<section id="HE7890F780DA1412DAC945E3D0716C89D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Government Equity Improvement Act of 2024</short-title></quote>.</text></section> <section id="H6FBDBA1F69C54DD9A9D0A4C967173435" section-type="subsequent-section"><enum>2.</enum><header>Performance improvement officers</header><text display-inline="no-display-inline">Section 1124 of title 31, United States Code, is amended—</text> 
<paragraph id="H7C54DF4FDE154F31B0153F9ED3DBCB29"><enum>(1)</enum><text>in subsection (a)(2)—</text> <subparagraph id="H0673A35D0D69454AAB27905FF09C1A48"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph> 
<subparagraph id="H4989DE639D8A43A5A1B3B8164918223E"><enum>(B)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="H25AEDF0BC4854E54845C31CE4D6178FC"><enum>(C)</enum><text>by inserting at the end the following:</text>

<subparagraph id="H0EEDB1A2CCAB4E7FA24A01F2446EDE89"><enum>(G)</enum><text display-inline="yes-display-inline">establish and serve as the head of an Agency Equity Advisory Team, with at least 10 members, that includes representation from at least 10 of the following:</text> <clause id="H8F7EC27FF221493D927336534A8F2E4B"><enum>(i)</enum><text>The head of the agency.</text></clause> 
<clause id="H7BF68227D0CB46B8991C102B583A4704"><enum>(ii)</enum><text>Regulatory affairs senior designee.</text></clause> <clause id="H67C179C9F11A4BC8B0CA6F59180A9D31"><enum>(iii)</enum><text>Counsel.</text></clause> 
<clause id="H887620440F69408D966F3BA04B857C94"><enum>(iv)</enum><text>Civil rights enforcement senior designee.</text></clause> <clause id="H0981B5589A79498EA2F4E2E62D061639"><enum>(v)</enum><text>Policy development senior designee.</text></clause>

<clause id="H3F0FEA7F92C54868A910F82C73C10F7B"><enum>(xii)</enum><text>Procurement senior designee.</text></clause> <clause id="HAB702558DE8744B19E6812F87E0702D6"><enum>(xiii)</enum><text>Customer or user experience leadership.</text></clause> 
<clause id="HDB92A3BE25E140D9BF183A8F4D7DD095"><enum>(xiv)</enum><text>Communications or public affairs senior designee.</text></clause> <clause id="H97E2095819D14740B336D2847092FD2D"><enum>(xv)</enum><text>Public engagement senior designee.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HA821FC03DBF44977A0CDB38A0CF97D06"><enum>(2)</enum><text>in subsection (b), by adding at the end the following new paragraph:</text> <quoted-block style="USC" id="H4D4A5FD895A24D3CB83ABBE31BF23E40" display-inline="no-display-inline"> <paragraph id="HF4ADE8B6703F4E81A3EF0D95B3A78B3D"><enum>(4)</enum><header>Equity Subcommittee</header> <subparagraph id="H4B5E6275D63F4051B5B135B7F229B8BA"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established an Equity Subcommittee of the Performance Improvement Council, consisting of members of that Council, to be selected by the Council.</text></subparagraph> 
<subparagraph id="H7CFB1EDD425E4E008922F26E7B3F2C12"><enum>(B)</enum><header>Functions</header><text display-inline="yes-display-inline">The Equity Subcommittee of the Performance Improvement Council shall—</text> <clause id="HBFB70368EA3D41CB81FCE98E9623F864"><enum>(i)</enum><text display-inline="yes-display-inline">assist the Director of the Office of Management and Budget in identifying guidance agencies need on how to provide services more equitably and developing such guidance;</text></clause> 
<clause id="HF1E5449EA7184BA1A84FF0A204EAD231"><enum>(ii)</enum><text display-inline="yes-display-inline">facilitate the sharing of information across agencies regarding practices that have led to the more equitable provision of services;</text></clause> <clause id="H733DF674BF024FC79F0E6F62DAD12923"><enum>(iii)</enum><text display-inline="yes-display-inline">coordinate with the Equitable Data Working Group of the Chief Data Officer Council (established pursuant to section 3520A of title 44) to ensure that agencies share best practices related to the equitable collection and use of data; and</text></clause> 
<clause id="H3DFCA221A16041AEB844456484E88FB0"><enum>(iv)</enum><text display-inline="yes-display-inline">solicit input from nongovernmental organizations, State and local governments, and recipients of government services to determine best practices for providing government services equitably.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HEB24D7718B5949F8BBCF8D0A99B53B23"><enum>3.</enum><header>Chief data officers</header><text display-inline="no-display-inline">Title 44, United States Code, is amended—</text> 
<paragraph id="HA2F774FAEA034240B0FA09020341ADF7"><enum>(1)</enum><text>in section 3520(c)—</text> <subparagraph id="H397A0FF51CE04C5194C9555F406CB94B"><enum>(A)</enum><text>in paragraph (13), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph> 
<subparagraph id="HEF0A91ACE4B545AD9BAE2E5BBD3A48E0"><enum>(B)</enum><text>in paragraph (14) by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="HB792F310B5E74520A78988587E43749C"><enum>(C)</enum><text>by inserting at the end the following new paragraph:</text>

