<official-title display="yes">Making emergency supplemental appropriations to provide defense support to Ukraine, Israel, and Taiwan for the fiscal year ending September 30, 2024, to require the Secretary of Homeland Security to suspend the entry of inadmissible aliens, and for other purposes.</official-title>

<section id="H473A14D7878B4974A4EE60FA37B46D2E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defending Borders, Defending Democracies Act</short-title></quote>. </text></section> <section id="HA30E1612986C412E922F2A7DFA33EB51"><enum>2.</enum><header>Expiration of authorities and appropriations</header><text display-inline="no-display-inline">Authorities provided by this Act and any amounts authorized or otherwise made available under this Act may not be exercised after the date that is 1 year after the date of enactment of this Act.</text></section> 
<division id="HBD9CD988A95E4962990BF5B53BDD89FE" style="OLC"><enum>A</enum><header>Defending Borders</header> 
<section id="H8F94F28334BB472EBC6B9AEF2439EBEB"><enum>101.</enum><header>Temporary expulsion of inadmissible arriving aliens</header> 
<subsection id="H4F6B616D1BB24941A9C3DF2AFD859527"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, during the period beginning on the date of the enactment of this Act and ending on the date that is 1 year following the date of enactment of this Act, an immigration officer who determines that an alien who is arriving in the United States at or along the border between the United States and Mexico is inadmissible under section paragraph (6)(C) or (7) of section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>), shall, subject to sections 102 and 103, process the alien for expulsion from the United States without further hearing or review.</text></subsection> <subsection id="H30B775CF925649548565A3EF0627D463"><enum>(b)</enum><header>Detention pending expulsion</header><text>An alien subject to expulsion under subsection (a) shall be detained pending expulsion.</text></subsection></section> 
<section id="H9A73BAED558D4F85A668D848B59EF08B"><enum>102.</enum><header>Countries to which aliens may be expelled</header> 
<subsection id="HEA8BAA21D1494281AD96E51C498EDAF2"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), an alien who is processed for expulsion pursuant to section 101(a) shall be expelled to Mexico.</text></subsection> <subsection id="H7265D96810A741D391F1291E21EDC7C8"><enum>(b)</enum><header>Alternative countries</header><text>If the Government of Mexico is unwilling to accept an alien subject to expulsion under section 101(a) into the territory of Mexico or if the Secretary of Homeland Security determines that expulsion to Mexico would not be in the national interest of the United States, such alien shall be expelled, as directed by the Secretary, to—</text> 
<paragraph id="H9A50F9E181F24DA5B79C877522B61B10"><enum>(1)</enum><text>the country of which such alien is a citizen, subject, or national;</text></paragraph> <paragraph id="H2F97C3FA82F745DBB97D8180E36FC05F"><enum>(2)</enum><text>the country in which such alien was born;</text></paragraph> 
<paragraph id="HC45A4B22EE2E4C1B9C5AE0E76C712782"><enum>(3)</enum><text>the country in which such alien has a residence; or</text></paragraph> <paragraph id="H423E5F8D6734493DB1753554143E2BDF"><enum>(4)</enum><text>a country with a government that will accept such alien into its territory if expulsion to each country described in paragraphs (1) through (3) is impracticable, inadvisable, or impossible.</text></paragraph></subsection> 
<subsection id="H192094BF4B374DDB88E822F7E11D1C1C"><enum>(c)</enum><header>Restriction on expulsion to a country where an alien would be threatened with persecution or torture</header> 
<paragraph id="HDB2EC2633DB246F5957900018ECA78D1"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsections (a) and (b), and except as provided in paragraph (2), the Secretary of Homeland Security may not expel an alien to a country if—</text> <subparagraph id="HC4B715ACE40D4BC3B9FA4CF5677F6ABE"><enum>(A)</enum><text>the alien’s life or freedom would be threatened in such country because of such alien’s race, religion, nationality, membership in a particular social group or political opinion; or</text></subparagraph> 
<subparagraph id="H71243DC17CAD4704B5A69D8FC7C76947"><enum>(B)</enum><text>there are substantial grounds for believing that such alien would be in danger of being subjected to torture if expelled to such country.</text></subparagraph></paragraph> <paragraph id="H78F4CA10CB294F7BBC6C7CB7062657C3"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply—</text> 
