which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit a State from issuing a motor vehicle operator’s license for the operation or use of an ADS-equipped vehicle operating at Level 4 or Level 5 in a manner that discriminates on the basis of disability.</official-title></form><legis-body id="H0110D432820B40EABCD4FF457507C87F" style="OLC"><section id="H342FAF9DA87C40C28408CF6856EF3665" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Autonomous Vehicle Accessibility Act</short-title></quote> or the <quote><short-title>AV Accessibility Act</short-title></quote>. </text></section><section id="H24BBBADAC09942789E8C0C10ED5EBC0F" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HB658E9A255594F4EBA4704596927BB63"><enum>(1)</enum><header>Disability</header><text>The term <quote>disability</quote> has the meaning given the term in section 12102 of title 42, United States Code.</text></paragraph><paragraph id="HECB3B64E04824930B13A43D452BAF15E" commented="no"><enum>(2)</enum><header>Public transportation</header><text>The term <quote>public transportation</quote> has the meaning given the term in section 5302 of title 49, United States Code. </text></paragraph><paragraph id="HB2B63B7FFF224C919BFF4CD24F687DDA"><enum>(3)</enum><header>Ride-hail ads-equipped vehicle</header><text>The term <quote>ride-hail ADS-equipped vehicle</quote> means an ADS-equipped vehicle that is—</text><subparagraph id="H9DCD33D5821D474BB63791ED17CE6B4A"><enum>(A)</enum><text display-inline="yes-display-inline">offered for pre-arranged transportation services for compensation, using an online-enabled application or electronic platform to connect passengers with vehicles; and</text></subparagraph><subparagraph id="H1D87D7F2565A425BA2B75CB037467E66"><enum>(B)</enum><text display-inline="yes-display-inline">dispatched in driverless operation.</text></subparagraph></paragraph><paragraph id="H8C94A51ACDFB4FEE9E9D78C44AE81506"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Transportation.</text></paragraph><paragraph id="HA339DD8568DA4E60B423C517F182D37F" commented="no"><enum>(5)</enum><header>SAE-defined terms</header><text display-inline="yes-display-inline">The terms <quote>ADS-equipped vehicle</quote>, <quote>dispatch</quote>, <quote>Level 4</quote>, <quote>Level 5</quote>, and <quote>driverless operation</quote> have the meanings given such terms in the document titled SAE International Recommended Practice J3016, published in April 2021, or by a revision of that such document subsequently adopted by the Secretary. </text></paragraph></section><section id="H6EC98DCA5F4D4053835B7C9610B9FD33" commented="no"><enum>3.</enum><header>Licensing</header><text display-inline="no-display-inline">In accordance with title II of the Americans with Disabilities Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12132">42 U.S.C. 12132</external-xref>), a State shall not issue a motor vehicle operator’s license for the operation or use of an ADS-equipped vehicle operating at Level 4 or Level 5 in a manner that discriminates on the basis of disability against a qualified individual with a disability. </text></section><section id="H0AFB6C60B65F4FB097365271F13DCDE5"><enum>4.</enum><header>Accessible infrastructure study</header><text display-inline="no-display-inline">The Secretary shall seek to enter into an agreement with the National Academies to conduct a study to—</text><paragraph id="H6CDF18AC8B2F4E8698B3A855851D945A"><enum>(1)</enum><text>determine changes to public transportation infrastructure that would improve the ability of individuals with disabilities to find, access, and use ride-hail ADS-equipped vehicles, including during pickup and dropoff; and</text></paragraph><paragraph id="HA9FD96C609BE40F58A014E23853AF1A2"><enum>(2)</enum><text display-inline="yes-display-inline">identify options to simplify safe access of ride-hail ADS-equipped vehicles, such as non-visual access for individuals with disabilities, including the consideration of—</text><subparagraph id="HDA5F0DE30FEA43D381158E0E2FDCFBA5"><enum>(A)</enum><text>technological solutions for dynamic curb management;</text></subparagraph><subparagraph id="HFC937AFF2FF54D998143945C51ACDE8B"><enum>(B)</enum><text>sidewalk and roadway design;</text></subparagraph><subparagraph id="H49AD802AAAAA44CEAFC891CF2E472632"><enum>(C)</enum><text>dedicated pick-up and drop-off zones;</text></subparagraph><subparagraph id="HFE98EFBFD0AF483BA2287C8EE1D015AB"><enum>(D)</enum><text>curb extension;</text></subparagraph><subparagraph id="HB20EF0BF97F04290BDF558B3E5FA2C31"><enum>(E)</enum><text>infrastructure design; and</text></subparagraph><subparagraph id="H3298648F9BD0459BBA088F4BE37D20AF"><enum>(F)</enum><text>other factors that can better enable individuals with disabilities to safely locate, enter, use, and exit ride-hail ADS-equipped vehicles during pickup and dropoff.</text></subparagraph></paragraph></section><section id="H8F8DA0852A094E2D97BA8EDE128B3003"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated $5,000,000 to carry out section 4, to be available until expended.</text></section></legis-body></bill>
