which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To exempt certain structures from removal from Army Corps of Engineers property on Table Rock Lake, and for other purposes.</official-title></form><legis-body id="HCD03B3ED11BF48B8BDFDC97A3B5B5C4D" style="OLC"><section id="H555CB8CCB71E4F2793812A4E5AAB8F9A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Table Rock Lake Property Protection Act</short-title></quote>.</text></section><section id="H210C33E7B620429A80BD7BF7E681B894" section-type="subsequent-section"><enum>2.</enum><header>Table Rock Lake encroachment</header><subsection id="H81D2A3AB362B4F40918BFBCE7A6A93A2"><enum>(a)</enum><header>In general</header><text>The Secretary shall—</text><paragraph id="H028AC5487FFD40B099ABDECBCEAF3553"><enum>(1)</enum><text>suspend any activities to require eligible property owners to remove eligible structures; and</text></paragraph><paragraph id="HC76158AD7B4A403C8942E317046AB2CC"><enum>(2)</enum><text>offer to an eligible property owner a conveyance or release that—</text><subparagraph id="HFE9CE033C85B4986A97D839DC4A7669B"><enum>(A)</enum><text>for an eligible structure located on fee land, conveys by quitclaim deed the minimum land required to maintain the eligible structure, reserving the right to flood the land, if applicable;</text></subparagraph><subparagraph id="HBE3B4ABF58BE49AEA4DC01D1852F393A"><enum>(B)</enum><text display-inline="yes-display-inline">for an eligible structure located on land subject to a flowage easement, releases by quitclaim deed the easement prohibition; and</text></subparagraph><subparagraph id="H8222D66F770D49A188DD128E1638BDB0"><enum>(C)</enum><text>provides that—</text><clause id="H0DEA783394234D52BDD31449E4A22C85"><enum>(i)</enum><text>the eligible structure shall not be extended further onto fee land or land subject to the flowage easement; </text></clause><clause id="HFB39A178677D4025B2E63001795AEDA2"><enum>(ii)</enum><text>additional structures for human habitation shall not be placed on fee land or land subject to the flowage easement;</text></clause><clause id="H4354531EEFBD465B853B5F041CFABAFE"><enum>(iii)</enum><text display-inline="yes-display-inline">the United States shall not be liable or responsible for damage to the eligible structure caused by the operation of the Lake; and</text></clause><clause id="H7A3A0B25CBE94DEAA9438FA399440A02"><enum>(iv)</enum><text>no claim to compensation shall accrue from the exercise of any flowage easement right.</text></clause></subparagraph></paragraph></subsection><subsection id="HF30584DAA6864D92B6C38EB4B47A87FB"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3D5925C166A5402FAC901384F582A4F0" commented="no"><enum>(1)</enum><header>Easement prohibition</header><text>The term <term>easement prohibition</term> means the rights acquired by the United States, in a flowage easement, to prohibit structures for human habitation on land subject to the easement.</text></paragraph><paragraph id="HB3477391726A4B5CA5C337AEFC723E64"><enum>(2)</enum><header>Eligible property owner</header><text>The term <term>eligible property owner</term> means a person who owns an eligible structure. </text></paragraph><paragraph id="HEAE73E0A60A9495BAEBD07B842FC4735"><enum>(3)</enum><header>Eligible structure</header><text>The term <term>eligible structure</term> means a structure for human habitation, including a septic system—</text><subparagraph id="H17098F904FD24E0A8F7173DB63AA1C3E"><enum>(A)</enum><text>that is located on fee land or land subject to the flowage easement; and</text></subparagraph><subparagraph id="H033278126E114C55A956595A2D2E09F7"><enum>(B)</enum><text>for which a license for right-of-way has been provided by the Secretary and is in effect on the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="H9C893E77B2A249A4958FDA0B6909A810"><enum>(4)</enum><header>Fee land</header><text>The term <term>fee land</term> means the land acquired in fee title by the United States for the Lake.</text></paragraph><paragraph id="H8380545AAC1D4EEFAE97A7091F60C6CF" commented="no"><enum>(5)</enum><header>Flowage easement</header><text>The term <term>flowage easement</term> means an interest in land acquired by the United States that includes the right to flood land surrounding the Lake.</text></paragraph><paragraph id="H8BD175FFB9E04F48B302D7E98F054CBE"><enum>(6)</enum><header>Lake</header><text display-inline="yes-display-inline">The term <term>Lake</term> means the Table Rock Lake project of the Corps of Engineers, located in Missouri and Arkansas, authorized as one of the multiple-purpose reservoir projects in the White River Basin by section 4 of the Act of June 28, 1938 (52 Stat. 1218).</text></paragraph><paragraph id="H9BCB54E3C33944A7AEDB2952B1177327"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Army, acting through the Chief of Engineers. </text></paragraph></subsection></section></legis-body></bill>
