which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, <committee-name committee-id="HAG00">Agriculture</committee-name>, and <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Administrator of the Environmental Protection Agency to carry out certain activities to protect communities from the harmful effects of plastics, and for other purposes.</official-title></form><legis-body id="HE845EF5C82754F788C2B1C05C72B9CD7" style="OLC"><section id="H2FB1E1746B854B3E8185B28261453EC6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Communities from Plastics Act of 2024</short-title></quote>.</text></section><section id="H90621FABB0C54347AABF53B96CA147C1"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HD6C5515D0687400D90B999D4F2E656BC"><enum>(1)</enum><text>plastics production is exacerbating the climate crisis and driving environmental injustice in vulnerable communities located near petrochemical facilities;</text></paragraph><paragraph id="H82973E72165F451FB6D8D9E67BE7BCA6"><enum>(2)</enum><text>plastics production is on track to double in the decade beginning on the date of enactment of this Act, locking in harmful emissions for decades;</text></paragraph><paragraph id="H91D54048DD804AD9A3CCF3E8D0A917AF"><enum>(3)</enum><text>plastics and other petrochemicals are forecasted to become the largest driver of oil and hydraulically fractured gas demand by 2050;</text></paragraph><paragraph id="H13E47EE7CDF1415A94AC5039102707AE"><enum>(4)</enum><text>some studies have projected that the plastics industry will emit more greenhouse gas emissions than coal plants in the United States by 2030;</text></paragraph><paragraph id="H0EDE4DB18CDA4B288E7029D767D73B9A"><enum>(5)</enum><text>petrochemical facilities that produce plastics are more likely to be located in low-income communities and communities of color, disproportionately exposing those communities to harmful pollutants;</text></paragraph><paragraph id="H3F032E1C920E4409A708DF9FE93C514F"><enum>(6)</enum><text>plastics production and certain disposal facilities pollute surrounding communities with chemicals that are known to cause cancer, birth defects, and other serious illnesses;</text></paragraph><paragraph id="HCD43B1F2FE3D4D01852946E523460067"><enum>(7)</enum><text>transitioning from the use of fossil fuels for power generation and transportation only to replace that demand with more fossil fuel-based plastics production—</text><subparagraph commented="no" display-inline="no-display-inline" id="HD6797722B3C24397B9EEBA915B5DC2A2"><enum>(A)</enum><text display-inline="yes-display-inline">is not a viable strategy; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE44A0C95B40B4493BFBEA0475921948E"><enum>(B)</enum><text display-inline="yes-display-inline">fails to protect communities;</text></subparagraph></paragraph><paragraph id="H82027F1F68534001B922AF89D66D3A7A"><enum>(8)</enum><text>plastics carry impacts throughout the lifecycle, including the impacts of—</text><subparagraph id="H4F6BF604276743A890EA128FF4326121"><enum>(A)</enum><text>oil and gas extraction;</text></subparagraph><subparagraph id="H5D88B084C05D4612BC445C433B608ABD"><enum>(B)</enum><text>plastics refining, manufacturing, and certain methods of disposal; and</text></subparagraph><subparagraph id="H48677AEC33AF4D9F924978AE5AE7B15C"><enum>(C)</enum><text>resulting plastics pollution in communities and the environment, where the degrading plastics—</text><clause commented="no" display-inline="no-display-inline" id="HF48171E24FF34736A04550B24FC83B64"><enum>(i)</enum><text display-inline="yes-display-inline">leach chemical additives; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H0E18A3810729464182E651ED3CF23FC3"><enum>(ii)</enum><text display-inline="yes-display-inline">emit greenhouse gases;</text></clause></subparagraph></paragraph><paragraph id="H0A9DD64D98B344A39AABB40E57168833"><enum>(9)</enum><text>addressing the plastics crisis requires a shift away from single-use plastics in nonessential settings;</text></paragraph><paragraph id="H880BB44067C84DD8BB1940C635C841B5" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text>technologies that convert plastics to fuel, use plastics for energy generation, generate feedstocks for the chemical industry, or produce hazardous waste and toxic air pollution are not a sustainable solution to the plastics crisis; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA58E2A467CCC48F8BAC34FFD0A78D427"><enum>(11)</enum><text>the projected impacts of climate change, including rising sea levels, heat, and extreme weather, pose physical risks to facilities involved in plastics production and disposal, which can increase the risk of accidents, additional emissions, and other negative impacts on surrounding communities.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="H8B3614E406894BD182C3DEBC7261F6B9"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H18E5F615316E43B9AE7E034C583B5A01"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency. </text></paragraph><paragraph id="H1182100C867A4C0E9F598A21A8BBBA21"><enum>(2)</enum><header>Beverage</header><subparagraph commented="no" display-inline="no-display-inline" id="HD4A329CCDDCA4975BD3B5FF60DAEB020"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>beverage</term> means any drinkable liquid intended for human oral consumption, including—</text><clause id="HBA8587259E6140469418230631AB885D"><enum>(i)</enum><text>water;</text></clause><clause id="H25910F28E11D44D4BFB08432311B6A1B"><enum>(ii)</enum><text>flavored water;</text></clause><clause id="HAC25BFB8AAB040A8BD1A132F35C3B2DA"><enum>(iii)</enum><text>soda water;</text></clause><clause id="H036F33EBA1BB4560AFA8A15727960F28"><enum>(iv)</enum><text>mineral water;</text></clause><clause id="H2FC7C8794AE449A99F1A7C65FF59074A"><enum>(v)</enum><text>beer;</text></clause><clause id="HE8876F94BDBE49109BC719CA1B42AB8F"><enum>(vi)</enum><text>a malt beverage;</text></clause><clause id="HA61F390A590B48E7A069AD84F37152D3"><enum>(vii)</enum><text>a carbonated soft drink;</text></clause><clause id="H20E2694E993F435C9C1204B3D4E2C091"><enum>(viii)</enum><text>liquor;</text></clause><clause id="HED610F988A914E46986F74DF72BE36AC"><enum>(ix)</enum><text>tea;</text></clause><clause id="H84F6CCD69E1D4207AFFEEE680C092C7A"><enum>(x)</enum><text>coffee;</text></clause><clause id="H6F835CCBF0CC42DCBF47330FE4EB09C8"><enum>(xi)</enum><text>hard cider;</text></clause><clause id="H60538925EDF84D13A94291DB4B414713"><enum>(xii)</enum><text>fruit juice;</text></clause><clause id="H9B2023B5162E4A7787FF6D9182E585A5"><enum>(xiii)</enum><text>an energy or sports drink;</text></clause><clause id="HE331E480DD8642BDB75366A62A1F74A7"><enum>(xiv)</enum><text>coconut water;</text></clause><clause id="HE216736F50C7428193B659B0052E861D"><enum>(xv)</enum><text>wine;</text></clause><clause id="H4AC0593E65954AAD8A07096CF1555918"><enum>(xvi)</enum><text>a yogurt drink;</text></clause><clause id="HC9165AB3D4624375ABB71601032D7E66"><enum>(xvii)</enum><text>a probiotic drink;</text></clause><clause id="H53D007C8A8894F86B3BFC2CE186B5D7C"><enum>(xviii)</enum><text>a wine cooler; and</text></clause><clause id="HE9FA894E34294FFBA8D0088F9B1F0C1C"><enum>(xix)</enum><text>any other beverage determined to be appropriate by the Administrator.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8F1F58A30A544BFD82871E30388CD05C"><enum>(B)</enum><header>Exclusions</header><text display-inline="yes-display-inline">The term <term>beverage</term> does not include—</text><clause id="H9C796DFA152A4AA791A79BD49198DEE7"><enum>(i)</enum><text>a drug regulated under the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>);</text></clause><clause id="H43D26A23FAC446839FC31D4EDBE25D2E"><enum>(ii)</enum><text>infant formula; or</text></clause><clause id="HD2493003016E41B7A85030D64BAACBC3"><enum>(iii)</enum><text>a meal replacement liquid.</text></clause></subparagraph></paragraph><paragraph id="H2FD49E81A5BE448E94FDA10FC0AED75C"><enum>(3)</enum><header>Beverage container</header><subparagraph commented="no" display-inline="no-display-inline" id="HB8D1BB5E65AC4EE4981E7F75342DCB4E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>beverage container</term> means a prepackaged container that—</text><clause commented="no" display-inline="no-display-inline" id="H9572235B679B4C18BCE7E5708402F140"><enum>(i)</enum><text display-inline="yes-display-inline">is designed to hold a beverage;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC41A2CE08BC5460981A059FF7304A3B0"><enum>(ii)</enum><text display-inline="yes-display-inline">is made of any material, including glass, plastic, and metal; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HA0797211FB0249BFB09D0D5F8F6F25A7"><enum>(iii)</enum><text display-inline="yes-display-inline">has a volume of not more than 3 liters.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBDF86D7B36B347BBAA157039775A60D3"><enum>(B)</enum><header>Exclusions</header><text display-inline="yes-display-inline">The term <term>beverage container</term> does not include—</text><clause id="HF7D773A4F2B44FA3AD515D97784F54CF"><enum>(i)</enum><text>a carton;</text></clause><clause id="H98BB7F0398E64E758434A847A95D2153"><enum>(ii)</enum><text>a pouch; or</text></clause><clause id="HBC18810871EA4CAF8B2D6273E7AA603D"><enum>(iii)</enum><text>aseptic packaging, such as a drink box. </text></clause></subparagraph></paragraph><paragraph id="H64A0ECF2D98F45C69A8811CB481E562D"><enum>(4)</enum><header>Community of color</header><text>The term <term>community of color</term> means a geographically distinct area in which the percentage of the population of the community represented by people of color is higher than the percentage of the population of the State represented by people of color. </text></paragraph><paragraph id="H3F5E1771DE714392AE4446570B5539F8"><enum>(5)</enum><header>Consultation</header><text>The term <term>consultation</term> means the meaningful and timely process of—</text><subparagraph id="H9BF96C29DCFF4F429F89DB743A0BF590"><enum>(A)</enum><text>seeking, discussing, and carefully considering the views of fenceline communities in a manner that is cognizant of the values of all parties; and</text></subparagraph><subparagraph id="HAD83ECF7D3CA472395F35A0938495988"><enum>(B)</enum><text>when feasible, seeking agreement among the parties. </text></subparagraph></paragraph><paragraph id="H32AE4210CE6C4FFD8F72759D06CBE375"><enum>(6)</enum><header>Covered facility</header><text>The term <term>covered facility</term> means—</text><subparagraph id="H5A246D10D7C34A188754EA3B4499FBAE"><enum>(A)</enum><text>an industrial facility that transforms petrochemical gas and liquids into ethylene and propylene for later conversion into plastic polymers;</text></subparagraph><subparagraph id="H9733298186BD45DF85687065ED7F6589"><enum>(B)</enum><text>an industrial facility that transforms ethylene and propylene into any other chemical for later conversion into plastic polymers;</text></subparagraph><subparagraph id="H8B76A8B7F1E24B19A4DD58B11BE599F6"><enum>(C)</enum><text>a plastic polymerization, monomer, polymer, or resin production facility;</text></subparagraph><subparagraph id="HF0C8E182F722483DB91AF5CFEEF1DE9C"><enum>(D)</enum><text>an industrial facility that depolymerizes or otherwise breaks down plastic polymers into chemical feedstocks for use in new products or as fuel;</text></subparagraph><subparagraph id="HC08A4E2E918E4532A3B88C28372889A9"><enum>(E)</enum><text>an industrial facility that converts, including through pyrolysis or gasification, plastic polymers into chemical feedstocks;</text></subparagraph><subparagraph id="HBAEBD59D41CD4C66B0374D42E32E4CD2"><enum>(F)</enum><text>an industrial facility that generates fuel or energy from plastic polymers through waste-to-fuel technology, an incinerator, pyrolysis, gasification, or other similar technology, as determined by the Administrator; and</text></subparagraph><subparagraph id="H5075DB03318C4ACA9A75A03FFAB540BB"><enum>(G)</enum><text>an industrial facility that produces a chemical feedstock for use in the plastics manufacturing industry. </text></subparagraph></paragraph><paragraph id="H1793F9B771A2483C81868E9392A2EC90"><enum>(7)</enum><header>Covered product</header><text>The term <term>covered product</term> means—</text><subparagraph id="H2EFB97F51FA64D5ABCC9E4BC13B37DC4"><enum>(A)</enum><text>ethylene;</text></subparagraph><subparagraph id="H1FACBD5364C04CDBAA0DC7E16C76DEB3"><enum>(B)</enum><text>propylene; and</text></subparagraph><subparagraph id="H7494D64BF1A24F04A9B0CDB240931AB3"><enum>(C)</enum><text>raw plastic materials in any form, including pellets, resin, nurdles, powder, and flakes, including—</text><clause id="HC7535B4D5F964C509A3431AAAA8054C9"><enum>(i)</enum><text>polyethylene terephthalate (commonly referred to as <quote>PET</quote> or <quote>PETE</quote>);</text></clause><clause id="H54C25DF5F89F40509A3F4B09AF296A6F"><enum>(ii)</enum><text>high-density polyethylene (commonly referred to as <quote>HDPE</quote>);</text></clause><clause id="HED245746BD00449AA6D37408B1B6A6EB"><enum>(iii)</enum><text>low-density polyethylene (commonly referred to as <quote>LDPE</quote>);</text></clause><clause id="H59CD0C53D43B4954930D260B5BC20670"><enum>(iv)</enum><text>polypropylene (commonly referred to as <quote>PP</quote>);</text></clause><clause id="H2F8C19D4960E46E7A38BC361446EAAC3"><enum>(v)</enum><text>polyvinyl chloride (commonly referred to as <quote>PVC</quote>);</text></clause><clause id="H0CC4B82E8AED4598BD1517DDCFA06755"><enum>(vi)</enum><text>polystyrene (commonly referred to as <quote>PS</quote>); and</text></clause><clause id="H8CF4E9F416D044D2933C4DDAD32E3879"><enum>(vii)</enum><text>any other plastic polymer determined to be appropriate by the Administrator.</text></clause></subparagraph></paragraph><paragraph id="H5706F119886D44519089E25C37A29FCC"><enum>(8)</enum><header>Environmental justice</header><text>The term <term>environmental justice</term> means the fair treatment and meaningful involvement of all individuals, regardless of race, color, national origin, educational level, or income, with respect to the development, implementation, and enforcement of environmental laws, regulations, and policies to ensure that—</text><subparagraph id="H38A7878EAABC423A91498D1024E98E20"><enum>(A)</enum><text>communities with significant populations of racial minorities, communities of color, Indigenous communities, and low-income communities have full access to public information and opportunities for meaningful public participation with respect to human health and environmental planning, regulations, and enforcement;</text></subparagraph><subparagraph id="HF446C2636D6946ACB79D211EB8A88B23"><enum>(B)</enum><text>no community described in subparagraph (A) is exposed to a disproportionate burden of the negative human health and environmental impacts of pollution or other environmental hazards; and</text></subparagraph><subparagraph id="H7D481D3094394D3DB542E3F305BBC68F"><enum>(C)</enum><text>the 17 principles described in the document entitled <quote>The Principles of Environmental Justice</quote>, written and adopted at the First National People of Color Environmental Leadership Summit convened on October 24 through 27, 1991, in Washington, DC, are upheld.</text></subparagraph></paragraph><paragraph id="H30F0F6F0DBD74381B25AA517D4F244BF"><enum>(9)</enum><header>Fenceline community</header><subparagraph id="HFEE7830F07304EEDB448928AAAD92916"><enum>(A)</enum><header>In general</header><text>The term <term>fenceline community</term> means a community located near a covered facility that has experienced, as a result of that location—</text><clause id="HA0970B13BFAC4FE0BC5C9CBE2A8AFCDD"><enum>(i)</enum><text>negative impacts on human health and the environment; and</text></clause><clause id="H7279C57A8B4F46DFB5FAF310BBFB6AD0"><enum>(ii)</enum><text>systemic socioeconomic disparity or another form of injustice with respect to policies, regulations, or enforcement.</text></clause></subparagraph><subparagraph id="HE4CD59124ABA43EE980A851F977A02D6"><enum>(B)</enum><header>Inclusions</header><text>The term <term>fenceline community</term> includes a low-income community, an Indigenous community, and a community of color.</text></subparagraph></paragraph><paragraph id="H0917CA2859814430AB20E02ECB99268C"><enum>(10)</enum><header>Food service product</header><text>The term <term>food service product</term> means an item intended to deliver a food product, regardless of the recyclability or compostability of the item, including—</text><subparagraph id="H24BC72C64711471999601B117FEDC2FD"><enum>(A)</enum><text>a utensil;</text></subparagraph><subparagraph id="H5B1A9B5D0AFC44A7AD6C00377E4CB467"><enum>(B)</enum><text>a straw;</text></subparagraph><subparagraph id="HAE34999AEE994A3A847FFBACC986B2A7"><enum>(C)</enum><text>a stirrer;</text></subparagraph><subparagraph id="HE32118028CDA4F069A2A52E32B019844"><enum>(D)</enum><text>a drink cup;</text></subparagraph><subparagraph id="HBF9012791CA34F0CA7B5317A65434F53"><enum>(E)</enum><text>a drink lid;</text></subparagraph><subparagraph id="HF38CC6CC33094B41BF538C1EE0B856A2"><enum>(F)</enum><text>a food package;</text></subparagraph><subparagraph id="H74A3FE230E18443E8B8BAFA3BEE524A9"><enum>(G)</enum><text>a food container;</text></subparagraph><subparagraph id="H8EB8BB6A2515422C9E23D4ABA007C0D8"><enum>(H)</enum><text>a hinged or lidded container (commonly known as a <quote>clamshell</quote>);</text></subparagraph><subparagraph id="H8DEF3F7F3F24407BA8F612974A8AD587"><enum>(I)</enum><text>a plate;</text></subparagraph><subparagraph id="HFAFB6F9FAE3841AEBFF334582CAD0F69"><enum>(J)</enum><text>a bowl;</text></subparagraph><subparagraph id="H7DB07000955A4E259C5A2B462B14FC9D"><enum>(K)</enum><text>a meat, fish, seafood, or vegetable tray;</text></subparagraph><subparagraph id="HC2B4121172AD4D6AAC54E764B4E499BB"><enum>(L)</enum><text>a food wrapper; and</text></subparagraph><subparagraph id="H2BFA903EB26F4ED1A8DA9898F231795B"><enum>(M)</enum><text>a beverage container.