<official-title display="yes">To require providers of social media platforms to prohibit children under the age of 16 from accessing such social media platforms, and for other purposes.</official-title>

<section id="HC15B7606DA9243268AD0ED690B405CBF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Social Media Child Protection Act</short-title></quote>.</text></section> <section id="H25D4965E940846628443E8A36D0C5366"><enum>2.</enum><header>Requirements for social media platforms</header> <subsection id="HF2D9AD63CCED46BEA1FCF96C1FD53A73"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A provider of a social media platform—</text>
<paragraph id="HD0BEA128C8FE4FD29045D664C9E6C77A"><enum>(1)</enum><text>may not permit a child to access such social media platform;</text></paragraph> <paragraph id="H01E3EB47772E49FD9DAC09E78AAE7313"><enum>(2)</enum><text display-inline="yes-display-inline">may not permit any individual to access such social media platform unless such provider has verified the age of such individual by—</text>
<subparagraph id="H0CAA932A47794F958777343AB1B2AA6F"><enum>(A)</enum><text>requiring such individual to provide a valid identity document issued by the Federal Government or a State or local government, such as a birth certificate, driver’s license, or passport; or</text></subparagraph> <subparagraph id="HECF465A9376F4C22849BD07683D6CB8B"><enum>(B)</enum><text>using another reasonable method of verification (taking into consideration available technology); and</text></subparagraph></paragraph>
<paragraph id="HEEBE95181B614D169E048B3D58030679"><enum>(3)</enum><text display-inline="yes-display-inline">shall establish and maintain reasonable procedures to protect the confidentiality, security, and integrity of the personal information of users and prospective users of such social media platform, which shall be consistent with the procedures required under section 1303(b)(1)(D) of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6502">15 U.S.C. 6502(b)(1)(D)</external-xref>).</text></paragraph></subsection> <subsection id="H96887B6AD67044FDABC64DEDED9F3A15"><enum>(b)</enum><header>Enforcement</header> <paragraph id="H05B0F9CCA460428FB21E73551E4534DC"><enum>(1)</enum><header>Enforcement by Federal Trade Commission</header> <subparagraph id="H912621D0818E4E34A3F55549A805C8EB"><enum>(A)</enum><header>Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of this section shall be treated as a violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></subparagraph>
<subparagraph id="H76C4412AD5844BD4873351B4C959B79A"><enum>(B)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section. Any person who violates this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></subparagraph></paragraph> <paragraph id="H5F4699A9F9364623AF1488656A89967D"><enum>(2)</enum><header>Actions by States</header> <subparagraph id="HA7DDD8182016449292078F43F72CF63C"><enum>(A)</enum><header>In general</header> <clause id="H94A1CAE3258A43F2B7D588D8A2AECFB9"><enum>(i)</enum><header>Civil actions</header><text>In any case in which the attorney general of a State has reason to believe that an interest of the residents of such State has been or is threatened or adversely affected by the engagement of a provider of a social media platform in an act or practice that violates this section, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in a district court of the United States of appropriate jurisdiction to—</text>
<subclause id="H030ABB9C7CBF4CA697FB5F8932FAFDC4"><enum>(I)</enum><text display-inline="yes-display-inline">enjoin such act or practice;</text></subclause> <subclause id="H1C34A6C81D8E4B1F866CCB06466364EF"><enum>(II)</enum><text display-inline="yes-display-inline">enforce compliance with this section;</text></subclause>
<subclause id="H690017AB628C45198F7C3EDEBCB06484"><enum>(III)</enum><text display-inline="yes-display-inline">obtain damages, restitution, or other compensation on behalf of residents of the State; or</text></subclause> <subclause id="H09E56C78B2DC44F6B83D879A4839A722"><enum>(IV)</enum><text>obtain such other relief as the court may consider to be appropriate.</text></subclause></clause>
<clause id="H3D29C58A6F9A482D93F33A77D7A319FF"><enum>(ii)</enum><header>Notice</header>
<subclause id="H70097411EF59491EB1070B73B6B1C9E8"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Before filing an action under clause (i), the attorney general of the State involved shall provide to the Commission—</text> <item id="H3DE53C4F66B44363B5B53D83655898B1"><enum>(aa)</enum><text>written notice of such action; and</text></item>
