R. 7674</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240313">March 13, 2024</action-date><action-desc><sponsor name-id="P000614">Mr. Pappas</sponsor> (for himself and <cosponsor name-id="D000617">Ms. DelBene</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to establish the Advisory Committee on Lesbian, Gay, Bisexual, Transgender, and Queer Veterans.</official-title></form><legis-body id="H7550798A2C3849ADADE7B7F7015F9FFD" style="OLC"><section id="H28F5FC2906F444A088CE271333A5F5DA" section-type="section-one"><enum>1.</enum><header>Establishment of Advisory Committee on Lesbian, Gay, Bisexual, Transgender, and Queer Veterans</header><subsection id="H7AA3D652C82A4D07BC62EDF068D0D643"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/5">chapter 5</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block id="HC60F614D217F486DBB50A4C03F3E78CC" style="USC"><section id="H717B8A4FBE9D43EDADA66DA4D43DCB5F"><enum>549.</enum><header>Advisory Committee on Lesbian, Gay, Bisexual, Transgender, and Queer Veterans</header><subsection id="H024C84B1E612449AB4511CC19EBFC7E6"><enum>(a)</enum><header>Establishment</header><text>There is in the Department the Advisory Committee on Lesbian, Gay, Bisexual, Transgender, and Queer Veterans (in this section referred to as <quote>the Committee</quote>).</text></subsection><subsection id="HD0106E99CA94470890BFC7C3B89C2C3F"><enum>(b)</enum><header>Membership</header><paragraph commented="no" display-inline="yes-display-inline" id="HFE1EFC31805243ADB4D997778C8C36FE"><enum>(1)</enum><text>The Committee shall consist of members appointed by the Secretary from the general public, including—</text><subparagraph id="HF4BBC884C5FA41EF8DAE24BDE0CF5509" indent="up1"><enum>(A)</enum><text>representatives of LGBTQ veterans;</text></subparagraph><subparagraph id="H11B4BF78C3EC464A828FCE5FA7BF5172" indent="up1"><enum>(B)</enum><text>individuals who are recognized authorities in fields pertinent to the needs of LGBTQ veterans, including the specific health-care needs of LGBTQ veterans;</text></subparagraph><subparagraph id="H372517DFC49E42D69BE105CACDC48FE7" indent="up1"><enum>(C)</enum><text>representatives of LGBTQ veterans with service-connected disabilities, including at least one lesbian, gay, or bisexual veteran with a service-connected disability, and at least one transgender veteran with a service-connected disability;</text></subparagraph><subparagraph id="HE8256646CE394AEDBA88AB9501E97D16" indent="up1"><enum>(D)</enum><text>Veterans who are minority group members, as defined in section 544 of this title; and</text></subparagraph><subparagraph id="H0CFB1F95537B472589FFF8C773301D40" indent="up1"><enum>(E)</enum><text>LGBTQ veterans who are recently separated from service in the Armed Forces, including veterans who were involuntarily separated from the Armed Forces due to being LGBTQ.</text></subparagraph></paragraph><paragraph id="H4AF60F59547D4B8C9C882565C92718E4" indent="up1"><enum>(2)</enum><text>The Committee shall include, as ex officio members—</text><subparagraph id="H797680B15EC34B08B845A23074ED93D9"><enum>(A)</enum><text>the Secretary of Labor (or the designee of the Secretary of Labor after consultation with the Assistant Secretary of Labor for Veterans’ Employment);</text></subparagraph><subparagraph id="HF6CA7E12C79F4E39944FCF7EBEF123B4"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Defense (or the designee of the Secretary of Defense); </text></subparagraph><subparagraph id="HFD8C93D769704523BE5D3E2D7673DC56"><enum>(C)</enum><text display-inline="yes-display-inline">the Under Secretary for Health (or the designee of such Under Secretary); and</text></subparagraph><subparagraph id="HD89DA7DC57AE4C99A60E2DCC3DE578EB"><enum>(D)</enum><text display-inline="yes-display-inline">the Under Secretary for Benefits (or the designee of such Under Secretary).</text></subparagraph></paragraph><paragraph id="H31072F9FFAD74D35B257C46194373B27" indent="up1"><enum>(3)</enum><text>The Secretary may invite representatives of other Federal departments and agencies to participate in the meetings and other activities of the Committee.