<paragraph id="HA917C95771604239A31D80DEB50B2F54"><enum>(15)</enum><text display-inline="yes-display-inline">ensure the agency applies the recommendations of the Chief Data Officer Council developed pursuant to paragraphs (1) through (5) of section 3520A(b). </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H5208C3A629684FABBADFDF54E882EB76"><enum>(2)</enum><text>in section 3520A—</text> 
<subparagraph id="HC3FE95AADBB143F5B2E09FC5F883D2D4"><enum>(A)</enum><text>in subsection (b)—</text> <clause id="HD39D84462B0A48BFB36106987850D708"><enum>(i)</enum><text>in paragraph (1), by striking <quote>the use</quote> and inserting <quote>the equitable use</quote>;</text></clause> 
<clause id="H21CB00AEFF394011A39098295C9BF7D5"><enum>(ii)</enum><text>in paragraph (2), by striking <quote>between agencies</quote> and inserting <quote>between agencies, academic and research partners, State and local governments, community and advocacy groups, and other stakeholders</quote>; </text></clause> <clause id="HDE99E283C3894D90B6316E723C57D7AA"><enum>(iii)</enum><text>in paragraph (3), by striking <quote>policymaking</quote> and inserting <quote>equitable policymaking</quote>;</text></clause> 
<clause id="HEE361EE1A2D24353B7EB07B716094484"><enum>(iv)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>access</quote> and inserting <quote>equitable access</quote>; and</text></clause> <clause id="H09D68393A1AC4A8BB09A1569A56997E5"><enum>(v)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>collection</quote> and inserting <quote>equitable collection</quote>;</text></clause></subparagraph> 
<subparagraph id="H50E4B97DAC25415C8943A78A17B6AA45"><enum>(B)</enum><text>in subsection (d), by striking <quote>the Council.</quote> and inserting <quote>the Council, including the work of the Equitable Data Working Group.</quote>;</text></subparagraph> <subparagraph id="HE91E173CF3684BE38DCB4995BE5258CF"><enum>(C)</enum><text display-inline="yes-display-inline">by amending subsection (e) to read as follows:</text>

<subsection id="H56305A72959B41F78A3CF6219829E7AD"><enum>(e)</enum><header>Evaluation and termination</header> 
<paragraph id="HA850DB2A9BCE4452A8B6915210C4FF63"><enum>(1)</enum><header>GAO Evaluation of Council</header><text display-inline="yes-display-inline">Not later than 4 years after the date of the enactment of this paragraph, the Comptroller General shall submit to Congress a report on whether the additional duties of the Council, including the Equitable Data Working Group, improved the equitable collection and use of evidence, including for program evaluation, in the Federal Government.</text></paragraph> <paragraph id="H2F4A2A024ACC4B769B20DCF0B5F3BA34" display-inline="no-display-inline" commented="no"><enum>(2)</enum><header>Termination of Council</header><text display-inline="yes-display-inline">The Council, including the Equitable Data Working Group, shall not terminate until at least two years after the date on which the Comptroller General submits the report under paragraph (1) to Congress.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H9A7891FD6759424EAACF642F4D89E016"><enum>(D)</enum><text>by adding at the end the following new subsections:</text> <quoted-block style="USC" id="H0024E53EF9624136B818A5572F12BC66" display-inline="no-display-inline"> <subsection id="HEB336194D9BD4C25B3C6E764062A005C"><enum>(f)</enum><header>Equitable Data Working Group</header> <paragraph id="H36F29CD0FC84445680D752A34BD8BD03"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the Council an Equitable Data Working Group.</text></paragraph> 
<paragraph id="H51764D0657D840DCA539B34A4C658E75"><enum>(2)</enum><header>Purpose and functions</header><text display-inline="yes-display-inline">The Equitable Data Working Group shall ensure that the Council prioritizes equity when carrying out the functions of the Council described in paragraphs (1) through (5) of subsection (b).</text></paragraph> <paragraph id="H9534F0CB8156449192BE50AC8483BEE9"><enum>(3)</enum><header>Meetings; reports</header><text display-inline="yes-display-inline">Not less frequently than once per quarter, the Equitable Data Working Group shall meet submit to the Chief Data Officer Council a written report with recommendations on how to execute the functions described in paragraphs (1) through (5) of subsection (b) to better achieve equitable methods and outcomes.</text></paragraph> 
<paragraph id="H2D394825BD304DDB9D01EE9765A961F3"><enum>(4)</enum><header>Membership</header> 
<subparagraph id="HC4966D96B1C34954B1165EF382EFE6E7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Council shall select a subset of the members of the Council to serve as members of the Equitable Data Working Group. </text></subparagraph> <subparagraph id="H9CFEFD6B5006490C8B7AE4CF903605C1"><enum>(B)</enum><header>Chair</header><text display-inline="yes-display-inline">The Chair of the Council shall select the Chair of the Equitable Data Working Group from among the members of the Equitable Data Working Group.</text></subparagraph></paragraph></subsection> 
<subsection id="H9947B2025ACC461EA5F0D2D7340DA185" commented="no"><enum>(g)</enum><header>State defined</header><text display-inline="yes-display-inline">In this section and section 1124 of title 31, the term <term>State</term> means each State of the United States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> </legis-body></bill>