<subparagraph id="H55032E5B21524D3AA9F222D5F66B71DB"><enum>(A)</enum><text>to an alien who is deportable under section 237(a)(4)(D) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)(D)</external-xref>); or</text></subparagraph> <subparagraph id="HDA2465E0624B4D0887BA7AE8E0A76CE1"><enum>(B)</enum><text>if the Secretary of Homeland Security determines that—</text> 
<clause id="H9E2281B56B694530B27954767D9D52A2"><enum>(i)</enum><text>the alien ordered, incited, assisted, or otherwise participated in the persecution of an individual because of the individual’s race, religion, nationality, membership in a particular social group, or political opinion;</text></clause> <clause id="H46E8F8AFCCD34EB085CAAD6D8E1E357B"><enum>(ii)</enum><text>the alien, having been convicted by a final judgement of a particularly serious crime, is a danger to the citizens of the United States;</text></clause> 
<clause id="HE873886BC85243A9A8C5ED6D5238BDA9"><enum>(iii)</enum><text>there are serious reasons to believe that the alien committed a serious nonpolitical crime outside the United States before the alien arrived in the United States; or</text></clause> <clause id="HCC2AC70CA3684612B0B628FB81878103"><enum>(iv)</enum><text>there are reasonable grounds to believe that the alien is a danger to the national security of the United States.</text></clause></subparagraph></paragraph> 
<paragraph id="H9C4D67FE5C7144F5917A1BE1A1C338BC"><enum>(3)</enum><header>Determinations</header> 
<subparagraph id="H64DAFE7E7E894316B1F24E76BD18A494"><enum>(A)</enum><header>Particularly serious crime</header><text>For purposes of paragraph (2)(B)(ii), an alien who has been convicted of an aggravated felony or felonies for which the alien has been sentenced to an aggregate term of imprisonment of not less than 5 years shall be considered to have committed a particularly serious crime. Notwithstanding the previous sentence, the Secretary of Homeland Security may determine that an alien sentenced to an aggregate term of imprisonment of less than 5 years has been convicted of a particularly serious crime.</text></subparagraph> <subparagraph id="H83BB0CC231BF4D6DB03D4246C8B4F3A5"><enum>(B)</enum><header>Danger to national security</header><text>For purposes of paragraph (2)(B)(iv), an alien who is described in section 237(a)(4)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)(B)</external-xref>) shall be considered to be an alien with respect to whom there are reasonable grounds for regarding as a danger to the national security of the United States.</text></subparagraph></paragraph> 
<paragraph id="H539E4252ADF24E84BD525B9E57F8A04C"><enum>(4)</enum><header>Referral to asylum officer</header> 
<subparagraph id="HDE383A763105493DA32BD69FBAD58810"><enum>(A)</enum><header>Referral</header><text>If an alien expresses to an immigration officer a fear that such alien’s life or freedom would be threatened in the country to which such alien will be expelled or that the alien would be in danger of being subjected to torture in such country, the immigration officer shall refer the alien for an interview by an asylum officer employed in the Refugee, Asylum and International Operations Directorate of U.S. Citizenship and Immigration Services for a determination pursuant to paragraphs (1) and (2).</text></subparagraph> <subparagraph id="HE80D3451F95D444382D72D448A0988A8"><enum>(B)</enum><header>Burden of proof; credibility</header><text>In determining whether an alien has demonstrated that such alien’s life or freedom would be threatened for a reason described in paragraph (1)(A) or whether the alien would be subjected to torture described in subparagraph (1)(B), the asylum officer shall—</text> 
<clause id="H228277931AEB4320B04B71A06077B3A3"><enum>(i)</enum><text>determine whether the alien has sustained the alien’s burden of proof; and</text></clause> <clause id="HD3EDF51A829549F299420A215FAD9047"><enum>(ii)</enum><text>make credibility determinations, in the manner described in clauses (ii) and (iii) of section 208(b)(1)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(1)(B)</external-xref>).</text></clause></subparagraph></paragraph></subsection></section> 
<section id="H1C8AD44AD8944C0B9F2E78B666A0FC0C"><enum>103.</enum><header>Waiver Authority</header> 
