<section id="HE21514DD66E94A0A9C1F5B4797AEFF40" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stream Protection and Vegetation Restoration Act</short-title></quote>.</text></section> <section id="HB86CB992EDAD4C29BBE2118EA16456E7"><enum>2.</enum><header>Amendments to Surface Mining Control and Reclamation Act</header> <subsection id="H878B775EABB147EAA3BA51C87F52D7AF" commented="no"><enum>(a)</enum><header>Reclamation plan requirements</header><text display-inline="yes-display-inline">Section 508(a)(7) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1258">30 U.S.C. 1258(a)(7)</external-xref>) is amended by inserting <quote>, not to exceed the time and distance standards established in section 515(g)</quote> after <quote>reclamation plan</quote>.</text></subsection> 
<subsection id="HD8F324BD2BA848988E97D698F7F00D15"><enum>(b)</enum><header>Revision of permits</header><text>Section 511(a) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1261">30 U.S.C. 1261(a)</external-xref>) is amended—</text> <paragraph id="H5471E1A1844846828331EB9A3E706367"><enum>(1)</enum><text>by redesignating paragraph (3) as paragraph (5); and</text></paragraph> 
<paragraph id="H63075E9B25E14A5A958C42B204C52455"><enum>(2)</enum><text>by inserting after paragraph (2) the following: </text> <quoted-block style="OLC" id="H4757D5176FC3403199758185CEA48A38" display-inline="no-display-inline"> <paragraph id="H921DA89A76D64C419067FD848B8D4C06" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A request to temporarily cease or suspend mining operations is a significant permit revision for purposes of paragraph (2).</text></paragraph> 
<paragraph id="HAC3C28EA2B394E74832F9E1E0118634F" indent="up1"><enum>(4)</enum><text>In each case where no active coal removal or reclamation has occurred at a permitted mine for more than 6 months during any 3-year period, the applicable permit shall be considered out of compliance with the reclamation plan—</text> <subparagraph id="H9EC9F1C990D64931ADD01909D70EFEC3"><enum>(A)</enum><text>unless the permit is in compliance with time and distance standards established in section 515(g) and does not have any variances from such standards; and</text></subparagraph> 
<subparagraph id="H6800AAA9A21544E0952F634D648572C5"><enum>(B)</enum><text>until the date on which the regulatory authority approves—</text> <clause id="H5409B9CDFB3142BC9B211CC800E363C1"><enum>(i)</enum><text display-inline="yes-display-inline">a reasonable plan submitted by the operator to return to production not later than 1 year after the date on which the operator is notified that the applicable permit is considered out of compliance under this paragraph; or</text></clause> 
<clause id="HBCE005B387D94B9AAA1D9A9F02FE0936"><enum>(ii)</enum><text>an application for a revision of the permit submitted by the permittee under paragraph (1).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H571F280DA12A46FA9CB42A607C3BC64B"><enum>(c)</enum><header>Environmental protection performance standards</header><text>Section 515 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1265">30 U.S.C. 1265</external-xref>) is amended—</text> 
<paragraph id="HEA43915AD84F427DA09DD5C633B0BA7C"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="HB750113A9F7B4C26B1AC0B8D6691147B"><enum>(A)</enum><text>in paragraph (16)—</text> 
<clause id="H1EA2FE04A5DB41538CA70D210F34F321"><enum>(i)</enum><text>by inserting <quote>, not to exceed the time and distance standards established in subsection (g)</quote> after <quote>contemporaneously as practicable with the surface coal mining operations</quote>; and</text></clause> <clause id="H4229660E10E44B7CA43591CEEDFE6B5B"><enum>(ii)</enum><text>in subparagraph (D), by striking the period at the end and inserting a semicolon;</text></clause></subparagraph> 
<subparagraph id="HCE7B6C72C7C14BC8B38190D02A9C3C75"><enum>(B)</enum><text>in paragraph (20)—</text> <clause id="H6C076AAA9BA446BBB3CD8708FA1A4360"><enum>(i)</enum><text>in subparagraph (A), by inserting <quote>and</quote> at the end; and</text></clause> 
<clause id="HC9FC123CA0884CD1A34162F49E331FAD"><enum>(ii)</enum><text>in subparagraph (B), by striking the period at the end and inserting a semicolon;</text></clause></subparagraph> <subparagraph id="HA422E3B511D64DDBBE0E498066BFAE7C"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (22)(I), by striking the period at the end and inserting a semicolon;</text></subparagraph> 
<subparagraph id="H61BA0E035BBC497F8B3A345E115F2B78"><enum>(D)</enum><text>in paragraph (23), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H2AECE7F34C1049D1AFFCA1B68DF668E8"><enum>(E)</enum><text>in paragraph (25), by striking the period at the end and inserting <quote>; and</quote>; and </text></subparagraph> 