</text></subparagraph></paragraph><paragraph id="HBC7C02998AAD475096222699B7A41874"><enum>(11)</enum><header>Indigenous community</header><text>The term <term>Indigenous community</term> means—</text><subparagraph id="H585229031BAC40389E058A81B6109A7B"><enum>(A)</enum><text>a federally recognized Indian Tribe;</text></subparagraph><subparagraph id="HA1431E88588E438EB3E2817133B1A599"><enum>(B)</enum><text>a State-recognized Indian Tribe;</text></subparagraph><subparagraph id="H33C98651921448018A59B4588D44F109"><enum>(C)</enum><text>an Alaska Native or Native Hawaiian community or organization; and</text></subparagraph><subparagraph id="H8A4A9DEFCBD54D20B92B8DFBC9BFCD18"><enum>(D)</enum><text>any other community of Indigenous individuals, including communities in other countries.</text></subparagraph></paragraph><paragraph id="H2B48932C9967446DAF0C5CB0337F7E46"><enum>(12)</enum><header>Limited english proficiency individual</header><text>The term <term>limited English proficiency individual</term> means an individual that—</text><subparagraph id="HE3A2835F5F0B4F8EA341544372DD7B0B"><enum>(A)</enum><text>does not speak English as their primary language; or</text></subparagraph><subparagraph id="H656D57F922BE42E79A33EB4652932D09"><enum>(B)</enum><text>has a limited ability to read, speak, write, or understand English.</text></subparagraph></paragraph><paragraph id="HA345299019F24029935790EA0035BD94"><enum>(13)</enum><header>Low-income community</header><text>The term <term>low-income community</term> means any census block group in which 30 percent or more of the population are individuals with an annual household income equal to, or less than, the greater of—</text><subparagraph id="H704FF44F444444589B405CE1E1E6D7F6"><enum>(A)</enum><text>an amount equal to 80 percent of the median income of the area in which the household is located, as reported by the Secretary of Housing and Urban Development; and</text></subparagraph><subparagraph id="H0851FDBE65A4420580CFFDBE24839028"><enum>(B)</enum><text>200 percent of the Federal poverty line.</text></subparagraph></paragraph><paragraph id="H1954F1CC09344B319B34B2FD4A94C079"><enum>(14)</enum><header>Material recovery facility</header><text>The term <term>material recovery facility</term> means a solid waste management facility that processes materials for reuse or recycling.</text></paragraph><paragraph id="HF05BC7D9C2994588A24495E44FEFD306"><enum>(15)</enum><header>Meaningful</header><text>The term <term>meaningful</term>, with respect to involvement by the public in a determination by a Federal agency, means that—</text><subparagraph id="H7D1BE248B488466086DC36387F3F52C5"><enum>(A)</enum><text>potentially affected residents of a community have an appropriate opportunity to participate in decisions relating to a proposed activity that will affect the environment or public health of the community;</text></subparagraph><subparagraph id="H3007414EAB7A4649A842BF006059F2E5"><enum>(B)</enum><text>the public contribution can influence the determination by the Federal agency;</text></subparagraph><subparagraph id="HD9FB151062754A22B2B2F2CFBDBF6C38"><enum>(C)</enum><text>the concerns of all participants are taken into consideration in the decisionmaking process; and</text></subparagraph><subparagraph id="H26B9926D21A14D7DBDB47F4D817D19CD"><enum>(D)</enum><text>the Federal agency—</text><clause id="H2588BCD5AC9240B7B42B9E1FFE1AA1D8"><enum>(i)</enum><text>provides to potentially affected members of the public accurate information, including identifying limited English proficiency individuals who need language assistance, implementing accessible language assistance measures, and providing notice to limited English proficiency individuals for effective engagement in decisions; and</text></clause><clause id="HC750C867733C421C8B88D85AB7B6C60B"><enum>(ii)</enum><text>facilitates the involvement of potentially affected members of the public. </text></clause></subparagraph></paragraph><paragraph id="HFD257613AB0E4E34824D653AE4D3C59F"><enum>(16)</enum><header>Packaging</header><subparagraph id="H92F39238381E4EF1A5B45F6C871136E9"><enum>(A)</enum><header>In general</header><text>The term <term>packaging</term> means—</text><clause id="H1812F93A783B4043B0D34FB408ADB353"><enum>(i)</enum><text>any package or container, regardless of recyclability or compostability; and</text></clause><clause id="H0E6FBF13B8744ECCBD54B2371680D33A"><enum>(ii)</enum><text>any separable and distinct material component, regardless of recyclability or compostability, used for the containment, protection, handling, delivery, and presentation of goods that are sold, offered for sale, or distributed to consumers in the United States, including through an internet transaction.</text></clause></subparagraph><subparagraph id="HB4F6EB1E940E4F0396F7F9BA5FFEB60E"><enum>(B)</enum><header>Inclusions</header><text>The term <term>packaging</term> includes—</text><clause commented="no" display-inline="no-display-inline" id="H0621AB5E7039467EB5CD48E39935E526"><enum>(i)</enum><text display-inline="yes-display-inline">an item described in subparagraph (A) that is—</text><subclause id="H2BFD5B763BDC4480970AA7B5532FAC9D"><enum>(I)</enum><text>sales packaging or primary packaging intended for the consumer market;</text></subclause><subclause id="H13E1BAD5C4E04579B3DA80E394450740"><enum>(II)</enum><text>service packaging designed and intended to be used or filled at the point of sale, such as carry-out bags, bulk good bags, take-out bags, and home delivery food service products;</text></subclause><subclause id="H0B1B02E137A2421DB74F824789C5C96B"><enum>(III)</enum><text>secondary packaging used to group products for multiunit sale; or</text></subclause><subclause id="H1735C2EA543A4387BB1AC2AA0FD9090A"><enum>(IV)</enum><text>tertiary packaging used for transportation or distribution directly to a consumer; and</text></subclause></clause><clause id="H1C9FD17F009C4FC0A590D1FE0F7C74B3"><enum>(ii)</enum><text>any ancillary element that is—</text><subclause commented="no" display-inline="no-display-inline" id="H96F7492E93554D22A87FA24BDE5D509C"><enum>(I)</enum><text display-inline="yes-display-inline">hung on, or attached to, a product; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HB43255690DD64CECB779B68CB089EEF5"><enum>(II)</enum><text display-inline="yes-display-inline">performing a packaging function.</text></subclause></clause></subparagraph><subparagraph id="HE4E83C281BA849E7BF1FA7CFCD19BDE3"><enum>(C)</enum><header>Exclusion</header><text>The term <term>packaging</term> does not include an item described in subparagraph (A) or (B) that—</text><clause id="HCA4A43044F2E45ED8E51B8360F9F598A"><enum>(i)</enum><text>is used for the long-term protection or storage of a product; and</text></clause><clause id="HAC840F3A9B674845B1FF4F8F8F66B0C8"><enum>(ii)</enum><text>has a useful life of not less than 5 years, as determined by the Administrator. </text></clause></subparagraph></paragraph><paragraph id="H157180041ED945EDB3E0C72C92CBDA73"><enum>(17)</enum><header>Physical climate risks</header><subparagraph id="H1BCC3B02D97D4F109A0F17FD236F0656"><enum>(A)</enum><header>In general</header><text>The term <term>physical climate risks</term> means risks to covered facilities and the operations of covered facilities that result from exposure to physical climate-related effects, including—</text><clause id="HC3D724671F134AFDA8E6AE4A7F02CBC0"><enum>(i)</enum><text>increased average global temperatures;</text></clause><clause id="H09DAE6F0825D4EEC8998FF89A65BF35D"><enum>(ii)</enum><text>increased severity and frequency of extreme weather events;</text></clause><clause id="HF2966DAB9FAA49BC98C41557C90E98D2"><enum>(iii)</enum><text>increased flooding;</text></clause><clause id="H853ED92400EC4E43A2F925B05A281928"><enum>(iv)</enum><text>sea-level rise;</text></clause><clause id="H241F895872704856AFEB0BC427971465"><enum>(v)</enum><text>increased severity and frequency of heat waves;</text></clause><clause id="HAE66D966F4374FE2B582605192BA456C"><enum>(vi)</enum><text>increased frequency of wildfires;</text></clause><clause id="HBDD72CB5BCB24F23BEA34341A9B98BAE"><enum>(vii)</enum><text>decreased arability of farmland; and</text></clause><clause id="H5B0E53F578554D1C93202E2923845B42"><enum>(viii)</enum><text>decreased availability of fresh water.</text></clause></subparagraph><subparagraph id="H4D23AAD32AF1436C9696BB7303F3DFE9"><enum>(B)</enum><header>Inclusions</header><text>The term <term>physical climate risks</term> includes the risk of additional emissions, accidents, failure of hazardous waste containment, and other risks resulting from the exposure of covered facilities and the operations of covered facilities to physical climate-related effects. </text></subparagraph></paragraph><paragraph id="H3338E7B2C77C41BC878704D7E57B8DC4"><enum>(18)</enum><header>Plastic</header><subparagraph id="HED06130664584D99B9B6A1D4903C56E5"><enum>(A)</enum><header>In general</header><text>The term <term>plastic</term> means a synthetic or semisynthetic material that—</text><clause id="H1A56C662CCB74B5D9CA850F5739F33E7"><enum>(i)</enum><text>is synthesized by the polymerization of organic substances; and</text></clause><clause id="HBCEEE0176BF34B86BACC896E87CAF504"><enum>(ii)</enum><text>is capable of being shaped into various rigid and flexible forms.</text></clause></subparagraph><subparagraph id="H48A046C94C4E4A2AAB4EC2C3FF583563"><enum>(B)</enum><header>Inclusions</header><text>The term <term>plastic</term> includes coatings and adhesives described in subparagraph (A).</text></subparagraph><subparagraph id="H04149891AB874C9F86C6603A46CD7DB6"><enum>(C)</enum><header>Exclusions</header><text>The term <term>plastic</term> does not include—</text><clause id="H33A6B74FE5DB4C8BB5B2E7B96C7A82F6"><enum>(i)</enum><text>natural rubber; or</text></clause><clause id="H7FE005D008574905AB869BD51E6B4C56"><enum>(ii)</enum><text>naturally occurring polymers, such as proteins or starches. </text></clause></subparagraph></paragraph><paragraph id="H6460CED7FDC7440B8CF19FDBA908BD7D" commented="no"><enum>(19)</enum><header>Producer</header><subparagraph id="H7D43179F8E2A41AD964D8DC223FD2543"><enum>(A)</enum><header>In general</header><text>The term <term>producer</term> means an entity that—</text><clause commented="no" display-inline="no-display-inline" id="HF549125A7E9049DFB520527CDECBDCD8"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H3CF5A2EF258745379AB8C93772EA6D1F"><enum>(I)</enum><text display-inline="yes-display-inline">manufactures a covered product or beverage container; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H5129137909184789854F4451DA6D443D" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">owns, or is a licensee of, the brand or trademark under which that covered product or beverage container is—</text><item commented="no" display-inline="no-display-inline" id="HEE99D871808D4582BAF70BCC3AED7259"><enum>(aa)</enum><text display-inline="yes-display-inline">used in a commercial enterprise in the United States;</text></item><item commented="no" display-inline="no-display-inline" id="H4823AF2808A6453089E94B3D1D9A0404"><enum>(bb)</enum><text display-inline="yes-display-inline">sold or offered for sale in the United States; or</text></item><item commented="no" display-inline="no-display-inline" id="H1207E2F9D79242AB8E60EF1FB1631A59"><enum>(cc)</enum><text display-inline="yes-display-inline">distributed in the United States;</text></item></subclause></clause><clause id="H59CCC868C13146009526448F1C4E587A"><enum>(ii)</enum><text>if no entity described in clause (i) exists with respect to a covered product or beverage container, owns or, if the owner is not located in the United States, is the exclusive licensee of a brand or trademark under which the covered product or beverage container is used in a commercial enterprise, sold or offered for sale, or distributed, in the United States; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H57CE117786854E249CEAB440EF0E4C51"><enum>(iii)</enum><text>if no entity described in clause (i) or (ii) exists with respect to a covered product or beverage container, sells, offers for sale, or distributes the covered product or beverage container in the United States.</text></clause></subparagraph><subparagraph id="HE0886D216BE94E84A54E985EEE3C7B99"><enum>(B)</enum><header>Exclusion</header><text>The term <term>producer</term> does not include an entity that produces, harvests, and packages an agricultural commodity on the site where the agricultural commodity was grown or raised.</text></subparagraph><subparagraph id="H319EAB9926B44F7795848746ABF6D96E"><enum>(C)</enum><header>Related definitions</header><text>For purposes of subparagraph (A):</text><clause id="HC43C778BF0D04235AB0EB98BA251B52A"><enum>(i)</enum><header>Licensee</header><text>The term <term>licensee</term> means an entity that holds the exclusive right to use a trademark or brand in the United States in connection with the manufacture, sale, or distribution of a covered product or beverage container.</text></clause><clause id="H90AF338A2B5A4CABA379BCF6A21B756B"><enum>(ii)</enum><header>Manufacture</header><text>The term <term>manufacture</term>, with respect to a beverage container, means to bottle, can, or otherwise fill a beverage container for sale to—</text><subclause id="H891D7C6197434F0BB634B58A586CC83E"><enum>(I)</enum><text>distributors distributing beverage containers to retailers;</text></subclause><subclause id="HDB79F4D35622418A8C38F537F16CFA55"><enum>(II)</enum><text>importers; or</text></subclause><subclause id="HDF04251B530F4839803C0C6C6E59B875"><enum>(III)</enum><text>retailers.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HFCA1E46602A8438AA01EF01F5EAF5087"><enum>(iii)</enum><header>Sale</header><text>The term <term>sale</term> includes the delivery of a covered product or beverage container to a purchaser in the United States. </text></clause></subparagraph></paragraph><paragraph id="H52DACB8436564536BD1D2250B5F0A421"><enum>(20)</enum><header>Refill; refillable; reusable; reuse</header><text>The terms <term>refill</term>, <term>refillable</term>, <term>reusable</term>, and <term>reuse</term> mean—</text><subparagraph id="H116C9A0A28E9442B9D047991C77784E7"><enum>(A)</enum><text>with respect to packaging or a food service product that is reused or refilled by a producer, that the packaging or food service product is—</text><clause id="H9EA6B02C0BA540ACB2993E84E56763A1"><enum>(i)</enum><text>explicitly designed and marketed to be utilized for not less than the number of cycles that the Administrator determines to be appropriate, for the same product, or for another purposeful packaging use in a supply chain;</text></clause><clause id="HAC049A15CB4C40EB9CB9C7E82BB952A3"><enum>(ii)</enum><text>designed for durability to function properly in original condition for multiple cycles;</text></clause><clause id="H41CE6A1D45964813BB2D23F527A28B44"><enum>(iii)</enum><text>composed of materials that do not contain—</text><subclause id="H50318353144C4238A5718893E44B3771"><enum>(I)</enum><text>toxic heavy metals;</text></subclause><subclause id="H10C0F50E2C614A2F8AC35D32F53530A6"><enum>(II)</enum><text>pathogens;</text></subclause><subclause id="HA82F7D0D43BA42B3A6D26E020B06AF1C"><enum>(III)</enum><text>additives; or</text></subclause><subclause id="H6AE24481D7034F47B8A84101F44FB344"><enum>(IV)</enum><text>toxic substances or chemical substances designated as high-priority substances under section 6(b)(1) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(b)(1)</external-xref>), including the chemicals or mixtures of chemicals described in section 4(f)(3);</text></subclause></clause><clause id="H89DAE823724E4A9D9A92A2FEB22A02AE"><enum>(iv)</enum><text>supported by adequate infrastructure to ensure that the packaging or food service product can be conveniently and safely reused or refilled for multiple cycles; and</text></clause><clause id="HA1C948D2184B40B38FC99AE19F4F3CB3"><enum>(v)</enum><text>repeatedly recovered, inspected, and repaired, if necessary, and reissued into the supply chain for reuse or refill for multiple cycles; and</text></clause></subparagraph><subparagraph id="HF6E7ED3E0A18484C8F9EEFA23ECBA18F"><enum>(B)</enum><text>with respect to packaging or a food service product that is reused or refilled by a consumer, that the packaging or food service product is—</text><clause id="HE858AE2B21A240DC86B1EAFA680A7EB4"><enum>(i)</enum><text>explicitly designed and marketed to be utilized for not less than the number of cycles that the Administrator determines to be appropriate, for the same product;</text></clause><clause id="H37A28BF4D4E348E3B04BCE7B3980660C"><enum>(ii)</enum><text>designed for durability to function properly in its original condition for multiple cycles;</text></clause><clause id="H6DFB826BB05D4E80B6339619BCCC16D4"><enum>(iii)</enum><text>composed of materials that do not contain—</text><subclause id="HCB9E0B10722541A2AD2D2FA07002376F"><enum>(I)</enum><text>toxic heavy metals;</text></subclause><subclause id="H39CC0816B2A74C10B899CC6762FB1B97"><enum>(II)</enum><text>pathogens;</text></subclause><subclause id="H28C3712FF88444A8B1E412DA325E9C7B"><enum>(III)</enum><text>additives; or</text></subclause><subclause id="H462A7B05695E4284A2351BA6D66D04AA"><enum>(IV)</enum><text>toxic substances or chemical substances designated as high-priority substances under section 6(b)(1) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(b)(1)</external-xref>), including the chemicals or mixtures of chemicals described in section 4(f)(3); and</text></subclause></clause><clause id="H6479AD8C7EEC44DE87D63A9BBE772B29"><enum>(iv)</enum><text>supported by adequate and convenient availability of, and retail infrastructure for, bulk or large format packaging that may be refilled to ensure the packaging or food service product can be conveniently and safely reused or refilled by the consumer for multiple cycles, as needed. </text></clause></subparagraph></paragraph><paragraph id="H45771D7B165B40ED92990E4F9B1C9621"><enum>(21)</enum><header>Single-use plastic</header><subparagraph id="HD2A9172133A64E9EA3159817655C4E41"><enum>(A)</enum><header>In general</header><text>The term <term>single-use plastic</term> means a plastic product or packaging that—</text><clause id="H406AA1669A104BE19A5BBB46D5C40D97"><enum>(i)</enum><text>is routinely disposed of, recycled, or otherwise discarded after a single use; or</text></clause><clause id="HD3D1E9B176BD40B0BE7A4DE3326A3E69"><enum>(ii)</enum><text>is not sufficiently durable or washable to be, or is not intended to be, reusable or refillable.