Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Federal Trade Commission to revise the Telemarketing Sales Rule to require disclosures for telemarketing using artificial intelligence and to provide for enhanced penalties for violations involving artificial intelligence voice or text message impersonation, and for other purposes.</official-title></form><legis-body id="H3F4F8E4F6D4E42A586DFFB0B4892BFBE" style="OLC"><section id="H3696454F443B436884D0C05C589B1A73" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restrictions on Utilizing Realistic Electronic Artificial Language Act</short-title></quote> or the <quote><short-title>R U REAL Act</short-title></quote>.</text></section><section id="HA3B1DFE431934D7E88ACA8B2001DB82A"><enum>2.</enum><header>Disclosure required for telemarketing using AI</header><subsection id="H5A25D791BA5E453EAA8CB3325AA98635"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Federal Trade Commission shall revise the Telemarketing Sales Rule (part 310 of title 16, Code of Federal Regulations) so as to add a requirement that, if a person makes a call or sends a text message with respect to telemarketing and uses artificial intelligence in such call or text message to emulate a human being, such person shall disclose at the beginning of such call or text message the fact that artificial intelligence is being used.</text></subsection><subsection id="H52018BFB1F5D4679A9F0E8A358FB2954"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the terms <quote>telemarketing</quote> and <quote>text message</quote> have the meanings given such terms in section 7 of the Telemarketing and Consumer Fraud and Abuse Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6106">15 U.S.C. 6106</external-xref>), as amended by this Act.</text></subsection></section><section id="H32E3AA8141A749D8AF76D9B92D39CF34"><enum>3.</enum><header>Enhanced penalties for violations of telemarketing rules involving AI voice or text message impersonation</header><subsection id="H0AC294E7972C4FDABB4FA1CC9BEC56F0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 6 of the Telemarketing and Consumer Fraud and Abuse Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6105">15 U.S.C. 6105</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HEB86F8B59DC94513BA50FE286D0E4C1F" display-inline="no-display-inline"><subsection id="HB96A934301A4455A82E650874522D247"><enum>(e)</enum><header>Enhanced penalties for violations involving AI voice or text message impersonation</header><paragraph id="H47E6D024AE574D6C85B10414C744F190"><enum>(1)</enum><header>Penalties under Federal Trade Commission Act</header><text display-inline="yes-display-inline">Notwithstanding subsection (b), in the case of a violation described in paragraph (2), the maximum amount of the civil penalty that may be imposed for such violation under subsection (l) or (m) (as the case may be) of section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>) shall be twice the maximum amount that may be imposed for such violation under such subsection without regard to this subsection.</text></paragraph><paragraph id="H796FF1B68C844DA597FFF8DD2CD03D3E"><enum>(2)</enum><header>Violations described</header><text>The violations described in this paragraph are the following:</text><subparagraph id="H84C5C1926C624FE48B39DFBBB864105A"><enum>(A)</enum><text display-inline="yes-display-inline">A violation of a rule prescribed by the Commission under section 3 with respect to which the party making the call or sending the text message uses artificial intelligence to impersonate an individual or entity with the intent to defraud, cause harm, or wrongfully obtain anything of value.</text></subparagraph><subparagraph id="HF94D0A592EDC463BB8E1BFFF2ED2DE8E" commented="no"><enum>(B)</enum><text>A violation of a cease-and-desist order issued by the Commission under section 5(b) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(b)</external-xref>) with respect to a violation described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H547A7DCD935C403C9B0B9F7F46365FA3"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply with respect to violations occurring after the date of the enactment of this Act.</text></subsection></section><section id="H5D4700AD0CFE4FC994AB950F46E743FA"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 7 of the Telemarketing and Consumer Fraud and Abuse Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6106">15 U.S.C. 6106</external-xref>) is amended—</text><paragraph id="H6403C2758862430CBD8F171DF194061D"><enum>(1)</enum><text>in paragraph (4), by inserting <quote>or text message</quote> after <quote>telephone call</quote>; and</text></paragraph><paragraph id="H5B68F8208DFC46FC9DC1E56D49DC4D3D"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H7E4C3494AE8442FFA3997DFDCE12ECCB" display-inline="no-display-inline"><paragraph id="H00CEAD7CC9FC4862BFEA593DC43EEEBC" commented="no"><enum>(5)</enum><header>Text message</header><subparagraph id="HCA58FA64F5B14AD084A6EF37DDD97D8E" commented="no"><enum>(A)</enum><header>In general</header><text>The term <quote>text message</quote> means a message consisting of text, images, sounds, or other information that is transmitted to or from a device that is identified as the receiving or transmitting device by means of a 10-digit telephone number, N11 service code, short code telephone number, or email address, or that is transmitted through application-to-person messaging, and includes—</text><clause id="H7F8D2A11F80740B2B45D6C09DBFEBDA8" commented="no"><enum>(i)</enum><text>a short message service (commonly referred to as <quote>SMS</quote>) message;</text></clause><clause id="H2AE7530807DD4B91BAECEC71B067701D" commented="no"><enum>(ii)</enum><text>a multimedia message service (commonly referred to as <quote>MMS</quote>) message; and</text></clause><clause id="H19D93A66486A4EA7A8DB040D2117FF79" commented="no"><enum>(iii)</enum><text>a rich communication service (commonly referred to as <quote>RCS</quote>) message. </text></clause></subparagraph><subparagraph id="H49AFC25081B1415B81300A140CB7A58B" commented="no"><enum>(B)</enum><header>Limitation</header><text>The term <quote>text message</quote> does not include a real-time, two-way voice or video communication. </text></subparagraph></paragraph><after-quoted-block>.
