<section id="HC30DD76947A549578241BCB1A1DCA58C" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wireless Broadband Competition and Efficient Deployment Act</short-title></quote>.</text></section> <section id="H4245BDC7C4AD4E2CB09F4A793498339A"><enum>2.</enum><header>Application of NEPA and NHPA to collocation of certain personal wireless service facilities</header> <subsection id="HE4595CC070364027A1F4BCDE667E7EA1"><enum>(a)</enum><header>NEPA exemption</header><text display-inline="yes-display-inline">A Federal authorization with respect to a covered project may not be considered a major Federal action under section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></subsection> 
<subsection id="H360209715E9E409F938840AD4D95CA9F"><enum>(b)</enum><header>National Historic Preservation Act exemption</header><text display-inline="yes-display-inline">A covered project may not be considered an undertaking under section 300320 of title 54, United States Code.</text></subsection> <subsection id="H428E6161B55F4F59B005E4BED8758AFE"><enum>(c)</enum><header>Definitions</header><text>In this section: </text> 
<paragraph id="H96C307738C184A0FB054CB9950FBC65E"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission. </text></paragraph> <paragraph id="HA2F46094DC934901B36F6D6FC5134AC1" commented="no"><enum>(2)</enum><header>Covered project</header><text display-inline="yes-display-inline">The term <term>covered project</term> means a project—</text> 
<subparagraph id="HCA480159D93E46E08D16E7138BBB1B52" commented="no"><enum>(A)</enum><text>for—</text> <clause id="HC427308EAEAF4BC2A21C802EFB585449"><enum>(i)</enum><text display-inline="yes-display-inline">the mounting or installation of an eligible personal wireless service facility with another eligible personal wireless service facility that exists at the time at which a complete request for authorization of such mounting or installation is filed with a State or local government or instrumentality thereof or with an Indian Tribe; or</text></clause> 
<clause id="H605204BBFDC24F5F8D50B3AE8C728DFE" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the modification of an eligible personal wireless service facility; and</text></clause></subparagraph> <subparagraph id="HD71DD0A6606142BB9E9493163B4854C2"><enum>(B)</enum><text display-inline="yes-display-inline">for which a permit, license, or approval from the Commission is required or that is otherwise subject to the jurisdiction of the Commission.</text></subparagraph></paragraph> 
<paragraph id="HF3358D2F6ADA40C1B3D95A265BE87DB3" commented="no"><enum>(3)</enum><header>Eligible personal wireless service facility</header><text display-inline="yes-display-inline">The term <term>eligible personal wireless service facility</term> means any antenna, apparatus, or transmitting device, and any equipment, switches, wiring, cabling, power sources, shelters, or cabinets, for the provision of a personal wireless service.</text></paragraph> <paragraph id="HF8C1C84D80A742F6BB0BF3D43EBBABDF"><enum>(4)</enum><header>Federal authorization</header><text>The term <term>Federal authorization</term>—</text> 
<subparagraph id="HBE82B9EC179B4637AE11751D0432F22E"><enum>(A)</enum><text>means any authorization required under Federal law with respect to a covered project; and</text></subparagraph> <subparagraph id="H641F98A155C34AEBB5986BF6FB743767"><enum>(B)</enum><text>includes any permits, special use authorizations, certifications, opinions, or other approvals as may be required under Federal law with respect to a covered project.</text></subparagraph></paragraph> 
<paragraph id="H061931215CF54C1DAE3ABB73BB3D4A31"><enum>(5)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> under section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>).</text></paragraph> <paragraph id="H243FC8B18D1640B99F5A3BF6F24B44D2"><enum>(6)</enum><header>Personal wireless services</header><text>The term <term>personal wireless services</term>—</text> 
<subparagraph id="H45C00502AFE0411DAA26225B623CF5EF"><enum>(A)</enum><text>has the meaning given such term in section 332(c)(7)(C) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(c)(7)(C)</external-xref>); and</text></subparagraph> <subparagraph id="H87FCF314243947C1B43850BE4B4B40C3"><enum>(B)</enum><text>also includes commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>)).</text></subparagraph></paragraph> 
<paragraph id="H441157E142E9472C865DB64868CF04E9" commented="no"><enum>(7)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State of the United States, the District of Columbia, and each territory or possession of the United States.</text></paragraph></subsection></section> </legis-body></bill>
