which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reauthorize the State Criminal Alien Assistance Program, and for other purposes.</official-title></form><legis-body id="HFAA00ED81BF54290B0BB18F800F782C9" style="OLC"><section id="HA787FF0EA4DF4EA8A5D7D50209C8AB71" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Detain Illegals until Repatriated or Expelled Act </short-title></quote> or the <quote><short-title>DIRE Act</short-title></quote>. </text></section><section id="H1F018D5FAE374230A851BA22332AD91C"><enum>2.</enum><header>State Criminal Alien Assistance Program</header><text display-inline="no-display-inline">Section 241(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(i)</external-xref>) is amended—</text><paragraph id="HD4B60AC265244A0E94F21E36F98B7678"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HF99A1FEE0AC347B3A8FE162C03EEE7D2"><enum>(A)</enum><text>by inserting <quote><header-in-text level="paragraph" style="OLC">Authorization</header-in-text>.—</quote> before <quote>If the chief</quote>;</text></subparagraph><subparagraph id="HDBB2902AEDD446609ABE5AFECDB988F4"><enum>(B)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>and medical expenses</quote> after <quote>incarceration</quote>; and</text></subparagraph><subparagraph id="HAC4B93FBB1F44A40A82BFF8595E049EC"><enum>(C)</enum><text>by inserting <quote>or an alien with an unknown status</quote> after <quote>undocumented criminal alien</quote> each place that term appears;</text></subparagraph></paragraph><paragraph id="H81C586B561E447ECB6212AF953C5451E"><enum>(2)</enum><text>by striking paragraphs (2) and (3) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H99F225F2E18E40DABA66B997AC7FB9F8" style="OLC"><paragraph commented="no" id="H03073C0F47454FA58131C918B4AEF7EB"><enum>(2)</enum><header>Compensation</header><subparagraph commented="no" id="H08DFBA5E11354864AF7B373DF61C97A5"><enum>(A)</enum><header>Compensation of State for incarceration</header><text>The Attorney General shall compensate a State or political subdivision of a State referred to in paragraph (1)(A), in accordance with subparagraph (B), for the incarceration of an alien—</text><clause commented="no" id="H0635B2C813024C918CE972943A8F4CC0"><enum>(i)</enum><text>whose immigration status cannot be verified by the Secretary of Homeland Security; and</text></clause><clause commented="no" id="HC8A6DEE36EB1470098DF87F367E0ED7F"><enum>(ii)</enum><text>who would otherwise be an undocumented criminal alien if the alien is unlawfully present in the United States.</text></clause></subparagraph><subparagraph commented="no" id="H06DD3CFF46C843E98B3BA9BCC008E370"><enum>(B)</enum><header>Calculation of compensation</header><text>Compensation under subparagraph (A) shall be equal to the average cost of incarceration of a prisoner in the relevant State, as determined by the Attorney General.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDBE77831EEB8462884F38979A9F6E62D"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="HECC937CA45774927A342DA7C052E6B41"><enum>(A)</enum><header display-inline="yes-display-inline">Alien with an unknown status</header><text display-inline="yes-display-inline">The term <term>alien with an unknown status</term> means an individual—</text><clause commented="no" display-inline="no-display-inline" id="HE0855191B0C54D9CB72ADE9686E136E0"><enum>(i)</enum><text display-inline="yes-display-inline">who has been incarcerated by a Federal, State, or local law enforcement entity; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H1625456B6D3D4632A3073D4BB4E3DA36"><enum>(ii)</enum><text display-inline="yes-display-inline">whose immigration status cannot be definitively identified.</text></clause></subparagraph><subparagraph id="H175EB01C008046968C033D86A1A5A9F7"><enum>(B)</enum><header>Incarceration</header><text display-inline="yes-display-inline">The term <quote>incarceration</quote> means the confining in a correctional facility or county jail of an alien with unknown status or an undocumented criminal alien.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD92C8AEE1A84410C9A0391FECFCC5884"><enum>(C)</enum><header>Undocumented criminal alien</header><text display-inline="yes-display-inline">The term <term>undocumented criminal alien</term> means an alien who—</text><clause commented="no" display-inline="no-display-inline" id="H978A7419F3C146729E6A1A4E149F75FF"><enum>(i)</enum><text>has been charged with or convicted of a felony or 2 misdemeanors; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H69D819B3DAAB46D6AC3D0339282D7AF6"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HBBE789C1C53C4DB29A943F107F17FE85"><enum>(I)</enum><text>entered the United States without inspection or at any time or place other than as designated by the Secretary of Homeland Security;</text></subclause><subclause id="HA9961E129DA24422BE3E6C3F0E1519C4" indent="up1"><enum>(II)</enum><text>was the subject of exclusion or deportation or removal proceedings at the time he or she was taken into custody by the State or a political subdivision of the State; or</text></subclause><subclause id="H61FECACC8D544B7E88474E0C48E89EB1" indent="up1"><enum>(III)</enum><text>was admitted as a nonimmigrant and, at the time he or she was taken into custody by the State or political subdivision—</text><item id="H6C256F2D717F4195AD1D64044BF8DD77"><enum>(aa)</enum><text>failed to maintain the nonimmigrant status in which the alien was admitted or to which it was changed under section 248; or</text></item><item id="H11B76C861C8C403EBE9B5CD7BEBF5D46"><enum>(bb)</enum><text>failed to comply with the conditions of any such status.</text></item></subclause></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H4BC6FF2F848E4725A67804E9FD09D7F5"><enum>(3)</enum><text>in paragraph (4), by inserting <quote>and aliens with an unknown status</quote> after <quote>undocumented criminal aliens</quote> each place that term appears; and</text></paragraph><paragraph id="H60B5340884364081BDBBFAE49CBB0E1C"><enum>(4)</enum><text>by striking paragraphs (5) and (6) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HD0AE85F7191641CC9691E6E622062D4A" style="OLC"><paragraph id="HFCCDD31829D0497D9FF0030604FB0130"><enum>(5)</enum><header>Authorization of appropriations</header><subparagraph id="HE2B9F08F5DF44B2BA798D0D0E2362013"><enum>(A)</enum><header>In general</header><text>There are authorized to be appropriated $950,000,000 for each of the fiscal years 2025 through 2029 to carry out this subsection.</text></subparagraph><subparagraph id="H0F20C9A443F54841A66289D47C6C621D"><enum>(B)</enum><header>Limitation</header><text>Amounts appropriated pursuant to subparagraph (A) that are distributed to a State or a political subdivision of a State, including a municipality, may be used only for correctional purposes.</text></subparagraph></paragraph><paragraph id="HD72AD8ADC2714A0F88064D0D8A4A8B5C" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header>Distribution of reimbursement</header><text>Any amounts provided to a State or a political subdivision of a State as compensation under paragraph (1)(A) for a fiscal year shall be distributed to such State or political subdivision not later than 120 days after the last day of the period specified by the Attorney General for the submission of requests under that paragraph for that fiscal year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