<item id="H3657B22524964CD4B2BEEABF7383A20D"><enum>(bb)</enum><text>a copy of the complaint for such action.</text></item></subclause> <subclause id="HA77C51E481B6443785D28529A4FC9AF5"><enum>(II)</enum><header>Exemption</header> <item id="H149C472D524D4540AB2A47DD57FDE034"><enum>(aa)</enum><header>In general</header><text display-inline="yes-display-inline">Subclause (I) shall not apply with respect to the filing of an action by an attorney general of a State under this subparagraph, if the attorney general determines that it is not feasible to provide the notice described in such subclause before the filing of such action.</text></item>
<item id="H81E9DF639FEE485D8580A909973661FC"><enum>(bb)</enum><header>Notification</header><text>In an action described in item (aa), the attorney general of a State shall provide notice and a copy of the complaint to the Commission at the same time as the attorney general files such action.</text></item></subclause></clause></subparagraph> <subparagraph id="H9CDDFF7552CA46CC94A4B603D013F0B6"><enum>(B)</enum><header>Intervention</header> <clause id="H38AD16B5D766464A8E250EF04C2BB27F"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">On receiving notice under subparagraph (A)(ii), the Commission shall have the right to intervene in the action that is the subject of such notice.</text></clause>
<clause id="HF11BE8B4136840EEAEB10B220D486EA0"><enum>(ii)</enum><header>Effect of intervention</header><text display-inline="yes-display-inline">If the Commission intervenes in an action under subparagraph (A), it shall have the right—</text> <subclause id="H9A9D792FFBEC43388E3D531499639B0A"><enum>(I)</enum><text display-inline="yes-display-inline">to be heard with respect to any matter that arises in such action; and</text></subclause>
<subclause id="H4352AAB586564020821C5455284305BC"><enum>(II)</enum><text>to file a petition for appeal.</text></subclause></clause></subparagraph> <subparagraph id="H8FC93B591A1F40E48F3DD7C33364F391"><enum>(C)</enum><header>Construction</header><text display-inline="yes-display-inline">For purposes of bringing any civil action under subparagraph (A), nothing in this section shall be construed to prevent an attorney general of a State from exercising the powers conferred on the attorney general by the laws of that State to—</text>
<clause id="HA90A70A154AB499689BDD988FA9F7F48"><enum>(i)</enum><text>conduct investigations;</text></clause> <clause id="H6526294AF1924E069C0DF062F7BEEDAA"><enum>(ii)</enum><text>administer oaths or affirmations; or</text></clause>
<clause id="HE7CFD39F8619416BB9C00F3350C0A8BE"><enum>(iii)</enum><text display-inline="yes-display-inline">compel the attendance of witnesses or the production of documentary and other evidence.</text></clause></subparagraph></paragraph> <paragraph id="H891606A0100146DB943B3AF74E5232B1"><enum>(3)</enum><header>Private right of action</header><text display-inline="yes-display-inline">A parent of a child injured by a violation of this section by a provider of a social media platform may bring in a district court of the United States of appropriate jurisdiction a civil action to—</text>
<subparagraph id="HEFE2DE4F901C48FEA5EB8CEF5A1A0BFE"><enum>(A)</enum><text display-inline="yes-display-inline">enjoin the violation;</text></subparagraph> <subparagraph id="HAE8C11DCA9204FFA87CECD82A3DE496B"><enum>(B)</enum><text>obtain compensatory damages and punitive damages; or</text></subparagraph>
<subparagraph id="HB2F3BF8F347043A489309D6F536EAF0D"><enum>(C)</enum><text>obtain such other relief as the court may consider to be appropriate.</text></subparagraph></paragraph></subsection> <subsection id="H5C2D512E6BB9409DA9ACDC8D773B6CA6"><enum>(c)</enum><header>Review and report to Congress</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Commission shall—</text>
<paragraph id="HD8AB3D7FA9014444985ABFD071B399E2"><enum>(1)</enum><text display-inline="yes-display-inline">review the implementation of this section, including the effects of the implementation of this section on providers of social media platforms, the efforts of the Commission to ensure such providers comply with this section and the successfulness of such efforts, any violations of this section by such providers, and the actions taken by such providers to verify the age and identity of users and prospective users of the social media platforms of such providers; and</text></paragraph> <paragraph id="HFB5A37C4AE4748EE96ABC8F4DF994237"><enum>(2)</enum><text display-inline="yes-display-inline">submit to Congress a report on the results of the review described in paragraph (1). </text></paragraph></subsection>
