R. 7352</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240214">February 14, 2024</action-date><action-desc><sponsor name-id="F000476">Mr. Frost</sponsor> (for himself, <cosponsor name-id="H001066">Mr. Horsford</cosponsor>, <cosponsor name-id="K000385">Ms. Kelly of Illinois</cosponsor>, and <cosponsor name-id="M001217">Mr. Moskowitz</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit States from prohibiting or otherwise deterring the usage of any merchant category code established by the International Organization for Standardization, including codes that identify firearm merchants and ammunition merchants.</official-title></form><legis-body id="HA17DBF115EB841E48A1DA481C498C69E" style="OLC"><section id="H239E6A9FA3AC40F8B38B3911A24F4814" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Identify Gun Stores Act</short-title></quote>. </text></section><section id="H8D7B71F1CAF34271AB2DEA2F8C5C6A1D"><enum>2.</enum><header>Preemption relating to merchant category codes</header><text display-inline="no-display-inline">Section 5313 of title 31, United States Code, is amended by inserting after subsection (g) the following:</text><quoted-block style="OLC" id="HA3A901F43D484D66B240A212A2E7D35F" display-inline="no-display-inline"><subsection id="H2CEF187487A54916AFC3F2D6DCDF174E"><enum>(h)</enum><header>Merchant category code usage</header><paragraph id="H042E73826E284BA692EC9209C9D7C367"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No State may prohibit or otherwise deter the usage of any merchant category code established by the International Organization for Standardization, including codes that identify firearm merchants and ammunition merchants.</text></paragraph><paragraph id="H48359086087B4311A767DDF3AF9B85FE"><enum>(2)</enum><header>Enforcement</header><text>The Attorney General may bring a civil action in the appropriate district court to enforce this subsection. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
