<official-title display="yes">To amend the Geothermal Steam Act of 1970 to waive the requirement for a Federal drilling permit for certain activities, to exempt certain activities from the requirements of the National Environmental Policy Act of 1969, and for other purposes.</official-title>

<section id="HCE57EA6267264EF984AFEF1F878C6E64" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Harnessing Energy At Thermal Sources Act</short-title></quote> or the <quote><short-title>HEATS Act</short-title></quote>.</text></section> <section id="HAD486058D37C468489C3072D56351200"><enum>2.</enum><header>No Federal permit required for geothermal activities on certain land</header><text display-inline="no-display-inline">The Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H8ACEA0C1703E4C8E960EFDE57F3107BF"><enum>30.</enum><header>No Federal permit required for geothermal activities on certain land</header>
<subsection id="H9AA8265FAF5A4F71813F6C0D0F21F14C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall not require an operator to obtain a Federal drilling permit for geothermal exploration and production activities conducted on a non-Federal surface estate, provided that—</text> <paragraph id="H69FC0F2A26B64AED9ED01D68F7C17D23"><enum>(1)</enum><text>the United States holds an ownership interest of less than 50 percent of the subsurface geothermal estate to be accessed by the proposed action; and </text></paragraph>
<paragraph id="H410421FD21EE491D920A8CE4BC86F6E4"><enum>(2)</enum><text>the operator submits to the Secretary a State permit to conduct geothermal exploration and production activities on the non-Federal surface estate.</text></paragraph></subsection> <subsection id="H50DE74865DCE430AA3E8908043C66A5E"><enum>(b)</enum><header>No Federal action</header><text display-inline="yes-display-inline">A geothermal exploration and production activity carried out under subsection (a)—</text>
<paragraph id="HF857290E1036476AB74047323CC8F37B"><enum>(1)</enum><text display-inline="yes-display-inline">shall not be considered a major Federal action for the purposes of section 102(2)(C) of the National Environmental Policy Act of 1969;</text></paragraph> <paragraph id="H79D921B1B1F94CF8A61053943EA69A12"><enum>(2)</enum><text>shall require no additional Federal action;</text></paragraph>
<paragraph id="HC9F11B60DCB54650AC479FDE729BCBA4"><enum>(3)</enum><text>may commence 30 days after submission of the State permit to the Secretary;</text></paragraph> <paragraph id="HEA581E33EBD74FBBA84D3DD2F2D077BA"><enum>(4)</enum><text>shall not be subject to section 7 of the Endangered Species Act of 1973; and</text></paragraph>
<paragraph id="HDF0A13FED3624D038DC7A38B7B70354A" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">shall only be considered an undertaking under division A of subtitle III of title 54, United States Code (commonly referred to as the <quote>National Historic Preservation Act</quote>), if, with respect to the State in which the activity occurs, there is no State law in effect that addresses the preservation of historic properties in such State.</text></paragraph></subsection> <subsection id="H1889F9AD38584E40ADC3E649D8D6EEF6"><enum>(c)</enum><header>Royalties and production accountability</header> <paragraph commented="no" display-inline="yes-display-inline" id="H040790AE9F3D4886A3A6AC61E95FCC47"><enum>(1)</enum><text>Nothing in this section shall affect the amount of royalties due to the United States under this Act from the production of electricity using geothermal resources (other than direct use of geothermal resources) or the production of any byproducts.</text></paragraph>
<paragraph id="H33C3EB2337BC43709E899AEFFE338E59" indent="up1"><enum>(2)</enum><text>The Secretary may conduct onsite reviews and inspections to ensure proper accountability, measurement, and reporting of the production described in subsection (a), and payment of royalties.</text></paragraph></subsection> <subsection id="H9E15C2745F774DEBB929D16EA0D0B21B"><enum>(d)</enum><header>Exceptions</header><text display-inline="yes-display-inline">This section shall not apply to actions on Indian lands or resources managed in trust for the benefit of Indian Tribes.</text></subsection>
<subsection id="HE72A559762FC41708C1FADB335894BF8"><enum>(e)</enum><header>Indian land</header><text>In this section, the term <term>Indian land</term> means—</text> <paragraph id="HFA9E1CB7E44C47E6A184013899A3687C"><enum>(1)</enum><text display-inline="yes-display-inline">any land located within the boundaries of an Indian reservation, pueblo, or rancheria; and</text></paragraph>
<paragraph id="H16550434B5F04EA6BC1AAA8733CF1F09"><enum>(2)</enum><text>any land not located within the boundaries of an Indian reservation, pueblo, or rancheria, the title to which is held—</text> <subparagraph id="H07BDA600256F48E382C583E1FBA1ED0D"><enum>(A)</enum><text>in trust by the United States for the benefit of an Indian tribe or an individual Indian;</text></subparagraph>
<subparagraph id="H66019388152C4F4BA2D04E3D6E4EDE4C"><enum>(B)</enum><text>by an Indian tribe or an individual Indian, subject to restriction against alienation under laws of the United States; or</text></subparagraph> <subparagraph id="H1DE4CCE00B1244DCBC8C5B214328CE6D"><enum>(C)</enum><text>by a dependent Indian community.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
