which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Tennessee Valley Authority Act to provide for further transparency of the Tennessee Valley Authority, and for other purposes.</official-title></form><legis-body id="H0C8A91905AB344D0ADF14914F7CE4884" style="OLC"><section id="H9AE50EA66E8243169C5A07ED764B45F7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>TVA Increase Rate of Participation Act</short-title></quote> or the <quote><short-title>TVA IRP Act</short-title></quote>.</text></section><section id="H601CDFABF36148299082BAB7DE8296A2"><enum>2.</enum><header>Office of Public Participation</header><text display-inline="no-display-inline">The Tennessee Valley Authority Act of 1933 (<external-xref legal-doc="usc" parsable-cite="usc/16/831k-1">16 U.S.C. 831k–1</external-xref>) is amended by inserting after section 12a the following: </text><quoted-block style="OLC" id="HDC1D265FDB3244B080E605D453C6FB1C" display-inline="no-display-inline"><section id="H7D53AEE55CEB41728CE57476134DA12E"><enum>12b.</enum><header>Office of Public Participation</header><subsection id="H7789F64A3F3F45BEAFEFDB0D4B34E57E"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Corporation an Office of Public Participation to engage with the public through direct outreach and education to facilitate greater understanding of the processes of the Authority and solicit broader participation in matters of the Authority affecting the public.</text></subsection><subsection id="H3AFD75F9D715441B809A641A6FE586FC"><enum>(b)</enum><header>Hiring</header><text>Hiring authority for the Office of Public Participation shall lay with the Board and such authority may not be delegated to Corporation staff.</text></subsection><subsection id="HFC2D7457B1FF4D0481AEDAF751736215"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The Office of Public Participation established under subsection (a) shall—</text><paragraph id="H767CD702C45A492BAFD40E180C48521E"><enum>(1)</enum><text display-inline="yes-display-inline">act as a liaison to members of the public affected by and interested in Corporation proceedings, by providing ongoing process information on individual proceedings and responding to requests for technical assistance;</text></paragraph><paragraph id="HD1DE8D1B0B11436A83BD409298D1C15D"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate with other program offices of the Corporation to improve, or, as appropriate, make recommendations to improve processes in a manner responsive to public input, with the goal of ensuring processes are inclusive, fair, and easy to navigate; and</text></paragraph><paragraph id="HF4AFD04B4CE7431FB7E15B6E65E6EEF7"><enum>(3)</enum><text display-inline="yes-display-inline">with public participation and feedback, create and facilitate a process not later than 1 year after the date of enactment of this section, for meaningful and open public engagement in the Authority’s integrated resource planning process, including opportunities for intervention, discovery, filed comments or testimony, and an evidentiary hearing.</text></paragraph></subsection><subsection id="H98A314AEBBEC491F9B21B9DE0DB38924"><enum>(d)</enum><header>Public participation in integrated resource planning process</header><text display-inline="yes-display-inline">The process required under subsection (b)(3) shall include—</text><paragraph id="H4BA14EF1E96940DE9AD1B24D801F9715"><enum>(1)</enum><text>a public comment period that begins not later than 100 days before release of a draft of an integrated resource plan and ends on the last day of the evidentiary hearing for such plan; and</text></paragraph><paragraph id="HA56D32A9FBFA4C83A512A2245560DA15"><enum>(2)</enum><text>a requirement for a response to any request for discovery from an intervenor not later than 15 days after such request is submitted.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HA41A0CD7C4174AC08405E94743CEEC70"><enum>3.</enum><header>Integrated Resource Plan</header><subsection id="HB1D4C40659A64CEE885BA98052BE4EE0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In drafting an integrated resource plan pursuant to section 113 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/16/831m-1">16 U.S.C. 831m–1</external-xref>), the Board of Directors of the Tennessee Valley Authority shall—</text><paragraph id="H2EDFB13162AA4DC682C02C2C8B518D2D"><enum>(1)</enum><text>oversee the process for meaningful and open public engagement in the integrated resource planning process established under section 12b of the Tennessee Valley Authority Act of 1933 (as added by this Act), including presiding over any evidentiary hearing required under such process;</text></paragraph><paragraph id="HA8FD19445AC14690A500AEDC4FF5978F"><enum>(2)</enum><text display-inline="yes-display-inline">include in such plan—</text><subparagraph id="HA511131C544445D5A22879D4FF2476F7"><enum>(A)</enum><text>a long-term forecast of the Authority’s sales and peak demand under various reasonable scenarios;</text></subparagraph><subparagraph id="HA842BFFED11D4A30847FBAABE95CB32A"><enum>(B)</enum><text>a summary of electrical transmission investments planned by the Authority;</text></subparagraph><subparagraph id="HE3C69899FAE5458488CDC45FEB9FAA10"><enum>(C)</enum><text>resource portfolios developed with the purpose of fairly evaluating the range of demand-side and supply-side technologies and services available to meet the Authority’s service obligations; and</text></subparagraph><subparagraph id="H0F1E7DB8F9794F22A1D90804F5320C49"><enum>(D)</enum><text>sensitivity analysis related to fuel costs, environmental regulations, electrification, distributed energy resources, and other uncertainties or risks;</text></subparagraph></paragraph><paragraph id="HA8808E7D66054154B8C8AE33DA069A1C"><enum>(3)</enum><text display-inline="yes-display-inline">not later than 100 days before the public release of a draft of the plan, provide to the public the modeling assumptions used in developing such a plan, including costs and constraints on the model; </text></paragraph><paragraph id="HE9C89BA32A3D49998A3EA837F3412712"><enum>(4)</enum><text display-inline="yes-display-inline">provide in such draft plan details of how and where public input informed the plan; </text></paragraph><paragraph id="H0B3373D25A1C4A138647ACC169E4A731"><enum>(5)</enum><text display-inline="yes-display-inline">evaluate whether the draft plan takes into account the features required under section 113(b)(2) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/16/831m-1">16 U.S.C. 831m–1</external-xref>); and</text></paragraph><paragraph id="H3A4F5B57B2664F219A390120A8AA7125"><enum>(6)</enum><text>issue a decision to approve, deny, or require modifications to such draft plan as necessary based on the evaluation under paragraph (5) and public input provided through the public comment period and evidentiary hearing required under section 12b of the Tennessee Valley Authority Act of 1933 (as added by this Act).</text></paragraph></subsection><subsection id="H25B9AD3DE15344A697EA56EF52D2B583"><enum>(b)</enum><header>Tennessee Valley Authority least-Cost planning program</header><text display-inline="yes-display-inline">Section 113(b)(2)(A) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/16/831m-1">16 U.S.C. 831m–1</external-xref>) is amended by inserting <quote>resilience, extreme weather risk, impacts to public health,</quote> after <quote>dispatchability</quote>.</text></subsection></section></legis-body></bill>
