this Act are—</text><paragraph id="H50412922DB36495D98C9F22F731766E4"><enum>(1)</enum><text>to establish a Truth and Healing Commission on Indian Boarding School Policies in the United States, including other necessary advisory committees and subcommittees;</text></paragraph><paragraph id="HD982B80DAE4B4F3896DD3F4F1F8C4ABD"><enum>(2)</enum><text>to formally investigate, document, and report on the histories of Indian Boarding Schools, Indian Boarding School Polices, and the systematic and long-term effects of those schools and policies on Native American peoples;</text></paragraph><paragraph id="H284E205D0C844F868EDC6E2692C095E0"><enum>(3)</enum><text>to develop recommendations for Federal participation based on the findings of the Commission; and</text></paragraph><paragraph id="HD37182385E304D35BD0CE8DBF2EF46C2"><enum>(4)</enum><text>to promote healing for survivors of Indian Boarding Schools, the descendants of those survivors, and the communities of those survivors.</text></paragraph></section><section id="HB950BFE20A6B47CF9DFE4EBF3C416BAF"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H6AE3EFEB79BB426D8115DD4FD0070950"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Truth and Healing Commission on Indian Boarding School Policies in the United States established by section 101(a).</text></paragraph><paragraph id="H6CCA934151B14CDE8D53B9273DF236EF"><enum>(2)</enum><header>Federal truth and healing advisory committee</header><text>The term <term>Federal Truth and Healing Advisory Committee</term> means the Federal Truth and Healing Advisory Committee established by section 211(a).</text></paragraph><paragraph id="H13D54C8054C849349BE90C2830C0942B"><enum>(3)</enum><header>Indian</header><text>The term <term>Indian</term> has the meaning given the term in section 6151 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7491">20 U.S.C. 7491</external-xref>).</text></paragraph><paragraph id="H27805F28DC1B43C7BB5C8D7765CC4D30"><enum>(4)</enum><header>Indian boarding school</header><text>The term <term>Indian Boarding School</term> means—</text><subparagraph id="H83682961A3AA4E2E8F21E9EA8FD822D8"><enum>(A)</enum><text>a site of an institution that—</text><clause id="H99236E10654B4C9688AE52A28FC67D99"><enum>(i)</enum><text>provided on-site housing or overnight lodging;</text></clause><clause id="H90ECEC314D134078A348377084BD847E"><enum>(ii)</enum><text>was described in Federal records as providing formal academic or vocational training and instruction to American Indians, Alaska Natives, or Native Hawaiians;</text></clause><clause id="H67F92351F84D4DC9B166E9A4E65C4CF9"><enum>(iii)</enum><text>received Federal funds or other Federal support; and</text></clause><clause id="H775B4EF05C494885AF209F9CFBA69ABA"><enum>(iv)</enum><text>was operational before 1969;</text></clause></subparagraph><subparagraph id="H31DAC12989934826B1996582991D1A0B"><enum>(B)</enum><text>a site of an institution identified by the Department of the Interior in appendices A and B of the report entitled <quote>Federal Indian Boarding School Initiative Investigative Report</quote> and dated May 2022 (or a successor report); or</text></subparagraph><subparagraph id="H761C3FF4F6C3414FACE7762394A04E8D"><enum>(C)</enum><text>any other institution that implemented Indian Boarding School Policies, including an Indian day school.</text></subparagraph></paragraph><paragraph id="H8D956F98E3C94F1E8CC32E887AB4E7A6"><enum>(5)</enum><header>Indian boarding school policies</header><text>The term <term>Indian Boarding School Policies</term> means Federal laws, policies, and practices purported to <quote>assimilate</quote> and <quote>civilize</quote> Indians, Alaska Natives, and Native Hawaiians that included psychological, physical, sexual, and mental abuse, forced removal from home or community, and identity-altering practices intended to terminate Native languages, cultures, religions, social organizations, or connections to traditional land.</text></paragraph><paragraph id="HE2D78A49BCA64A529A8AA723656ABBC6"><enum>(6)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="HC6277F16BA3145839367C2D4C2CC8D70"><enum>(7)</enum><header>Native american</header><text>The term <term>Native American</term> means an individual who is—</text><subparagraph id="H7F9D7F458352488F9A61F4B2066EB24F"><enum>(A)</enum><text>an Indian; or</text></subparagraph><subparagraph id="H7D73502750DB479FB830548B32F14A54"><enum>(B)</enum><text>a Native Hawaiian.</text></subparagraph></paragraph><paragraph id="HC2FE35BA3A73483998FD6FB3161B04F0"><enum>(8)</enum><header>Native american truth and healing advisory committee</header><text>The term <term>Native American Truth and Healing Advisory Committee</term> means the Native American Truth and Healing Advisory Committee established by the Commission under section 201(a).</text></paragraph><paragraph id="HDC28EDDB21D3455B81C4ECCB980DEA7F"><enum>(9)</enum><header>Native hawaiian</header><text>The term <term>Native Hawaiian</term> has the meaning given the term in section 6207 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>).</text></paragraph><paragraph id="H489F70597B414A00B6DE30CE6D9B486B"><enum>(10)</enum><header>Native hawaiian organization</header><text>The term <term>Native Hawaiian organization</term> means a private nonprofit organization that—</text><subparagraph id="HE934B2B3E5D74515BDA75A8486C5BC99"><enum>(A)</enum><text>serves and represents the interests of Native Hawaiians;</text></subparagraph><subparagraph id="H24FF1A23A322454B8D369A317BD93066"><enum>(B)</enum><text>has as its primary and stated purpose the provision of services to Native Hawaiians;</text></subparagraph><subparagraph id="HFD118C5D3861449CAFC1CE0F00B0D687"><enum>(C)</enum><text>has Native Hawaiians serving in substantive and policymaking positions; and</text></subparagraph><subparagraph id="H430563B7DFBB47E1A112EC8CC1D8724A"><enum>(D)</enum><text>has expertise in Native Hawaiian affairs.</text></subparagraph></paragraph><paragraph id="HAD3583197FA44FDD808011812E18465E"><enum>(11)</enum><header>Office of hawaiian affairs</header><text>The term <term>Office of Hawaiian Affairs</term> has the meaning given the term in section 6207 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>).</text></paragraph><paragraph id="H2684002A0F234FD1AB862B34D591B210"><enum>(12)</enum><header>Survivors truth and healing subcommittee</header><text>The term <term>Survivors Truth and Healing Subcommittee</term> means the Survivors Truth and Healing Subcommittee established by section 121(a).</text></paragraph><paragraph id="H244603E3B6304057AF9466AA790086E6"><enum>(13)</enum><header>Trauma-informed care</header><text>The term <term>trauma-informed care</term> means holistic psychological and health care practices that include promoting culturally responsive practices, patient psychological, physical, and emotional safety, and environments of healing, trust, peer support, and recovery.</text></paragraph><paragraph id="H039A07AE419243A59F67E7C97D4E4733"><enum>(14)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph></section><title id="H75589088627042B4B3ECC0F1C55B244B"><enum>I</enum><header>COMMISSION AND SUBCOMMITTEES</header><subtitle id="HA42243E4DB9545FA87CE0531B3192BD6"><enum>A</enum><header>Truth and Healing Commission on Indian Boarding School Policies in the United States</header><section id="HEB05B52C84D64FBF9CD03ABB8EB43815"><enum>101.</enum><header>Truth and Healing Commission on Indian Boarding School Policies in the United States</header><subsection id="H20BB438A356A4D1CA35C7F97BE724064"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the legislative branch a commission, to be known as the <quote>Truth and Healing Commission on Indian Boarding School Policies in the United States</quote>.</text></subsection><subsection id="H43012D75774E40FB9F0D1873D4CD6CCC"><enum>(b)</enum><header>Membership</header><paragraph id="H36A064BB3F9543BDB9292658FB48E341"><enum>(1)</enum><header>Membership</header><subparagraph id="H568F5CEED0064412BBBA9295AB062FBB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall include 5 members, to be jointly appointed by the Speaker of the House of Representatives, the Majority Leader of the Senate, and the Minority Leaders of the House of Representatives and the Senate, in consultation with the Chairperson and Vice Chairperson of the Committee on Indian Affairs of the Senate and the Chair and ranking minority member of the Committee on Natural Resources of the House of Representatives, from among the nominees submitted under paragraph (2)(A), of whom—</text><clause id="H599DE9961763401D933E00AFE243D330"><enum>(i)</enum><text>1 shall be an individual with extensive experience and expertise as a principal investigator overseeing or leading complex research initiatives with and for Indian Tribes and Native Americans;</text></clause><clause id="H282FEB26A42B40038CF1E2312776B802"><enum>(ii)</enum><text>1 shall be an individual (barred in good standing) with extensive experience and expertise in the area of indigenous human rights law and policy, including overseeing or leading broad-scale investigations of abuses of indigenous human rights;</text></clause><clause id="HA2D5B1D5AA8547589E6DF7CFCAAE4851"><enum>(iii)</enum><text>1 shall be an individual with extensive experience and expertise in Tribal court judicial and restorative justice systems and Federal agencies, such as participation as a Tribal judge, researcher, or former presidentially appointed commissioner;</text></clause><clause id="HBB9D3AAA46A74FC0AC57834C38FBACAB"><enum>(iv)</enum><text>1 shall be an individual with extensive experience and expertise in providing and coordinating trauma-informed care and other health-related services to Indian Tribes and Native Americans; and</text></clause><clause id="H635E4EDABC604871AE2D9D4D3B7E5462"><enum>(v)</enum><text>1 shall be a Native American individual recognized as a traditional cultural authority by their respective Native community.</text></clause></subparagraph><subparagraph id="H22331493409B401780FE0061C87A4B7F"><enum>(B)</enum><header>Additional requirements for membership</header><text>In addition to the requirements described in subparagraph (A), each member of the Commission shall be a person of recognized integrity and empathy, with a demonstrated commitment to the values of truth, reconciliation, healing, and expertise in truth and healing endeavors that are traditionally and culturally appropriate so as to provide balanced points of view and expertise with respect to the duties of the Commission.