which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To strengthen compliance with the FDA Food Traceability Rule, to enhance the FDA foodborne illness outbreak investigation process, and for other purposes.</official-title></form><legis-body id="H24B5E510CFD7438EB4C8545228A6C436" style="OLC"><section id="H2C3DB880E8BB45EA92C4A6FAAD089C3A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Traceability Enhancement Act</short-title></quote>. </text></section><section id="H62EF91EDC70341CB8F579AC8AE67C509"><enum>2.</enum><header>Easing recordkeeping and traceability lot code requirements</header><text display-inline="no-display-inline">Section 204(d) of the FDA Food Safety Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/21/2223">21 U.S.C. 2223(d)</external-xref>) is amended—</text><paragraph id="H51E0413443884975B12DD7D02568B3C1"><enum>(1)</enum><text>in paragraph (5), by striking <quote>not more than 2 years</quote> and inserting <quote>not more than 1 year</quote>; and </text></paragraph><paragraph id="H04AC3CBAF5874257A63B6B8083B1CC6D"><enum>(2)</enum><text>in paragraph (6), by adding at the end the following:</text><quoted-block style="OLC" id="HC6CA2EECCAFF462DBCA65E397D67FB10" display-inline="no-display-inline"><subparagraph id="H58359E1A6A0649808E8C396FBA6765C0"><enum>(J)</enum><header>Traceability lot codes at retail food establishments, restaurants, and warehouses</header><clause id="H323CEC7B506C4F1FACA07FDAB3B3423D"><enum>(i)</enum><header>In general</header><text>The requirements under this subsection shall not require restaurants, retail food establishments, and warehouses to maintain traceability lot code information or provide traceability lot code information to the Secretary or other entities in the supply chain. </text></clause><clause id="H9CC02C4A1E45480CB4AA3B173F731B17"><enum>(ii)</enum><header>Warehouse defined</header><text>In this subparagraph, the term <term>warehouse</term> means any facility primarily engaged in the storage of food to be shipped to retail food establishments or restaurants.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H60ED8615B1DA434B867DFC330BD5D3DE"><enum>3.</enum><header>Pilot projects on food tracing</header><subsection id="H00726F140EA64C72BE50FE1D4DF290CA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall conduct at least 9 pilot projects, in coordination with food industry members operating restaurants, retail food establishments, and warehouses distributing to retail food establishments and restaurants, to—</text><paragraph id="H2C38619D89DA4A97BC5B441FE61A1F1A"><enum>(1)</enum><text>measure the effectiveness of foodborne illness outbreak investigations conducted without the use of traceability lot code information; and</text></paragraph><paragraph id="H08402A9479B24F1781AEFB3B5BCC1EEF"><enum>(2)</enum><text>identify and evaluate the feasibility and effectiveness of low-cost food tracing technologies.</text></paragraph></subsection><subsection id="H0ECB84704AAA4CF0A22FDC253640E4A0"><enum>(b)</enum><header>Diversity</header><text display-inline="yes-display-inline">In conducting the pilot projects required by subsection (a), the Secretary shall—</text><paragraph id="H46B881F4B58D4306AE7B7CCD44923F36"><enum>(1)</enum><text>conduct—</text><subparagraph id="H03D66CD016CB492FAB81E6AF6D36D7D4"><enum>(A)</enum><text>at least 3 pilot projects in coordination with restaurants;</text></subparagraph><subparagraph id="HA03B43F0E8CE43D283CC52E709DCB280"><enum>(B)</enum><text>at least 3 pilot projects in coordination with retail food establishments; and</text></subparagraph><subparagraph id="HFCE2658742D44A3C832D01CF2648C44E"><enum>(C)</enum><text>at least 3 pilot projects in coordination with warehouses distributing to retail food establishments and restaurants; and</text></subparagraph></paragraph><paragraph id="HF488289FD6F4479B903715CDE73F0AAF"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that each pilot project uses at least 1 commodity—</text><subparagraph id="HE0161141E21146E681E9511126604F8D"><enum>(A)</enum><text>included in the Food Traceability List published by the Food and Drug Administration on November 21, 2022 (87 Fed. Reg. 70916); and</text></subparagraph><subparagraph id="H9E18E34DE47445AA9C455D148413B726"><enum>(B)</enum><text display-inline="yes-display-inline">not used in another such pilot project.</text></subparagraph></paragraph></subsection><subsection id="H0178CDF304BB4E69A217A15D4755C3F4"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary shall submit to Congress a report on the findings of the pilot projects required by subsection (a), including—</text><paragraph id="H3E9DE814C6B54798BE0FD812858886BA"><enum>(1)</enum><text>recommendations to minimize disruptions across the food supply chain;</text></paragraph><paragraph id="HFEF83B0E1BA94590824DE7E72B42FF1A"><enum>(2)</enum><text>recommendations to ensure product availability and diversity are not negatively impacted;</text></paragraph><paragraph id="H36CA425CC31E4104933727025419AE8B"><enum>(3)</enum><text>recommendations to reduce the compliance burden for small businesses covered by the final rule titled <quote>Requirements for Additional Traceability Records for Certain Foods</quote>, published on November 21, 2022 (87 Fed. Reg. 70910);</text></paragraph><paragraph id="HE4C029ADC1BF478EBAE309405E1490B2"><enum>(4)</enum><text>a list of low-cost food tracing technologies that are commercially available and an evaluation of the effectiveness of each technology; and</text></paragraph><paragraph id="HB7C30AE413D44A2096B6F6615EA06580"><enum>(5)</enum><text>a list of all revisions that, as a result of such pilot projects, will be made to such final rule.</text></paragraph></subsection></section><section id="H94B9B7D55C72476E9CA300C2020C806C"><enum>4.</enum><header>Compliance date of final rule on food traceability</header><text display-inline="no-display-inline">The compliance date for the final rule titled <quote>Requirements for Additional Traceability Records for Certain Foods</quote>, published on November 21, 2022 (87 Fed. Reg. 70910), or any other rule promulgated in accordance with section 204 of the FDA Food Safety Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/21/2223">21 U.S.C. 2223</external-xref>), shall be no earlier than the date that is 2 years after the date on which the pilot projects required by section 3(a) are completed.</text></section><section id="HC55914B9CDAA4E279B8BD14AEA6B9B02"><enum>5.</enum><header>Report on barriers to information sharing between FDA and food establishments</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Health and Human Services shall submit to Congress a report, which shall include a list of all barriers, legal or otherwise, that prevent the Food and Drug Administration from sharing with retail food establishments and restaurants pertinent information regarding foodborne illness outbreak investigations, including—</text><paragraph id="HE75828D1EFDB41C2BAA2DF4A12A341CD"><enum>(1)</enum><text>information surrounding early warning signals of foodborne illnesses;</text></paragraph><paragraph id="H4B3EE558A0BC4BFE93CDF170B49AD71B"><enum>(2)</enum><text>reported consumer illnesses; and</text></paragraph><paragraph id="H162156A28E864D0FBA68C135381D195E"><enum>(3)</enum><text>suspected transmission vehicles of a foodborne illness.</text></paragraph></section></legis-body></bill>
