R. 8170</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240430">April 30, 2024</action-date><action-desc><sponsor name-id="E000246">Mr. Edwards</sponsor> (for himself, <cosponsor name-id="T000483">Mr. Trone</cosponsor>, and <cosponsor name-id="T000467">Mr. Thompson of Pennsylvania</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 40, United States Code, to provide for certain exceptions to the mileage limitation for Appalachian development highway system projects.</official-title></form><legis-body id="HF681CDD78B1B45C4A0A5D768668BF440" style="OLC"><section id="H6F9ACA70DCD34481B38F3B97BEDBC8C1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Appalachian Regional Continuing Development Act of 2024</short-title></quote> or the <quote><short-title>ARC Development Act of 2024</short-title></quote>.</text></section><section id="H0F7468C4B04D403FBC5C6568F04AB112" section-type="subsequent-section"><enum>2.</enum><header>Mileage limitation exemption for certain Appalachian development highway system projects</header><text display-inline="no-display-inline">Section 14501 of title 40, United States Code, is amended—</text><paragraph id="H3EC95E8989C84B06A159198BC985C496"><enum>(1)</enum><text>by redesignating subsections (c) through (g) as subsections (f) through (j), respectively;</text></paragraph><paragraph id="H680B68C40B7E42DD9E86AEDE5F36B068"><enum>(2)</enum><text>by redesignating subsection (b) as subsection (d);</text></paragraph><paragraph id="H439ADFDF10EC42B0BA0732F6BB66D84E"><enum>(3)</enum><text>in subsection (a)—</text><subparagraph id="HF0C1D686AA184137812A0EB3327419A4"><enum>(A)</enum><text>by striking <quote>There shall not</quote> and inserting <quote>(c) <header-in-text level="subsection" style="USC">Local access road mileage</header-in-text>.—There shall not</quote>; and</text></subparagraph><subparagraph id="H3139AA2BAFC04DFCB07F7FD9CFAFC100"><enum>(B)</enum><text>by striking <quote>Construction on the development</quote> and inserting <quote>(b) <header-in-text level="subsection" style="USC">Limitation on total mileage</header-in-text>.—Except as provided in subsection (e), construction on the development</quote>; </text></subparagraph></paragraph><paragraph id="H6F190A5D514744F1B0CFB112E7A2D70C"><enum>(4)</enum><text>by inserting after subsection (d), as redesignated by this section, the following: </text><quoted-block style="USC" id="H09BB28F2E0114C33A4A2470B9E25C088" display-inline="no-display-inline"><subsection id="H02DB4C975C5C4D38A3B938BEEE266ED0"><enum>(e)</enum><header>Application for alternative route</header><paragraph id="HEE0D067CBDBA419D99F2B6DEA26C9D99"><enum>(1)</enum><header>Exemption from mileage limitation</header><text display-inline="yes-display-inline">The Appalachian Regional Commission may approve a waiver of the limitation in subsection (b) for a construction project under this section if the final alignment as determined through the National Environmental Policy Act documentation process of a route approved for assistance under this section exceeds such limitation.</text></paragraph><paragraph id="H1F74D6715D114C44A76DFD426A475CD2"><enum>(2)</enum><header>Treatment of project mileage</header><text display-inline="yes-display-inline">Any mileage in excess of the limitation in subsection (b) that is approved under paragraph (1) shall be added to the mileage limitation in such subsection and shall be considered eligible development highway system miles under this section.</text></paragraph><paragraph id="H0857347622294A1EB7FA932EB5EE95E7"><enum>(3)</enum><header>Application</header><text>To be eligible for a waiver under paragraph (1), a participating State shall submit to the Commission an application in such manner, and containing such information, as the Commission may require.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