</text></subparagraph></paragraph><paragraph id="H1DA1AAC8CC7F4C1AAB2A91B55E797002"><enum>(2)</enum><header>Nominations</header><subparagraph id="HEA7B812001AC4B0491E9585BB8404802"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, Indian Tribes, Tribal organizations, Native Americans, the Office of Hawaiian Affairs, and Native Hawaiian organizations may submit to the Secretary of the Interior nominations for individuals to be appointed to the Commission.</text></subparagraph><subparagraph id="H42EEF230E4674ACC81BBAF114560AC4B"><enum>(B)</enum><header>Native american preference</header><text>Individuals nominated under subparagraph (A) who are Native American shall receive a preference in the selection process for appointment to the Commission under paragraph (1).</text></subparagraph><subparagraph id="HE04072CBB43243CABF26FFA98AD25BC1"><enum>(C)</enum><header>Submission to congress</header><text>Not later than 7 days after the submission deadline for nominations described in subparagraph (A), the Secretary of the Interior shall submit to Congress a list of the individuals nominated under that subparagraph.</text></subparagraph></paragraph><paragraph id="H6261C61959B84B638B8AD9929EC823BC"><enum>(3)</enum><header>Date</header><text>Members of the Commission under paragraph (1) shall be appointed not later than 180 days after the date of the enactment of this Act.</text></paragraph><paragraph id="H2E5F9EE32B2640DB9747BA688C2A8D23"><enum>(4)</enum><header>Period of appointment; vacancies; removal</header><subparagraph id="HBE232EADC7DE4E5BAD8B281451556E47"><enum>(A)</enum><header>Period of appointment</header><text>A member of the Commission shall be appointed for a term that is the shorter of—</text><clause id="HC027AAC3A2C34BE5A770C8C0D83B3728"><enum>(i)</enum><text>6 years; and</text></clause><clause id="H210CCD69D0BD4F65B8DFF6EB96BD0039"><enum>(ii)</enum><text>the life of the Commission.</text></clause></subparagraph><subparagraph id="H12FE2C6CF5A5460082FE1BDBCF185CCD"><enum>(B)</enum><header>Vacancies</header><text>After all initial members of the Commission are appointed and the initial business meeting of the Commission has been convened under subsection (c)(1), a single vacancy in the Commission—</text><clause id="HF4406951B2E94A86984285315C39AE51"><enum>(i)</enum><text>shall not affect the powers of the Commission; and</text></clause><clause id="HA4732371E7FB4129914DE7182F85820C"><enum>(ii)</enum><text>shall be filled within 90 days in the same manner as was the original appointment.</text></clause></subparagraph><subparagraph id="H4CA68D9180464F169E308CB06EF77BF8"><enum>(C)</enum><header>Removal</header><text>A quorum of members of the Commission may remove a member of the Commission only for neglect of duty or malfeasance.</text></subparagraph></paragraph><paragraph id="HEF544F9823BA492B9C148DD2B08A4270"><enum>(5)</enum><header>Termination</header><text display-inline="yes-display-inline">The Commission shall terminate 6 years after the date of the enactment of this Act.</text></paragraph><paragraph id="H0DBCA7ACEE3E42BE891467370F921010"><enum>(6)</enum><header>Limitation</header><text>No member of the Commission shall be an officer or employee of the Federal Government.</text></paragraph></subsection><subsection id="H6C51E3A1837248B9852A50EB183543EE"><enum>(c)</enum><header>Business meetings</header><paragraph id="HADF41F1D148B4D98AAC8C0FDC54C6960"><enum>(1)</enum><header>Initial business meeting</header><text>90 days after the date on which all of the members of the Commission are appointed under subsection (b)(1)(A), the Commission shall hold the initial business meeting of the Commission—</text><subparagraph id="H570146EE16704235A38482803687CE80"><enum>(A)</enum><text>to appoint a Chairperson, a Vice Chairperson, and such other positions as determined necessary by the Commission;</text></subparagraph><subparagraph id="H6F5CE99D5C67433DB14C6B0BC450E021"><enum>(B)</enum><text>to establish rules for meetings of the Commission; and</text></subparagraph><subparagraph id="HA1A25CD137E94C658DE3629B6991F89E"><enum>(C)</enum><text>to appoint members of—</text><clause id="H05F98745A8D74735AA875783E75C5286"><enum>(i)</enum><text>the Survivors Truth and Healing Subcommittee under section 121(b)(1); and</text></clause><clause id="H621B1CC1B458430CA2CE1C32121C2EDC"><enum>(ii)</enum><text>the Native American Truth and Healing Advisory Committee under section 201(b)(1).</text></clause></subparagraph></paragraph><paragraph id="HA71003804A96479C88B59722E550E378"><enum>(2)</enum><header>Subsequent business meetings</header><text>After the initial business meeting of the Commission is held under paragraph (1), the Commission shall meet at the call of the Chairperson.</text></paragraph><paragraph id="H70CD6ACCB2F9435B80EBC06CC8D60B3E"><enum>(3)</enum><header>Advisory and subcommittee committees designees</header><text>Each Commission business meeting shall include participation by 2 non-voting designees from each of the Survivors Truth and Healing Subcommittee, the Native American Truth and Healing Advisory Committee, and the Federal Truth and Healing Advisory Committee, as appointed in accordance with section 121(c)(1)(D), section 201(e)(1)(C), and section 211(c)(1)(B), as applicable.</text></paragraph><paragraph id="H29869BAF89224ADB81965BE2B4CE8330"><enum>(4)</enum><header>Format of meetings</header><text>A business meeting of the Commission may be conducted in-person or virtually.</text></paragraph><paragraph id="H2A1011A9EC144D6C9881DD517ABC55DE"><enum>(5)</enum><header>Quorum required</header><text>A business meeting of the Commission may be held only once after a quorum, established in accordance with subsection (d), is present.</text></paragraph></subsection><subsection id="HC34410D351F74DA5B549D3BA1B63AD19"><enum>(d)</enum><header>Quorum</header><text>A simple majority of the members of the Commission present shall constitute a quorum for a business meeting.</text></subsection><subsection id="HC0CA8735A60F463DA360AAC68F068B00"><enum>(e)</enum><header>Rules</header><text>The Commission may establish, by a majority vote, any rules for the conduct of Commission business, in accordance with this section and other applicable law.</text></subsection><subsection id="H1DD2714716D043C093EB4A3552C4815F"><enum>(f)</enum><header>Commission personnel matters</header><paragraph id="H50F39E6D45D34308A20695A8FAF3DCAC"><enum>(1)</enum><header>Compensation of commissioners</header><text>A member of the Commission shall be compensated at a daily equivalent of the annual rate of basic pay prescribed for grade 14 of the General Schedule under section 5332 of title 5, United States Code, for each day, not to exceed 14 days per month, for which a member is engaged in the performance of their duties under this Act, limited to convening meetings, including public or private meetings to receive testimony in furtherance of the duties of the Commission and the purposes of this Act.</text></paragraph><paragraph id="H9E321C1100374A3686B6E3EF29062BCC"><enum>(2)</enum><header>Travel expenses</header><text>A member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission.</text></paragraph><paragraph id="HDC5F421C007E4852BD3DE27DB0C3ED7D"><enum>(3)</enum><header>Detail of government employees</header><text>Any Federal Government employee, with the approval of the head of the appropriate Federal agency and at the request of the Commission, may be detailed to the Commission without—</text><subparagraph id="H29B40956F0D0435F83249695FE6492A8"><enum>(A)</enum><text>reimbursement to the agency of that employee; and</text></subparagraph><subparagraph id="HD040D17E5A3749DCB571B18E8AAB37C8"><enum>(B)</enum><text>interruption or loss of civil service status, benefits, or privileges.</text></subparagraph></paragraph></subsection><subsection id="HBABC69BB57FA47298A25EF343633B8A8"><enum>(g)</enum><header>Powers of commission</header><paragraph id="H066E1AF0EBFB44B68FA3A934FFE9E57B"><enum>(1)</enum><header>Hearings and evidence</header><text>The Commission may, for the purpose of carrying out this Act—</text><subparagraph id="H49C0E3676A24485CACFBF8DE0137E879"><enum>(A)</enum><text>hold such hearings and sit and act at such times and places, take such testimony, and receive such evidence, virtually or in-person, as the Commission may determine necessary to accomplish the purposes of this Act;</text></subparagraph><subparagraph id="H0A105AB3FE3D4C848F90E8280FB1AAD5"><enum>(B)</enum><text>conduct or request such interdisciplinary research, investigation, or analysis of such information and documents, records, or other evidence as the Commission may determine necessary to accomplish the purposes of this Act, including—</text><clause id="H3A232678AC1046E6912E7FE8716FAD2F"><enum>(i)</enum><text>securing, directly from a Federal agency, such information as the Commission considers necessary to accomplish the purposes of this Act; and</text></clause><clause id="HF54FADAB12A246469F998759A7DEA22F"><enum>(ii)</enum><text>requesting the head of any relevant Tribal or State agency to provide to the Commission such information as the Commission considers necessary to accomplish the purposes of this Act;</text></clause></subparagraph><subparagraph id="HF3BB668590CB499CA74CB4940D1833B3"><enum>(C)</enum><text>subject to paragraphs (1) and (2) of subsection (i), require, by subpoena or otherwise, the production of such records, papers, correspondence, memoranda, documents, books, videos, oral histories, recordings, or any other paper or electronic material, as the Commission may determine necessary to accomplish the purposes of this Act;</text></subparagraph><subparagraph id="HCAAF0705BDC240DB83AAC0D65EB5906F"><enum>(D)</enum><text>oversee, direct, and collaborate with the Federal Truth and Healing Advisory Committee, the Native American Truth and Healing Advisory Committee, and the Survivors Truth and Healing Subcommittee to accomplish the purposes of this Act; and</text></subparagraph><subparagraph id="H872AA79CC5D04388B2C806C5DF592D5C"><enum>(E)</enum><text>coordinate with Federal and non-Federal entities to preserve and archive, as appropriate, any gifts, documents, or other property received while carrying out the purposes of this Act.</text></subparagraph></paragraph><paragraph id="H9D21C4823E244DC6A08F171C6AF3EC1A"><enum>(2)</enum><header>Contracting; volunteer services</header><subparagraph id="HA979D443CDC640D9ADCE9A258B4F3B3C"><enum>(A)</enum><header>Contracting</header><text>The Commission may, to such extent and in such amounts as are provided in appropriations Acts, and in accordance with applicable law, enter into contracts and other agreements with public agencies, private organizations, and individuals to enable the Commission to carry out the duties of the Commission under this Act.