which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Veterans Affairs to improve mental health care for veterans through the establishment of a minimum requirement for the number of Vet Centers per State.</official-title></form><legis-body id="HB204830ECB144FA599A15EFE87CBBF2D" style="OLC"><section id="HCEB32B58DE8A4970835519CBA15991D0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Census-Enabled National Treatment Equitable Resource Supplement for Mental Health Act of 2023</short-title></quote> or the <quote><short-title>Vet CENTERS for Mental Health Act of 2023</short-title></quote>. </text></section><section id="H5D5FAECFC2994798BCF03BAFE855D485"><enum>2.</enum><header>Minimum requirement for number of Vet Centers per State</header><subsection id="HB0FABDC080DE4BD2B51C6EA9E9553DE3" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall ensure that, by not later than one year after the date of enactment of this Act, the number of covered Vet Centers located in each State is at least the minimum required number described in subsection (b) with respect to that State.</text></subsection><subsection id="H5EA7DF74A1454D60A29D8033EB5AEDB8"><enum>(b)</enum><header>Minimum required number</header><text>The minimum required number described in this subsection is the following:</text><paragraph id="HE6AF488C00424A9A8B362EB0DAAC5025" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">With respect to each State that is one of the several States not located in the contiguous United States, the District of Columbia, the Commonwealth of Puerto Rico, or any other territory or possession of the United States that is not one of the several States, the greater of the following:</text><subparagraph id="H42AD0141B2D14BBA900E3386BEA3282C" commented="no"><enum>(A)</enum><text>One covered Vet Center per State.</text></subparagraph><subparagraph id="H2826A4D3D3244C3787DEB18896D45B24" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">The total number of covered Vet Centers that were located in the State on January 1, 2020.</text></subparagraph></paragraph><paragraph id="H0303F720B5EF4479943A341EAC3AB9F1" commented="no"><enum>(2)</enum><text>With respect to each of the several States located in the contiguous United States and not referred to in paragraph (1), the greater of the following:</text><subparagraph id="HFD071DA216994F0FA464025964C311E6" commented="no"><enum>(A)</enum><text>One covered Vet Center per every 30,000 square miles of land area in the State.</text></subparagraph><subparagraph id="H3A4BEC3CBD7C424AAEA036474FC45D3F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">One covered Vet Center per every 55,000 veterans located in the State (calculated by using the number of veterans in the State as determined by the Director of the United States Census Bureau for the most recent census).</text></subparagraph></paragraph></subsection><subsection id="H5E99CAC7934542DFB89F6A5AE8EDCBDB"><enum>(c)</enum><header>Establishment of additional Vet Centers</header><paragraph id="H937A846F82A04A858D498AF51C3ACE96"><enum>(1)</enum><header>In general</header><text>In carrying out subsection (a), the Secretary shall establish such additional covered Vet Centers in each State as may be necessary to meet the minimum required number described in subsection (b) with respect to the State. </text></paragraph><paragraph id="HAF3E3B0565074C85931C9F3481333D9C" commented="no"><enum>(2)</enum><header>Existing facilities</header><text>In establishing additional covered Vet Centers pursuant to paragraph (1), the Secretary may establish such covered Vet Centers at facilities made available to the Secretary by the head of a State, local government, or federally recognized Indian tribe to carry out this section, regardless of whether such facility is made available at a cost to the Secretary.</text></paragraph><paragraph id="H7425FEE09D194A549B43F6AD4BF37B6A"><enum>(3)</enum><header>Vet Center outstations</header><text display-inline="yes-display-inline">If the establishment of more than one additional covered Vet Center in a State is necessary to meet the minimum required number described in subsection (b) with respect to the State, the Secretary—</text><subparagraph id="H8B14076EAE324B1D83470C9E1EA23B32"><enum>(A)</enum><text>shall establish at least one additional covered Vet Center to meet such number; and</text></subparagraph><subparagraph id="H911BAFDDE8094F869F2C2F49E806F92F"><enum>(B)</enum><text>for each remaining covered Vet Center necessary to meet such number, may establish a covered Vet Center outstation in lieu of a covered Vet Center.</text></subparagraph></paragraph></subsection><subsection id="H2B1B64BB617649CF8686DF388AB080EC"><enum>(d)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="HADDA1EF33E3349AE8680DD9955131C5F"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>covered Vet Center</quote> means a Vet Center, as such term is defined in section 1712A of title 38, United States Code, that is scheduled to be open for the provision of services under such section for a minimum of eight hours per day during five days of the week, except that the Vet Center may be open for less than such minimum on a temporary basis as a result of a Federal holiday, weather concern, safety concern, pandemic, or for such other reasons as may be determined appropriate by the Secretary.</text></paragraph><paragraph id="H727D7ECA23E7430AB424D0BD0B095E8D"><enum>(2)</enum><text>The term <quote>covered Vet Center outstation</quote> means a Vet Center outstation that—</text><subparagraph id="H007BC0A57B1F4D4AA96BA8BFDEDE9F58" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">provides similar child care services as the child care services provided at a Vet Center; and</text></subparagraph><subparagraph id="H35EFB377CCAC4823B1E971346E18B8F6"><enum>(B)</enum><text>is scheduled to be open in accordance with the minimum hours and days specified in paragraph (1).</text></subparagraph></paragraph><paragraph id="H44D5F8C3920542C4A75C0BC4E2C71419"><enum>(3)</enum><text>The term <quote>State</quote> has the meaning given such term in section 101 of title 38, United States Code. </text></paragraph></subsection></section></legis-body></bill>