<subsection id="H56AD65B679DD4E75BA5E2CCD708B7BB0"><enum>(a)</enum><header>In general</header><text>The Office of Field Operations Port Director (referred to in this subsection as <quote>Director</quote>) for each land port of entry situated on the border between the United States and Mexico shall coordinate with the Commissioner of U.S. Customs and Border Protection to determine the maximum number of aliens per day that the Office of Field Operations staff at such port are capable of—</text> <paragraph id="HCDF32F3438C6409396DC88971552215E"><enum>(1)</enum><text>safely processing through such port of entry; and</text></paragraph> 
<paragraph id="HB7F49AF2760E4DD1BD609E81491E1B8B"><enum>(2)</enum><text>placing with nongovernmental organizations to provide short term shelter and services.</text></paragraph></subsection> <subsection id="HAFE487EBFC184943B2621ACF3EE5A856"><enum>(b)</enum><header>Strategy</header><text>At the time of a determination under subsection (a), the Director shall develop a strategy to safely and humanely identify eligible individuals in the United States, giving priority to individuals who—</text> 
<paragraph id="H02EEC2D843E04130B29C595D4021D2D7"><enum>(1)</enum><text>have a disability or an acute medical condition;</text></paragraph> <paragraph id="H09E2E91F32824699A66F268ECFE376DC"><enum>(2)</enum><text>are in need of advanced medical care that cannot be obtained in their current location; or</text></paragraph> 
<paragraph id="H25F8DE960EFE446D86BC9304ED333600"><enum>(3)</enum><text>are described in section 102(c)(1).</text></paragraph></subsection> <subsection id="HE430101663EC4B3EAC8D3528C65BE28C"><enum>(c)</enum><header>Exception</header><text>An immigration officer, after approval from the Commissioner of U.S. Customs and Border Protection, may, on a case-by-case basis, except an alien from expulsion based on the totality of the circumstances, including consideration of significant law enforcement officer, public safety, humanitarian, and public health interests. An alien who has been excepted from expulsion under this subsection shall be processed in accordance with the immigration laws (as defined in section 101(a)(17) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(17)</external-xref>)).</text></subsection></section> 
<section id="HEF97CA71C71649809BACA971F64E5CF3"><enum>104.</enum><header>Authority to suspend entry of aliens at the border</header> 
<subsection id="H513D505EEEA944369C66518FF52BC567"><enum>(a)</enum><header>Authority To suspend entry of aliens at borders of the United States</header><text>Notwithstanding any other provision of law, if the Secretary of Homeland Security determines, in his discretion, that the suspension of the entry of covered aliens at an international land or maritime border of the United States is necessary in order to achieve operational control over such border, the Secretary may prohibit, in whole or in part, the entry of covered aliens at such border for such period of time as the Secretary determines is necessary for such purpose.</text></subsection> <subsection id="H45BEBC7A3D564CFF932D4B8CBA74D7F0"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HD8555534C4394624AC785F362D3AAD82"><enum>(1)</enum><text>Except as otherwise provided, the terms have the meanings given such terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph> <paragraph id="HB039A32A6BB740E1AA3F740B81F76830"><enum>(2)</enum><text>The term <quote>covered alien</quote> means an alien seeking entry to the United States who is inadmissible under section 212(a)(7) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(7)</external-xref>).</text></paragraph> 
<paragraph id="HF76920519E0141EABFD23C4B396DD53F"><enum>(3)</enum><text>The term <quote>operational control</quote> has the meaning given such term in section 2 of the Secure Fence Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/8/1701">8 U.S.C. 1701</external-xref> note).</text></paragraph></subsection></section> <section id="H87C417C7DFD34AB898DFEFD32405085C"><enum>105.</enum><header>Limitation on use of Federal funds to move aliens</header><text display-inline="no-display-inline">No Federal funds may be used to transfer or otherwise move an alien in the custody of the Federal Government from a facility in which such alien was first detained to another location for a purpose other than adjudicating such alien’s status.</text></section> 