</text></subparagraph><subparagraph id="H850AA55BE4FD4A62A37688934C317A58"><enum>(B)</enum><header>Volunteer and uncompensated services</header><text>Notwithstanding section 1342 of title 31, United States Code, the Commission may accept and use such voluntary and uncompensated services as the Commission determines to be necessary.</text></subparagraph><subparagraph id="H3D09BB5A50024E879EE08ADAF6C7E1E2"><enum>(C)</enum><header>General services administration</header><text>The Administrator of General Services shall provide, on request of the Commission, on a reimbursable basis, administrative support and other services for the performance of the functions of the Commission under this Act.</text></subparagraph></paragraph><paragraph id="H24FAB76B1AA64C06A2309247F1EA7C92"><enum>(3)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other agencies of the Federal Government.</text></paragraph><paragraph id="H542FBD07AA58418383B5BD57275F6614"><enum>(4)</enum><header>Gifts, fundraising, and disbursement</header><subparagraph id="H94DA316CA5B242B291B4FF261F2900BC"><enum>(A)</enum><header>Gifts and donations</header><clause id="H0EC67F4C51E54471AC86F72158111114"><enum>(i)</enum><header>In general</header><text>The Commission may accept, use, and dispose of any gift, donation, service, property, or other record or recording to accomplish the purposes of this Act.</text></clause><clause id="H43A44B9192B04148B89E0071F53C2FD2"><enum>(ii)</enum><header>Return of gifts and donations</header><text>On termination of the Commission under subsection (b)(5), any gifts, unspent donations, property, or other record or recording accepted by the Commission under clause (i) shall be—</text><subclause id="HCE318FE107634229BDC6CE42BF99BC63"><enum>(I)</enum><text>returned to the donor that made the donation under that clause; or</text></subclause><subclause id="HE86DB3A7D35F4A4F9706A213CE40696B"><enum>(II)</enum><text>archived under subparagraph (E).</text></subclause></clause></subparagraph><subparagraph id="H3F8DD9C5486B4EF395E30809DC0270F9"><enum>(B)</enum><header>Fundraising</header><text>The Commission may, on the affirmative vote of <fraction>3⁄5</fraction> of the members of the Commission, solicit funds to accomplish the purposes of this Act.</text></subparagraph><subparagraph id="H86DA44C52376493EA2C05DFAD1AA77BC"><enum>(C)</enum><header>Disbursement</header><text>The Commission may, on the affirmative vote of <fraction>3⁄5</fraction> of the members of the Commission, approve the expenditure of funds to accomplish the purposes of this Act.</text></subparagraph><subparagraph id="HAD0611E5B0724AC0915938A9915658B2"><enum>(D)</enum><header>Tax documents</header><text>The Commission (or a designee) shall, on request of a donor under subparagraph (A) or (B), provide tax documentation to that donor for any tax-deductible gift made by that donor under those subparagraphs.</text></subparagraph><subparagraph id="HD751B929F1B64166AB1C7C6BA5BFB45D"><enum>(E)</enum><header>Archiving</header><text>The Commission shall coordinate with the Library of Congress and the Smithsonian Institution to archive and preserve relevant gifts or donations received under subparagraph (A) or (B).</text></subparagraph></paragraph></subsection><subsection id="H0E0682224F3B4359ADEA91E1CFBF3D79"><enum>(h)</enum><header>Convening</header><paragraph id="HE7972C5CF3F54364A628411A6C77756E"><enum>(1)</enum><header>Convening protocol</header><subparagraph id="H18044616B2284A9E9D990BC445DB6DD6"><enum>(A)</enum><header>In general</header><text>Not later than 45 days after the initial business meeting of the Native American Truth and Healing Advisory Committee, the Commission, 3 designees from the Native American Truth and Healing Advisory Committee, and 3 designees from the Survivors Truth and Healing Subcommittee shall hold a meeting to recommend rules, protocols, and formats for convenings carried out under this subsection.</text></subparagraph><subparagraph id="H7D9D71AEB91E48E69D1446ADDA8DE072"><enum>(B)</enum><header>Rules and protocols</header><text>Not later than 45 days after the initial meeting described in subparagraph (A), the Commission shall finalize rules, protocols, and formats for convenings carried out under this subsection by a <fraction>3⁄5</fraction> majority in attendance at a meeting of the Commission.</text></subparagraph><subparagraph id="HB9B1FD65711F49FF9EF833368217FBBA"><enum>(C)</enum><header>Additional meetings</header><text>The Commission and designees described in subparagraph (A) may hold additional meetings, as necessary, to amend, by a <fraction>3⁄5</fraction> majority in attendance at a meeting of the Commission, the rules, protocols, and formats for convenings established under that subparagraph.</text></subparagraph></paragraph><paragraph id="H68FD4B7688D94892A2594D8589C2B982"><enum>(2)</enum><header>Announcement of convenings</header><text>Not later than 30 days before the date of a convening under this subsection, the Commission shall announce the location and details of the convening.</text></paragraph><paragraph id="H4821E9D1BCBE40CB8E2B41D6D05A3B62"><enum>(3)</enum><header>Minimum number of convenings</header><text>The Commission shall hold—</text><subparagraph id="H50FDC20ADAFB4651820B7FED7D760E1E"><enum>(A)</enum><text>not fewer than 1 convening in each of the 12 regions of the Bureau of Indian Affairs and in Hawai’i during the life of the Commission; and</text></subparagraph><subparagraph id="H6ADE7F5FADE84BE18959A5115BC36C5A"><enum>(B)</enum><text>beginning 1 year after the date of the enactment of this Act, not fewer than 1 convening in each quarter to receive testimony each calendar year until the date on which the Commission submits the final report of the Commission under section 111(e)(3).</text></subparagraph></paragraph><paragraph id="H16C320B8CF344D8E9F787524E56022EF"><enum>(4)</enum><header>Opportunity to provide testimony</header><text>No person or entity shall be denied the opportunity to provide relevant testimony at a convenings held under this subsection, except at the discretion of the Chairperson of the Commission (or a designee).</text></paragraph></subsection><subsection id="HA8EEA209624646DF9B70B635FD40BC81"><enum>(i)</enum><header>Subpoenas</header><paragraph id="HC08E81F522724C62810C3953A46454E6"><enum>(1)</enum><header>In general</header><subparagraph id="HFD2E88A596E34E23A2072676F7D1FEBA"><enum>(A)</enum><header>Issuance of subpoenas</header><clause id="HA8982B15344B435586AB264BB60FD428"><enum>(i)</enum><header>In general</header><text>If a person fails to supply information requested by the Commission, the Commission may, on a unanimous vote of the Commission, issue a subpoena requiring from a person the production of any written or recorded evidence necessary to carry out the duties of the Commission under section 111.</text></clause><clause id="H8AD756A33E7743308375043CA27B8507"><enum>(ii)</enum><header>Notification</header><subclause id="H158A8F97056D4D45BFF9D820BCAEC447"><enum>(I)</enum><header>In general</header><text>Not later than 10 days before the date on which the Commission issues a subpoena under clause (i), the Commission shall submit to the Attorney General a confidential, written notice of the intent to issue the subpoena.</text></subclause><subclause id="H0514237A1E044537894D9561318FE377"><enum>(II)</enum><header>Subpoena prohibited by attorney general</header><item id="H38427B0B79E044809CC0D6068D06F195"><enum>(aa)</enum><header>In general</header><text>The Attorney General, on receiving a notice under subclause (I), may, on a showing of a procedural or substantive defect, and after the Commission has a reasonable opportunity to cure, prohibit the issuance of the applicable subpoena described in that notice.</text></item><item id="H952F6E50D5AD47F2970AD4F37425F0FC"><enum>(bb)</enum><header>Notification to congress</header><text>On prohibition of the issuance of a subpoena under item (aa), the Attorney General shall submit to Congress a report detailing the reasons for that prohibition.</text></item></subclause></clause></subparagraph><subparagraph id="H6B99466E734041DE8E4649EF446DB652"><enum>(B)</enum><header>Production of evidence</header><text>The production of evidence may be required from any place within the United States.</text></subparagraph></paragraph><paragraph id="H92EE1A16F0F0490D9B07CE59859DD120"><enum>(2)</enum><header>Failure to obey a subpoena</header><subparagraph id="HD5A8ADA0F5B546B4B06CBCE895CF4152"><enum>(A)</enum><header>Order from a district court of the united states</header><text>If a person does not obey a subpoena issued under paragraph (1), the Commission is authorized to apply to a district court of the United States described in subparagraph (B) for an order requiring that person to comply with the subpoena.</text></subparagraph><subparagraph id="H7FA0E43ACA564C6BAC1DA67456EA96D9"><enum>(B)</enum><header>Location</header><text>An application under subparagraph (A) may be made within the judicial district where the person described in that subparagraph resides or transacts business.</text></subparagraph><subparagraph id="H5615A8902AA145E5AE1105526172215B"><enum>(C)</enum><header>Penalty</header><text>Any failure to obey an order of a court described in subparagraph (A) may be punished by the court as a civil contempt.</text></subparagraph></paragraph><paragraph id="H0393BE037D3041C582DBA593B39769AF"><enum>(3)</enum><header>Subject matter jurisdiction</header><text>The district court of the United States in which an action is brought under paragraph (2)(B) shall have original jurisdiction over any civil action brought by the Commission to enforce, secure a declaratory judgment concerning the validity of, or prevent a threatened refusal or failure to comply with the applicable subpoena issued by the Commission.</text></paragraph><paragraph id="H5BA165AB10F54928855F2EE495998650"><enum>(4)</enum><header>Service of subpoenas</header><text>The subpoenas of the Commission shall be served in the manner provided for subpoenas issued by a district court of the United States under the Federal Rules of Civil Procedure.</text></paragraph><paragraph id="HEE4C106A79B14EAC9C207FF7DF7471B8"><enum>(5)</enum><header>Service of process</header><text>All process of any court to which an application is made under paragraph (2) may be served in the judicial district in which the person required to be served resides or transacts business.</text></paragraph></subsection><subsection id="H5D4D4BE64D704743880C0666F2ABF59B"><enum>(j)</enum><header>Federal advisory committee act applicability</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code (commonly known as the <quote>Federal Advisory Committee Act</quote>), shall not apply to the Commission.