</text></paragraph><paragraph id="H55A6CA5427C641B0A3B25E167B75582F" indent="up1"><enum>(4)</enum><text>The Secretary shall determine the number, terms of service, and pay and allowances of members of the Committee appointed by the Secretary, except that a term of service of any such member may not exceed three years. The Secretary may reappoint any such member for additional terms of service.</text></paragraph><paragraph id="H3D391C46676C41F7BDAE7A0D68872D1F" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The Committee shall meet as often as the Secretary determines necessary or appropriate, but not less often than twice each fiscal year.</text></paragraph></subsection><subsection id="H55C27944138548538D8D358276730EF1"><enum>(c)</enum><header>Consultation</header><text>The Secretary shall consult regularly with and seek the advice of the Committee with respect to the administration of benefits by the Secretary for LGBTQ veterans, reports and studies pertaining to LGBTQ veterans and the needs of LGBTQ veterans with respect to compensation, health care, rehabilitation, outreach, and other benefits and programs administered by the Secretary, including the Center for Women Veterans and Center for Minority Veterans.</text></subsection><subsection id="H453482094FA943EA9DA5246BAE26064D"><enum>(d)</enum><header>Reporting</header><paragraph commented="no" display-inline="yes-display-inline" id="H2CEE12CF5FE4428FB5F49FDD0D9E0005"><enum>(1)</enum><text>Not later than July 1 of each even-numbered year, the Committee shall submit to the Secretary a report on the programs and activities of the Department that pertain to LGBTQ veterans. Each such report shall include—</text><subparagraph id="H22DDA7F95DA74371B8A91AF22AB7E1F1" indent="up1"><enum>(A)</enum><text>an assessment of the needs of LGBTQ veterans with respect to compensation, health care, rehabilitation, outreach, and other benefits and programs administered by the Secretary;</text></subparagraph><subparagraph id="H8D32F7B67737412B8CB81F88BCF223A4" indent="up1"><enum>(B)</enum><text>a review of the programs and activities of the Department designed to meet such needs; and</text></subparagraph><subparagraph id="H3EE4AF9421B942B793BDDE26D1A03580" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">such recommendations (including recommendations for administrative and legislative action) as the Committee determines appropriate.</text></subparagraph></paragraph><paragraph id="H933C25E0B621465C9AA93C8660816086" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall, not later than 60 days after receiving each report under paragraph (1), submit to the Congress a copy of the report, together with any comments concerning the report that the Secretary determines appropriate.</text></paragraph><paragraph id="H859E44720062441BA1EA53F6809A952B" indent="up1"><enum>(3)</enum><text>The Committee may also submit to the Secretary such other reports and recommendations the Committee determines appropriate.</text></paragraph><paragraph id="H704EE51CD4154747997D0D5592C0B60F" indent="up1"><enum>(4)</enum><text>The Secretary shall submit, with each annual report submitted to Congress pursuant to section 529 of this title, a summary of all reports and recommendations of the Committee received by the Secretary since the previous such annual report.</text></paragraph></subsection><subsection id="H02896F2F5E2142D09C5E4827BDDD2A4A"><enum>(e)</enum><header>LGBTQ defined</header><text display-inline="yes-display-inline">In this section, the term <quote>LGBTQ</quote> means lesbian, gay, bisexual, transgender, or queer.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3E69FC6C431D40AAABCB538AF8D73C96"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding after the item relating to section 548 the following new item:</text><quoted-block style="USC" id="HF61C86C4D0B2486C9C5E1CCA38C34ED0" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">549.