<subparagraph id="H78B23E2E9CCB4ACB958CB9724992A194"><enum>(F)</enum><text>by adding at the end the following: </text> <quoted-block style="OLC" id="HCBF73D56B39B483D9F29F17B581C1C5D" display-inline="no-display-inline"> <paragraph id="H263F336DD9E147B58BBE166AF3976737"><enum>(26)</enum><text display-inline="yes-display-inline">conduct contemporaneous reclamation so as not to exceed the time and distance standards established in subsection (g).</text> </paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H53A10DDC517948299EFA0BE5E6F6F15F"><enum>(2)</enum><text>by adding at the end the following: </text> <quoted-block style="OLC" id="H0CEFD07AD9504BD7AFECE0A2B4AEFC8A" display-inline="no-display-inline"> <subsection id="H6C91DFCB140D48D7BFE9874411979832"><enum>(g)</enum><text>Rough backfilling and grading for surface mining activities shall be completed according to one of the following schedules:</text> 
<paragraph id="HC1C63F2B5FDC482B94DBF5F7E54911D9"><enum>(1)</enum><text>For contour mining, within 60 days or 1,500 linear feet following coal removal, whichever occurs first.</text></paragraph> <paragraph id="H9D57CFD38DE74A419C8574A6DE046291"><enum>(2)</enum><text>For area mining, within 180 days following coal removal, and not more than 4 spoil ridges behind the pit being worked, the spoil from the active pit constituting the first ridge.</text></paragraph> 
<paragraph id="H20AFA0DFD4F542268557A233905C7AAB"><enum>(3)</enum><text>For other surface mining methods, in accordance with the schedule established by the regulatory authority. For States with approved State programs, schedules are subject to the State program approval process.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HF0A61794881246509F575CD81B666B22"><enum>(d)</enum><header>Inspections and monitoring</header><text>Section 517(b) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1267">30 U.S.C. 1267(b)(2)</external-xref>) is amended—</text> 
<paragraph id="HA21A01AB566F4D6E87CB1DF501BF2648"><enum>(1)</enum><text>in paragraph (2), to read as follows: </text> <quoted-block style="OLC" id="H9F7C2A9CAD674DF583E66784D9BCECB5" display-inline="no-display-inline"> <paragraph id="H702C36D83B8644F994BBAA2635133826"><enum>(2)</enum><text display-inline="yes-display-inline">the regulatory authority shall—</text> 
<subparagraph id="H0F26BDE6824C4C6CA3B632DA518DC122"><enum>(A)</enum><text>require quarterly monitoring of both surface water and ground water during mining and reclamation; and</text></subparagraph> <subparagraph id="H48735BDA1E17436CAC1CBA555F0B3080"><enum>(B)</enum><text>specify those—</text> 
<clause id="H29A43C2ADBC14C9BA67F7E69481E8B30"><enum>(i)</enum><text>monitoring sites to record the quantity and quality of surface drainage above and below the mine site as well as in the potential zone of influence;</text></clause> <clause id="HEF5D9E1F72F24E109CEB2AC979504757"><enum>(ii)</enum><text>monitoring sites to record level, amount, and samples of ground water and aquifers potentially affected by the mining and also directly below the lowermost (deepest) coal seam to be mined; </text></clause> 
<clause id="H2AF7FBDE70B04BCEB4BF6B540E7649E9"><enum>(iii)</enum><text>records of well logs and borehole data to be maintained; and</text></clause> <clause id="H4DE86859522444949B86D1368045D798"><enum>(iv)</enum><text>monitoring sites to record precipitation;</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8EE2920D338746A99EC3F680C0E45A91"><enum>(2)</enum><text>by redesignating paragraph (3) as paragraph (5); and</text></paragraph> <paragraph id="HCD762FCA5C844E078AC291A0491C735C"><enum>(3)</enum><text>by inserting after paragraph (2) the following: </text> 
<quoted-block style="OLC" id="H5F1EF3D3BCB24E0EB27D1360A31F8BE1" display-inline="no-display-inline"> 
<paragraph id="HAD089F869ACD4F65A184A56F5633C95A"><enum>(3)</enum><text display-inline="yes-display-inline">the regulatory authority shall conduct an annual assessment of the biological condition of streams to demonstrate progress with respect to restoring of the pre-mining biological condition of the stream;</text></paragraph> <paragraph id="HD65B573E16A4411692D1936F9FD23D60"><enum>(4)</enum><text display-inline="yes-display-inline"> the regulatory authority shall conduct an inspection of surface water runoff control structures after each precipitation event that is at least as intense as a 100-year, 6-hour precipitation event; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section>