</text></subsection><subsection id="H55B26716814B472B903DEBF6A78812B9"><enum>(k)</enum><header>Congressional Accountability Act applicability</header><text>For purposes of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>)—</text><paragraph id="H3602AAE0B2E748BE894B167DDE3E8323"><enum>(1)</enum><text>any individual who is an employee of the Commission shall be considered a covered employee under the Act; and</text></paragraph><paragraph id="H9634626E8236417BA448BCBC74696B6C"><enum>(2)</enum><text>the Commission shall be considered an employing office under the Act.</text></paragraph></subsection><subsection id="HC48CE85D399043898FE6F0B136E2F6F1"><enum>(l)</enum><header>Consultation or engagement with Native Americans, Indian Tribes, Tribal organizations, the Office of Hawaiian Affairs, and Native Hawaiian organizations</header><text>In carrying out the duties of the Commission under section 111, the Commission shall meaningfully consult or engage, as appropriate, in a timely manner with Native Americans, Indian Tribes, Tribal organizations, the Office of Hawaiian Affairs, and Native Hawaiian organizations.</text></subsection><subsection id="H2A5EC0657F044214BC5039B604E002C3" commented="no"><enum>(m)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">For each fiscal year in which the Commission is operational, there is authorized to be appropriated $15,000,000 to the Commission to carry out this Act. Amounts appropriated pursuant to this authorization shall be derived and transferred from the unexpired, unobligated balances of all amounts made available to the Indian Health Service to prevent, prepare for, or respond to coronavirus.</text></subsection><subsection id="HF1A8E21F1C234EB988B686F459E5D8CE" commented="no"><enum>(n)</enum><header>Rescission</header><text display-inline="yes-display-inline">Of the unobligated balances of funds made available by section 11001 of <external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>, $90,000,000 are hereby permanently rescinded.</text></subsection></section></subtitle><subtitle id="H602227CFC4AA421A8CDA996533C0F22B"><enum>B</enum><header>Duties of the Commission</header><section id="H0CB519168D1B4A109C1921912106427B"><enum>111.</enum><header>Duties of the commission</header><subsection id="HD68637D8EAFB46629CE778DEF8082E31"><enum>(a)</enum><header>Investigation</header><paragraph id="H69E40A69C0BA466ABC34D0E485CCA14C"><enum>(1)</enum><header>In general</header><text>The Commission shall conduct a comprehensive interdisciplinary investigation of Indian Boarding School Policies, including the social, cultural, economic, emotional, and physical effects of Indian Boarding School Policies in the United States on Native American communities, Indian Tribes, survivors of Indian Boarding Schools, families of those survivors, and their descendants.</text></paragraph><paragraph id="H41011965679348A29F8DFE8D430CFCB2"><enum>(2)</enum><header>Matters to be investigated</header><text>The matters to be investigated by the Commission under paragraph (1) shall include, at a minimum—</text><subparagraph id="HE67D112178884AA09B2CBE61157961D9"><enum>(A)</enum><text>conducting a comprehensive review of existing research and historical records of Indian Boarding School Policies and any documentation, scholarship, or other resources relevant to the purposes of this Act from—</text><clause id="H7ED6805836A54CA1A15567E0F74025C7"><enum>(i)</enum><text>any archive or any other document storage location, notwithstanding the location of that archive or document storage location; and</text></clause><clause id="H6F3E9EE34CFB4D8E8793F242F1AE9E43"><enum>(ii)</enum><text>any research conducted by private individuals, private entities, and non-Federal Government entities, whether domestic or foreign, including religious institutions;</text></clause></subparagraph><subparagraph id="HC760DAF41F1943618B114441C0F05A0C"><enum>(B)</enum><text>collaborating with the Federal Truth and Healing Advisory Committee to obtain all relevant information from—</text><clause id="H9D3A1287F9E84B29B7A91C978BB52523"><enum>(i)</enum><text>the Department of the Interior, the Department of Health and Human Services, other relevant Federal agencies, and institutions or organizations, including religious institutions or organizations, that operated an Indian Boarding School, carried out Indian Boarding School Policies, or have information that the Commission determines to be relevant to the investigation of the Commission; and</text></clause><clause id="H022B4572F0004DAC8F96BE50F8D746D9"><enum>(ii)</enum><text>Indian Tribes, Tribal organizations, Native Americans, the Office of Hawaiian Affairs, and Native Hawaiian organizations; and</text></clause></subparagraph><subparagraph id="H1758154ACB5F41838EDFC82D38CBB5E7"><enum>(C)</enum><text display-inline="yes-display-inline">conducting a comprehensive assessment of the impacts of Indian Boarding School Policies on American Indian, Alaska Native, and Native Hawaiian students and alumni, including the impact on cultures, traditions, and languages.</text></subparagraph></paragraph><paragraph id="H6C0DF979DA57463AA20FDE4ED0294FE3"><enum>(3)</enum><header>Research related to objects, artifacts, and real property</header><text>If the Commission conducts a comprehensive review of research described in paragraph (2)(A)(ii) that focuses on objects, artifacts, or real or personal property that are in the possession or control of private individuals, private entities, or non-Federal Government entities within the United States, the Commission may enter into a contract or agreement to acquire, hold, curate, or maintain those objects, artifacts, or real or personal property until the objects, artifacts, or real or personal property can be properly repatriated or returned, consistent with applicable Federal law, subject to the condition that no Federal funds may be used to purchase those objects, artifacts, or real or personal property.</text></paragraph></subsection><subsection id="H513D6CB555B045CE9106F09313BE2E81"><enum>(b)</enum><header>Meetings and convenings</header><paragraph id="HF836F8FB841B42548D991959D5FD9B3F"><enum>(1)</enum><header>In general</header><text>The Commission shall hold, with the advice of the Native American Truth and Healing Advisory Committee and the Survivors Truth and Healing Subcommittee, and in coordination with, as relevant, Indian Tribes, Tribal organizations, the Office of Hawaiian Affairs, and Native Hawaiian organizations, as part of its investigation under subsection (a), safe, trauma-informed, and culturally appropriate public or private meetings or convenings to receive testimony relating to that investigation.</text></paragraph><paragraph id="H4103CF16468841A0B7BD68DC3925522C"><enum>(2)</enum><header>Requirements</header><text>The Commission shall ensure that meetings and convenings held under paragraph (1) provide access to adequate trauma-informed care services for participants, attendees, and communities during and following the meetings and convenings where the Commission receives testimony, including ensuring that private space is available for survivors and descendants of survivors, family members, and other community members to receive trauma-informed care services.</text></paragraph></subsection><subsection id="HD729F08E379048A3881F726E48080B3A"><enum>(c)</enum><header>Recommendations</header><paragraph id="HB4BD2C98F97E497DA6BC15423C6F381A"><enum>(1)</enum><header>In general</header><text>The Commission shall make recommendations to Congress relating to the investigation carried out under subsection (a), which shall be included in the final report required under subsection (e)(3).</text></paragraph><paragraph id="H32349F81D2C1454A8F86A0571FA9C546"><enum>(2)</enum><header>Inclusions</header><text>Recommendations made under paragraph (1) shall include, at a minimum, recommendations relating to—</text><subparagraph id="H5D0BF4701DF54322BEF5EE94F58F6065"><enum>(A)</enum><text>in light of Tribal and Native Hawaiian law, Tribal customary law, tradition, custom, and practice, how the Federal Government can meaningfully acknowledge the role of the Federal Government in supporting Indian Boarding School Policies in all issue areas that the Commission determines relevant, including appropriate forms of memorialization, preservation of records, objects, artifacts, and burials;</text></subparagraph><subparagraph id="H0C4A5BE6133F41DB84F5EA45D40174A6"><enum>(B)</enum><text>how modification of existing statutes, procedures, regulations, policies, budgets, and practices will, in the determination of the Commission, address the findings of the Commission and ongoing effects of Indian Boarding School Policies; and</text></subparagraph><subparagraph id="H2ACB1C86D6A44A41B8A011043C5F4285"><enum>(C)</enum><text>how the Federal Government can promote public awareness of, and education about, Indian Boarding School Policies and the impacts of those policies, including through coordinating with the Native American Truth and Healing Advisory Committee, the Survivors Truth and Healing Subcommittee, the Smithsonian Institution, and other relevant institutions and organizations.</text></subparagraph></paragraph></subsection><subsection id="H321BAFE806BC4E2C8DB4154086C4FD1B"><enum>(d)</enum><header>Duties related to burials</header><text>The Commission shall, with respect to burial sites associated with Indian Boarding Schools—</text><paragraph id="HC3CCC798D6F44B67ABB25A6C7CEE765D"><enum>(1)</enum><text>coordinate, as appropriate, with the Native American Truth and Healing Advisory Committee, the Federal Truth and Healing Advisory Committee, the Survivors Truth and Healing Subcommittee, lineal descendants, Indian Tribes, the Office of Hawaiian Affairs, Federal agencies, institutions, and organizations to locate and identify, in a culturally appropriate manner, marked and unmarked burial sites, including cemeteries, unmarked graves, and mass burial sites, where students of Indian Boarding Schools were originally or later interred;</text></paragraph><paragraph id="HAB8954735EF44A17BF381696A4E2F548"><enum>(2)</enum><text>locate, document, analyze, and coordinate the preservation or continued preservation of records and information relating to the interment of students, including any records held by Federal, State, international, or local entities or religious institutions or organizations; and</text></paragraph><paragraph id="H69461D14028F483AABEFDC8D6ADB03A3"><enum>(3)</enum><text>share, to the extent practicable, with affected lineal descendants, Indian Tribes, and the Office of Hawaiian Affairs burial locations and the identities of children who attended Indian Boarding Schools.