</text></clause></subparagraph><subparagraph id="HCCD6BA1745CF4478BFF45718F36DF699"><enum>(B)</enum><header>Exclusions</header><text>The term <term>single-use plastic</term> does not include—</text><clause id="H83013E94B19A47CC8DBA0B555F3D60DA"><enum>(i)</enum><text>medical equipment, medical devices, consumer personal protective equipment, or other products determined by the Secretary of Health and Human Services to necessarily be made of plastic for the protection of public health or for people with disabilities;</text></clause><clause id="H189D601590904C879F0980396647A489"><enum>(ii)</enum><text>packaging that is—</text><subclause id="HFF76F3BE20C540F297440763D1F9AAB8"><enum>(I)</enum><text>for any product described in clause (i) that is determined by the Secretary of Health and Human Services to necessarily be used for the protection of public health or for people with disabilities; or</text></subclause><subclause id="HA42EF5F3FC1D40F982D83821F3AAD2D8"><enum>(II)</enum><text>used for the shipment of hazardous materials, such that the packaging is prohibited from being composed of used materials under section 178.509 or 178.522 of title 49, Code of Federal Regulations (as in effect on the date of enactment of this Act); or</text></subclause></clause><clause id="H17697FF50F0541C3A8510A3B512E703F"><enum>(iii)</enum><text>personal hygiene products that, due to the intended use of the products, could become unsafe or unsanitary to recycle, such as diapers. </text></clause></subparagraph></paragraph><paragraph id="H8772D3E86F904B419798237479A1B13A"><enum>(22)</enum><header>Temporary pause period</header><text>The term <term>temporary pause period</term> means the period—</text><subparagraph id="H7E6559BA5DCC49C4845D93270B2321CF"><enum>(A)</enum><text>beginning on the date of enactment of this Act; and</text></subparagraph><subparagraph id="H6D29F4963CCC430F974065A198AD8A05"><enum>(B)</enum><text>ending on the date that is the first date on which—</text><clause id="HAE1AD139D0CA49E4BA4DDFE6F350C0C0"><enum>(i)</enum><text>all regulations and final rules required under subsections (c), (d), and (e) of section 4 are in effect; and</text></clause><clause id="H48DE7B0F3B9B4C2192B6A3B1C20DFD3D"><enum>(ii)</enum><text>the amendments made by subsection (h) of that section are fully implemented.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8B1C9A3FB700457694FBF3990C2E6E10"><enum>(23)</enum><header>Toxic substance</header><subparagraph commented="no" display-inline="no-display-inline" id="HAF567C6C5E584FD682459F6ECB85441E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>toxic substance</term> means any substance, mixture, or compound that—</text><clause commented="no" display-inline="no-display-inline" id="H1ED88639F0214865ADE7E8EB0099B578"><enum>(i)</enum><text display-inline="yes-display-inline">may cause—</text><subclause commented="no" display-inline="no-display-inline" id="HADB2E2129B9E4025B304D560F3E0D342"><enum>(I)</enum><text display-inline="yes-display-inline">personal injury or disease to humans through ingestion, inhalation, or absorption through any body surface; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H4E132B625DDB4D3AA7E13E89AD402495"><enum>(II)</enum><text display-inline="yes-display-inline">adverse impacts on the environment; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HCFCE09267C154C6B9BB3D41BECAA62F8"><enum>(ii)</enum><text display-inline="yes-display-inline">satisfies 1 or more of the conditions described in subparagraph (B).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF60C1AC6AB9C4427924E71B43897F150"><enum>(B)</enum><header>Conditions</header><text>The conditions referred to in subparagraph (A)(ii) are the following:</text><clause id="HCC7C4E2D880E4CA0A5A70D8325C67B38"><enum>(i)</enum><text>The substance, mixture, or compound is subject to reporting requirements under—</text><subclause id="HB6AD007E44234860A28BA69207AAF4E7"><enum>(I)</enum><text>the Emergency Planning and Community Right-To-Know Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11001">42 U.S.C. 11001 et seq.</external-xref>);</text></subclause><subclause id="H1B3932725F3647B9972F24AFFFAD77D9"><enum>(II)</enum><text>the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>); or</text></subclause><subclause id="H4526EF06635544C9A5B1704E8B180D27"><enum>(III)</enum><text>section 112(r) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)</external-xref>).</text></subclause></clause><clause id="H7637E7D8305E436C8A3274619CC03C7C"><enum>(ii)</enum><text>The National Institute for Occupational Safety and Health, the Occupational Safety and Health Administration, the National Toxicology Program, the Centers for Disease Control and Prevention, the Administrator of Health and Human Services, the National Institute for Environmental Health Sciences, or the Environmental Protection Agency has established that the substance, mixture, or compound poses an acute or chronic health hazard, including developmental, reproductive, or endocrine effects.</text></clause><clause id="H79D30BA7BA574219BB1B9ADBA2AAADDB"><enum>(iii)</enum><text>The National Institute for Occupational Safety and Health or the Environmental Protection Agency has recognized that the substance, mixture, or compound may increase the risk of developing a latent disease.</text></clause><clause id="H726317D8342E4A39B9F1B2230ABC32B3"><enum>(iv)</enum><text>The substance, mixture, or compound is—</text><subclause id="H020BB3FE95EE4B9AB031BB10AD315919"><enum>(I)</enum><text>a perfluoroalkyl or polyfluoroalkyl substance;</text></subclause><subclause id="H0C785D3A146F4AB48C747D989FF6289B"><enum>(II)</enum><text>an orthophthalate;</text></subclause><subclause id="HF789C45252214DB1B960D481E8E62DAD"><enum>(III)</enum><text>a bisphenol compound (but not including an alkyl-substituted bisphenol compound generated through a xylenol-aldehyde process); </text></subclause><subclause id="HE87957B8F85B47A499B618B9255F6846"><enum>(IV)</enum><text>a halogenated or nanoscale flame-retardant chemical;</text></subclause><subclause id="HC4D05837BE444128B83E6ED4FA0D48CE"><enum>(V)</enum><text>UV 328 (2–(2H-benzotriazol-2-yl)–4,6-di-tert-pentylphenol);</text></subclause><subclause id="H34D9E003A48F46D0A98BC2A1B481797D"><enum>(VI)</enum><text>a chlorinated paraffin;</text></subclause><subclause id="H84D8BBAFBEEA4897AEC3736204BCD64D"><enum>(VII)</enum><text>listed as a persistent organic pollutant by the Stockholm Convention on Persistent Organic Pollutants;</text></subclause><subclause id="H93865CABEFF74F5A9E344BB6D74F9B12"><enum>(VIII)</enum><text>given an overall carcinogenicity evaluation of Group 1, Group 2A, or Group 2B by the International Agency for Research on Cancer; or</text></subclause><subclause id="H733B455F910D498580C2E0BC5002AAE4"><enum>(IX)</enum><text>listed as a toxic, poisonous, explosive, corrosive, flammable, ecotoxic, or infectious waste by the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal, done at Basel, Switzerland, March 22, 1989.</text></subclause></clause><clause id="HB4D1256D180C4F4D9BF7D1A394474F39"><enum>(v)</enum><text>The substance, mixture, or compound is a chemical or chemical class that, as determined by the Administrator, has been identified by a Federal agency, State agency, or international intergovernmental agency as being 1 or more of the following:</text><subclause id="HAB0EA23A89254BE8A9705C050E7D9591"><enum>(I)</enum><text>A carcinogen, mutagen, reproductive toxicant, immunotoxicant, neurotoxicant, or endocrine disruptor.</text></subclause><subclause id="HDB0E38D481904E45B6BBDA496ED26D38"><enum>(II)</enum><text>A persistent bioaccumulative.</text></subclause><subclause id="HE6DF8210277D489D940FDA072BDF5E10"><enum>(III)</enum><text>A chemical or chemical class that may—</text><item commented="no" display-inline="no-display-inline" id="H4A02B80AE1014C5B8ED9B2B3AB5B2D83"><enum>(aa)</enum><text display-inline="yes-display-inline">harm the normal development of a fetus or child or cause other developmental toxicity in humans or wildlife;</text></item><item id="HE80A9581F2844C4C97477D3BA66ED0AA"><enum>(bb)</enum><text>harm organs or cause other systemic toxicity; or</text></item><item id="H3E75F80B9EDF4A2E8F6E8AA4FC9EB49B"><enum>(cc)</enum><text>have an adverse impact on—</text><subitem commented="no" display-inline="no-display-inline" id="HA6A960A700A5474786857A147403472E"><enum>(AA)</enum><text display-inline="yes-display-inline">air quality;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="HA64D8E6D4E6F49FF89649FF8D0D58C98"><enum>(BB)</enum><text display-inline="yes-display-inline">ecology;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="HD4E7E8A52694429CB81A76028EF1888F"><enum>(CC)</enum><text display-inline="yes-display-inline">soil quality; or</text></subitem><subitem commented="no" display-inline="no-display-inline" id="H3683E93A8BC4459AA567394BF5474189"><enum>(DD)</enum><text display-inline="yes-display-inline">water quality.</text></subitem></item></subclause><subclause id="HD728EFA149A7445ABCB5EA32683E5D9E"><enum>(IV)</enum><text>A chemical or chemical class that has toxicity equivalent to the toxicity reflected in a criterion described in any of subclauses (I) through (III). </text></subclause></clause></subparagraph></paragraph><paragraph id="H651FD869F5394761900587B73898DA66"><enum>(24)</enum><header>Translation services</header><text>The term <term>translation services</term> means professional language translation and interpretation for oral communications, and translation for written documents and notices, in any language spoken by more than 5 percent of the population residing within a fenceline community. </text></paragraph></section><section commented="no" display-inline="no-display-inline" id="HC2C45D65E8C24BFE8FB693AE85E463D7"><enum>4.</enum><header>Environmental justice protections at covered facilities</header><subsection id="HBC1E413BD2BC488A915719F1A19DC6E6"><enum>(a)</enum><header>National academies study of plastics industry</header><paragraph id="HE3E50E28965344B68FE904C173CF634C"><enum>(1)</enum><header>Agreement</header><subparagraph id="H399F41BB265745BDA992EEE14A75F68B"><enum>(A)</enum><header>In general</header><text>The Administrator shall offer to enter into an agreement with the National Academy of Sciences and the National Institutes of Health to conduct a study of—</text><clause id="HD1ADE563CC0A405492272893C50AFA6B"><enum>(i)</enum><text>the existing and planned expansion of the industry of producers of covered products, including the entire supply chain, the extraction and refining of fossil fuels and polymer feedstocks, chemical recycling efforts, end uses, disposal fate, and lifecycle impacts of covered products;</text></clause><clause id="HB85DAD6E964E4632B47FC52F9FED1C2A"><enum>(ii)</enum><text>the environmental, public health, environmental justice, and pollution impacts of covered facilities and the products of covered facilities;</text></clause><clause id="HA256FB9EDFD149F384D1DBD8DAB02433"><enum>(iii)</enum><text>the use of additives in the production of covered products and the consequences of those additives on public health;</text></clause><clause id="HCDA61CAA4A60495F8A75BBC2C1C63CF9"><enum>(iv)</enum><text>the existing standard technologies and practices of covered facilities with respect to the discharge and emission of pollutants into the environment;</text></clause><clause id="H80E806CD89344DAFB8FEB6A01B15BF26"><enum>(v)</enum><text>the best available technologies and practices that reduce or eliminate the environmental justice and pollution impacts of covered facilities, associated infrastructure of covered facilities, and the products of covered facilities; and</text></clause><clause id="HE6FF2CCE6EF249D0BCDC32C51061AE04"><enum>(vi)</enum><text>the toxicity of plastic polymers, additives, and chemicals (including byproducts), including the impacts of those polymers, additives, and chemicals on—</text><subclause id="H7CA559E64A8F4DB1B1ED55816467B053"><enum>(I)</enum><text>public health;</text></subclause><subclause id="H72F6429A1F3F4AAD9499D4FCD0069E43"><enum>(II)</enum><text>the recyclability of plastic; and</text></subclause><subclause id="H4C024E0A2E364CD9BD1C35AAFCB17EDE"><enum>(III)</enum><text>the ability to use recycled content.</text></subclause></clause></subparagraph><subparagraph id="HD6B0BEA661C0442AB5658F29C9D10F09"><enum>(B)</enum><header>Failure to enter agreement</header><text>If the Administrator fails to enter into an agreement described in subparagraph (A), the Administrator shall conduct the study described in that subparagraph.</text></subparagraph></paragraph><paragraph id="H3699198DF36D49818556415935EEBC16"><enum>(2)</enum><header>Requirements</header><text>The study under paragraph (1) shall—</text><subparagraph id="H068D050079AC47928436D5A2FAE3C43B"><enum>(A)</enum><text>take into consideration—</text><clause id="HCE0D5DDE0F76493E8FE4845A02C7F9D0"><enum>(i)</enum><text>the direct, indirect, and cumulative environmental impacts of industries, including plastic production industries, chemical recycling industries, and the industries of other covered facilities;</text></clause><clause id="H8F020D5D27DA40B2B13D5AEA40385F7E"><enum>(ii)</enum><text>the impacts of the planned expansion of those industries, including local, regional, national, and international air, water, waste, climate change, public health, and environmental justice impacts of those industries; and</text></clause><clause id="HC343E50CC6764BC78C0FDCE5F37B8C92"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HC57BAFA0DA2C4C488001A2AA91ED360F"><enum>(I)</enum><text>the impacts of physical climate risks on the environmental, public health, environmental justice, and pollution risks posed by covered facilities and the products of covered facilities; and</text></subclause><subclause id="HB1950CDB830F4F30A7F2908466EA4A52" indent="up1"><enum>(II)</enum><text>the effectiveness of best available technologies to reduce or eliminate those environmental, public health, and environmental justice and pollution risks; and</text></subclause></clause></subparagraph><subparagraph id="H6F31C42A2AAE47BBA2BC0AA843BE0609"><enum>(B)</enum><text>recommend technologies, regulations, standards, and practices, including recommendations for technologies, regulations, standards, and practices that will best carry out the regulatory modifications required under subsections (c), (d), and (f), to remediate or eliminate the local, regional, national, and international air, water, waste, climate change, public health, and environmental justice impacts of the industries described in subparagraph (A)(i).</text></subparagraph></paragraph><paragraph id="H5D66BC973124425DBFB254EC00620E0F"><enum>(3)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator shall submit to Congress a report describing the results of the study under paragraph (1).</text></paragraph><paragraph id="HD67537CEF15B42E1B9BAC455480CD695"><enum>(4)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the National Academy of Sciences and the National Institutes of Health such sums as are necessary to carry out this subsection.