<subsection id="HDEAC65731A4D41CC93C4F561235A95E9"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HE9633F5E02A446E8A24566E43D82864E"><enum>(1)</enum><header>Access</header><text display-inline="yes-display-inline">The term <term>access</term> means, with respect to a social media platform—</text>
<subparagraph id="H263FB3BDA6C14A848376787769552850"><enum>(A)</enum><text>to establish an account on such social media platform;</text></subparagraph> <subparagraph id="HEA2B831E6753436FA7643EDDF8EDD911"><enum>(B)</enum><text>to create a profile on such social media platform; or</text></subparagraph>
<subparagraph id="H900BC83FDD414FE78B9A35AFBF11BFAE"><enum>(C)</enum><text>to create, share, or view user-generated content through such account or profile.</text></subparagraph></paragraph> <paragraph id="H07D1FA7AC4064E74AA6535F347839EC4"><enum>(2)</enum><header>Child</header><text display-inline="yes-display-inline">The term <term>child</term> means an individual under the age of 16.</text></paragraph>
<paragraph id="H4515FD94B2504162900835CFE27A507A"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph> <paragraph id="H50FD419F3F6E43B7ADB5FAA836D389A6"><enum>(4)</enum><header>Parent</header><text display-inline="yes-display-inline">The term <term>parent</term> has the meaning given such term in section 1302 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>).</text></paragraph>
<paragraph id="H2D6508C7C16A4B41B22A4147886CC60D"><enum>(5)</enum><header>Personal information</header><text display-inline="yes-display-inline">The term <term>personal information</term> means individually identifiable information about an individual collected online, including—</text> <subparagraph id="H31DFBBB4E6A94B11883E7F834D0DD10A"><enum>(A)</enum><text display-inline="yes-display-inline">a first and last name;</text></subparagraph>
<subparagraph id="HB262429CC2184665A01192FB96FF10D4"><enum>(B)</enum><text>a home or other physical address, including street name and name of a city or town;</text></subparagraph> <subparagraph id="H922C7AD01B3C4F74B64F644E1565A46D"><enum>(C)</enum><text>an email address;</text></subparagraph>
<subparagraph id="HE16FE84B89B147E88C71A0E3AC891F49"><enum>(D)</enum><text>a telephone number;</text></subparagraph> <subparagraph id="HD86D2E2C52314D1898EC4A827A596C50"><enum>(E)</enum><text>a Social Security number; or</text></subparagraph>
<subparagraph id="H7A456057F15A4911A7C8A599F7A4BEA2"><enum>(F)</enum><text>any other information the Commission determines permits the physical or online contacting of a specific individual.</text></subparagraph></paragraph> <paragraph id="H3601E2C03F574C6CA3DD565670AB9B0A"><enum>(6)</enum><header>Social media platform</header> <subparagraph id="HF9290CB618B24F27B4591C7A8ED990DC"><enum>(A)</enum><header>In general</header><text>The term <term>social media platform</term> means a website or other internet medium that does the following:</text>
<clause id="H95B35EADCFEB464B82EE3D35AF41A98B"><enum>(i)</enum><text display-inline="yes-display-inline">Permits a person to establish an account or create a profile for the purpose of allowing users to create, share, and view user-generated content through such account or profile.</text></clause> <clause id="H151F18B749EF425E87585263ABD1D089"><enum>(ii)</enum><text display-inline="yes-display-inline">Enables 1 or more users to generate content that can be viewed by other users of such medium.</text></clause>
<clause id="H0BC056A316AD429CBAF93DB04A49CFC8"><enum>(iii)</enum><text display-inline="yes-display-inline">Primarily serves as a medium for users to interact with content generated by other users of such medium.</text></clause></subparagraph> <subparagraph id="HFD7FD6D0C88B46CC9095D3A8CB792EB1"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>social media platform</term> includes Facebook, Twitter, Instagram, Snapchat, and TikTok.</text></subparagraph></paragraph>
<paragraph id="H78163F1A4CF64CD1A5941C7333EC6810" commented="no"><enum>(7)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State of the United States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe. </text></paragraph></subsection> <subsection id="H3CFBF85AA4874FE7B4801145F93191D3" commented="no"><enum>(e)</enum><header>Effective date</header><text>This section shall take effect on the date that is 90 days after the date of the enactment of this Act.</text></subsection></section>