</text></paragraph></subsection><subsection id="H310506CC2FC3413D96FC770BBFF337AE"><enum>(e)</enum><header>Reports</header><paragraph id="H03E5B25F72424C47B09DF169B0B8D25D"><enum>(1)</enum><header>Annual reports to congress</header><text>Not less frequently than annually until the year before the year in which the Commission expires, the Commission shall submit to the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives a report that describes the activities of the Commission during the previous year, including an accounting of funds and gifts received and expenditures made, the progress made, and any barriers encountered in carrying out this Act.</text></paragraph><paragraph id="HB80309C7336241B79B32D38567098A4A"><enum>(2)</enum><header>Commission initial report</header><text>Not later than 4 years after the date on which a majority of the members of the Commission are appointed under section 101(b)(1), the Commission shall submit to the individuals described in paragraph (4), and make publicly available, an initial report containing—</text><subparagraph id="H38373F2FDED847E5B7DAB303C825A9CF"><enum>(A)</enum><text>a detailed review of existing research, including documentation, scholarship, or other resources shared with the Commission that further the purposes of this Act;</text></subparagraph><subparagraph id="H4A569C2CFF81483BAB4C242AA854BDD9"><enum>(B)</enum><text>a detailed statement of the initial findings and conclusions of the Commission; and</text></subparagraph><subparagraph id="H9E6596F5F89941CEBE923F85EB6C6F65"><enum>(C)</enum><text>a detailed statement of the initial recommendations of the Commission.</text></subparagraph></paragraph><paragraph id="HDA70CC5A8BD04C7CA51895A364FFE162"><enum>(3)</enum><header>Commission final report</header><text display-inline="yes-display-inline">Before the expiration of the Commission, the Commission shall submit to the individuals described in paragraph (4), and make publicly available, a final report containing the findings, conclusions, and recommendations of the Commission that have been agreed on by the vote of a majority of the members of the Commission and <fraction>3⁄5</fraction> of the members of each of the Native American Truth and Healing Advisory Committee and the Survivors Truth and Healing Subcommittee.</text></paragraph><paragraph id="H384456D117C6446281C1DFD59B6EAB4A"><enum>(4)</enum><header>Report recipients</header><text>The individuals referred to in paragraphs (2) and (3) are—</text><subparagraph id="HBB8F1B7721E24D6295C7609DB6041080"><enum>(A)</enum><text>the President;</text></subparagraph><subparagraph id="H13179C83E14644CD9561B53B932043C0"><enum>(B)</enum><text>the Secretary of the Interior;</text></subparagraph><subparagraph id="H5479D388BC334B5598930A3BCE115D7C"><enum>(C)</enum><text>the Attorney General;</text></subparagraph><subparagraph id="HC1E7CAABE39B4AB2A7372827E2E972F9"><enum>(D)</enum><text>the Comptroller General of the United States;</text></subparagraph><subparagraph id="HAB410C6BED2D442DA5627805A694CDF9"><enum>(E)</enum><text>the Secretary of Education;</text></subparagraph><subparagraph id="HE1566ACB7B894C00966B3FF4E0147801"><enum>(F)</enum><text>the Secretary of Health and Human Services;</text></subparagraph><subparagraph id="H09DA67FC72134784972B6013762BF083"><enum>(G)</enum><text>the Secretary of Defense;</text></subparagraph><subparagraph Indian.</text></subparagraph></paragraph><paragraph id="H07B4BD61FFAD4098B38D6B3F34F536AE"><enum>(5)</enum><header>Additional commission responsibilities relating to the publication of the initial and final reports</header><subparagraph id="H0575E608FEE945459E38B0DB08081C86"><enum>(A)</enum><header>Events relating to initial report</header><clause id="H84CE7F21EC0C446EBC3284C38FB2F322"><enum>(i)</enum><header>In general</header><text>The Commission shall hold not fewer than 2 events in each region of the Bureau of Indian Affairs and in Hawai’i following publication of the initial report under paragraph (2) to receive comments on the initial report.</text></clause><clause id="H751A5C7F8537485EBB810305E479E03A"><enum>(ii)</enum><header>Timing</header><text>The schedule of events referred to in clause (i) shall be announced not later than 90 days after the date on which the initial report under paragraph (6) is published.</text></clause></subparagraph><subparagraph id="H80DDA8AAF09942FCBBC709E86D0FFE71"><enum>(B)</enum><header>Publication of final report</header><text>Not later than 180 days after the date on which the Commission submits the final report under paragraph (3), the Commission, the Secretary of the Interior, the Secretary of Education, the Secretary of Defense, and the Secretary of Health and Human Services shall each make the final report publicly available on the website of the applicable agency.</text></subparagraph></paragraph><paragraph id="H6A17C57BC6D94801BDB4082039968848"><enum>(6)</enum><header>Secretarial response to final report</header><text>Not later than 120 days after the date on which the Secretary of the Interior, the Secretary of Education, the Secretary of Defense, and the Secretary of Health and Human Services receive the final report under paragraph (3), the Secretaries shall each make publicly available a written response to recommendations for future action by those agencies, if any, contained in the final report, and submit the written response to—</text><subparagraph id="H4ADE2BF61D484CB49A6F5DABB176871E"><enum>(A)</enum><text>the President;</text></subparagraph><subparagraph id="H50674767AD9447D18CD6C2617FDD4986"><enum>(B)</enum><text>the Committee on Indian Affairs of the Senate;</text></subparagraph><subparagraph id="H3568CCF91A2048D685C6EE0F8E702058"><enum>(C)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></subparagraph><subparagraph id="H326D3CABBF1148A8AB498E5C5D29B5E5"><enum>(D)</enum><text>the Comptroller General of the United States.</text></subparagraph></paragraph></subsection></section></subtitle><subtitle id="H830C2089D4A9467B923C88695873962B"><enum>C</enum><header>Survivors Truth and Healing Subcommittee</header><section id="H576634CB56404D71B92D84CB1C05406D"><enum>121.</enum><header>Survivors truth and healing subcommittee</header><subsection id="H214397E14E8C4E939363C7A76AC1A9FA"><enum>(a)</enum><header>Establishment</header><text>There is established a subcommittee of the Commission, to be known as the <quote>Survivors Truth and Healing Subcommittee</quote>.</text></subsection><subsection id="HB34D4080008D40DB9DB8BE5F42E630EE"><enum>(b)</enum><header>Membership, nomination, and appointment to the survivors truth and healing subcommittee</header><paragraph id="H221ED0515951426092F28906298FC797"><enum>(1)</enum><header>Membership</header><text>The Survivors Truth and Healing Subcommittee shall include 15 members, to be appointed by the Commission, in consultation with the National Native American Boarding School Healing Coalition, from among the nominees submitted under paragraph (2)(A), of whom—</text><subparagraph id="HBF93907990D04929B970A4B66AD3FB79"><enum>(A)</enum><text> 12 shall be representatives from each of the 12 regions of the Bureau of Indian Affairs and 1 shall be a representative from Hawai’i;</text></subparagraph><subparagraph id="H4C63C221E00A463682C8A296AEC031D4"><enum>(B)</enum><text> 9 shall be individuals who attended an Indian Boarding School of whom—</text><clause id="HA24AE5ADDB0C4F1A977DAF8D75601B99"><enum>(i)</enum><text>not fewer than 2 shall be individuals who graduated during the 5-year period preceding the date of the enactment of this Act from—</text><subclause id="H20CFC799C2854410BA9D73CCC3295657"><enum>(I)</enum><text>an Indian Boarding School in operation as of that date of the enactment; or</text></subclause><subclause id="HD37903127214435B9FD4EFB404398605"><enum>(II)</enum><text>a Bureau of Indian Education-funded school; and</text></subclause></clause><clause id="H336E7FB15A434978A3D37640540AF0C3"><enum>(ii)</enum><text>all shall represent diverse regions of the United States;</text></clause></subparagraph><subparagraph id="HBF280021AED24311AA664680959917EE"><enum>(C)</enum><text>5 shall be descendants of individuals who attended Indian Boarding Schools, who shall represent diverse regions of the United States; and</text></subparagraph><subparagraph id="H1BF193318E65497D8C22B7F10BE17AD3"><enum>(D)</enum><text>1 shall be an educator who, as of the date of the appointment—</text><clause id="H29E8861B97EF4473AE6A460242A83685"><enum>(i)</enum><text>is employed at an Indian Boarding School; or</text></clause><clause id="HF9BB06DA8FF2409088C18247D90916AF"><enum>(ii)</enum><text>was employed at an Indian Boarding School during the 5-year period preceding the date of the enactment of this Act.</text></clause></subparagraph></paragraph><paragraph id="H55972C98B65D4337A6CE9B12E1B88C4D"><enum>(2)</enum><header>Nominations</header><subparagraph id="HA36CFBA909014DCEAB229918F0CD4F20"><enum>(A)</enum><header>In general</header><text>Indian Tribes, Tribal organizations, Native Americans, the Office of Hawaiian Affairs, and Native Hawaiian organizations may submit to the Secretary of the Interior nominations for individuals to be appointed to the Survivors Truth and Healing Subcommittee not later than 90 days after the date of the enactment of this Act.</text></subparagraph><subparagraph id="HBBBBCBB8CB0B4361998C21B278948801"><enum>(B)</enum><header>Submission</header><text>The Secretary of the Interior shall provide the Commission with nominations submitted under subparagraph (A) at the initial business meeting of the Commission under section 101(c)(1) and the Commission shall select the members of the Survivors Truth and Healing Subcommittee from among those nominees.</text></subparagraph></paragraph><paragraph id="H04C0222328464F82A74AB971D91AE263"><enum>(3)</enum><header>Date</header><subparagraph id="H905095D5D1134EE68BE53248D83DD732"><enum>(A)</enum><header>In general</header><text>The Commission shall appoint all members of the Survivors Truth and Healing Subcommittee during the initial business meeting of the Commission under section 101(c)(1).</text></subparagraph><subparagraph id="HDA135E4EDF6B4C999F70F0DB84A825EF"><enum>(B)</enum><header>Failure to appoint</header><text>If the Commission fails to appoint all members of the Survivors Truth and Healing Subcommittee in accordance with subparagraph (A), the Chair of the Committee on Indian Affairs of the Senate, with the concurrence of the Vice Chair of the Committee on Indian Affairs of the Senate, shall appoint individuals, in accordance with the requirements of paragraph (1), to all vacant positions of the Survivors Truth and Healing Subcommittee not later than 30 days after the date of the initial business meeting of the Commission under section 101(c)(1).