<section id="H6FCE7E9B38FE441F8719634A43DCE88D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>TANF State Expenditure Integrity Act of 2024</short-title></quote>.</text></section> <section id="HB4DCAE09A4C04878AA643210FE67CD38"><enum>2.</enum><header>Authority to prevent and address intentional misuse of subrecipient funds under the TANF program</header> <subsection id="H28D1DB9076A143759154FCE75003AA3C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 417 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/617">42 U.S.C. 617</external-xref>) is amended—</text> 
<paragraph id="HEE0EECD13A67475A930206AEA9FBBA9C"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general.—</header-in-text></quote> before <quote>No</quote>; and</text></paragraph> <paragraph id="H854998081F6D485889FDE27773834B71"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H38C6EA423BD64392BBA4B773A1220074" display-inline="no-display-inline"> 
<subsection id="HD04FE5BCC2824018AF68B1EC8BCB0EF8"><enum>(b)</enum><header>Authority To prevent intentional misuse of subrecipient funds</header> 
<paragraph id="H2F75EB9D4D8D4D8AB703C74AA18F6A54"><enum>(1)</enum><header>Subrecipient monitoring</header> 
<subparagraph id="HEF1572EB43C143C68E1B3D632ED4DA9B"><enum>(A)</enum><header>In general</header><text>The Secretary—</text> <clause id="H27AB49C84CE74CF08B9D4C8E82B9BA12"><enum>(i)</enum><text display-inline="yes-display-inline">shall develop a framework for the monitoring of subrecipient use of funds provided under section 403(a)(1) of this Act, for the purpose of identifying intentional misuse, to supplement single State audits conducted under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/75">chapter 75</external-xref> of title 31, United States Code;</text></clause> 
<clause id="H00119C311EEC4EF9A2C6FE390DBE7314"><enum>(ii)</enum><text display-inline="yes-display-inline">may establish State plan requirements or formats relating to clause (i); and</text></clause> <clause id="H7642910758B943BBB16DB4B0C3FA10EB"><enum>(iii)</enum><text>may request States to report to the Secretary such information to supplement the report provided under section 411(a) as the Secretary determines is necessary to enable the Secretary to comply with clauses (i) and (ii) of this subparagraph.</text></clause></subparagraph> 
<subparagraph id="HAD597182E3CE47BDB5A61E88C72D8512"><enum>(B)</enum><header>No effect on single State audit authority</header><text>Clause (i) of this subparagraph shall not be interpreted to limit the authority of the Secretary to conduct single State audits under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/75">chapter 75</external-xref> of title 31, United States Code.</text></subparagraph></paragraph> <paragraph id="HB7FBE1F9B7984028B039055094AF91DA"><enum>(2)</enum><header>Program Integrity Unit authorization and funding</header> <subparagraph id="HFACCDDB5DE1F42C1973779E3F13ECA5D"><enum>(A)</enum><header>TANF Program Integrity Unit</header><text>The Secretary shall create a TANF Program Integrity Unit at the Administration for Children &amp; Families, which shall conduct the monitoring described in paragraph (1)(A)(i).</text></subparagraph> 
<subparagraph id="HBDF7E2EEFE274086935464E79D9F9357"><enum>(B)</enum><header>Appropriation</header><text>Out of any money in the Treasury not otherwise appropriated, the amount made available in section 403(a)(1)(C) for each fiscal year shall be increased by $10,000,000, and the amount of the increase shall be available for the staffing and operations of the TANF Program Integrity Unit and related functions.</text></subparagraph></paragraph> <paragraph id="HC39ABC928A8F40E391E6DCA0D8380E1F"><enum>(3)</enum><header>Annual report to the Congress</header><text display-inline="yes-display-inline">The Secretary shall submit an annual report to the Congress on the activities undertaken under paragraph (2)(A) in the fiscal year covered by the report.</text> </paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H9EB4B51DD74246EBB5DE71C5AE2C6B9B"><enum>(b)</enum><header>Remedies</header><text>Section 409(a)(1)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/609">42 U.S.C. 609(a)(1)(B)</external-xref>) is amended—</text> <paragraph id="HAD2BD7A796A8407795EBC42B8FA103AD"><enum>(1)</enum><text>by striking <quote>(B) <header-in-text level="subparagraph" style="OLC">Enhanced penalty for intentional violations.—</header-in-text>If</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="HC9A2299572D244039EBFB0B30EBDEC8D" display-inline="no-display-inline"> 
<subparagraph id="H9B5EB008F0C644D0A78727700BE3EB77"><enum>(B)</enum><header>Enhanced penalty for intentional violations</header> 
<clause id="HD140816181E04201A031A5250A63B1ED"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">If</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H8F4435EB2AE9487D8E5ADF4842CF524C"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H3032CAE570234DB5A7191D2F76DA0927" display-inline="no-display-inline"> 
<clause id="HE2CE38435DB440ED8BFC01B0F57734F4"><enum>(ii)</enum><header>Additional remedies</header><text display-inline="yes-display-inline">If the Secretary finds, as a result of subrecipient monitoring under section 417(b)(1) of this Act, that an amount has been intentionally misused in violation of this part, then the Secretary shall—</text> <subclause id="H14900EB1B51D401FB3192F2ECF8913F8"><enum>(I)</enum><text>notify the State involved of the finding; and</text></subclause> 
<subclause id="H0FDF783500444C428F6D19A22656C5F7"><enum>(II)</enum><text display-inline="yes-display-inline">in addition to any penalty imposed under clause (i), require the State to expend, in addition to any other amount required to be expended under the State program funded under this part, an amount equal to the amount so misused, for the provision of cash assistance directly to families with an income below 100 percent of the poverty line (as defined in section 673(2) of the Omnibus Budget Reconciliation Act of 1981, including any revision required by such section, applicable to a family of the size involved).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HC04C52EEF10C4800A34E19980B89FC6D"><enum>(c)</enum><header>Deadline for publication of notice of rulemaking</header><text>Within 2 years after the date of the enactment of this Act, the Secretary of Health and Human Services shall publish a notice of rulemaking to implement the amendments made by this section.</text></subsection> 
<subsection id="H0962E31AB27A47BD847C232E237D23BD"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the later of—</text> <paragraph id="H513CC31C3763403B833876AAE6137BD6"><enum>(1)</enum><text>the 1st day of the 5th calendar quarter that begins after the date of the enactment of this Act; or</text></paragraph> 
<paragraph id="HB5905E7224B94E3295F61D8F8DDD18CA"><enum>(2)</enum><text>the 1st day of the 1st Federal fiscal year that begins after such date of enactment.</text> </paragraph></subsection></section> </legis-body> </bill>