</text></paragraph></subsection><subsection id="H6592CD88A5F94F04B7BCE25EC4A299F3"><enum>(b)</enum><header>Permitting moratorium for covered facilities</header><paragraph id="H1E6F2A9F3BCC46C1A5BD62642CCE5D2A"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), during the temporary pause period, notwithstanding any other provision of law—</text><subparagraph id="HDBAD7A261E174D56A439A9EF755734E2"><enum>(A)</enum><text>the Administrator shall not issue a new permit for a covered facility under—</text><clause id="HFEE508C132DA46B59618C8E855C3CB51"><enum>(i)</enum><text>the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>); or</text></clause><clause id="HB63A075515DA41EF99711BF505AB3A74"><enum>(ii)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>);</text></clause></subparagraph><subparagraph id="HFC4346AD24434C4EBCC488602BF82461"><enum>(B)</enum><text>the Secretary of the Army, acting through the Chief of Engineers, shall not issue a new permit for a covered facility under section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>);</text></subparagraph><subparagraph id="H79E72A34C0EF47E1B9F717F99BA7DAD7"><enum>(C)</enum><text>the Administrator shall object in writing under subsections (b) and (c) of section 505 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7661d">42 U.S.C. 7661d</external-xref>) or section 402(d)(2) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(d)(2)</external-xref>), as applicable, to any new permit issued to a covered facility by a State agency delegated authority under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) or the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>); and</text></subparagraph><subparagraph id="H1D812257749B44E08039163D69F981B7"><enum>(D)</enum><text>the export of covered products is prohibited.</text></subparagraph></paragraph><paragraph id="H13B12682C2D2497FB1B037662150BF6E"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) does not apply to a permit described in that paragraph for a facility that is—</text><subparagraph id="HCDB63E8443754D4E8359189E53B8C60C"><enum>(A)</enum><text>a material recovery facility;</text></subparagraph><subparagraph id="HF9695CF045454AD1841CDB9E690414F4"><enum>(B)</enum><text>a mechanical recycling facility; or</text></subparagraph><subparagraph id="H962F5192995F419EAD89A2ECC4D0DBCA"><enum>(C)</enum><text>a compost facility.</text></subparagraph></paragraph></subsection><subsection id="H2B49FDDB527748CAA65B6133363D65BA"><enum>(c)</enum><header>Clean air requirements for covered facilities</header><paragraph id="H4CA149BE3BE5406C855DCD5DDA457E94"><enum>(1)</enum><header>Timely revision of emissions standards</header><text>Section 111(b)(1)(B) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411(b)(1)(B)</external-xref>) is amended by striking the fifth sentence.</text></paragraph><paragraph id="H98FCD6AB38284C6FB1C5C664FE412385"><enum>(2)</enum><header>New source performance standards for certain facilities</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator shall promulgate a final rule—</text><subparagraph id="H5476B36947BC4E3D99738CCF5A30AD9E"><enum>(A)</enum><text>designating petrochemical feedstock and polymer production facilities as a category of stationary source under section 111(b)(1)(A) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411(b)(1)(A)</external-xref>); and</text></subparagraph><subparagraph id="H16417B4017A848EBBC753F94CCBB5259"><enum>(B)</enum><text>establishing new source performance standards under section 111(f)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411(f)(1)</external-xref>) for the category of stationary source designated under subparagraph (A).</text></subparagraph></paragraph><paragraph id="H867B3EC75E3E45C9BA6DFC4BA7916873"><enum>(3)</enum><header>Storage vessels for covered products</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator shall promulgate a final rule modifying section 60.112b(a) of title 40, Code of Federal Regulations, to ensure that an owner or operator of a storage vessel containing liquid with a vapor pressure equal to or more than 5 millimeters of mercury under actual storage conditions that is regulated under that section uses—</text><subparagraph id="H115C76616D984A1DAF4D0D08EBE989E1"><enum>(A)</enum><text>an internal floating roof tank connected to a volatile organic compound control device; or</text></subparagraph><subparagraph id="HE0496427F9B64C4489D82592B8B7483F"><enum>(B)</enum><text>a fixed-roof tank connected to a volatile organic compound control device.</text></subparagraph></paragraph><paragraph id="H7F17E2731C7F483EB4000EB15A984987"><enum>(4)</enum><header>Flaring</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall promulgate a final rule—</text><subparagraph id="H164E58D31497499DBA3D3EC28975CC96"><enum>(A)</enum><text>modifying title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), to ensure that flaring, at ground-level and elevated, shall only be permitted when necessary solely for safety reasons; and</text></subparagraph><subparagraph id="H9E0A02D3162048FDB6166D21C7847FC9"><enum>(B)</enum><text>modifying sections 60.112b(a)(3)(ii), 60.115b(d)(1), 60.482–10a(d), 60.562–1(a)(1)(i)(C), 60.662(b), and 60.702(b) of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), to ensure that—</text><clause id="H2BB3BB22AC32443BB8F1B402E01CBBE1"><enum>(i)</enum><text>references to flare standards under those sections refer to the flare standards established under subparagraph (A); and</text></clause><clause id="H2229E901F5A6492AAA2174175B7D9290"><enum>(ii)</enum><text>the flare standards under those sections are, without exception, continuously applied.</text></clause></subparagraph></paragraph><paragraph id="H7A5EC648742340B08FCDC7E208AD9988"><enum>(5)</enum><header>Natural gas-fired steam boilers</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator shall promulgate a final rule revising subpart Db of part 60 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), to ensure that boilers or heaters located at an affected covered facility regulated under that subpart may only burn gaseous fuels, not solid fuels or liquid fuels.</text></paragraph><paragraph id="H349EEF0914734A8D84B9E7967EE2F985"><enum>(6)</enum><header>Monitoring</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall promulgate a final rule revising subparts DDD, NNN, and RRR and other relevant subparts of part 60 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act)—</text><subparagraph id="H1BE5C1AF516C40FA82E9DD86AF794376"><enum>(A)</enum><text>to require continuous emissions monitoring of benzene, nitrogen oxides, sulfur dioxide, carbon monoxide, other hazardous air pollutants, and filterable particulate matter for all combustion devices, including during startups, shutdowns, and malfunctions of the facilities regulated by those subparts;</text></subparagraph><subparagraph id="H146529490FE345688CA24D99804C6E34"><enum>(B)</enum><text>to require—</text><clause id="HC7B97DC80586429588E005E3464FD4BE"><enum>(i)</enum><text>accurate and continuous recordkeeping when continuous emissions monitoring is required under subparagraph (A); and</text></clause><clause id="H7B6ADC9588164469B1E59E50669688EF"><enum>(ii)</enum><text>the records required under clause (i) to be made available to the public in real time;</text></clause></subparagraph><subparagraph id="H151416F1AE874C2CB553F5D8865F9F18"><enum>(C)</enum><text>to require continuous monitoring of emissions from combustion devices under section 63.658 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), for nitrogen oxides, sulfur dioxide, carbon monoxide, filterable and condensable particulate matter, and all other relevant hazardous air pollutants; and</text></subparagraph><subparagraph id="HFDA2FF4B963D4B688AF1CC96178CA4B5"><enum>(D)</enum><text>to ensure that the continuous monitoring of combustion devices required under subparagraphs (A) and (C) are used to determine the compliance of facilities regulated by those subparts with the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>). </text></subparagraph></paragraph></subsection><subsection id="HEEF661BCCA4740E688C0598FD7284BDA"><enum>(d)</enum><header>Clean water requirements for covered facilities</header><paragraph id="HCF9FD7F46D4A446ABF270869426B4F1A"><enum>(1)</enum><header>BAT and NSPS standards for plastic polymer production</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator shall promulgate a final rule—</text><subparagraph id="HF2AFD3BCA0FE472887BA31A272AB7200"><enum>(A)</enum><text>modifying part 414 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), to ensure that the best available technology and new source performance standard requirements under that part reflect updated best available technology and best available demonstrated control technology for all pollutants discharged by covered facilities that produce covered products, including pollutants of concern that are not regulated on the date of enactment of this Act;</text></subparagraph><subparagraph id="HCCBAED4339B647B59865505926AFB3F5"><enum>(B)</enum><text>modifying sections 414.91(b), 414.101(b), and 414.111(b) of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), to ensure that—</text><clause id="HA9EDEE49C1BA4249AB2776D3C2E9EACD"><enum>(i)</enum><text>for new source performance standards for applicable covered facilities producing covered products, the maximum effluent limit for any 1 day and for any monthly average for the priority pollutants described in appendix A to part 423 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), is 0 milligrams per liter, unless the Administrator—</text><subclause id="H3B2D0AF2E8FE4755BA14DEC7C27E40EC"><enum>(I)</enum><text>determines that higher limits are justified using best available demonstrated control technology; and</text></subclause><subclause id="H7984BC9D32F7416CA139A512D7D079BD"><enum>(II)</enum><text>publishes the determination under subclause (I) and the proposed higher limits in a rulemaking; and</text></subclause></clause><clause id="H08D4143E0E2348F091D1356501ED9ED0"><enum>(ii)</enum><text>for best available technology and new source performance standards, the maximum effluent limit for any 1 day and for any monthly average for total plastic pellets and other plastic material is 0 milligrams per liter; and</text></clause></subparagraph><subparagraph id="H0FE2052B97AC457685C1D752292037CA"><enum>(C)</enum><text>that ensures that the best available technology limitations described in part 414 of title 40, Code of Federal Regulations (as modified under subparagraph (A)) apply to covered facilities that produce fewer than 5,000,001 pounds of covered products per year.</text></subparagraph></paragraph><paragraph id="HC4D3B402243A4AB98D0BC879BFC60D15"><enum>(2)</enum><header>Revised effluent limitations guidelines for petrochemical feedstock and polymer production</header><subparagraph id="H438180A9E83D4456AF4EEA10AF7E4A57"><enum>(A)</enum><header>BAT and NSPS standards</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator shall promulgate a final rule—</text><clause id="H7DB015976E7641A68834E47996FB302B"><enum>(i)</enum><text>modifying sections 419.23, 419.26, 419.33, and 419.36 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), to ensure that the best available technology and new source performance standards reflect updated best available technology and best available demonstrated control technology for all pollutants discharged by covered facilities producing petrochemical feedstocks and polymers; and</text></clause><clause id="HBBF2426B4A6C4CB7BB44AEF1A4D1635D"><enum>(ii)</enum><text>modifying sections 419.26(a) and 419.36(a) of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), to ensure that the new source performance standards for any 1 day and for average of daily values for 30 consecutive days for the priority pollutants described in appendix A to part 423 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), is 0 milligrams per liter, unless the Administrator—</text><subclause id="H048ED9155CB342AFB9DCB6A42C20489D"><enum>(I)</enum><text>determines that higher limits are necessary based on the best available demonstrated control technology; and</text></subclause><subclause id="H25616E2116734785AC68147FF7EE3D5E"><enum>(II)</enum><text>publishes the determination under subclause (I) and the proposed higher limits in a rulemaking.</text></subclause></clause></subparagraph><subparagraph id="HE47BACE654904A6EB30071D5C39A1ABC"><enum>(B)</enum><header>Runoff limitations for ethylene and propylene production</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator shall promulgate a final rule modifying sections 419.26(e) and 419.36(e) of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), to ensure that runoff limitations that reflect best available demonstrated control technology are included. </text></subparagraph></paragraph></subsection><subsection id="HBDD5BBFD68994C899C11A115593F75C5"><enum>(e)</enum><header>Environmental justice requirements for covered facilities</header><paragraph id="HA9BDE3B78C0A484E83EB0D928E1BE82C"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall promulgate a final rule to ensure that—</text><subparagraph id="H23D8E3090A0442158E6BA84B0AB820A3"><enum>(A)</enum><text>any proposed permit to be issued by the Administrator or a State agency to which authority is delegated under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) or the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) with respect to a covered facility is accompanied by an environmental justice assessment that—</text><clause id="HC3143293D2E14039B2B06C40E37BC742"><enum>(i)</enum><text>assesses the direct, indirect, and cumulative economic, environmental, and public health impacts of the proposed permit on fenceline communities, considering conditions in existence on the date of the assessment and the foreseeable impacts of climate change, including physical climate risks; and</text></clause><clause id="H26D51249A753424BB7401790D55F8D5B"><enum>(ii)</enum><text>proposes changes or alterations to the proposed permit that would, to the maximum extent practicable, eliminate or mitigate the impacts described in clause (i);</text></clause></subparagraph><subparagraph id="HA055457F4E3B4342BFF6BF67D0096CCF"><enum>(B)</enum><text>each proposed permit and environmental justice assessment described in subparagraph (A) is delivered to applicable fenceline communities at the beginning of the public comment period for the proposed permit for purposes of notification and consultation, which shall include—</text><clause id="HFAEA6D5F8EF344F8A2C40646F3950114"><enum>(i)</enum><text>prompt notification—</text><subclause id="H6CA6AF6C78C94004B36995D9FBCBB03F"><enum>(I)</enum><text>through direct means, including in non-English languages for limited English proficiency individuals;</text></subclause><subclause id="H48D87349E6BB49A4B001FD48BFBECFF8"><enum>(II)</enum><text>through publications likely to be obtained by residents of the fenceline community, including non-English language publications; and</text></subclause><subclause id="H0C3DBB4B80C444879FCB3212EAE70C58"><enum>(III)</enum><text>in the form of a public hearing in the fenceline community—</text><item id="H37E4164D1EB347B68321CFA7B4D67482"><enum>(aa)</enum><text>for which public notice is provided—</text><subitem id="H1E0B6B6B4691446194BA92F413B6C63D"><enum>(AA)</enum><text>not later than 60 days before the date on which the public hearing is to be held; and</text></subitem><subitem id="HD664BF3748AB4E37A8FFB010F31B9BFF"><enum>(BB)</enum><text>using the means described in subclauses (I) and (II);</text></subitem></item><item id="HA6D67BEDDA494EB090A917B0B65F7750"><enum>(bb)</enum><text>for which translation services are provided; and</text></item><item id="H0DBB12EE95754D929365249CC10DB9E3"><enum>(cc)</enum><text>that is accessible through live-streaming or alternative video streaming services for which translation services are provided; and</text></item></subclause></clause><clause id="H0FC5BA03AE0C41BEAAF9884A8CA22549"><enum>(ii)</enum><text>after the prompt notification required under clause (i), consultation that—</text><subclause id="H4D63AB0E93EE4982B9BE9ED72BA72630"><enum>(I)</enum><text>facilitates effective collaboration and informed policymaking that further recognizes the importance of regular communication and collaboration with fenceline communities, regardless of whether specific regulatory or policy changes are being considered;</text></subclause><subclause id="HEBA9D287E2204E7BB88118B9410E2080"><enum>(II)</enum><text>seeks information and input from fenceline communities by soliciting the collaboration, cooperation, and participation of those fenceline communities;</text></subclause><subclause id="HF84E8CD237A44EC09DB2618A4BB06EDA"><enum>(III)</enum><text>includes an in-person meeting or a telephone conference that—</text><item id="H8D4E3F9F86224B9F8CE0C1643172BEA2"><enum>(aa)</enum><text>is in a location, if applicable, that is selected by those engaged in the consultation to be mutually accessible to representatives of fenceline communities and applicable Federal or State Government participants; and</text></item><item id="H0C4287B358B545FE8EA508260A59B869"><enum>(bb)</enum><text>removes institutional and procedural impediments that adversely affect working directly with fenceline communities;</text></item></subclause><subclause id="HCD3BDE64FD984733B56E3EEFD4A6108C"><enum>(IV)</enum><text>ensures that any health or environmental concerns raised by fenceline communities will be properly investigated and considered in decisions to grant or deny the proposed permit; and</text></subclause><subclause id="HCB3FF89356974EBFBD63E9000E6AED1A"><enum>(V)</enum><text>explains to the representatives of the fenceline community the range of resulting actions that the Administrator or State agency may take;</text></subclause></clause></subparagraph><subparagraph id="H441234B1F4644E3591A5179A1A796F1B"><enum>(C)</enum><text>the Administrator or a State agency to which authority is delegated under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) or the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>), as applicable, shall not approve a proposed permit described in subparagraph (A) unless—</text><clause id="H2D299066A7F04FC585F52333A6EAF95D"><enum>(i)</enum><text>changes or alterations have been incorporated into the revised proposed permit that, to the