R. 750</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20230202">February 2, 2023</action-date><action-desc><sponsor name-id="C001039">Mrs. Cammack</sponsor> (for herself and <cosponsor name-id="S001200">Mr. Soto</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require any person that sells or distributes a mobile application that the Federal Government has prohibited for Government-owned devices to disclose that fact to any individual who downloads, updates, or otherwise uses such application, and for other purposes.</official-title></form><legis-body id="HE60C78B62A774B0AB65B0FD9CF553A70" style="OLC"><section id="HA71F4EFBC2FE4A6DA94F0315716BB113" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chinese-owned Applications Using The Information of Our Nation Act of 2023</short-title></quote> or the <quote><short-title>CAUTION Act of 2023</short-title></quote>.</text></section><section id="HE00375AC24CD475F835905E9FE053D4D"><enum>2.</enum><header>Disclosure requirements</header><subsection id="HD38EDC49A0D242B9903A18FB41B8C028"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any person that sells or distributes a mobile application that the Federal Government has prohibited the use of for Government-owned devices under <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>, before the download or update of the application, shall disclose, in a clear and conspicuous manner, that the use of the mobile application is prohibited on Government-owned devices under law to any individual who downloads, updates, or otherwise uses the application.</text></subsection><subsection id="HEA636FC42A6B4F98B98DFB88B38A2AD9"><enum>(b)</enum><header>Enforcement</header><paragraph id="H40DA95572A4A4CC3B19B8372C1D8E18E"><enum>(1)</enum><header>Unfair and deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of this section shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="H59DEEF18F37C470889E8D491CD8CCB57"><enum>(2)</enum><header>Powers of the Federal Trade Commission</header><subparagraph id="HE93BD4D42E75435AA27741ED9C723DD6"><enum>(A)</enum><header>In general</header><text>The Federal Trade Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section.</text></subparagraph><subparagraph id="H461D57FFE7AE4CBBADBA49E3ED5C3243"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person that violates this section shall be subject to the penalties (including the provisions of subsections (l) and (m) of section 5 of such Act that provide for a maximum civil penalty per violation of $46,517 and entitled to the privileges and immunities, provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
