R. 7193</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240201">February 1, 2024</action-date><action-desc><sponsor name-id="C001114">Mr. Curtis</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Clean Air Act to provide for exclusion of air quality monitoring data that is directly due to a catastrophic or beneficial use wildfire from use in determinations with respect to exceedances or violations of the national ambient air quality standard for any air pollutant, and for other purposes.</official-title></form><legis-body id="H66C684192C8A47FE8F1702C86219F6C3" style="OLC"><section id="H3CA69B8767FA4A0EB34B6B397CEA0BAD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildfire Air Quality Act</short-title></quote>.</text></section><section id="HE7026E542E474075BCAA9F4A452FD748"><enum>2.</enum><header>Air quality monitoring data excluded during a wildfire event</header><subsection id="HCCF97348CA114A8582BFCEE243D89169"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 319 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7619">42 U.S.C. 7619</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD3FF1D9F03B2454EA0FF5D9D8EC6DF20" display-inline="no-display-inline"><subsection id="HCA1B105092EB49E48C9BDF50F2C5E664"><enum>(c)</enum><header>Air quality monitoring data excluded during a wildfire event</header><text display-inline="yes-display-inline">In the event of a catastrophic or beneficial use wildfire determined by the Administrator to have a significant impact on air quality, the Administrator shall exclude air quality monitoring data that is directly due to such wildfire from use in determinations by the Administrator with respect to exceedances or violations of the national ambient air quality standard for any air pollutant.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H62100244749A460B93F9B9ACAA709A4A"><enum>(b)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall publish a final rule to carry out the amendment made by subsection (a).</text></subsection></section></legis-body></bill>