maximum extent practicable, eliminate or mitigate the impacts described in subparagraph (A)(i);</text></clause><clause id="HD1A5CCB00C384783AB01826D8B8E3D3C"><enum>(ii)</enum><text>the changes or alterations described in clause (i) have been developed with meaningful input from residents or representatives of the fenceline community in which the covered facility to which the proposed permit would apply is located or seeks to locate; and</text></clause><clause id="H51F96FB7082E4BF8A632E907A6EF4563"><enum>(iii)</enum><text>the permit includes a community benefit agreement that—</text><subclause id="H8CE3E73AE5E748BD87DDB192368D2727"><enum>(I)</enum><text>has been entered into after the prompt notification and consultation required under clauses (i) and (ii), respectively, of subparagraph (B); and</text></subclause><subclause id="H97984BBE80524AC6A9DD6597821D8182"><enum>(II)</enum><text>stipulates the benefits the covered facility agrees to fund or furnish in exchange for community support for the covered facility, which may include—</text><item id="H3F79B2BB18164A2582578EBE2B7A822C"><enum>(aa)</enum><text>commitments to hire directly from a community;</text></item><item id="H16C75324B13A413D81D5FBA1738E1A8A"><enum>(bb)</enum><text>contributions to economic and health trust funds;</text></item><item id="HB814A519DEF240D8888FC95C6B6D4BFD"><enum>(cc)</enum><text>local workforce training guarantees;</text></item><item id="H5434712A3B29451FB494131230FFA06C"><enum>(dd)</enum><text>increased pollution control technologies;</text></item><item id="H4CB32C6A32A54473B8E462A6F59F222F"><enum>(ee)</enum><text>operation restrictions;</text></item><item id="H87F9665B850048AD95DFAF81B2C06C64"><enum>(ff)</enum><text>financial assurances; and</text></item><item id="HBABB76DCB2C24D2FB14C4F855A106E3D"><enum>(gg)</enum><text>siting restrictions;</text></item></subclause></clause></subparagraph><subparagraph id="H8A30F2783A764764A29EA19E55692A4F"><enum>(D)</enum><text>the Administrator or a State agency to which authority is delegated under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) or the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>), as applicable, shall not approve a proposed permit described in subparagraph (A) during the 45-day period beginning on the date on which a public hearing described in subparagraph (B)(i)(III) is held for the proposed permit;</text></subparagraph><subparagraph id="H1506FC6AE8064EDBAD5EBEBCCE754E09"><enum>(E)</enum><text>the approval of a proposed permit described in subparagraph (A) is conditioned on the covered facility providing—</text><clause id="H4D31BDDB5EB545A79DF53F5F8125FF98"><enum>(i)</enum><text>response strategies that fully protect public health and safety and the environment in fenceline communities, for which the affected fenceline communities have the opportunity to provide meaningful input; and</text></clause><clause id="H21B5F715473E45FD9966716D0D1CA053"><enum>(ii)</enum><text>subject to subparagraph (F)—</text><subclause id="HB78C353EBDA141D99A365D235F5F59EF"><enum>(I)</enum><text>comprehensive, continuous, real-time monitoring of ambient air quality—</text><item id="H6C8FCFAE3C65439090B7AFA12DDB55E4"><enum>(aa)</enum><text>around the perimeter of the covered facility; and</text></item><item id="HB986885F863C4EB395424400005AC4C7"><enum>(bb)</enum><text>in any areas that can reasonably be impacted by the covered facility;</text></item></subclause><subclause id="HF1652797E08B4C739C738423603D3524"><enum>(II)</enum><text>water quality testing of wastewater discharges from the covered facility; and</text></subclause></clause></subparagraph><subparagraph id="HCF6C7B968B0D4235AE901D962499C9B8"><enum>(F)</enum><text>regardless of whether a permit has been sought or issued with respect to the chemical, each covered facility shall conduct appropriate air and water quality monitoring and testing relating to each chemical produced at the covered facility in a quantity of more than 100 pounds per year, and each chemical produced at the covered facility that is emitted in excess of the applicable level permitted under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) or the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>), as applicable, to ensure that any discharge of such a chemical into the air or water shall be—</text><clause id="H3390EF8CD9224E049DB7ED46F8DBD33D"><enum>(i)</enum><text>reported to the Administrator by not later than 48 hours after receipt of the test result; and</text></clause><clause id="HE767CF3052C64DB7A43F458C5D776FBB"><enum>(ii)</enum><text>if a release of information to the public is not limited due to confidentiality concerns, made publicly available in accordance with subclauses (I) and (II) of subparagraph (B)(i).</text></clause></subparagraph></paragraph><paragraph id="H6E3A7090AAF84E7289BF459168C161ED"><enum>(2)</enum><header>Requirements</header><subparagraph id="H3501C590FF384EEEA688093B2AAAC020"><enum>(A)</enum><header>Input</header><text>The Administrator shall develop the final rule under paragraph (1) with meaningful input from—</text><clause id="H51E9EAA17D4A441894E5260A8AA64217"><enum>(i)</enum><text>residents of fenceline communities; and</text></clause><clause id="H7FFD1E9C9D874ABE838BE75676215E48"><enum>(ii)</enum><text>representatives of fenceline communities.</text></clause></subparagraph><subparagraph id="H0B0B514A4565469EAB900E79C321FCBA"><enum>(B)</enum><header>Community consultation</header><text>In carrying out consultation under paragraph (1)(B)(ii), the Administrator and each State agency to which authority is delegated under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) or the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) shall establish a dedicated position that—</text><clause id="HD3949B3133164C98BF10DE17FF3B1AC9"><enum>(i)</enum><text>supports fenceline communities in understanding the technical nuances of the permit and regulatory process; and</text></clause><clause id="H7B2C6493DAF74DAD8AC72A36C62A88FD"><enum>(ii)</enum><text>accounts for limited English proficiency individuals.</text></clause></subparagraph></paragraph><paragraph id="H641B1AE3E6A7436EBEF7B1CA3658CA40"><enum>(3)</enum><header>Report to congress on state permitting programs</header><text>Not later than 2 years after the date on which the final rule required under paragraph (1) is published in the Federal Register, and not less frequently than once every 5 years thereafter, the Administrator shall submit to Congress a report evaluating the implementation by States of required environmental justice considerations pursuant to that final rule in State permitting programs under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) and the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>). </text></paragraph></subsection><subsection id="HEF97DB809E7949E3BA8D820EA933F797"><enum>(f)</enum><header>Toxic substances</header><paragraph id="H0F1DC9B8F13F43A793B895F8A6C65E0D"><enum>(1)</enum><header>Inventory and reporting</header><text>Section 8(b) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2607">15 U.S.C. 2607(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5B20CF86664045779558626EEFD04F21"><paragraph id="HB2CA8B10FF9845A68A8F73D911F5D997"><enum>(11)</enum><header>Plastics</header><subparagraph id="H30B2B96BFF5D45738813693A7820A0CF"><enum>(A)</enum><header>Definitions of covered facility; covered product; plastic; single-use plastic</header><text>In this paragraph, the terms <term>covered facility</term>, <term>covered product</term>, <term>plastic</term>, and <term>single-use plastic</term> have the meanings given those terms in section 3 of the <short-title>Protecting Communities from Plastics Act of 2024</short-title>.</text></subparagraph><subparagraph id="H31FB2D41D5F54AC4876B0C91D84F9A45"><enum>(B)</enum><header>Inventory</header><text>Not later than April 1, 2027, and every 3 years thereafter, the Administrator shall prepare, and publish in the Federal Register, an inventory of plastic manufacturing, distribution in commerce, and trade in the United States.</text></subparagraph><subparagraph id="H0715CFAE863443E682F83BC9A76FD1A9"><enum>(C)</enum><header>Process</header><text>In preparing the inventory under subparagraph (B), the Administrator shall—</text><clause id="HC5D32562F6C244A8B4E3BFAE9981E5A9"><enum>(i)</enum><text>identify—</text><subclause id="HD2065245791D42ACB7CF4B63F664E784"><enum>(I)</enum><text>each covered facility; and</text></subclause><subclause id="H029DF5CAE8464CBA89B09A453D8BA55B"><enum>(II)</enum><text>any other manufacturer of plastic products;</text></subclause></clause><clause id="H3894B4D92EFA4D088E8C8797495FFD64"><enum>(ii)</enum><text>identify—</text><subclause id="H948C00BC42DC45D89B0BD915AA896B5B"><enum>(I)</enum><text>the monomers and polymers associated with plastic production;</text></subclause><subclause id="H4811840512F7438B8EC8F33D80C85790"><enum>(II)</enum><text>the types or uses of plastic products manufactured; and</text></subclause><subclause id="HE81407D75BB042E4A4724E0961F143D9"><enum>(III)</enum><text>the associated quantities of polymer and product manufacture and uses;</text></subclause></clause><clause id="HE34BE4E6269B4DF09A1A2714352BF2A6"><enum>(iii)</enum><text>quantify the single-use plastics manufactured—</text><subclause id="H9221533AC29849B999AF00B5B616F372"><enum>(I)</enum><text>in the aggregate; and</text></subclause><subclause id="HA3F57DC103A74E05B3A96CBFDAFDC9FA"><enum>(II)</enum><text>by use category;</text></subclause></clause><clause id="HFAABA6FF50114270874D4F2476EED2A0"><enum>(iv)</enum><text>quantify the percentage of post-consumer recycled material content of feedstocks for manufacture of the types of plastic products identified under clause (ii)(II);</text></clause><clause id="H97DA3274C969431ABE1F9B2589024E68"><enum>(v)</enum><text>provide information and quantified estimates regarding the fate of the plastic products at the end of useful life;</text></clause><clause id="H1DBB71F3C4C14D29832A3DCD585B837A"><enum>(vi)</enum><text>identify the chemicals used in polymer or plastic production that may pose a potential risk to human health and the environment, taking into account the data reported under subparagraph (D)(i), which shall include, at a minimum, the information described in subparagraphs (A) through (G) of subsection (a)(2);</text></clause><clause id="HBAEFA850A3DE4A64AAB9804D02A1A8C0"><enum>(vii)</enum><text>specify any chemicals identified under clause (vi)—</text><subclause id="H6DF8562F3459404D8AB748BA1B477612"><enum>(I)</enum><text>that are undergoing regulatory action under section 6; or</text></subclause><subclause id="H1C54A2EE80A841C7953B20321104F3B3"><enum>(II)</enum><text>for which regulatory action under section 6 is anticipated during the following 3 years;</text></subclause></clause><clause id="H8C0B30B5CD974D21BD15562D7221F550"><enum>(viii)</enum><text>for each chemical identified under clause (vi) that is not specified under clause (vii), provide a timetable for regulatory action under section 6 and any other recommended actions, including proposed revisions of Federal law or regulations, to achieve further reductions in plastic manufacture or distribution in commerce; and</text></clause><clause id="H60FDB2BABA274BCDB22DF5BAAD721EB1"><enum>(ix)</enum><text>propose revisions to Federal law or regulations to achieve further reductions in plastic manufacture or distribution in commerce.</text></clause></subparagraph><subparagraph id="HFDAEAFE066F94270BB33145B8279B334"><enum>(D)</enum><header>Reporting</header><clause id="H8E4AFBE52015456DB56A0A4C81333D77"><enum>(i)</enum><header>In general</header><text>To assist in the preparation of the inventory under subparagraph (B), notwithstanding section 3(2)(B), each person that manufactures a covered product used in plastic production, and each person that manufactures a plastic product, shall submit to the Administrator periodic reports at such time and including such information as the Administrator shall determine, by rule.</text></clause><clause id="H76E0140AE7E7425F9C63B6F8B007A71A"><enum>(ii)</enum><header>Promulgation of rule</header><text>Not later than July 1, 2026, the Administrator shall promulgate the rule described in clause (i).</text></clause><clause id="H3F52601462244AE99C171E79351E1B5D"><enum>(iii)</enum><header>Previously submitted information</header><text>To avoid duplication, information previously submitted to the Administrator under this section may be considered to be partially compliant with the reporting requirements of this subparagraph if the information previously submitted is an accurate reflection of the current information.</text></clause><clause id="H471FAE7E71F74D8395B51595FCBEC1E3"><enum>(iv)</enum><header>Public availability</header><text>The Administrator shall make available to the public, in an accessible database, the reports submitted under clause (i), in accordance with section 14.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H4A1F05A419B642D3860F0D6EEF7791AD"><enum>(2)</enum><header>Cumulative health risks posed by covered facilities</header><subparagraph id="HA418863540EA4660A466CDBD92FB5991"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="HE8B4CD3D10DD477CB9A0B4B69DC2DEB4"><enum>(i)</enum><header>Chemical substance; mixture</header><text>The terms <term>chemical substance</term> and <term>mixture</term> have the meanings given those terms in section 3 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2602">15 U.S.C. 2602</external-xref>).</text></clause><clause id="H5485B540B21E4AECB541B88EDA0495DC"><enum>(ii)</enum><header>Covered facility</header><text>The term <term>covered facility</term> means a covered facility identified in the inventory.</text></clause><clause id="HAF416247E2354FA8BDE8100F2641406C"><enum>(iii)</enum><header>Inventory</header><text>The term <term>inventory</term> means the inventory published under paragraph (11) of section 8(b) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2607">15 U.S.C. 2607(b)</external-xref>).</text></clause></subparagraph><subparagraph id="H1D6A329B9F75440384953B5CE2195062"><enum>(B)</enum><header>Assessment</header><text>Not later than April 1, 2029, taking into account the inventory, the Administrator shall conduct a single assessment of the aggregate, cumulative public health impacts on fenceline communities at covered facilities.</text></subparagraph><subparagraph id="H7C4C16D5843D4622AF3E872B9EB86054"><enum>(C)</enum><header>Requirements</header><text>The assessment under subparagraph (B) shall—</text><clause id="H8AD7FB1A08064A488E6B5EE64C18AB96"><enum>(i)</enum><text>ascertain the potentially exposed or susceptible subpopulations;</text></clause><clause id="H26CC40AD89F5447C8FE1CE272C6AD7FD"><enum>(ii)</enum><text>estimate the magnitude of the potential health impacts on—</text><subclause id="HBF252F1BF45542D28FC6658A8672F42B"><enum>(I)</enum><text>fenceline communities generally; and</text></subclause><subclause id="H45129D1412BE44699DF03BC15F0525ED"><enum>(II)</enum><text>more exposed or susceptible subpopulations specifically;</text></subclause></clause><clause id="HFC87AF31AE364168B22C3996BA69D931"><enum>(iii)</enum><text>determine which chemical substances or mixtures may be causing or contributing to potential adverse public health impacts;</text></clause><clause id="H25FA860AA5904538BFEBCAAAF9E33585"><enum>(iv)</enum><text>include an assessment of—</text><subclause id="H382CA54BEAF74AFFA1C3C078E96EE517"><enum>(I)</enum><text>the cumulative exposures associated with covered facilities from all chemicals used to make plastic polymers, considering conditions in existence on the date of the assessment and the foreseeable impacts of climate change, including physical climate risks;</text></subclause><subclause id="H67D485F2D5EB4218ADA97DBF0951E600"><enum>(II)</enum><text>the chemical substances (including plastic polymers, additives, and byproducts) produced from—</text><item id="H496607EBCE6B4BC9B5EB31C47ED60F4C"><enum>(aa)</enum><text>the use of the plastic polymers as feedstocks for other chemicals; and</text></item><item id="H4F70FFF419ED4E1E8359EDA0891D1ABD"><enum>(bb)</enum><text>waste-to-fuel technology; and</text></item></subclause><subclause id="HB7840CE8134A4FF7A69EEA380D9911F5"><enum>(III)</enum><text>the impact of chemical substances (including plastic polymers, additives, and byproducts) on—</text><item id="H6A06114CF04248C7A78508234E1A239E"><enum>(aa)</enum><text>the recyclability of plastics;</text></item><item id="H86AFA3053EB043D5B5144C93DA41176B"><enum>(bb)</enum><text>the use of recycled content in food contact products and packaging; and</text></item><item id="H913FE47624294487A2609367190750CB"><enum>(cc)</enum><text>public health; and</text></item></subclause></clause><clause id="HA42330032A0E4EDA8924A979DD0A65FB"><enum>(v)</enum><text>focus on—</text><subclause id="HD6FF5513FBCB4D228BD8C24D22628627"><enum>(I)</enum><text>communities located near covered facilities;</text></subclause><subclause id="H7FB332453E6B4388BE7E657B99624337"><enum>(II)</enum><text>workers at covered facilities;</text></subclause><subclause id="H09251E9C9BA54C7C8041CFD57F5924BB"><enum>(III)</enum><text>other potentially exposed or susceptible subpopulations; and</text></subclause><subclause id="H00E0A521D08D4C9F815D16A6BE6CE7A6"><enum>(IV)</enum><text>impacts in other countries resulting from—</text><item id="H9A069FF030134912B1BFDEDA18ABA691"><enum>(aa)</enum><text>volatile organic compounds, metals, and other toxic additives and air emissions of foreign recycling facilities;</text></item><item id="H0422EFF690F94BF6928707E7A5A1EB7E"><enum>(bb)</enum><text>the export from the United States of plastic products, intermediary products (such as pellets), and plastic waste from covered facilities;</text></item><item id="HCC81BA915B534DABA3CF529C905C9F01"><enum>(cc)</enum><text>disposal and management of unrecycled fractions from the exports described in item (bb);</text></item><item id="H0B6A536C1BA847058CFB643F2851587F"><enum>(dd)</enum><text>water and land pollution resulting from importation of those exports; and</text></item><item id="HBD5483F2713D42B9962BF6453F007EEB"><enum>(ee)</enum><text>the legality of those imports, including under the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal, done at Basel, Switzerland, March 22, 1989.