</text></subparagraph></paragraph><paragraph id="HCE137F763D794068AAA143AC7F328F4B"><enum>(4)</enum><header>Period of appointment; vacancies; removal</header><subparagraph id="H24AF52255E3849D39C3A88F89610593A"><enum>(A)</enum><header>Period of appointment</header><text>A member of the Survivors Truth and Healing Subcommittee shall be appointed for an automatically renewable term of 2 years.</text></subparagraph><subparagraph id="H02E043D77CF147A498021C8565352190"><enum>(B)</enum><header>Vacancies</header><clause id="HF87FBF305AE541B380AED26A82F84A73"><enum>(i)</enum><header>In general</header><text>A member of the Survivors Truth and Healing Subcommittee may vacate the position at any time and for any reason.</text></clause><clause id="HE1A9809919D94831AFDFA87FCE018B0E"><enum>(ii)</enum><header>Effect; filling of vacancy</header><text>A vacancy in the Survivors Truth and Healing Subcommittee—</text><subclause id="HEB3EC8160B174766A0C3033C15721CC7"><enum>(I)</enum><text>shall not affect the powers of the Survivors Truth and Healing Subcommittee if a simple majority of the positions of the Survivors Truth and Healing Subcommittee are filled; and</text></subclause><subclause id="H5387BF2C32A64E218C288B0C7FE2CA73"><enum>(II)</enum><text>shall be filled within 90 days in the same manner as was the original appointment.</text></subclause></clause></subparagraph><subparagraph id="HDC5E0B181BD54C159317525AF375135E"><enum>(C)</enum><header>Removal</header><text>A quorum of members of the Commission may remove a member of the Survivors Truth and Healing Subcommittee only for neglect of duty or malfeasance.</text></subparagraph></paragraph><paragraph id="H9138CAE5B05045FBB5E7152E50E52ED8"><enum>(5)</enum><header>Termination</header><text>The Survivors Truth and Healing Subcommittee shall terminate 90 days after the date on which the Commission submits the final report required under section 111(e)(3).</text></paragraph><paragraph id="H6D93BA85F6BE42B693576ECE78F5F257"><enum>(6)</enum><header>Limitation</header><subparagraph id="HC9802B29FD724350B1EF9D6EEC61F591"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), no member of the Survivors Truth and Healing Subcommittee shall be an officer or employee of the Federal Government.</text></subparagraph><subparagraph id="HBDB93A4E207C47CA88158C713EADF445" commented="no"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply to an employee of a Bureau school (as defined in section 1141 of the Education Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/2021">25 U.S.C. 2021</external-xref>)).</text></subparagraph></paragraph></subsection><subsection id="HBD4BD3E0D312458D84D37CE660718ADE"><enum>(c)</enum><header>Business meetings</header><paragraph id="HFFD7EEC9DE7A4D37AE9A9385385AC9BE"><enum>(1)</enum><header>Initial meeting</header><text>Not later than 30 days after the date on which all members of the Survivors Truth and Healing Subcommittee are appointed under subsection (b)(1), the Survivors Truth and Healing Subcommittee shall hold an initial business meeting—</text><subparagraph id="HA88E9D5EF34A4689BF1879C420C13F7F"><enum>(A)</enum><text>to appoint—</text><clause id="H3F70D0A3CEED47CB8FC6FEA9B910939C"><enum>(i)</enum><text>a Chairperson, who shall also serve as the Vice Chairperson of the Federal Truth and Healing Advisory Committee;</text></clause><clause id="H0310810ED1EA4BF2BC6D61C52577D816"><enum>(ii)</enum><text>a Vice Chairperson, who shall also serve as the Vice Chairperson of the Native American Truth and Healing Advisory Committee; and</text></clause><clause id="HAA388A99229B476E97E99EA23C33E20D"><enum>(iii)</enum><text>a Secretary;</text></clause></subparagraph><subparagraph id="HBD01B49F93FF403FACD5B498D45C4571"><enum>(B)</enum><text>to establish, with the advice of the Commission, rules for the Survivors Truth and Healing Subcommittee;</text></subparagraph><subparagraph id="H10EB645DEC2F48E5A067B58D8A05EBC6"><enum>(C)</enum><text>to appoint 3 designees to fulfill the responsibilities described in section 101(h)(1)(A); and</text></subparagraph><subparagraph id="HC85B2FCE04C04BAAB39B4F66C04FECF9"><enum>(D)</enum><text>to appoint, with the advice of the Commission, 2 members of the Survivors Truth and Healing Subcommittee to serve as non-voting designees on the Commission in accordance with section 101(c)(3).</text></subparagraph></paragraph><paragraph id="H56D57FE765E64B938BAE1C89D08FE833"><enum>(2)</enum><header>Subsequent business meetings</header><text>After the initial business meeting of the Survivors Truth and Healing subcommittee is held under paragraph (1), the Survivors Truth and Healing Subcommittee shall meet at the call of the Chairperson.</text></paragraph><paragraph id="HCED01F57BC0B4BF1AD149A82DD74287D"><enum>(3)</enum><header>Format of business meetings</header><text>A business meeting of the Survivors Truth and Healing Subcommittee may be conducted in-person or virtually.</text></paragraph><paragraph id="H0964B989BCED46F6AA2B8C0E1822412F"><enum>(4)</enum><header>Quorum required</header><text>A business meeting of the Survivors Truth and Healing Subcommittee may be held only once a quorum, established in accordance with subsection (d), is present.</text></paragraph></subsection><subsection id="H6A365C06C4DC4D71B5747259604AAB27"><enum>(d)</enum><header>Quorum</header><text>A simple majority of the members of the Survivors Truth and Healing Subcommittee present shall constitute a quorum for a business meeting.</text></subsection><subsection id="HF85E0BE768A94377806E30227FA84BFF"><enum>(e)</enum><header>Rules</header><text>The Survivors Truth and Healing Subcommittee, with the advice of the Commission, may establish, by a majority vote, any rules for the conduct of business, in accordance with this section and other applicable law.</text></subsection><subsection id="HBC15281F4F0347D49623F4C141B0BC21"><enum>(f)</enum><header>Duties</header><text>The Survivors Truth and Healing Subcommittee shall assist the Commission, the Native American Truth and Healing Advisory Committee, and the Federal Truth and Healing Advisory Committee in coordinating public and private convenings, including—</text><paragraph id="H04ACE558F9294451A10D13A2E617C471"><enum>(1)</enum><text>providing advice to the Commission on developing criteria and protocols for convenings;</text></paragraph><paragraph id="H7C33AC3EA01C40E49BDEFC0E7CE41B28"><enum>(2)</enum><text>providing advice and evaluating Committee recommendations relating to the commemoration and public education relating to Indian Boarding Schools and Indian Boarding School Policies; and</text></paragraph><paragraph id="HA7A729AA124240C9934740AB083A9AAA"><enum>(3)</enum><text>providing such other advice as may be required by the Commission.</text></paragraph></subsection><subsection id="HF5A94BCA96F8472EA0C711F6BDACF298"><enum>(g)</enum><header>Consultation or engagement with native americans, indian tribes, tribal organizations, the office of hawaiian affairs, and native hawaiian organizations</header><text>In carrying out the duties of the Survivors Truth and Healing Subcommittee under subsection (f), the Survivors Truth and Healing Subcommittee shall meaningfully consult or engage, as appropriate, in a timely manner with Native Americans, Indian Tribes, Tribal organizations, the Office of Hawaiian Affairs, and Native Hawaiian organizations.</text></subsection><subsection id="H05C3950194B349A5B272935D26D4E723"><enum>(h)</enum><header>Federal advisory committee act applicability</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code (commonly known as the <quote>Federal Advisory Committee Act</quote>), shall not apply to the Survivors Truth and Healing Subcommittee.</text></subsection><subsection id="H049B2C50AB944C9D8020AF6BE1AE6E07" display-inline="no-display-inline"><enum>(i)</enum><header>Congressional Accountability Act applicability</header><text>For purposes of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>)—</text><paragraph id="H1938DFCAD94440549115934625BB50A6"><enum>(1)</enum><text display-inline="yes-display-inline">any individual who is an employee of the Survivors Truth and Healing Subcommittee shall be considered a covered employee under the Act; and</text></paragraph><paragraph id="H757CAA45B80645138F94E566BB19D6B4"><enum>(2)</enum><text display-inline="yes-display-inline">the Survivors Truth and Healing Subcommittee shall be considered an employing office under the Act.</text></paragraph></subsection><subsection id="H8B95CA4E63DB4D2890F71A6124336155"><enum>(j)</enum><header>Personnel matters</header><paragraph id="HC7864856CECF4179A371AB7BCDEC4E14"><enum>(1)</enum><header>Compensation of members</header><text display-inline="yes-display-inline">A member of the Survivors Truth and Healing Subcommittee shall be compensated at a daily equivalent of the annual rate of basic pay prescribed for grade 13 of the General Schedule under section 5332 of title 5, United States Code, for each day, not to exceed 14 days per month, for which a member of the Survivors Truth and Healing Subcommittee is engaged in the performance of their duties under this Act limited to convening meetings, including public and private meetings to receive testimony in furtherance of the duties of the Survivors Truth and Healing Subcommittee and the purposes of this Act.</text></paragraph><paragraph id="H61330A418B3E45A6B7F9E8C6D6841C44"><enum>(2)</enum><header>Travel expenses</header><text>A member of the Survivors Truth and Healing Subcommittee shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Survivors Truth and Healing Subcommittee.</text></paragraph></subsection></section></subtitle></title><title id="HC259367682B74C23BC0B685EEB733FA7"><enum>II</enum><header>ADVISORY COMMITTEES </header><subtitle id="H377B14F09B164837A7C34FDAE87E9A1A"><enum>A</enum><header>Native American Truth and Healing Advisory Committee</header><section id="H62538472104D413096821190B377976E"><enum>201.</enum><header>Native American Truth and Healing Advisory Committee</header><subsection id="H25709CF6AEAE4AC9960DC19BF9F97BC1"><enum>(a)</enum><header>Establishment</header><text>The Commission shall establish an advisory committee, to be known as the <quote>Native American Truth and Healing Advisory Committee</quote>.