<section id="H3FA646CD71314B0B8F45BB1B79D090FC"><enum>106.</enum><header>Treatment of Aliens arriving from contiguous territory</header><text display-inline="no-display-inline">Section 1225(b)(2)(C) of title 8, United States Code, is amended by striking “may” and inserting “shall”.</text></section> </division> <division style="appropriations" id="H9A7DBA8E8CD74D9588B8819206B1BA78"><enum>B</enum><header display-inline="yes-display-inline">Defending Democracies</header> <section id="HCE71519BF0734328A7970B38AFA8A99D" section-type="undesignated-section"><text>The following sums are appropriated, out of any money in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2024, and for other purposes, namely:</text></section><appropriations-major id="HE1A89EB6C8074D84A4B2C319303304E5"><header>MILITARY PERSONNEL</header></appropriations-major><appropriations-intermediate id="H167B8973FF254BBFB5435DD4F1BB19CB"><header>Military personnel, army</header><text display-inline="no-display-inline">For an additional amount for <quote>Military Personnel, Army</quote>, $207,158,000, to remain available until September 30, 2025, to respond to the situation in Ukraine and for related expenses: <proviso><italic>Provided,</italic></proviso> That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985. </text></appropriations-intermediate><appropriations-intermediate commented="no" id="H180F26C5FE1C496C9B27D24077D8192B"><header>Military personnel, marine corps</header><text display-inline="no-display-inline">For an additional amount for <quote>Military Personnel, Marine Corps</quote>, $3,538,000, to remain available until September 30, 2025, to respond to the situation in Ukraine and for related expenses: <proviso><italic>Provided,</italic></proviso> That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985. </text></appropriations-intermediate><appropriations-intermediate commented="no" 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985. </text></appropriations-intermediate><appropriations-intermediate commented="no" id="H743203EE224545F7AA70133B44514CC5"><header>Operation and maintenance, navy</header><text display-inline="no-display-inline">For an additional amount for <quote>Operation and Maintenance, Navy</quote>, $1,534,163,000, to remain available until September 30, 2025, to respond to the situation in Ukraine, to support improvements to the submarine industrial base, and for related expenses: <proviso><italic>Provided,</italic></proviso> That of the total amount provided under this heading in this Act, $976,405,000 shall be to respond to the situation in Ukraine and for related expenses: <proviso><italic>Provided further,</italic></proviso> That of the total amount provided under this heading in this Act, $557,758,000 shall be to support improvements to the submarine industrial base and for related expenses: <proviso><italic>Provided further,</italic></proviso> That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985. </text></appropriations-intermediate><appropriations-intermediate commented="no" situation in Ukraine and for related expenses: <proviso><italic>Provided,</italic></proviso> That such amount is designated by the Congress as being for an emergency requirement pursuant to section Space Force</quote>, $8,443,000, to remain available until September 30, 2025, to respond to the situation in Ukraine and for related expenses: <proviso><italic>Provided,</italic></proviso> That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985. </text></appropriations-intermediate><appropriations-intermediate commented="no" id="HE52CA8D9EE444178BD107277DA37D49E"><header>Operation and maintenance, defense-Wide</header></appropriations-intermediate><appropriations-small id="HF52EFE3A464F49A8B2C02B5D85469C04"><header>(INCLUDING TRANSFERS OF FUNDS)</header><text display-inline="no-display-inline">For an additional amount for <quote>Operation and Maintenance, Defense-Wide</quote>, $34,230,780,000, to remain available until September 30, 2025, to respond to the situations in Israel, Ukraine, and Taiwan and for related expenses: <proviso><italic>Provided,</italic></proviso> That of the total amount provided under this heading in this Act, $13,772,460,000 shall be for the Ukraine Security Assistance Initiative: <proviso><italic>Provided further,</italic></proviso> That such funds for the Ukraine Security Assistance Initiative shall be available to the Secretary of Defense under the same terms and conditions as are provided for under this heading in the Additional Ukraine Supplemental Appropriations Act, 2023 (division M of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>), and shall be available notwithstanding section 8135 of the Department of Defense Appropriations Act, 2023 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) or any similar provision in any other Act making appropriations for the Department of Defense: <proviso><italic>Provided further,</italic></proviso> That of the total amount provided under this heading in this Act, up to $4,400,000,000, to remain available until September 30, 2025, may