<section id="H47808CA61E244144A8C15BE9A4A1F8AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reproductive Data Privacy and Protection Act</short-title></quote>.</text></section> <section id="H0BE47BDACAA4431580C0B96C4F0D147D"><enum>2.</enum><header>Procedure for interception of wire, oral, or electronic communications</header> <subsection id="HA279BC968FAC432A86C41A23BA0D34E2"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">Section 2518(1) of title 18, United States Code, is amended—</text> 
<paragraph id="HAA5F02E2BF0A4AD9A710BE2D239F172B"><enum>(1)</enum><text>in paragraph (e), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="HBCCAF02E6CFF4F0281BE56FCFF8D435D"><enum>(2)</enum><text>in paragraph (f), by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HB516354FEBFD418E9E5BFED1488F1DE0"><enum>(3)</enum><text>by inserting after paragraph (f) the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H4B66CF1878B74E9C88206DD7B420F6E9"> <subsection id="H8EAB3AF5180F4998A265A4479F622B43"><enum>(g)</enum><text display-inline="yes-display-inline">a statement affirming that the applicant will not use the contents of any wire, oral, or electronic communication, including any communication with respect to reproductive or sexual health information, to initiate or conduct an investigation into or proceeding against any person inquiring about, seeking, obtaining, providing, or facilitating reproductive or sexual health treatment or care.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H2911DBFD0FB8433B8A7A7D39D799CFB3"><enum>(b)</enum><header>Order</header><text display-inline="yes-display-inline">Section 2518(4) of title 18, United States Code, is amended—</text> <paragraph id="HDD730168054F4463A7AE1018DBF5A0A3"><enum>(1)</enum><text>in paragraph (d), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H0191C94CA3A94C0BA920F7AC21973A46"><enum>(2)</enum><text>in paragraph (e), by striking the period and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="H078455ED3E1F4EC0A64FE733EFBD217C"><enum>(3)</enum><text>by inserting after paragraph (e) the following: </text>

<subsection id="HE3EFD3610E444A89A58EC087AB96E0C9" indent="down1"><enum>(f)</enum><text display-inline="yes-display-inline">that the applicant will not use the contents of any wire, oral, or electronic communication, including any communication with respect to reproductive or sexual health information, to initiate or conduct an investigation into or proceeding against any person inquiring about, seeking, obtaining, providing, or facilitating reproductive or sexual health treatment or care.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HE2291B39245A4576BE76AA4B86E61701"><enum>(c)</enum><header>Definition</header><text>Section 2518 of title 18, United States Code, is amended by adding at the end the following: </text> 
<quoted-block style="USC" display-inline="no-display-inline" id="H60BAE73BF1EB4AB39944735547F986B9"> 
<paragraph id="H2BF03BE197DE4ACDA566AAB3D2C13238" indent="up1"><enum>(13)</enum><text display-inline="yes-display-inline">In this section, the term <quote>reproductive or sexual health information</quote> means information relating to—</text> <subparagraph id="HE30389062C414A5391892DB9E23FF833"><enum>(A)</enum><text display-inline="yes-display-inline">reproductive-related surgeries or procedures, including abortion and in vitro fertilization;</text></subparagraph> 
<subparagraph id="HD960B3254F324FE6A6F5BE6AC49ED80D"><enum>(B)</enum><text>the use or purchase of contraceptives, medication abortion, or any other drug, device, or materials related to reproductive health;</text></subparagraph> <subparagraph id="HA424202FF3B94241B5ADB6D2A090C2AB"><enum>(C)</enum><text>the prescription, recommendation, or distribution of contraceptives, medication abortion, in vitro fertilization, or any other drug, device, or materials related to reproductive health;</text></subparagraph> 
<subparagraph id="H9FE12A1391374FDFAEDE82756975E441"><enum>(D)</enum><text display-inline="yes-display-inline">reproductive or sexual health conditions, status, diseases, or diagnoses, including pregnancy and pregnancy-related conditions, menstruation, ovulation, ability to conceive a pregnancy (including through in vitro fertilization), whether such individual is sexually active, and whether such individual is engaging in unprotected sex; and</text></subparagraph> <subparagraph id="HDF3727C8B3874F86AC039574DF7BE58A"><enum>(E)</enum><text display-inline="yes-display-inline">any other medical or non-medical service or care provided in conjunction with information described in subparagraphs (A) through (D). </text></subparagraph> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA65F798E304545CF814DBF6EF93339E1"><enum>(d)</enum><header>Required disclosure of customer communications or records</header><text display-inline="yes-display-inline">Section 2703 of title 18, United States Code, is amended by adding at the end the following: </text> <quoted-block style="OLC" id="HCBD76E8E8F5341DE82602914E853714F" display-inline="no-display-inline"> <subsection id="H684C195426904D368D0B98CA5E074318"><enum>(i)</enum><header>Disclosure of customer communications or records</header><text display-inline="yes-display-inline">A government entity seeking to compel disclosure pursuant to a subpoena, court order, or warrant shall provide a statement under oath that it shall not use the contents of any wire, oral, or electronic communication, including reproductive or sexual health information, for the purpose of conducting an investigation into or proceeding against any person in connection with inquiring about, seeking, obtaining, providing, or facilitating reproductive or sexual health treatment or care. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