</text></subsection><subsection id="H614C03C5039147BBB3334EA230284C08"><enum>(b)</enum><header>Membership, nomination, and appointment to the native american truth and healing advisory committee</header><paragraph id="HDCB1CDA3A35C49E5AA7BC6809580A2D3"><enum>(1)</enum><header>Membership</header><subparagraph id="HD22A0260F73243E782FFF36A49B6BCF9"><enum>(A)</enum><header>In general</header><text>The Native American Truth and Healing Advisory Committee shall include 19 members, to be appointed by the Commission from among the nominees submitted under paragraph (2)(A), of whom—</text><clause id="H270701D8990A421B9F353CB5FE8A2C8A"><enum>(i)</enum><text>1 shall be the Vice Chairperson of the Commission, who shall serve as the Chairperson of the Native American Truth and Healing Advisory Committee;</text></clause><clause id="H845BBC1C64C24FAE87F7528C2F8005D0"><enum>(ii)</enum><text>1 shall be the Vice Chairperson of the Survivors Truth and Healing Subcommittee, who shall serve as the Vice Chairperson of the Native American Truth and Healing Advisory Committee;</text></clause><clause id="H8D19DFE328F84F45BFEB4C6D3A305116"><enum>(iii)</enum><text>1 shall be the Secretary of the Interior, or a designee, who shall serve as the Secretary of the Native American Truth and Healing Advisory Committee;</text></clause><clause id="HD75B080DF42F46A7B74808BC61057ECC"><enum>(iv)</enum><text>12 shall be representatives from each of the 12 regions of the Bureau of Indian Affairs and 1 shall be a representative from Hawai’i;</text></clause><clause id="HF4E9E0024D03475DA0146199FFA158B1"><enum>(v)</enum><text>1 shall represent the National Native American Boarding School Healing Coalition;</text></clause><clause id="HC15FEA11F7014F629DD257CD7415B813"><enum>(vi)</enum><text>1 shall represent the National Association of Tribal Historic Preservation Officers; and</text></clause><clause id="HD41E4D6BD05B483BBB9E21898C395AF8"><enum>(vii)</enum><text>1 shall represent the National Indian Education Association.</text></clause></subparagraph><subparagraph id="H5E9DB660ED814D92BF77FF0672426F7E"><enum>(B)</enum><header>Additional requirements</header><text>Not fewer than 2 members of the Native American Truth and Healing Advisory Committee shall have experience with health care or mental health, traditional healing or cultural practices, counseling, or working with survivors, or descendants of survivors, of Indian Boarding Schools to ensure that the Commission considers culturally responsive support for survivors, families, and communities.</text></subparagraph></paragraph><paragraph id="HC0369C9A5C894BCDBF8D40ED3056D93D"><enum>(2)</enum><header>Nominations</header><subparagraph id="H63CC1EFB8A0744419A5D5FD51E4DDBB6"><enum>(A)</enum><header>In general</header><text>Indian Tribes, Tribal organizations, Native Americans, the Office of Hawaiian Affairs, and Native Hawaiian organizations may submit to the Secretary of the Interior nominations for individuals to be appointed to the Native American Truth and Healing Advisory Committee not later than 90 days after the date of the enactment of this Act.</text></subparagraph><subparagraph id="H6CD50E4EF0794A5197253513E8909E11"><enum>(B)</enum><header>Submission</header><text>The Secretary of the Interior shall provide the Commission with nominations submitted under subparagraph (A) at the initial business meeting of the Commission under section 101(c)(1) and the Commission shall select the members of the Native American Truth and Healing Advisory Committee from among those nominees.</text></subparagraph></paragraph><paragraph id="H5477F34CA45A443B836824EAA568939D"><enum>(3)</enum><header>Date</header><subparagraph id="HCB9FE9964985437191C04D3C511C4CEB"><enum>(A)</enum><header>In general</header><text>The Commission shall appoint all members of the Native American Truth and Healing Advisory Committee during the initial business meeting of the Commission under section 101(c)(1).</text></subparagraph><subparagraph id="HE2A62C1BA2B74CCCA7A0089946966D9C"><enum>(B)</enum><header>Failure to appoint</header><text>If the Commission fails to appoint all members of the Native American Truth and Healing Advisory Committee in accordance with subparagraph (A), the Chair of the Committee on Indian Affairs of the Senate, with the concurrence of the Vice Chair of the Committee on Indian Affairs of the Senate, shall appoint, in accordance with the requirements of paragraph (1), individuals to all vacant positions of the Native American Truth and Healing Advisory Committee not later than 30 days after the date of the initial business meeting of the Commission under section 101(c)(1).</text></subparagraph></paragraph><paragraph id="H73D093F742B14B99A7073C908957DEB9"><enum>(4)</enum><header>Period of appointment; vacancies</header><subparagraph id="H981E280FE27C42D79091844C92F60B16"><enum>(A)</enum><header>Period of appointment</header><text>A member of the Native American Truth and Healing Advisory Committee shall be appointed for an automatically renewable term of 2 years.</text></subparagraph><subparagraph id="H76155185F2AA4E519C15A99E2BD32861"><enum>(B)</enum><header>Vacancies</header><text>A vacancy in the Native American Truth and Healing Advisory Committee—</text><clause id="H8197E210179C4FD98EEDFAD81C438E53"><enum>(i)</enum><text>shall not affect the powers of the Native American Truth and Healing Advisory Committee if a simple majority of the positions of the Native American Truth and Healing Advisory Committee are filled; and</text></clause><clause id="H54E33327E4974CA8805EBEC7FA0DE638"><enum>(ii)</enum><text>shall be filled within 90 days in the same manner as was the original appointment.</text></clause></subparagraph></paragraph><paragraph id="H3BCA69FC651F4E1B8D5A91C08DF2F914"><enum>(5)</enum><header>Termination</header><text>The Native American Truth and Healing Advisory Committee shall terminate 90 days after the date on which the Commission submits the final report required under section 111(e)(3).</text></paragraph><paragraph id="H55AE1454DFA3447B90EE84A88EA84AE1"><enum>(6)</enum><header>Limitation</header><text>No member of the Native American Truth and Healing Advisory Committee (other than the member described in paragraph (1)(A)(iii)) shall be an officer or employee of the Federal Government.</text></paragraph></subsection><subsection id="H0FCE61020BA948A8AAA484A3B8580D0C"><enum>(c)</enum><header>Quorum</header><text>A simple majority of the appointed members of the Native American Truth and Healing Advisory Committee shall constitute a quorum.</text></subsection><subsection id="H96B6A4F6D326470593E130EC3486D790"><enum>(d)</enum><header>Removal</header><text>A quorum of members of the Native American Truth and Healing Advisory Committee may remove another member only for neglect of duty or malfeasance.</text></subsection><subsection id="HEABC04E936CF415AA912D160A47683BC"><enum>(e)</enum><header>Business meetings</header><paragraph id="H2A86D396FBDE405EAA4AE38D08F56F42"><enum>(1)</enum><header>Initial business meeting</header><text>Not later than 30 days after the date on which all members of the Native American Truth and Healing Advisory Committee are appointed under subsection (b)(1)(A), the Native American Truth and Healing Advisory Committee shall hold an initial business meeting—</text><subparagraph id="H1738BA263BF9411496E1DF037C45544A"><enum>(A)</enum><text>to establish rules for the Native American Truth and Healing Advisory Committee;</text></subparagraph><subparagraph id="HBC396F876B91486596B56677C181F075"><enum>(B)</enum><text>to appoint 3 designees to fulfill the responsibilities described in section 101(h)(1)(A); and</text></subparagraph><subparagraph id="H1540167B686B4D679AFD538B23810198"><enum>(C)</enum><text>to appoint 2 members of the Native American Truth and Healing Advisory Committee to serve as non-voting designees on the Commission in accordance with section 101(c)(3).</text></subparagraph></paragraph><paragraph id="H66FA0E3AD4744CB0B49880E9707E0553"><enum>(2)</enum><header>Subsequent business meetings</header><text>After the initial business meeting of the Native American Truth and Healing Advisory Committee is held under paragraph (1), the Native American Truth and Healing Advisory Committee shall meet at the call of the Chairperson.</text></paragraph><paragraph id="H30D244ED716B4A228BD9A10D979DCEED"><enum>(3)</enum><header>Format of business meetings</header><text>A meeting of the Native American Truth and Healing Advisory Committee may be conducted in-person or virtually.</text></paragraph><paragraph id="H09593CB47A84412B841576FA3F486DF1"><enum>(4)</enum><header>Quorum required</header><text>A business meeting of the Native American Truth and Healing Advisory Committee may be held only once a quorum, established in accordance with subsection (c), is present.</text></paragraph></subsection><subsection id="H8B0A0F8D09C14F79A30A9F90ACDE88E5"><enum>(f)</enum><header>Rules</header><text>The Native American Truth and Healing Advisory Committee may establish, with the advice of the Commission, by a majority vote, any rules for the conduct of business, in accordance with this section and other applicable law.</text></subsection><subsection id="H84110A84BC1743C480CEAE9356D313AA"><enum>(g)</enum><header>Duties</header><text>The Native American Truth and Healing Advisory Committee shall—</text><paragraph id="H34FEEF82F969470886681F70F3D47020"><enum>(1)</enum><text>serve as an advisory body to the Commission;</text></paragraph><paragraph id="HB07EE5ED11C34F61BF1EA859EE4D0CF0"><enum>(2)</enum><text>assist the Commission in organizing and carrying out culturally appropriate public and private convenings relating to the duties of the Commission;</text></paragraph><paragraph id="HFFF541FA65854449ABB0AED85E223C15"><enum>(3)</enum><text>assist the Commission in determining what documentation from Federal and religious organizations and institutions may be necessary to fulfill the duties of the Commission;</text></paragraph><paragraph id="HF953241FDAB5413E80474AFD62EE9A61"><enum>(4)</enum><text>assist the Commission in the production of the initial report and final report required under paragraphs (2) and (3), respectively, of section 111(e);</text></paragraph><paragraph id="H832EF40DFFA341D78E96B3074A38D356"><enum>(5)</enum><text>coordinate with the Federal Truth and Healing Advisory Committee and the Survivors Truth and Healing Subcommittee; and</text></paragraph><paragraph id="HDAE0D468217240FBBF3EC08E9DA5A0F7"><enum>(6)</enum><text>provide advice to, or fulfill such other requests by, the Commission as the Commission may require to carry out the purposes described in section 3.</text></paragraph></subsection><subsection id="H4B43836C42154AA896672BB92C8C0D21"><enum>(h)</enum><header>Consultation or engagement with native americans, indian tribes, tribal organizations, the office of hawaiian affairs, and native hawaiian organizations</header><text>In carrying out the duties of the Native American Truth and Healing Advisory Committee under subsection (g), the Native American Truth and Healing Advisory Committee shall meaningfully consult or engage, as appropriate, in a timely manner with Native Americans, Indian id="H8E9EA480466C42A896FA0AF59D5E88EC"><enum>211.