounter, including a lack of timely payment of benefits or child care availability; and</text></subparagraph><subparagraph id="HE29DE215AE4C42CDA40CF480D0DAA373"><enum>(C)</enum><text>data and details on improvements that could be made at the State or Federal level to promote equitable access to child care.</text></subparagraph></paragraph></subsection><subsection id="H3A92BC8E75B2440BA94F67CA0515F6AE"><enum>(e)</enum><header>Guaranteed number of grantees per State</header><text display-inline="yes-display-inline">For each grant cycle, the Secretary shall award a grant under this subtitle to at least 2 eligible local partners in each State that is not Puerto Rico, Guam, the Virgin Islands, American Samoa, or the Northern Mariana Islands, to the extent there are a sufficient number of applications submitted by the entities that meet the requirements applicable with respect to the grant.</text></subsection><subsection id="HDDA53BED84714C5EAFC1F9F8930ABBF5"><enum>(f)</enum><header>Maintenance of effort</header><text display-inline="yes-display-inline">Funds awarded to a State or county under this subtitle shall be used to supplement, not supplant, State and Federal funds, and may not be used to replace any personnel selected on a merit basis.</text></subsection></section><section id="H166CC274A99445678D4A1B44502C069C"><enum>2073.</enum><header>Criteria for making grants</header><text display-inline="no-display-inline">In determining whether to make a grant under this subtitle to an eligible local partner, the Secretary shall consider the commitment of the eligible local partner to—</text><paragraph id="H20BFDF108B824C579846204AA240155F"><enum>(1)</enum><text display-inline="yes-display-inline">carrying out the program described in section 2072; and</text></paragraph><paragraph id="H4D32BE042E084AC58DF3889CF9D440AF"><enum>(2)</enum><text display-inline="yes-display-inline">promoting equitable access to the program in the State in which the eligible local partner is located, including as the equitable access pertains to—</text><subparagraph id="HC5570D54D83D447D9C7A2C1402DD72FC"><enum>(A)</enum><text>race, ethnicity, sex, gender, sexual orientation, disability, economic status, religion, citizenship, or age;</text></subparagraph><subparagraph id="H434809700AD541938CD7C6A57853C59E"><enum>(B)</enum><text>geographic area; and</text></subparagraph><subparagraph id="H094F93A79DA84A1E962CE932E6230D15"><enum>(C)</enum><text display-inline="yes-display-inline">other factors as determined by the Secretary, in consultation with the Secretary of the Treasury and the Secretary of Labor.</text></subparagraph></paragraph></section><section id="H84EF1F0736EE43FCA9A1D7A3D9297272"><enum>2074.</enum><header>Limitations on authorization of appropriations</header><subsection id="H9E3A307E5180478D9B7A4894E79F1D41" commented="no"><enum>(a)</enum><header>Grants</header><text>For grants under this subtitle, there is authorized to be appropriated to the Secretary not more than $500,000,000 for each of fiscal years 2025 through 2029.</text></subsection><subsection id="HCC8C8175C27A4135A9FFA83B910CFE73"><enum>(b)</enum><header>Federal administration</header><text display-inline="yes-display-inline">For the provision of administrative support and technical assistance for grants awarded under this subtitle, there is authorized to be appropriated for each of fiscal years 2025 through 2029 $5,000,000 to the Secretary of Health and Human Services.</text></subsection></section><section id="HD627E13D72994C538D33D576EE1618E0"><enum>2075.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="HDBDA1B23BABE42C0AE9766FB0808EF5D" commented="no"><enum>(1)</enum><header>Eligible local partner</header><text display-inline="yes-display-inline">The term <term>eligible local partner</term> means a State, county, Indian tribe, tribal organization, or non-profit organization (including a labor organization) with a presence within a State, a history of knowledge of the resources described in section 2071, and a demonstrated commitment to helping workers and families.</text></paragraph><paragraph id="HA08AD6FC2F96497796E71EC441360752"><enum>(2)</enum><header>Indian tribe; tribal organization</header><text>The terms <term>Indian tribe</term> and <term>tribal organization</term> have the meanings give the terms in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="H9E16661B513D474CAA2617D8BD052485"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means the 50 States, the District of Columbia, Puerto Rico, Guam, the Virgin Islands, American Samoa, and the Northern Mariana Islands.</text></paragraph></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCDA79ADB498C4FC68F8EDBA926AA6045"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on October 1, 2024.</text></subsection></section></legis-body></bill>