</text></item></subclause></clause></subparagraph><subparagraph id="H1526440C8B064EE4ACFAA9DF1DB80DA1"><enum>(D)</enum><header>Procedural requirements</header><text>The assessment under subparagraph (B) shall be subject to—</text><clause id="H71FC3EABB16545729BEFC66AD74BB739"><enum>(i)</enum><text>public notice and an opportunity for public comment; and</text></clause><clause id="HCA856A1339104BFC9688A81621C5FFC8"><enum>(ii)</enum><text>peer review by the Science Advisory Committee on Chemicals established under section 26(o) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2625">15 U.S.C. 2625(o)</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="H6C0FE7E8E876436E81F5825B48E5DA51"><enum>(3)</enum><header>High-priority substances</header><subparagraph id="HA33A24A90CA84701B599A51F9C11232A"><enum>(A)</enum><header>Styrene and vinyl chloride</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator, after public notice and an opportunity for comment, shall make a final prioritization determination under section 6(b)(1) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(b)(1)</external-xref>) relating to—</text><clause id="HFBC3B893C814430DACF09EB35521EC30"><enum>(i)</enum><text>styrene (including polystyrene); and</text></clause><clause id="H0FFE61223EFD4DAEADFBA8746F000DA7"><enum>(ii)</enum><text>vinyl chloride (including polyvinyl chloride).</text></clause></subparagraph><subparagraph id="HC0097DC054394B3B8FFA130894EDF31F"><enum>(B)</enum><header>Other chemicals or mixtures</header><text>With respect to any chemical substances or mixtures (as those terms are defined in section 3 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2602">15 U.S.C. 2602</external-xref>)) not described in subparagraph (A) and identified in the assessment under paragraph (2) as causing or contributing to potential adverse public health impacts, the Administrator shall—</text><clause id="H6CE360B832E84A94943621DE2EA7B101"><enum>(i)</enum><text>include those chemical substances or mixtures in any subsequently published inventory; and</text></clause><clause id="H31F4F9EA23E94F148B81E46216D75448"><enum>(ii)</enum><text>specify applicable timetables for action as part of the inventory in accordance with clause (vii) or (viii) of paragraph (11) of section 8(b) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2607">15 U.S.C. 2607(b)</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="HCFDB2925F6CA4D02900DFD4A327F78E8"><enum>(4)</enum><header>Authorization of appropriations</header><subparagraph id="H10D86F4497FE483DA62B7A11A9A1016E"><enum>(A)</enum><header>In general</header><text>There are authorized to be appropriated to the Administrator such sums as are necessary to carry out this subsection and the amendments made by this subsection.</text></subparagraph><subparagraph id="HB98F836F83A84F61A2F95AD234956546"><enum>(B)</enum><header>Maintenance of funding</header><text>The funding provided under this paragraph shall supplement, not supplant, other Federal funding to carry out the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601 et seq.</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="H53677D925B0D4A9E9283075BFA7C8AA3"><enum>(g)</enum><header>Hazardous waste</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall initiate a rulemaking to list discarded polyvinyl chloride as a hazardous waste under the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>). </text></subsection><subsection id="H88D87D2E60D64C99B9103B0670A5F1BE"><enum>(h)</enum><header>Cumulative impact requirements for covered facilities</header><paragraph id="H74D943C799A543309B2AC706112EC9D1"><enum>(1)</enum><header>Federal Water Pollution Control Act</header><text>Section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended—</text><subparagraph id="H6FF3BABEE9054222A3B2CFC38599E47E"><enum>(A)</enum><text>by striking the section designation and heading and all that follows through <quote>Except as</quote> in subsection (a)(1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD03255AA44A6431DAC6D077597F18432"><section id="H4DD9CFC548614FCD9AF7CC494F9F9FAC"><enum>402.</enum><header>National pollutant discharge elimination system</header><subsection id="H0A1496F8412749B8B6A390FD1B0BF4D7"><enum>(a)</enum><header>Permits issued by Administrator</header><paragraph id="H6E58A9A7255744C688C722CE8F89DF1D"><enum>(1)</enum><header>In general</header><text>Except as</text></paragraph></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H62C59EA8A752498C9E40751B82DAAB8D"><enum>(B)</enum><text>in subsection (a)—</text><clause id="H8077FAA8093E4F1B94A8A38AFAFEF910"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="HEC427C6056B5433B8B17E831A8969699"><enum>(I)</enum><text>by striking <quote>upon condition that such discharge will meet either (A) all</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="HEF18087BF2D84FB7BA5C826D81BFAD16"><text>subject to the conditions that—</text><subparagraph id="H6B7E3C1F175B40329DB24AD6F2B25DE6"><enum>(A)</enum><text>the discharge will achieve compliance with—</text><clause id="H693C00E95C2E4D0B8A05A92EBDE7203A"><enum>(i)</enum><text>all</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause><subclause id="HC781183445D04D9184FCD361E80F6840"><enum>(II)</enum><text>by striking <quote>403 of this Act, or (B) prior</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="H91CC16588FF7435B9AE2108AF0D65F25"><text>403; or</text><clause id="H4010879BFFF944238479E4F5D7C8EF06"><enum>(ii)</enum><text>prior</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause id="H9082915334484E4A81D4A9E33B94BC41"><enum>(III)</enum><text>by striking <quote>this Act.</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="HB03E25B160794BE6BC564FB7DE3E8E2F"><text>this Act; and</text><subparagraph id="H323F17DD30274D0592EC7275A32171D8"><enum>(B)</enum><text>as applicable, with respect to the issuance or renewal of the permit to a covered facility (as defined in section 3 of the <short-title>Protecting Communities from Plastics Act of 2024</short-title>)—</text><clause id="H285FCFE469F140D0998FE9EBB3019C28"><enum>(i)</enum><text>based on an analysis by the Administrator of existing water quality and the potential cumulative impacts (as defined in section 501 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7661">42 U.S.C. 7661</external-xref>)) of the discharge from the covered facility (as so defined), considered in conjunction with the designated and actual uses of the impacted navigable water, there exists a reasonable certainty of no harm to the health of the general population, or to any potentially exposed or susceptible subpopulation; or</text></clause><clause id="H70EDD713C61E495EA8EE967413685600"><enum>(ii)</enum><text>if the Administrator determines that, due to those potential cumulative impacts, there does not exist a reasonable certainty of no harm to the health of the general population, or to any potentially exposed or susceptible subpopulation, the permit or renewal includes such terms and conditions as the Administrator determines to be necessary to ensure a reasonable certainty of no harm.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause id="H50743A210E954D49B2882A7035014202"><enum>(ii)</enum><text>in paragraph (2), by striking <quote>assure compliance with the requirements of paragraph (1) of this subsection, including conditions on data and information collection, reporting, and such other requirements as he deems appropriate.</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="yes-display-inline" id="HDDE46E3F4D644DC984BAAE95CA33D720"><text>ensure compliance with the requirements of paragraph (1), including—</text><subparagraph id="H5E9C63754886459197CF960985ADA948"><enum>(A)</enum><text>conditions relating to—</text><clause id="HF213889E6E7C49B09EFCFEC453D38189"><enum>(i)</enum><text>data and information collection;</text></clause><clause id="H75D73D06FAAE4A0BBD9D882E2BB2ADC7"><enum>(ii)</enum><text>reporting; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HF7AA6F41C6574420A12DBE5728F82F95"><enum>(C)</enum><text>in subsection (b)—</text><clause id="HC237D54E7BAA4002848ACFAA0FE23743"><enum>(i)</enum><text>in each of paragraphs (1)(D), (2)(B), and (3) through (7), by striking the semicolon at the end and inserting a period;</text></clause><clause id="H13AB5121707B4E2988ACAB12C306D7AE"><enum>(ii)</enum><text>in paragraph (8), by striking <quote>; and</quote> at the end and inserting a period; and</text></clause><clause id="HA24B65E6A5ED4F26B9AF376CC5BB006C"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5349CF95E78D4173BC9C6FE2FB9C7D22"><paragraph id="H7D2A31A9D56648A4A5995F9B55D26558"><enum>(10)</enum><text>To ensure that no permit will be issued to or renewed for a covered facility (as defined in section 3 of the <short-title>Protecting Communities from Plastics Act of 2024</short-title>) if, with respect to an application for the permit, the State determines, based on an analysis by the State of existing water quality and the potential cumulative impacts (as defined in section 501 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7661">42 U.S.C. 7661</external-xref>)) of the discharge from the covered facility (as so defined), considered in conjunction with the designated and actual uses of the impacted navigable water, that the terms and conditions of the permit or renewal would not be sufficient to ensure a reasonable certainty of no harm to the health of the general population, or to any potentially exposed or susceptible subpopulation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="HA479FE6E740C49188BF00B792DFBCCE9"><enum>(2)</enum><header>Clean Air Act</header><subparagraph id="H0833AF57E6384F038B540FE5B288FDF9"><enum>(A)</enum><header>Definitions</header><text>Section 501 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7661">42 U.S.C. 7661</external-xref>) is amended—</text><clause id="HC931DE784BAC443F93FEB95E0C022968"><enum>(i)</enum><text>in the matter preceding paragraph (1), by striking <quote>As used in this title—</quote> and inserting <quote>In this title:</quote>;</text></clause><clause id="H4B526CF69A9C4418B22235BCF34814CD"><enum>(ii)</enum><text>by redesignating paragraphs (2), (3), and (4) as paragraphs (3), (5), and (4), respectively, and moving the paragraphs so as to appear in numerical order; or</text></subclause><subclause id="H977DF448082649799A281396323EB51E"><enum>(III)</enum><text>otherwise; and</text></subclause></clause><clause id="HD2E1246212774459959E4891F9B14075"><enum>(ii)</enum><text>as assessed based on the combined past, present, and reasonably foreseeable emissions and discharges affecting the geographical area, considering conditions in existence on the date of the assessment and the foreseeable impacts of climate change, including physical climate risks (as defined in section 3 of the <short-title>Protecting Communities from Plastics Act of 2024</short-title>); and </text></clause></subparagraph><subparagraph id="H1CCAA8172BE74BDAA7EFC5F70CF13972"><enum>(B)</enum><text>evaluated taking into account sensitive populations and socioeconomic factors, where applicable.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H6860B9D22FCE4A24A3938C0344DF367C"><enum>(B)</enum><header>Permit programs</header><text>Section 502(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7661a">42 U.S.C. 7661a(b)</external-xref>) is amended—</text><clause id="HD0D7D9D085434FF2B8D5A2D912E25C66"><enum>(i)</enum><text>in paragraph (5)—</text><subclause id="HF41331F2CE724D5F901408BE0052AC71"><enum>(I)</enum><text>in subparagraphs (A) and (C), by striking <quote>assure</quote> each place it appears and inserting <quote>ensure</quote>; and</text></subclause><subclause id="HF78F4504DBB145649BFCD125FAF530F9"><enum>(II)</enum><text>by striking subparagraph (F) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD8874FAC043744FF977C760BF3CBA854"><subparagraph id="H7EC7E8693C684D6BB6E159DE3FF5929F"><enum>(F)</enum><text>ensure that no permit will be issued to or renewed for a covered facility (as defined in section 3 of the <short-title>Protecting Communities from Plastics Act of 2024</short-title>), as applicable, if—</text><clause id="H025DC46C431C473FA5F88CB38BFBF07F"><enum>(i)</enum><text>with respect to an application for a permit or renewal of a permit for a major source that is a covered facility (as so defined), the permitting authority determines under paragraph (9)(C)(ii)(I)(bb)(BB) that the terms and conditions of the permit or renewal would not be sufficient to ensure a reasonable certainty of no harm to the health of the general population, or to any potentially exposed or susceptible subpopulation, of the applicable census tracts or Tribal census tracts (as those terms are defined by the Director of the Bureau of the Census); or</text></clause><clause id="HE831967198AC44CB9B4614C9777EC0DC"><enum>(ii)</enum><text>the Administrator objects to the issuance of the permit in a timely manner under this title.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause><subclause id="H3C49FC5BFCC4464BB08DEA8D4EFA4810"><enum>(V)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H54A0BE2F9D8D453EBB4C48AF2D90F869"><subparagraph id="H4898B94BEEE54BED97A2E2090CAD4F59"><enum>(C)</enum><header>Certain plastics facilities</header><clause id="HB165D3FE99A94CCBABECC0F68C0FBCA5"><enum>(i)</enum><header>Definition of covered facility</header><text>In this subparagraph, the term <term>covered facility</term> has the meaning given the term in section 3 of the <short-title>Protecting Communities from Plastics Act of 2024</short-title>.</text></clause><clause id="HCEAE1A9E41A84CA39B1D5EC803C8E1C8"><enum>(ii)</enum><header>Additional requirements</header><text>With respect to any permit or renewal of a permit, as applicable, for a major source that is a covered facility, the permitting authority, in determining whether to issue or renew the permit, shall—</text><subclause id="H746A3332C0854938A6D3FC0A76B1D4D3"><enum>(I)</enum><text>evaluate the potential cumulative impacts of the proposed covered facility, as described in the applicable cumulative impacts analysis submitted under section 503(b)(3);</text></subclause><subclause id="H3A40F87B162441B697DDAD7ADBCEE104"><enum>(II)</enum><text>if, due to those potential cumulative impacts, the permitting authority cannot determine that there exists a reasonable certainty of no harm to the health of the general population, or to any potentially exposed or susceptible subpopulation, of any census tracts or Tribal census tracts (as those terms are defined by the Director of the Bureau of the Census) located in, or immediately adjacent to, the area in which the covered facility is, or is proposed to be, located—</text><item id="H1646268D63874F958536613A7B175056"><enum>(aa)</enum><text>include in the permit or renewal such terms and conditions (including additional controls or pollution prevention requirements) as the permitting authority determines to be necessary to ensure a reasonable certainty of no harm; or</text></item><item id="H7510CFD166414A528C0DF7538A32AF57"><enum>(bb)</enum><text>if the permitting authority determines that terms and conditions described in item (aa) would not be sufficient to ensure a reasonable certainty of no harm, deny the issuance or renewal of the permit;</text></item></subclause><subclause id="H8969F964489240D1B166BC4FE34702B2"><enum>(III)</enum><text>determine whether the applicant is a persistent violator, based on such criteria relating to the history of compliance by an applicant with this Act as the Administrator shall establish by not later than 180 days after the date of enactment of the <short-title>Protecting Communities from Plastics Act of 2024</short-title>;</text></subclause><subclause id="HC6CA4947F25B41E7BA394BB1D2343146"><enum>(IV)</enum><text>if the permitting authority determines under subclause (III) that the applicant is a persistent violator and the permitting authority does not deny the issuance or renewal of the permit pursuant to subclause (V)(bb)—</text><item id="H80874B90DE4A4589A2F61BF81D1B7D72"><enum>(aa)</enum><text>require the applicant to submit a redemption plan that describes, if the applicant is not in compliance with this Act, measures the applicant will carry out to achieve that compliance, together with an approximate deadline for that achievement, measures the applicant will carry out, or has carried out to ensure the applicant will remain in compliance with this Act, and to mitigate the environmental and health effects of noncompliance, and the measures the applicant has carried out in preparing the redemption plan to consult or negotiate with the communities affected by each persistent violation addressed in the plan; and</text></item><item id="HB8DA3E7B569142B4AE8823CB3507E32F"><enum>(bb)</enum><text>once such a redemption plan is submitted, determine whether the plan is adequate to ensuring that the applicant will achieve compliance with this Act expeditiously, will remain in compliance with this Act, will mitigate the environmental and health effects of noncompliance, and has solicited and responded to community input regarding the redemption plan; and</text></item></subclause><subclause id="H7B781C66C5AC4F26BD891F88EA6FE154"><enum>(V)</enum><text>deny the issuance or renewal of the permit if the permitting authority determines that—</text><item id="HC1C127BD9AB14742B91D8314A55C9AD0"><enum>(aa)</enum><text>the redemption plan submitted under subclause (IV)(aa) is inadequate; or</text></item><item id="H87C1A45700D74518BD579BC08552C834"><enum>(bb)</enum><subitem commented="no" display-inline="yes-display-inline" id="HCDDC3354DF9C4AADBA0C66A547FBA57F"><enum>(AA)</enum><text>the applicant has submitted a redemption plan on a prior occasion, but continues to be a persistent violator; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="H23AA2F67E1564C9492EC9CBEFCC7A757" indent="up1"><enum>(BB)</enum><text display-inline="yes-display-inline">no indication of extremely exigent circumstances excusing the persistent violations exists.