which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to provide additional entitlement to Post-9/11 Educational Assistance to certain veterans and members of the Armed Forces who require extra time to complete remedial and deficiency courses, and for other purposes.</official-title></form><legis-body id="H85BDDB4C52844DB680542AB01EAB873E" style="OLC"><section id="HD7EE1077261748ACAFAE5244A1F6F49C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Education and Transfer Extension Act of 2024</short-title></quote> or the <quote><short-title>VET Extension Act of 2024</short-title></quote>.</text></section><section id="H13A6DCF232E6412EA6A012F722873CD7"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="H6C206C8FB0F14667AB83BAA919296CBA"><enum>(1)</enum><text display-inline="yes-display-inline">Individuals who are entitled to Post-9/11 Educational Assistance who require remedial and deficiency courses exhaust their entitlement before completing a program of education with such assistance.</text></paragraph><paragraph id="HD08F1F8B63B647ED924FCC1D1133D3FB"><enum>(2)</enum><text>Members of the Armed Forces who are entitled to Post-9/11 Educational Assistance and who do not have dependents while serving as members of the Armed Forces are not able to transfer their entitlement to such assistance when they come to have dependents.</text></paragraph></section><section id="H6D3EB626430248F8A4A5F652E60E1654"><enum>3.</enum><header>Additional entitlement to Post-9/11 Educational Assistance for certain veterans and members of the Armed Forces who require extra time to complete remedial courses</header><subsection id="H0EA4BA1A2F3A4120BF70A96DD56FEDC2"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H443CC2CF853240F3ADB709C3FAE21C1E" style="USC"><section id="HF4F4DF12562F4C90B8C660292B54FD9D"><enum>3320A.</enum><header>Additional assistance</header><subsection id="H233C59F07EFC4A0696A8B3348CEDAD12"><enum>(a)</enum><header>In general</header><text>The number of months of educational assistance under section 3313 of this title an eligible individual is entitled to under section 3312 of this title is hereby increased by the lesser of—</text><paragraph id="H49625FB4E2344B65AA3852784E758453"><enum>(1)</enum><text>15 months; or</text></paragraph><paragraph id="H69D9A2018B134E33B72A06BCBABCA994"><enum>(2)</enum><text>in the case of an eligible individual who attempted or completed remedial and deficiency courses as described in subsection (b)(4), the full-time equivalent number of months of educational assistance used under this chapter to complete such remedial and deficiency courses.</text></paragraph></subsection><subsection id="H90A383E31C6941FEA70F48774F6455BC"><enum>(b)</enum><header>Eligibility</header><text>For purposes of this section, an eligible individual is an individual—</text><paragraph id="H37760CE38EAB40FC832AC5074863E6D6"><enum>(1)</enum><text>who is or was entitled to educational assistance under section 3311 of this title;</text></paragraph><paragraph id="HD350F156F40140A3A1BCB0D8E757BB84"><enum>(2)</enum><text>has received educational assistance under this chapter at any time during the most recent six-month period;</text></paragraph><paragraph id="H91A69701AEBF49528F415CC6849D6031"><enum>(3)</enum><text>who has used all of the educational assistance to which the individual is entitled under this chapter; and</text></paragraph><paragraph id="H93023218D3184408A7BD78EE2F009C84"><enum>(4)</enum><text>who has attempted or completed remedial and deficiency courses in pursuit of completing a program of education at an institution of higher learning and in doing so requires more than the standard 120 semester (or 180 quarter) credit hours for completion of a program of education at an institution of higher learning.</text></paragraph></subsection><subsection id="HC713BE5265CF4695966ECB2F6A9F18BF"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE96C7F242EB54EAF890C3F97465B8B00"><enum>(1)</enum><text>The term <term>institution of higher learning</term> has the meaning given such term in section 3452 of this title.</text></paragraph><paragraph id="H71821BB32A96461B819FCEEBC8D3B6C4"><enum>(2)</enum><text>The term <term>remedial and deficiency course</term> means a course offered by an institution of higher learning that is designed to overcome a deficiency.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H70EB6E565A8F4D43A2024DA4B42112FB"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 3320 the following new item:</text><quoted-block display-inline="no-display-inline" id="HB0E8B6B871524C6395D2E33F438DDD30" style="OLC"><toc><toc-entry bold="off" level="section">3320A. Additional assistance.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4C08BB14A8534A1297881A95EDBAFB76"><enum>(c)</enum><header>Conforming amendment</header><text>Section 3695 of title 38, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HC96EF26E23A34D458702CC4B63D2FD2E" style="OLC"><subsection id="H7F2551B49A0D4E64A1AEFB0696FEA366"><enum>(d)</enum><text>In the case of an individual who receives additional educational assistance under section 3320A of this title, the number of months specified in subsection (a) shall instead be construed to specify the number of months that is equal to the sum of—</text><paragraph id="H1E9C4401368C43DA95B9EF0586179D51"><enum>(1)</enum><text>such number of months, and</text></paragraph><paragraph id="HDDF8075D8A484398B839B38103CAE17D"><enum>(2)</enum><text>the amount of the increase in number of months of educational assistance to which the individual is entitled pursuant to section 3320A(a) of such title.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H2452EDA46412480E860E76BA01E12532"><enum>4.</enum><header>Increased flexibility in transferring entitlement to Post-9/11 Educational Assistance</header><text display-inline="no-display-inline">Section 3319 of title 38, United States Code, is amended—</text><paragraph id="HB6A3F4543C8E48D59125E17DCF963935"><enum>(1)</enum><text>in subsection (e)—</text><subparagraph id="H75BF4FD70E744B17A6E43DC3E6827511"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting such subparagraphs appropriately;</text></subparagraph><subparagraph id="H56F4E21C981A43F7A27195E05F414734"><enum>(B)</enum><text>in the matter before subparagraph (A), as redesignated by subparagraph (A), by striking <quote>An</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HA800A0CE0B754BC58030814C1491D8A7" style="OLC"><paragraph id="H3B48B49C88F240E38B364CCC11371C38"><enum>(1)</enum><header>In general</header><text>An</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HD6909907D69C4A7186D96A657FCD83D9"><enum>(C)</enum><text>by adding at the end the following new paragraph (2):</text><quoted-block display-inline="no-display-inline" id="H4A1C676E9D5F44FFA209FA6E3DE6A428" style="OLC"><paragraph id="HA5FABAF16FAA4DB9B93A7C37A0E5DDEE"><enum>(2)</enum><header>Timing of designation</header><text>In the case of an individual who elects to transfer entitlement under subsection (a) but who at the time of the election does not have any eligible dependents, the individual may carry out the designations required by paragraph (1) when the individual comes to have an eligible dependent to whom the individual would like to transfer entitlement under this section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H2AA389B4AB78499A9D493188E467F878"><enum>(2)</enum><text>in subsection (f)—</text><subparagraph id="HA8FAAE986DEE46CB9F43FC6FB068910C"><enum>(A)</enum><text>by striking paragraph (1);</text></subparagraph><subparagraph id="H28108B99C4D444F480AF68E99A80FCC3"><enum>(B)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (1) and (2), respectively; and</text></subparagraph><subparagraph id="H6B3DE8F73B5F45C1B2A95C1601A69631"><enum>(C)</enum><text>in paragraph (1)(A), as redesignated by subparagraph (B), by inserting <quote>, including by designating a new dependent or dependents to receive the unused entitlement</quote> before the period.</text></subparagraph></paragraph></section></legis-body></bill>
