which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Highway System Designation Act of 1995 to permit the construction of certain noise barriers with funds from the Highway Trust Fund, and for other purposes.</official-title></form><legis-body id="H223512C50DDE45C5B37985EEA406BFF2" style="OLC"><section id="H58EFE5A9BAF34DC18618F5156743FE87" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Negating Neighborhood Noise Act of 2024</short-title></quote>.</text></section><section id="H41C873DCFCC941E891356B1E901D597F"><enum>2.</enum><header>Permitting use of highway trust fund for construction of certain noise barriers</header><text display-inline="no-display-inline">Section 339(b) of the National Highway System Designation Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/23/109">23 U.S.C. 109</external-xref> note) is amended to read as follows:</text><quoted-block id="HDA7F4F67EAB24F86A1E4B1A9DEF99C30" style="OLC"><paragraph id="H199298E6CC6B4FC5A416CEDFF8DE168E"><enum>(1)</enum><header>General rule</header><text>No funds made available out of the Highway Trust Fund may be used to construct a Type II noise barrier (as defined by section 772.5 of title 23, Code of Federal Regulations) pursuant to subsections (h) and (i) of section 109 of title 23, United States Code.</text></paragraph><paragraph id="H5954FC256D564AB1BEA6816DFDC9275B"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) shall not apply to construction or preservation of a Type II noise barrier if such a barrier—</text><subparagraph id="HDB1C6C044B53427D86E3054742E1F976"><enum>(A)</enum><text>was not part of a project approved by the Secretary before November 28, 1995;</text></subparagraph><subparagraph id="H39928303E4544C7B890F665FC3094534"><enum>(B)</enum><text>is proposed along lands that were developed or were under substantial construction before approval of the acquisition of the rights-of-ways for, or construction of, the existing highway; or</text></subparagraph><subparagraph id="H80FD15EA61C04705975FC6E9B8E58329"><enum>(C)</enum><text>as determined and applied by the Secretary, separates a highway or other noise corridor from a group of structures of which the majority of such structures closest to the highway or noise corridor—</text><clause id="H79AB4B8AAF6F4423B5ACD50493F71094"><enum>(i)</enum><text>are residential in nature; and</text></clause><clause id="H27874363DA0841A69F86F831B523B3BC"><enum>(ii)</enum><text>are at least 10 years old as of the date of the proposal of the barrier project.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H7D2B3921DF5347F7B1BC7CE734322AF9" commented="no"><enum>3.</enum><header>Eligibility for surface transportation block grant funds</header><text display-inline="no-display-inline">Section 133 of title 23, United States Code, is amended—</text><paragraph id="H01B3A4AD13A140A1AAC3110862BD964A" commented="no"><enum>(1)</enum><text>in subsection (b) by adding at the end the following:</text><quoted-block id="H30A3BE58F0054303BF426AB3473EF276" style="OLC"><paragraph id="HFABCE53A82854CB0B6D987B79F6C0FE5" commented="no"><enum>(25)</enum><text>Planning, design, preservation, or construction of a Type II noise barrier (as described in section 772.5 of title 23, Code of Federal Regulations) and consistent with the requirements of section 339(b) of the National Highway System Designation Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/23/109">23 U.S.C. 109</external-xref> note).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H06DE977E2D87491186A520AA5DA5ADB3" commented="no"><enum>(2)</enum><text>in subsection (c)(2) by striking <quote>and paragraph (23)</quote> and inserting <quote>, paragraph (23), and paragraph (25)</quote>.</text></paragraph></section><section id="H03C6508FC6EA4137A3E84C2373EC6C73" commented="no"><enum>4.</enum><header>Multipurpose noise barriers</header><subsection id="H75EB6628D3074B1CA23F05DC8F61FB01" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation shall ensure that a noise barrier constructed or preserved under section 339(b) of the National Highway System Designation Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/23/109">23 U.S.C. 109</external-xref> note) or with funds made available under title 23, United States Code, may be a multipurpose noise barrier.</text></subsection><subsection id="HBD4555CF55E041E5BBF4C5882F20634B" commented="no"><enum>(b)</enum><header>State approval</header><text>A State, on behalf of the Secretary, may approve accommodation of a secondary beneficial use on a noise barrier within a right-of-way on a Federal-aid highway.</text></subsection><subsection id="H7DA29CD675A54E0D92B778E8EB628AED" commented="no"><enum>(c)</enum><header>Definitions</header><paragraph id="H1074629A7A5F4503BAB6CA9F32462876" commented="no"><enum>(1)</enum><header>Multipurpose noise barrier</header><text>The term <quote>multipurpose noise barrier</quote> means any noise barrier that provides a secondary beneficial use, including a barrier that hosts or accommodates renewable energy generation facilities, electrical transmission and distribution infrastructure, or broadband infrastructure and conduit.</text></paragraph><paragraph id="H7F3695C9507541C49F35F0C8774C1384" commented="no"><enum>(2)</enum><header>Secondary beneficial use</header><text>The term <quote>secondary beneficial use</quote> means an environmental, economic, or social benefit in addition to highway noise mitigation.</text></paragraph></subsection></section><section id="HA6FDD86A500442E792CB832A6DBB4CA9" commented="no"><enum>5.</enum><header>Aesthetics</header><text display-inline="no-display-inline">A project sponsor constructing or preserving a noise barrier under section 339(b) of the National Highway System Designation Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/23/109">23 U.S.C. 109</external-xref> note) or with funds made available under title 23, United States Code, shall consider the aesthetics of the proposed noise barrier, consistent with the latest version of the Noise Barrier Design Handbook published by the Federal Highway Administration of the Department of Transportation.</text></section></legis-body></bill>