</text></subitem></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph id="HA4CA145AD3384F86995396E93623412D"><enum>(C)</enum><header>Permit applications</header><text>Section 503(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7661b">42 U.S.C. 7661b(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HD1A2BFCAE9F04435AB552AB699A9691F" display-inline="no-display-inline" style="OLC"><paragraph id="H9B810903EF6E49288C494DED39014200"><enum>(3)</enum><header>Analyses for certain plastics facilities</header><text>The regulations required by section 502(b) shall include a requirement that an applicant for a permit or renewal of a permit for a major source that is a covered facility (as defined in section 3 of the <short-title>Protecting Communities from Plastics Act of 2024</short-title>) shall submit, together with the compliance plan required under this subsection, a cumulative impacts analysis for each census block tract or Tribal census block tract (as those terms are defined by the Director of the Bureau of the Census) located within 10 kilometers of, or immediately adjacent to, the area in which the major source that is a covered source (as so defined) is, or is proposed to be, located that analyzes—</text><subparagraph id="H5CC1415C15894C72B2A42F84EA9D16BD"><enum>(A)</enum><text>community demographics and locations of community exposure points, such as residences, schools, day care centers, nursing homes, hospitals, health clinics, places of religious worship, parks, playgrounds, and community centers;</text></subparagraph><subparagraph id="H5538F55824234FABBC35539F667A457F"><enum>(B)</enum><text>air quality (including with respect to hazardous air pollutants and criteria pollutants) and the potential effect on that air quality of emissions of air pollutants (including pollutants listed under section 108 or 112) from the proposed covered facility (as so defined), including in combination with existing sources of pollutants;</text></subparagraph><subparagraph id="H2BD4A3B5D00D4D41923AF83F65BEDC6E"><enum>(C)</enum><text>the potential effects on soil quality, water quality, and fish and game of emissions of air and water pollutants that could contaminate soil or water from the proposed major source, including in combination with existing sources of pollutants; and</text></subparagraph><subparagraph id="HDDB8EB111C954D7595F7E90436B806BE" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>public health and any potential effects on public health of the proposed covered facility (as so defined).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H8FF660FE644D433B83C980F25A9434FF"><enum>(i)</enum><header>Financial assurance requirements for covered facilities</header><paragraph id="HC5420F5119B0423BA358B54DC82865DA"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall develop and require as a condition to receiving a permit under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) or the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) financial assurance requirements for new covered facilities that demonstrate the presence of sufficient financial resources—</text><subparagraph id="H4F7FA2A9E06347F986FD6DEE45796D0D"><enum>(A)</enum><text>to safely close the covered facility at the end of the operational life of the covered facility; or</text></subparagraph><subparagraph id="H087F3D30D6974AB2B6CB7AFE07C57C00"><enum>(B)</enum><text>to provide appropriate emergency response in the case of an accidental release.</text></subparagraph></paragraph><paragraph id="H8137495901F24496BE44EB2A4D42ED4B"><enum>(2)</enum><header>Application to existing covered facilities</header><text>The financial assurance requirements under paragraph (1) shall apply to existing covered facilities at the time at which an existing covered facility seeks renewal of a permit under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) or the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>), as applicable.</text></paragraph></subsection><subsection id="H1F3C7190C1BB405280178672FD3CB732"><enum>(j)</enum><header>Siting restrictions for new covered facilities</header><text>The issuance or approval of a permit under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) or the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) for a new covered facility, or for the expansion of an existing covered facility, shall be prohibited within 5 miles of a community building or area, including a school, a residence, a daycare center, a nursing home, a hospital, a health clinic, a place of religious worship, a park, a playground, and a community center.</text></subsection></section><section id="HAB9B3F347DDC491ABEDBF54F9383980C"><enum>5.</enum><header>Federal source reduction and reuse targets</header><subsection id="H65B6FF8834014CC0A22E6C5C07711CA6"><enum>(a)</enum><header>Definition of source reduction</header><paragraph id="HC03165160E5444B9B995C2E06EC16461"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>source reduction</term> means the reduction in the quantity of single-use plastic packaging and food service product created by producers relative to the baseline established pursuant to subsection (b)(1) by methods that may include—</text><subparagraph id="H0DA3AAA31C7247809A463D0E163C584A"><enum>(A)</enum><text>shifting to reusable or refillable packaging or food service product systems; or</text></subparagraph><subparagraph id="HC571FED5542B4129A2E547422FC5165C"><enum>(B)</enum><text>eliminating unnecessary packaging.</text></subparagraph></paragraph><paragraph id="H490D8BB2B84142B996E91D848741F38A"><enum>(2)</enum><header>Exclusions</header><text>In this section, the term <term>source reduction</term> does not include—</text><subparagraph id="H238A831F7CBF4BC1ACE97512C4E1CDBF"><enum>(A)</enum><text>replacing a recyclable or compostable single-use plastic packaging or food service product with—</text><clause id="HB815F659574A43BE8A0EBC262D3CCB1C"><enum>(i)</enum><text>a nonrecyclable or noncompostable single-use plastic packaging or food service product; or</text></clause><clause id="H8BC9AB9911E34264812B6B7117867D20"><enum>(ii)</enum><text>a single-use plastic packaging or food service product that is less likely to be recycled or composted; or</text></clause></subparagraph><subparagraph id="H3DEB086321014BD19CD818FCB70F8706"><enum>(B)</enum><text>switching from virgin single-use plastic packaging or food service product to plastic postconsumer recycled content.</text></subparagraph></paragraph></subsection><subsection id="HDE1EA924896143CFB5D9F5CB62A874D6"><enum>(b)</enum><header>Federal source reduction targets</header><paragraph id="HB096B7CC7DB743DD9DD9CA86E676E576"><enum>(1)</enum><header>Baseline</header><text>Not later than December 31, 2027, the Administrator shall promulgate regulations to establish a baseline quantity, by total weight and total number of items, of all single-use plastic packaging and food service product produced, sold, offered for sale, imported, or distributed in the United States during calendar year 2026.</text></paragraph><paragraph id="HD57241FE44B4408A9391B7401B9A0F04"><enum>(2)</enum><header>Reduction targets</header><subparagraph id="H60540C0D8CB54A5F9409895FA351C14A"><enum>(A)</enum><header>In general</header><text>Not later than December 31, 2029, the Administrator shall promulgate regulations to establish phased source reduction targets for all single-use plastic packaging and food service product produced, sold, offered for sale, imported, or distributed in the United States, which shall be organized by product category.</text></subparagraph><subparagraph id="H1B46973B807D4EB982409BCE779D6FA9"><enum>(B)</enum><header>Minimum</header><text>The phased source reduction targets established under subparagraph (A) shall include a source reduction target of not less than 25 percent by 2034.</text></subparagraph></paragraph></subsection><subsection id="HF13BE3626EE64857B06A16BC87D83541"><enum>(c)</enum><header>Federal reuse and refill targets</header><paragraph id="HDC926E00057E40F49D0D1775C41CB932"><enum>(1)</enum><header>In general</header><text>Not later than December 31, 2027, the Administrator shall promulgate regulations to establish phased reuse and refill targets for all plastic packaging and food service product produced, sold, offered for sale, imported, or distributed in the United States.</text></paragraph><paragraph id="H3E2BA6B5018E45A4A0C7A009A832D831"><enum>(2)</enum><header>Minimum</header><text>The phased reuse and refill targets established under paragraph (1) shall include reuse and refill targets of not less than 30 percent by 2034.</text></paragraph></subsection><subsection id="H3A29A376E82F45E49F6F8937E4933EFA"><enum>(d)</enum><header>Exclusion</header><text>Nothing in this section applies to any single-use plastic used for—</text><paragraph id="H0FEFE5ED27B44F7C80B3DD8A8B21D8EB"><enum>(1)</enum><text>medical equipment, supplements, medical devices, consumer personal protective equipment, or other products determined by the Secretary of Health and Human Services to necessarily be made of plastic for the protection of public health or for people with disabilities;</text></paragraph><paragraph id="H5CA822A826E243E89077BC49BE15C60D"><enum>(2)</enum><text>packaging that is—</text><subparagraph id="H2C4D34338584414D9471720457AA9F72"><enum>(A)</enum><text>for any product described in paragraph (1) that is determined by the Secretary of Health and Human Services to necessarily be made of plastic for the protection of public health or for people with disabilities; or</text></subparagraph><subparagraph id="HFE94366209584C52BEC54729C58ABB7C"><enum>(B)</enum><text>used for the shipment of hazardous materials that is prohibited from being composed of used materials under section 178.509 or 178.522 of title 49, Code of Federal Regulations (as in effect on the date of enactment of this Act); or</text></subparagraph></paragraph><paragraph id="HC676CE65AB6F454DB37BEC703DB9BA1A"><enum>(3)</enum><text>a personal hygiene product that, due to the intended use of the product, could become unsafe or unsanitary to recycle, such as a diaper.</text></paragraph></subsection></section><section id="HDD77F5F4B655495F87131B7C1D0C1341"><enum>6.</enum><header>Advancing refillable and reusable systems</header><subsection id="H68AC272025694046BEBA88FC5BF75BB8"><enum>(a)</enum><header>Grant program To support equity and innovation in refillable and reusable packaging</header><paragraph id="HEDCAF907B00E4ABE92C3555F034510A9"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator shall establish a competitive grant program (referred to in this subsection as the <quote>program</quote>) to provide grants to eligible entities described in paragraph (3) to carry out scalable reuse and refill projects in accordance with this subsection.</text></paragraph><paragraph id="H9696507EF61E49099CE991BB8A35ECC3"><enum>(2)</enum><header>Objectives</header><text>To be eligible for a grant under the program, a reuse and refill project shall evaluate the efficacy and cost-effectiveness of tools, technologies, and techniques for 1 or more of the following objectives:</text><subparagraph id="HCE899145836D432BB977BA9F018BCC97"><enum>(A)</enum><text>Expanding reuse and refill programs to replace single-use plastics currently used in consumer goods industries, including replacement with food service and consumer food and beverage products that—</text><clause id="H0DA9460EB7614343814912D08F4D9783"><enum>(i)</enum><text>are affordable, convenient, scalable, nontoxic, and equitable; and</text></clause><clause id="HA4924977E9634B8984CF673190C03E2D"><enum>(ii)</enum><text>satisfy the requirements described in section 3(20)(A).</text></clause></subparagraph><subparagraph id="HE2D44A1492814E01B920040F77202E83"><enum>(B)</enum><text>Expanding consumer knowledge of reuse and refill programs, including through the development of accessible educational and outreach programs and materials.</text></subparagraph><subparagraph id="H5E786310A0C84B49A053ABC012B8EBFA"><enum>(C)</enum><text>Installing and expanding access to publicly available water bottle refilling stations.</text></subparagraph><subparagraph id="HF4E25F1C47D54A7FBC541D70BD4B7858"><enum>(D)</enum><text>Installing and expanding access to sanitation infrastructure in public or community buildings to enable safe and hygienic reuse, including dishwashers and sanitation stations.</text></subparagraph></paragraph><paragraph id="H1593AD3445A043D4A5E9503918B13A22"><enum>(3)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under the program, an entity shall be—</text><subparagraph id="H32700A1339E84AC58D07D9C8E70CA6A3"><enum>(A)</enum><text>an educational institution, including an institution of higher education;</text></subparagraph><subparagraph id="H2BE73B95C1B74FF28A3977D378D25BFC"><enum>(B)</enum><text>a nonprofit or community-based organization;</text></subparagraph><subparagraph id="H76CCABCEB5AC4D74A67CC49850F68721"><enum>(C)</enum><text>a State, local, or Tribal government;</text></subparagraph><subparagraph id="H810947ACA8354A068A82CCD184FB605A"><enum>(D)</enum><text>a for-profit restaurant, business, or other organization; or</text></subparagraph><subparagraph id="HC761107D088E479CBD7448879866DA7E"><enum>(E)</enum><text>a public-private partnership.</text></subparagraph></paragraph><paragraph id="HF5DD3734F1E04D6B9ECFBDE7B5997FFE"><enum>(4)</enum><header>Nontoxic requirements</header><text>Materials used as part of a reuse and refill project under the program shall not contain—</text><subparagraph id="H205AED9518BA48E491AA9594182D16DC"><enum>(A)</enum><text>toxic heavy metals, pathogens, or additives, including—</text><clause id="H03F04EBBE1CA4CEEBE3FF1A4E524E285"><enum>(i)</enum><text>a perfluoroalkyl or polyfluoroalkyl substance;</text></clause><clause id="H585DC5B46EF648738F8DD487B934ABBB"><enum>(ii)</enum><text>an ortho-phthalate;</text></clause><clause id="H49B8888EF3E143C8B7A5C77F82CFBFCE"><enum>(iii)</enum><text>a bisphenol compound (not including an alkyl-substituted bisphenol compound generated through a xylenol-aldehyde process); or</text></clause><clause id="HA287E54465564F4B87E2414F6466918D"><enum>(iv)</enum><text>a halogenated flame retardant; or</text></clause></subparagraph><subparagraph id="HA446DF8353F6422A8BDCE98A420662A3"><enum>(B)</enum><text>chemical substances designated as high-priority substances under section 6(b)(1) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(b)(1)</external-xref>), including the chemicals or mixtures of chemicals described in section 4(f)(3).</text></subparagraph></paragraph><paragraph id="H4F58D6C9D4D84400BCFE8ADD9A51838C"><enum>(5)</enum><header>Priorities</header><text>In awarding grants under the program, the Administrator shall—</text><subparagraph id="H5943CB00D85C4FDE8628C8AF3ACE2B10"><enum>(A)</enum><text>give priority to projects that will directly benefit populations of color, communities of color, indigenous communities, rural communities, and low-income communities;</text></subparagraph><subparagraph id="HDB14FC1BD33649648DD3D4348A46CDC6"><enum>(B)</enum><text>give priority to a project that achieves more than 1 of the objectives described in paragraph (2); and</text></subparagraph><subparagraph id="H37DAE16F99984611BCF53771E04252FD"><enum>(C)</enum><text>ensure that a grant is provided to carry out a project in each region of the Environmental Protection Agency.</text></subparagraph></paragraph><paragraph id="H7A1694E0372443FBB500B8D1E9B9E181"><enum>(6)</enum><header>Prize competition</header><subparagraph id="H35259ED990FA42B2BA821CC19EE09E51"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the first round of grants is awarded under the program, the Administrator shall establish a prize competition under which the Administrator shall—</text><clause id="HBF149016E1E34D6CB130806C48A1B3D6"><enum>(i)</enum><text>evaluate the projects carried out by each recipient of a grant under the program; and</text></clause><clause id="H9E1D8CA0CCAE4C95A5E1263B3BD93D48"><enum>(ii)</enum><text>award a prize to 1 of those recipients.</text></clause></subparagraph><subparagraph id="HF8CEE3EA54FA4547BEAE7C829CCF646F"><enum>(B)</enum><header>Amount</header><text>The Administrator shall determine the amount of the prize under this paragraph.