<section id="H9B68B884CB4C4AA1B02C6071C90ADB05" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helicopter Passenger Protection Act</short-title></quote>.</text></section> <section id="H000B384E638D4D4CAD94A7A996CC95B9"><enum>2.</enum><header>Crash-resistant fuel systems in rotorcraft</header> <subsection id="H86CDC992E70B437B9D73621DC55E5E6B"><enum>(a)</enum><header>In general</header><text>The Administrator of the Federal Aviation Administration shall task the Aviation Rulemaking Advisory Committee to—</text>
<paragraph id="HB711CD8C43574C54A0E9EC3DF938A228"><enum>(1)</enum><text>review the data analysis conducted and the recommendations developed by the Aviation Rulemaking Advisory Committee Rotorcraft Occupant Protection Working Group of the Administration;</text></paragraph> <paragraph id="H1B0C3B1D7DA54A2ABB3E4B1A4C1B8DEF"><enum>(2)</enum><text>update the 2018 report of such working group on rotorcraft occupant protection by—</text>
<subparagraph id="H7C14B731565E4B1E880A3E0CFC906232"><enum>(A)</enum><text>reviewing National Transportation Safety Board data from 2016 through 2023 on post-crash fires in helicopter accidents; and</text></subparagraph> <subparagraph id="HF386533C84EA45E4BCD6247D1B561DE1"><enum>(B)</enum><text>determining whether and to what extent crash-resistant fuel systems could have prevented fatalities; and</text></subparagraph></paragraph>
<paragraph id="H4A091200FB53425BB3238C9F9DFCC499"><enum>(3)</enum><text>develop recommendations for either the Administrator or the helicopter industry to encourage helicopter owners and operators to expedite the installation of crash-resistant fuel systems in the aircraft of such owners and operators regardless of original certification and manufacture date.</text></paragraph></subsection> <subsection id="H04C13848256747FAA8739B9BAFE67410"><enum>(b)</enum><header>Schedule</header> <paragraph id="H7589281605C84FC29715A7AB3B20CC2C"><enum>(1)</enum><header>Deadline</header><text>Not later than 18 months after the Administrator tasks the Aviation Rulemaking Advisory Committee under subsection (a), the Committee shall submit the recommendations developed under subsection (a)(2) to the Administrator.</text></paragraph>
<paragraph id="HA53DFDBAB7C8495FBDA1C1BEB93339F2"><enum>(2)</enum><header>Implementation</header><text>If applicable, and not later than 180 days after receiving the recommendations under paragraph (1), the Administrator shall—</text> <subparagraph id="H2CDDCA2F794949EDADE1718B1FE3E736"><enum>(A)</enum><text>begin implementing, as appropriate, any consensus safety recommendations the Administrator receives from the Aviation Rulemaking Advisory Committee, and brief the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on any recommendations the Administrator does not implement; and</text></subparagraph>
<subparagraph id="HF03B02713C214E4791BDD853ABC7772A"><enum>(B)</enum><text>partner with the United States Helicopter Safety Team, as appropriate, to facilitate implementation of any recommendations for the helicopter industry pursuant to subsection (a)(2).</text></subparagraph></paragraph></subsection></section> <section id="H8C428AEBAAFD43AFA3DED4352B0DE0FF" section-type="subsequent-section"><enum>3.</enum><header>Helicopter fuel system safety</header><text display-inline="no-display-inline">Section 44737 of title 49, United States Code, is amended—</text> 
<paragraph id="H6AEB263D90EB4E37A49E2880C85D22DA"><enum>(1)</enum><text>in subsection (a)(2) by striking <quote>the date that is 18 months after the date of enactment of this section</quote> and inserting <quote>April 5, 2020</quote>; </text></paragraph> <paragraph id="H4B604F475A344D70B28DC361849BE7DD"><enum>(2)</enum><text>by redesignating subsections (b) and (c) as subsections (c) and (d), respectively; and</text></paragraph> 
<paragraph id="H6FF936A4DEF3498C8F7B55E46B305FBA"><enum>(3)</enum><text>by inserting after subsection (a) the following:</text> <quoted-block style="USC" id="H7F6FC3FD33F047EE8DCD96E8FAD2930A" display-inline="no-display-inline"> <subsection id="H4751A2CAD982422F82B93622F7F441D9"><enum>(b)</enum><header>Prohibition for rotorcraft manufactured before April 5, 2020</header> <paragraph id="HE5A3D20F22F94CE599F9FD9D1566717F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of this subsection, a person may not operate in United States airspace a rotorcraft manufactured before April 5, 2020, for which the Administrator of the Federal Aviation Administration has issued a standard airworthiness certificate, unless such rotorcraft includes a fuel system that is certified by the Administrator to—</text> 
<subparagraph id="H1E711A93A0C142619FB15F783DBDCB8E"><enum>(A)</enum><text display-inline="yes-display-inline">comply with the requirements applicable to the category of the rotorcraft under paragraphs (1), (2), (3), (5), and (6) of section 27.952(a), section 27.952(f), and section 27.963(g) (but allowing for a minimum puncture force of 250 pounds) or paragraphs (1), (2), (3), (5), and (6) of section 29.952(a), section 29.952(f), and section 29.963(b) (but allowing for a minimum puncture force of 250 pounds) of title 14, Code of Federal Regulations, as in effect on the date of enactment of this subsection; or</text></subparagraph> <subparagraph id="H771742FD023E406DBA64A2B77D451733"><enum>(B)</enum><text>employ other means acceptable to the Administrator to provide an equivalent level of fuel system crash resistance.</text></subparagraph></paragraph> 
<paragraph id="HC3D9D1F080E14774B6B919557EE37A03"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">This subsection shall not apply to an unmanned aircraft that does not carry any occupants. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