</enum><header>Federal Truth and Healing Advisory Committee</header><subsection id="H408956E73B7347E7B1E1193525849450"><enum>(a)</enum><header>Establishment</header><text>There is established within the Department of the Interior an advisory committee, to be known as the <quote>Federal Truth and Healing Advisory Committee</quote>.</text></subsection><subsection id="H7FFE3498DAC7426AB21355BD13C99892"><enum>(b)</enum><header>Membership and appointment to the federal truth and healing advisory committee</header><paragraph id="H12E06C29F6BA443394B72DA0529062EE"><enum>(1)</enum><header>Membership</header><text>The Federal Truth and Healing Advisory Committee shall include 17 members, of whom—</text><subparagraph id="H81FEE62B90024C86A4AD791F83D2867E"><enum>(A)</enum><text>1 shall be the Chairperson of the Commission, who shall serve as the Chairperson of the Federal Truth and Healing Advisory Committee;</text></subparagraph><subparagraph id="H2DBF7F566CEC4D80A90F500FCEECBB63"><enum>(B)</enum><text>1 shall be the Chairperson of the Survivors Truth and Healing Subcommittee, who shall serve as the Vice Chairperson of the Federal Truth and Healing Advisory Committee;</text></subparagraph><subparagraph id="H4CC59E45A38545B89408CAFA26F38EDF"><enum>(C)</enum><text>1 shall be the White House Domestic Policy Advisor, who shall serve as the Secretary of the Federal Truth and Healing Advisory Committee;</text></subparagraph><subparagraph id="HEFE8572CD1944C68A3BEC49599F4A52B"><enum>(D)</enum><text>1 shall be the Director of the Bureau of Trust Funds Administration (or a designee);</text></subparagraph><subparagraph id="HC67348CBB098431089F5EA81021C4E88"><enum>(E)</enum><text>1 shall be the Archivist of the United States (or a designee);</text></subparagraph><subparagraph id="HCECE19B72F58433284DA97F331115B1F"><enum>(F)</enum><text>1 shall be the Librarian of Congress (or a designee);</text></subparagraph><subparagraph id="HE40A7C4744444B9D94D9D8CC52051657"><enum>(G)</enum><text>1 shall be the Director of the Department of the Interior Library (or a designee);</text></subparagraph><subparagraph id="H9FE1CBA22B41404182CEEAD7D859772E"><enum>(H)</enum><text>1 shall be the Director of the Indian Health Service (or a designee);</text></subparagraph><subparagraph id="H3D577D32B53D4601B033DA988978CD84"><enum>(I)</enum><text>1 shall be the Assistant Secretary for Mental Health and Substance Abuse of the Department of Health and Human Services (or a designee);</text></subparagraph><subparagraph id="H74A736629B584A408C490EEF183DFEF5"><enum>(J)</enum><text>1 shall be the Commissioner of the Administration for Native Americans of the Department of Health and Human Services (or a designee);</text></subparagraph><subparagraph id="HADA4F83383F045C0A715E3693A2EA508"><enum>(K)</enum><text>1 shall be the Director of the National Institutes of Health (or a designee);</text></subparagraph><subparagraph id="H32BDE3B20A684CA7B693913DF3D0E0C0"><enum>(L)</enum><text>1 shall be the Senior Program Director of the Office of Native Hawaiian Relations of the Department of the Interior (or a designee);</text></subparagraph><subparagraph id="H3CCB1C6BB9CC4E3AA2395E6B40FF20DF"><enum>(M)</enum><text>1 shall be the Director of the Office of Indian Education of the Department of Education (or a designee);</text></subparagraph><subparagraph id="HB356EF44B1B04363BCCF61DC10998BD0"><enum>(N)</enum><text>1 shall be the Director of the Rural, Insular, and Native American Achievement Programs of the Department of Education (or a designee);</text></subparagraph><subparagraph id="H73A12EE44B93469AB4F2B3CAC9890D9D"><enum>(O)</enum><text>1 shall be the Executive Director of the Advisory Council on Historic Preservation (or a designee);</text></subparagraph><subparagraph id="H7A5B41B344444EFF8D460F81B20EE1E1"><enum>(P)</enum><text>1 shall be the Assistant Secretary of Indian Affairs (or a designee); and</text></subparagraph><subparagraph id="H0B3022561265449289D240FAD177A739"><enum>(Q)</enum><text>1 shall be the Director of the Bureau of Indian Education (or a designee).</text></subparagraph></paragraph><paragraph id="HB13429E23F5846E3992C4D29C5A598D7"><enum>(2)</enum><header>Period of service; vacancies; removal</header><subparagraph id="H7A2ED8E9AFC14249AEBFC9ACC3DBB9DF"><enum>(A)</enum><header>Period of service</header><text>A member of the Federal Truth and Healing Advisory Committee shall serve for an automatically renewable at the call of the Chairperson.</text></paragraph><paragraph id="H0096B8D58C054058B753F10E62D55DE6"><enum>(3)</enum><header>Format of business meetings</header><text>A business meeting of the Federal Truth and Healing Advisory Committee may be conducted in-person or virtually.</text></paragraph><paragraph id="HC2C295C948FD446FA602E8ADF718D357"><enum>(4)</enum><header>Quorum required</header><text>A business meeting of the Federal Truth and Healing Advisory Committee may be held only once a quorum, established in accordance with subsection (d), is present.</text></paragraph></subsection><subsection id="H7977FB798CE64940ABC71B913B7410DD"><enum>(d)</enum><header>Quorum</header><text>A simple majority of the members of the Federal Truth and Healing Advisory Committee present shall constitute a quorum for a business meeting.</text></subsection><subsection id="HD3A81E3DA5644470965889F521FD02F1"><enum>(e)</enum><header>Rules</header><text>The Federal Truth and Healing Advisory Committee may establish, with the advice of the Commission, by a majority vote, any rules for the conduct of business, in accordance with this section and other applicable law.</text></subsection><subsection id="H9CC455C956D441989786F0FA26D74CB1"><enum>(f)</enum><header>Duties</header><text>The Federal Truth and Healing Advisory Committee shall—</text><paragraph id="HC0E0B54790F840309072BA6118D3FC71"><enum>(1)</enum><text>ensure the effective and timely coordination among Federal agencies in furtherance of the purposes of this Act;</text></paragraph><paragraph id="H89842A104E794794BAE7E7421DC8B54B"><enum>(2)</enum><text>assist the Commission and the Native American Truth and Healing Advisory Committee in coordinating—</text><subparagraph id="H08861CD0FF764610AACEDE13D213620C"><enum>(A)</enum><text>meetings and other related public and private convenings; and</text></subparagraph><subparagraph id="H56682901681F4F1E8578526E34CF064F"><enum>(B)</enum><text>the collection, organization, and preservation of information obtained from witnesses and by other Federal agencies; and</text></subparagraph></paragraph><paragraph id="HC2163D8C9E184D19BF654465C1156541"><enum>(3)</enum><text>ensure the timely submission to the Commission of materials, documents, testimony, and such other information as the Commission determines to be necessary to carry out the duties of the Commission.</text></paragraph></subsection><subsection id="H158B9E99BA0349FF9B6192DF0D069B68"><enum>(g)</enum><header>Consultation or engagement with native americans, indian tribes, tribal organizations, the office of hawaiian affairs, and native hawaiian organizations</header><text>In carrying out the duties of the Federal Truth and Healing Advisory Committee under subsection (f), the Federal Truth and Healing Advisory Committee shall meaningfully consult or engage, as appropriate, in a timely manner with Native Americans, Indian Tribes, Tribal organizations, the Office of Hawaiian Affairs, and Native Hawaiian organizations.</text></subsection><subsection id="H47BDCD60540E427791936B69441CB053"><enum>(h)</enum><header>Nondisclosure</header><paragraph id="HCBC67520435F403CA70067079AEA15CC"><enum>(1)</enum><header>Privacy Act of 1974 applicability</header><text display-inline="yes-display-inline">Subsection (b) of section 552a of title 5, United States Code (commonly known as the <quote>Privacy Act of 1974</quote>), shall not apply to the Federal Truth and Healing Advisory Committee.</text></paragraph><paragraph id="H3820C1B23E9C4FE183C3CFB909C28319" commented="no"><enum>(2)</enum><header>Freedom of Information Act applicability</header><text display-inline="yes-display-inline">Records and other communications in the possession of the Federal Truth and Healing Advisory Committee shall be exempt from disclosure under section (b)(3)(B) of section 552 of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>). </text></paragraph><paragraph id="HAE1D6FDE9FEA41108AA4C0C1A3BAF157"><enum>(3)</enum><header>Federal advisory committee act applicability</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code (commonly known as the <quote>Federal Advisory Committee Act</quote>), shall not apply to the Federal Truth and Healing Advisory Committee.</text></paragraph></subsection></section></subtitle></title><title id="HFAC227AB7BE74DF2ACD2806890610318"><enum>III</enum><header>GENERAL PROVISIONS</header><section id="H7B3D976D83144599B1AAED0821388133"><enum>301.</enum><header>Clarification</header><text display-inline="no-display-inline">Any human remains or associated or unassociated funerary objects located on Federal land, on land managed by a Federal agency, or land otherwise curated by a Federal agency and relating to an Indian Boarding School shall be considered collections or holdings over which a Federal agency has possession or control and the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>) shall apply.</text></section><section id="H0F8C7ED2E5A440C486135A8F75552B0D"><enum>302.</enum><header>Burial management</header><text display-inline="no-display-inline">A Federal agency that carries out activities pursuant to this Act or that created or controls a cemetery with remains of an individual who attended an Indian Boarding School may rebury the remains of that individual and any associated funerary items that have been repatriated pursuant to section 7 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3005">25 U.S.C. 3005</external-xref>), consistent with Tribal practices, on any Federal land as agreed to by the relevant parties.</text></section><section id="HCC4601FD0A6E4F1CB84016BF5A839EBE"><enum>303.</enum><header>Co-stewardship agreements</header><text display-inline="no-display-inline">A Federal agency that carries out activities pursuant to this Act or that created or controls a cemetery with remains of an individual who attended an Indian Boarding School or an Indian Boarding School may enter into a co-stewardship agreement for the management of the cemetery or Indian Boarding School.</text></section><section id="HFFFDEE00088F450AB3E989B0FCB70D81" commented="no"><enum>304.</enum><header>No right of action</header><text display-inline="no-display-inline">Nothing in this Act creates a private right of action to seek administrative or judicial relief.</text></section><section id="H48729A5185784484924D605A050D03E8"><enum>305.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act is held invalid, the remainder of this Act
