R. 7823</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240326">March 26, 2024</action-date><action-desc><sponsor name-id="M001211">Mrs. Miller of Illinois</sponsor> (for herself, <cosponsor name-id="B001291">Mr. Babin</cosponsor>, <cosponsor name-id="H001096">Ms. Hageman</cosponsor>, <cosponsor name-id="R000103">Mr. Rosendale</cosponsor>, <cosponsor name-id="H001086">Mrs. Harshbarger</cosponsor>, <cosponsor name-id="B001299">Mr. Banks</cosponsor>, and <cosponsor name-id="W000806">Mr. Webster of Florida</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Food, Drug, and Cosmetic Act to require a warning label advising that the effects of mifepristone can be counteracted, to amend the Public Health Service Act to establish a hotline to provide information to women seeking to counteract the effects of mifepristone, and for other purposes.</official-title></form><legis-body id="H3AEB3BC1A0C6473D810930F005A77E97" style="OLC"><section id="H0A1F239476B34B7B975791BAA8A0151E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Second Chance for Moms Act</short-title></quote>. </text></section><section id="HCD8A83E80D084A03832AE80FA9F6A1BB"><enum>2.</enum><header>Mifepristone warning label and hotline</header><subsection id="H4B903E49E5C84D4A886FF082557F9B32"><enum>(a)</enum><header>Warning label</header><paragraph id="H7D3DE6BBA4D34337AF15BFBAECFDBE10"><enum>(1)</enum><header>In general</header><text>Section 502 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/352">21 U.S.C. 352</external-xref>) is amended by adding at the end the following:</text><quoted-block style="traditional" id="H4E90E236BC684C45ACC6016378417FEB" display-inline="no-display-inline"><subsection id="H7562E6825D94454A9A661442ACE72206"><enum>(hh)</enum><text display-inline="yes-display-inline">If it is the drug mifepristone, and its labeling does not bear the following statement printed in conspicuous text: <quote>WARNING: Medical evidence suggests that the abortifacient effects of mifepristone can be counteracted by natural progesterone, which can increase the chance of fetal survival. The American Society for Reproductive Medicine has determined that natural progesterone is safe in the first trimester of pregnancy. For more information, call [___].</quote> (with the blank filled in to refer to the appropriate number for the hotline under section 1009 of the Public Health Service Act).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HE5146E3100FD421986C6A0E4B62CC5B1"><enum>(2)</enum><header>Effective date</header><text>Section 502(hh) of the Federal Food, Drug, and Cosmetic Act (as added by paragraph (1)) applies beginning on the date that is 6 months after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H7833696787074693891A27C3B9ACD52F"><enum>(b)</enum><header>Hotline</header><text display-inline="yes-display-inline">Title X of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300">42 U.S.C. 300 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC5881061AF6F4851A0270444C14E6758" display-inline="no-display-inline"><section id="H44CDA676750748CCB0F6CCC6D82BC94F"><enum>1009.</enum><header>Hotline for reversal of effects of mifepristone</header><text display-inline="no-display-inline">The Secretary shall establish or maintain, directly or by grant or contract, a toll-free hotline to provide support for 24 hours a day, 7 days a week, for women seeking to reverse the effects of the drug mifepristone.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