be transferred to accounts under the headings <quote>Operation and Maintenance</quote>, <quote>Procurement</quote>, and <quote>Revolving and Management Funds</quote> for replacement, through new procurement or repair of existing unserviceable equipment, of defense articles from the stocks of the Department of Defense, and for reimbursement for defense services of the Department of Defense and military education and training, provided to or identified for provision to the Government of Israel or to foreign countries that have provided support to Israel at the request of the United States: <proviso><italic>Provided further,</italic></proviso> That up to $13,414,432,000, to remain available until September 30, 2025, may be transferred to accounts under the headings <quote>Operation and Maintenance</quote>, <quote>Procurement</quote>, and <quote>Revolving and Management Funds</quote> for replacement, through new procurement or repair of existing unserviceable equipment, of defense articles from the stocks of the Department of Defense, and for reimbursement for defense services of the Department of Defense and military education and training, provided to or identified for <subsection commented="no" display-inline="yes-display-inline" id="H1E68BEB2EE9A4C4D9742F871F74F3D39"><enum>(a)</enum><text>Upon the determination of the Secretary of Defense that such action is necessary in the national interest, the Secretary may, with the approval of the Director of the Office of Management and Budget, transfer up to $1,000,000,000 only between the appropriations or funds made available in this title to the Department of Defense to respond to the situation in Ukraine and for related expenses: <proviso><italic>Provided,</italic></proviso> That the Secretary shall notify the Congress promptly of each transfer made pursuant to the authority in this subsection: <proviso><italic>Provided further,</italic></proviso> That such authority is in addition to any transfer authority otherwise provided by law and is subject to the same terms and conditions as the authority provided in section 8005 of the Department of Defense Appropriations Act, 2023, or any similar provision in any subsequent Act making appropriations for the Department of Defense for Fiscal Year 2024, except for monetary limitations concerning the amount of authority available.</text></subsection>

<section id="H48E947540000489594F40EE7FBAB55DA"><enum>102.</enum><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Secretary of Defense, in coordination with the Secretary of State, shall submit a report to the Committees on Appropriations, Armed Services, and Foreign Affairs of the House of Representatives and the Committees on Appropriations, Armed Services, and Foreign Relations of the Senate on measures being taken to account for United States defense articles designated for Ukraine since the February 24, 2022, Russian invasion of Ukraine, particularly measures with regard to such articles that require enhanced end-use monitoring; measures to ensure that such articles reach their intended recipients and are used for their intended purposes; and any other measures to promote accountability for the use of such articles: <proviso><italic>Provided,</italic></proviso> That such report shall include a description of any occurrences of articles not reaching their intended recipients or used for their intended purposes and a description of any remedies taken: <proviso><italic>Provided further,</italic></proviso> That such report shall be submitted in unclassified form, but may be accompanied by a classified annex. </text></section> 
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HE88818EB2C984D4AA496F2577F713DEF"><enum>103.</enum><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, and every 30 days thereafter through fiscal year 2025, the Secretary of Defense, in coordination with the Secretary of State, shall provide a written report to the Committees on Appropriations, Armed Services, and Foreign Affairs of the House of Representatives and the Committees on Appropriations, Armed Services, and Foreign Relations of the Senate describing United States security assistance provided to Ukraine since the February 24, 2022, Russian invasion of Ukraine, including a comprehensive list of the defense articles and services provided to Ukraine and the associated authority and funding used to provide such articles and services: <proviso><italic>Provided,</italic></proviso> That such report shall be submitted in unclassified form, but may be accompanied by a classified annex. </text></section>