</text></subparagraph><subparagraph id="HFBE321FDA6D84A6592AFFF42D15D3480"><enum>(C)</enum><header>Use</header><text>The recipient of the prize under this paragraph shall use the amount of the prize to demonstrate that the reuse or refill project carried out by the recipient under the program—</text><clause id="HE07A5128247C4598B5842841C1B789B6"><enum>(i)</enum><text>is scalable;</text></clause><clause id="H2CD236A8987443B98834EE9197A76E7D"><enum>(ii)</enum><text>serves the community in which the program is carried out; and</text></clause><clause id="HD56E30CC1984460FBBC67202EDA1B9E2"><enum>(iii)</enum><text>is implemented in a sustainable and equitable manner.</text></clause></subparagraph></paragraph><paragraph id="HF4CCD019DF3D4F71A51CBFAD25E9F8C9"><enum>(7)</enum><header>Report</header><text>Not later than 3 years after the date on which the Administrator establishes the program, the Administrator shall submit to Congress a report describing the effectiveness of the projects carried out under the program.</text></paragraph><paragraph id="H85BE89B10EB94206AA00EA22B4DF8B97"><enum>(8)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out the program.</text></paragraph></subsection><subsection id="HB6CEA989DB08480BB1BFC4B389E3E81F"><enum>(b)</enum><header>Report on reuse and refill product delivery systems</header><paragraph id="HBF55403135704778BA1F89A09B26E7A9"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, and every 5 years thereafter, the Administrator shall make publicly available a report on feasibility and best practices relating to reuse and refill within the following sectors:</text><subparagraph id="H457092C0D3FC4CF6967C2D061D4EF1DB"><enum>(A)</enum><text>Food service, including—</text><clause id="H2352F1F5B6954A989BCEE281DAA894A9"><enum>(i)</enum><text>take out;</text></clause><clause id="H310F949515C4473FA329D6BCB1677B95"><enum>(ii)</enum><text>delivery of prepared meals; and</text></clause><clause id="H0EC8D1FE4306426FA467ADCEEEEC1C9E"><enum>(iii)</enum><text>meal kits.</text></clause></subparagraph><subparagraph id="H4FC698E1370F42F5B4264095C4B238EE"><enum>(B)</enum><text>Consumer food and beverage products.</text></subparagraph><subparagraph id="HE8560BAD6BBF4EECB1C517CD15164D0C"><enum>(C)</enum><text>Consumer cleaning products.</text></subparagraph><subparagraph id="H1640CE698E704682AFDC5FD1731A2B2D"><enum>(D)</enum><text>Consumer personal care products.</text></subparagraph><subparagraph id="HE3BFDF69E1CB46668D21DE15AAB6CB29"><enum>(E)</enum><text>Transportation or shipping of wholesale and retail goods.</text></subparagraph><subparagraph id="H44FFD29D9B7C4174ABE3B8B282F77472"><enum>(F)</enum><text>Public educational institutions, including institutions of higher education.</text></subparagraph><subparagraph id="H04331DB70A5E4FAE8D4FEAE0611EB24E"><enum>(G)</enum><text>Other sectors, as identified by the Administrator.</text></subparagraph></paragraph><paragraph id="H0BD0173BF8484B52B40181E11282F470"><enum>(2)</enum><header>Objectives</header><text>The report under paragraph (1) shall evaluate and summarize—</text><subparagraph id="H57D9BCFF5CDB415FBA460D6449C5A23E"><enum>(A)</enum><text>types of reuse and refill product delivery systems that can be best used at different scales;</text></subparagraph><subparagraph id="H9A1E3B500F3146D6A897F4836E535CF5"><enum>(B)</enum><text>methods to ensure equitable distribution of reuse and refill product delivery systems in populations of color, communities of color, indigenous communities, and low-income communities;</text></subparagraph><subparagraph id="H97C80920D90D4758A7BE2DEB96278FDB"><enum>(C)</enum><text>job creation opportunities through the use or expansion of reuse and refill systems;</text></subparagraph><subparagraph id="H33460D96BE784D43B36907F3A6ED3AB5"><enum>(D)</enum><text>economic costs and benefits for—</text><clause id="H10FA279E69FB4C2E8A0CEA3A3F77D0EA"><enum>(i)</enum><text>the businesses that deploy reuse and refill technologies; and</text></clause><clause id="H277BDE1B0D754DD2AA491656E874E2CC"><enum>(ii)</enum><text>the parties responsible for waste collection and management;</text></clause></subparagraph><subparagraph id="H6CB86A9562564C0EBA0EE3BDCFE99333"><enum>(E)</enum><text>types of local, State, and Federal support needed to expand the use of reuse and refill systems; and</text></subparagraph><subparagraph id="H9EB0C4080DDC407CAE139BCF704CD5A4"><enum>(F)</enum><text>existing barriers to widespread implementation of reuse and refill systems.</text></subparagraph></paragraph><paragraph id="HEC6851495DC84DD3BC9D590F2954CE13"><enum>(3)</enum><header>Consideration</header><text>In preparing the report under paragraph (1), the Administrator shall consider relevant information on reuse and refill programs and approaches in States, units of local government, and other countries. </text></paragraph></subsection></section><section id="HD8BF186A74FA49408923305BCC292B97"><enum>7.</enum><header>Studies; agency directives</header><subsection id="HB8DA3984E40B4DF7AB0DA10DC206C027"><enum>(a)</enum><header>Definition of microplastic</header><text>In this section, the term <term>microplastic</term> means a plastic or plastic-coated particle that is less than 5 millimeters in any dimension.</text></subsection><subsection id="HCF81302B895244C98796C4F799DBFB58"><enum>(b)</enum><header>National Recycling Strategy limitation</header><text>The Administrator shall not expand the scope of the National Recycling Strategy of the Environmental Protection Agency to include facilities that treat plastic waste through the use of pyrolysis, gasification, or similar chemical recycling technologies.</text></subsection><subsection id="H4B70A5CE7A8543AD8C5FA616E796F1DA"><enum>(c)</enum><header>Food and Drug Administration study</header><paragraph id="H6EEB2DF14D72476A9FFE19325B8A0508"><enum>(1)</enum><header>In general</header><text>The Commissioner of Food and Drugs, in consultation with the Secretary of Agriculture and the heads of other necessary Federal departments and agencies, such as the Director of the National Institute of Standards and Technology, shall conduct a nationwide study on the presence and sources of microplastics in food (including drink) products, including food products containing fish, meat, fruits, or vegetables.</text></paragraph><paragraph id="HBD62CA1C29CF4EC2A530BF3EEEB52A86"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Commissioner of Food and Drugs shall submit to Congress, and make publicly available, a report describing the results of the study under this subsection.</text></paragraph><paragraph id="H593C2DA0DDC740D086F8193273C04E8F"><enum>(3)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this subsection.</text></paragraph></subsection><subsection id="H557CBFF9F2E64259BA91B38352C1FA68"><enum>(d)</enum><header>Microplastics pilot program</header><paragraph id="H7E68453291B94A9197E126F4EDD4A385"><enum>(1)</enum><header>Establishment</header><text>The Administrator shall establish a pilot program (referred to in this subsection as the <term>pilot program</term>) to test the efficacy and cost-effectiveness of tools, technologies, and techniques—</text><subparagraph id="HB0A280E9952D44B99EB78337E8B905AF"><enum>(A)</enum><text>to remove microplastics from the environment without causing additional harm to the environment; and</text></subparagraph><subparagraph id="HFDC19FFB76884583ACAB1CA60344E60C"><enum>(B)</enum><text>to prevent the release of microplastics into the environment.</text></subparagraph></paragraph><paragraph id="H99023FD378764892824FEAAF5C75DB6A"><enum>(2)</enum><header>Requirements</header><text>In carrying out the pilot program, the Administrator shall include testing of, and an analysis and mitigation of any environmental impacts on—</text><subparagraph id="H72A8D48C0EDD403FA36A44E8F527AA31"><enum>(A)</enum><text>natural infrastructure;</text></subparagraph><subparagraph id="H086A61EF6CC6430AB7D3EEB0477ADF3B"><enum>(B)</enum><text>green infrastructure (as defined in section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>)); and</text></subparagraph><subparagraph id="HBFDB5789C0224389B157F9173DF4C85D"><enum>(C)</enum><text>mechanical removal systems (such as pumps) and filtration technologies, including consideration of potential negative ecological impacts that may result from filtration in natural waterways and ocean waters.</text></subparagraph></paragraph><paragraph id="HC4DA593C4FF84316A0255386041E76B9"><enum>(3)</enum><header>Eligible locations</header><text>The Administrator may carry out under the pilot program projects located in—</text><subparagraph id="H4EEB4CE7F84F45DA9DD31A211C489699"><enum>(A)</enum><text>stormwater systems;</text></subparagraph><subparagraph id="H12C616D0E6F5496BA278AB19BD6A8AD5"><enum>(B)</enum><text>wastewater treatment facilities;</text></subparagraph><subparagraph id="HDB953D420D4A4F5681E3A62AD701C20E"><enum>(C)</enum><text>drinking water systems;</text></subparagraph><subparagraph id="HB1885C0FC24B40D094CBF71D52492558"><enum>(D)</enum><text>ports, harbors, inland waterways, estuaries, and marine environments; and</text></subparagraph><subparagraph id="HD03815102688446EB939DB37D29FA3C4"><enum>(E)</enum><text>roadways, highways, and other streets used for vehicular travel.</text></subparagraph></paragraph><paragraph id="HF10942567E704349972BC3579FC68F5A"><enum>(4)</enum><header>Outreach</header><text>In determining selection criteria and projects to carry out under the pilot program, the Administrator shall conduct outreach to—</text><subparagraph id="H084A8672D865451A83124D81E9B95C0B"><enum>(A)</enum><text>the Interagency Marine Debris Coordinating Committee established by section 5(a) of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1954">33 U.S.C. 1954(a)</external-xref>); and</text></subparagraph><subparagraph id="HAFD3B099E81C4CCA9608F5A4CDA43E9D"><enum>(B)</enum><text>stakeholders and experts in the applicable field, as determined by the Administrator.</text></subparagraph></paragraph><paragraph id="H1D6C2719FEB447D399EBC589D2CE08FA"><enum>(5)</enum><header>Reports</header><subparagraph id="HDAA2F7D37C0A47B4AA92BE3BA2F3AD21"><enum>(A)</enum><header>Outreach activities</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall submit to Congress a report describing the outreach conducted under paragraph (4).</text></subparagraph><subparagraph id="H3E17F927DC9643C895BB06A880B0D056"><enum>(B)</enum><header>Project effectiveness</header><text>Not later than 3 years after the date on which the Administrator establishes the pilot program, the Administrator shall submit to Congress a report describing the effectiveness of projects carried out under the pilot program.</text></subparagraph></paragraph><paragraph id="HBC3D4ABD323844C184D9DA9451D9FE4C"><enum>(6)</enum><header>Rulemaking required</header><text>Not later than 1 year after the date on which the Administrator submits to Congress the report required under paragraph (5)(B), the Administrator shall initiate a rulemaking to address abatement and mitigation of microplastics in the locations described in paragraph (3) using technologies and methods tested under the pilot program.</text></paragraph><paragraph id="H934CEBDE95784BEBA4AFDC4E85695D19"><enum>(7)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this subsection.</text></paragraph></subsection><subsection id="HED1F583E8A8A4E5AA4BAAEF9D653D8C8"><enum>(e)</enum><header>National Institutes of Health research</header><paragraph id="HF49D2E096EA849499AAEDBF6A01F0AA6"><enum>(1)</enum><header>In general</header><text>The Director of the National Institutes of Health shall conduct or support research on the presence of microplastics in the human body, which may include determining how the presence of microplastics in organs and biospecimens, including urine, breastmilk, and stool, impacts human health.</text></paragraph><paragraph id="H7C300D9E23064EC08413D901F76AD2F4"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, and annually for each of the 4 years thereafter, the Director of the National Institutes of Health shall submit to Congress, and make publicly available, a report that provides an overview of the research conducted or supported under this subsection, together with any relevant findings.</text></paragraph><paragraph id="H3DD33728C3C14330BF76CF61022B4AE0"><enum>(3)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this subsection.</text></paragraph></subsection></section><section id="HE657DA5CC8ED4D01A3CAE53A35BA6308"><enum>8.</enum><header>Reducing single-use plastics in agriculture</header><subsection id="H901BAA46DEB94FE1AFEC4EA9D9F063C0"><enum>(a)</enum><header>Biodegradable weed barriers practices under the Environmental Quality Incentives Program</header><text>The Secretary of Agriculture shall designate a project to replace the use of on-farm plastic weed barriers and weed mitigants with nonplastic, biodegradable alternatives as an agricultural conservation practice or enhancement that meets the requirement described in section 21001(a)(1)(B)(iii) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (136 Stat. 2016) (commonly known as the <quote>Inflation Reduction Act of 2022</quote>).</text></subsection><subsection id="H9C036D8B7ABC4877A089095B567E5F86"><enum>(b)</enum><header>Single-Use plastic farm product packaging reduction grants</header><text>Section 210A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1627c">7 U.S.C. 1627c</external-xref>) is amended—</text><paragraph id="HE9CD4AEF35174C7CAA1C1C08D4370476"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H255D6CB7550A42B4B7A8B174965741F7"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HAE2E02E7BF61486E9B821B5154211E6A"><enum>(B)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></subparagraph><subparagraph id="H112F8BB97E1A418884A89D09AC228518"><enum>(C)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB0E2D1FEF0D54EF1ADAC4F512564FFD9"><paragraph id="H01B6F615D01447B3BB21E70178540124"><enum>(6)</enum><text>supports the reduction of single-use plastics from the post-production distribution packaging of agricultural producers; and</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE400CDD64B4E468BAC45CD6EB48531D4"><enum>(2)</enum><text>by redesignating subsections (f) through (i) as subsections (g) through (j), respectively;</text></paragraph><paragraph id="H4C4FCBFA339846D7A3CAD7D94C78CD4B"><enum>(3)</enum><text>in paragraph (1) of subsection (i) (as so redesignated), in the matter preceding subparagraph (A), by striking <quote>subsection (i)(3)(E)</quote> and inserting <quote>subsection (j)(3)(E)</quote>;</text></paragraph><paragraph id="HC650FD1516C34BEA93287F60EAF699DE"><enum>(4)</enum><text>by striking <quote>subsection (i)</quote> each place it appears and inserting <quote>subsection (j)</quote>; and</text></paragraph><paragraph id="H7F5DAC3D8E8745CCBD5CFFC73422B4D9"><enum>(5)</enum><text>by inserting after subsection (e) the following:</text><quoted-block id="HE68A122681C249F0A5719135F33F7FF8" display-inline="no-display-inline" style="OLC"><subsection id="HEB13984D7F8848F58FA31DF9C11F1F9C"><enum>(f)</enum><header>Single-Use plastic farm product packaging reduction grants</header><paragraph id="H2B98B544F452402685D53050FD33BFE8"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Administrator of the Agricultural Marketing Service and in coordination with the Administrator of the Rural Business-Cooperative Service, shall provide grants to eligible entities described in paragraph (2) to significantly reduce or eliminate single-use plastics from the post-production distribution packaging of the entities.</text></paragraph><paragraph id="H5EA1505163614547BE983BED100AAA33"><enum>(2)</enum><header>Eligible entities</header><text>An entity shall be eligible for a grant under paragraph (1) if the entity is—</text><subparagraph id="H25A2DE58440943FD83E71A91007395A3"><enum>(A)</enum><text>an independent producer, as determined by the Secretary, of a value-added agricultural product; or</text></subparagraph><subparagraph id="H4BC5653E35644ACA87A29A985018B51F"><enum>(B)</enum><text>an agricultural producer group, farmer or rancher cooperative, or majority-controlled producer-based business venture, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="H7B90F4A49CB941A2A0AB273FC3D461E9"><enum>(3)</enum><header>Grant amount</header><text>The amount of a grant provided under paragraph (1) shall be not more than $250,000.</text></paragraph><paragraph id="H3EFB026A616C48049DEB35284DA9FCDF"><enum>(4)</enum><header>Term</header><text>The term of a grant provided under paragraph (1) shall be 3 years.</text></paragraph><paragraph id="HF987554A0DC2436093B301BBA2BB68B0"><enum>(5)</enum><header>Priority</header><text>In providing grants under paragraph (1), the Secretary shall give priority to—</text><subparagraph id="H846C185E9F82475EB7A64F49E859E16F"><enum>(A)</enum><text>beginning farmers or ranchers;</text></subparagraph><subparagraph id="HD8956AF82DF148D4B23BFB434F427E38"><enum>(B)</enum><text>veteran farmers or ranchers;</text></subparagraph><subparagraph id="HF54FD84509FD4745A699F2E2FB93BF6C"><enum>(C)</enum><text>organic and regenerative farmers; and</text></subparagraph><subparagraph id="H7FE60919421D4C6CB7B9198F15B2B18C"><enum>(D)</enum><text>socially disadvantaged farmers or ranchers.</text></subparagraph></paragraph><paragraph id="H602FDDD96996430193509A1261EEEE08" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $25,000,000 for each of fiscal years 2025 through 2034.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
