which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for a pilot program to accord lawful permanent residence.</official-title></form><legis-body id="H5EC713032D414B1E859FCBDDF0DEFE39" style="OLC"><section id="HD6BFA7F710E34D85B67B42E9819C3A7B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Courage to Serve Act of 2024</short-title></quote>.</text></section><section id="HDF82442AF20247D9A363CA9B4C700F76"><enum>2.</enum><header>Pilot program</header><subsection id="HED3C0D7439AE46E988D002B07053F21A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security, in coordination with the Secretary of Defense, shall establish a pilot program (hereinafter in this Act referred to as <quote>the program</quote>) to provide for an expedited process for adjustment of status for certain aliens. </text></subsection><subsection id="HCAAAF018D5B54169A191F8F1CD31C5CA"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">An alien is eligible to participate in the program if the alien—</text><paragraph id="H7B6EC670824B40638E87F71B98E83CCC"><enum>(1)</enum><text>successfully completes a background investigation conducted by the Federal Bureau of Investigation;</text></paragraph><paragraph id="H2CB755BA03DA4E5D8FCCC49A6CF755A4"><enum>(2)</enum><text>submits an application for participation in the program at such time, in such form, and including such information as the Secretary may by rule require; and</text></paragraph><paragraph id="HACA56019269D40759331AC2C07952D8A"><enum>(3)</enum><text display-inline="yes-display-inline">as of the date of application to the program—</text><subparagraph id="H3709289B849A434EA1CC8F8C400443E8"><enum>(A)</enum><text>has—</text><clause id="HB677CC0BD8D24BA0A5D2D787C4C91FFF"><enum>(i)</enum><text>no lawful status under the immigration laws; or</text></clause><clause id="H70DFAD2EE7764304A45E2480EAF6484A"><enum>(ii)</enum><text>temporary protected status under section 244 of the Immigration and Nationality Act;</text></clause></subparagraph><subparagraph id="H3AED74572C884A8AAC0D775B54B3DF8A"><enum>(B)</enum><text>is not inadmissible to the United States; and</text></subparagraph><subparagraph id="H1F30A0319D7342AF8E32F23688FEA385"><enum>(C)</enum><text>is otherwise eligible for enlistment in the Armed Forces.</text></subparagraph></paragraph></subsection><subsection id="H3D675FF96EF94F65AF8F687158BFB019"><enum>(c)</enum><header>Expedited process</header><text>In the case of a participant in the program, the following shall apply:</text><paragraph id="H4DC9CEB8C03A4EAF9EAD3B652ACFD475"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than 180 days after the date of enlistment in the Armed Forces, the participant shall submit an application for adjustment of status to that of an alien lawfully admitted for permanent residency, at such time, in such form, and including such information as the Secretary may by rule require.</text></paragraph><paragraph id="HB3C97DC8BE4B4561AC463721D636D170"><enum>(2)</enum><text>The Secretary shall provide technical assistance with the preparation of an application referred to under paragraph (1).</text></paragraph><paragraph id="H0A7FEC24D3A94DC8B2D1439CB47F2EB1"><enum>(3)</enum><text display-inline="yes-display-inline"> If the alien completes 3 years of honorable service in the Armed Forces or if the alien completes 1 year of honorable service in an active-duty status in the Armed Forces or if the alien completes 30-days of honorable service in a designated combat zone, the Secretary shall provide expedited consideration of such an application.</text></paragraph></subsection><subsection id="H1FA96E2346D540E89C6A12FF38E6202C"><enum>(d)</enum><header>Not subject to numerical limitations</header><text display-inline="yes-display-inline">An alien whose status is adjusted to that of an alien lawfully admitted for permanent residency under this section is not subject to the worldwide levels or numerical limitations of section 201(a) of the Immigration and Nationality Act.</text></subsection><subsection id="HB1B1BA996CFF400287FF893C3C6BC7CA"><enum>(e)</enum><header>Status during participation</header><text>A participant in the program may not be detained under the immigration laws, and no removal proceeding may be commenced or continued against such participant.</text></subsection><subsection id="H3670B15E948E4075BB17E2C9B68ECBC5"><enum>(f)</enum><header>Effect on other immigration benefits</header><text>Nothing in this Act may be construed to provide that application to or participation in the program precludes an alien from applying for asylum or parole.</text></subsection></section><section id="H833C64D24E2D48E0BEE10B3DB8D36811"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text><paragraph id="HE67536D7C9B1450E9F2AA0C208BF0940"><enum>(1)</enum><text>Terms used have the meanings given such terms in section 101 of the Immigration and Nationality Act.</text></paragraph><paragraph id="HAC16D310D8394FDC9E5DFA26BF62F634"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>Armed Forces</term> means the Army, Navy, Marine Corps, Space Force, and Air Force, including the reserve components.</text></paragraph><paragraph id="HA6148D78176941C18FE683584433EDC1"><enum>(3)</enum><text>The term <term>Secretary</term> means the Secretary of Homeland Security. </text></paragraph></section></legis-body></bill>
