R. 7110</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240129">January 29, 2024</action-date><action-desc><sponsor name-id="E000297">Mr. Espaillat</sponsor> (for himself and <cosponsor name-id="T000486">Mr. Torres of New York</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to require building inspections for certain qualified low-income buildings.</official-title></form><legis-body id="H639B748A1B344D9CBEB923C381A46704" style="OLC"><section id="H3D99D5F397754817B4928C9A687F81D6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Low Income Housing Tax Credit Landlord Accountability Act of 2024</short-title></quote> or the <quote><short-title>LIHTC Landlord Accountability Act of 2024</short-title></quote>.</text></section><section id="H5DF2517EB26742F1B453C93DC1DE9CBD"><enum>2.</enum><header>Low income housing tax credit building inspection requirements</header><subsection id="HF3F02C2B6C2F4B81B10B4D7062A53DAE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/42">Section 42(d)(2)(B)</external-xref> of the Internal Revenue Code of 1986 is amended in clause (iii) by striking <quote>and</quote> at the end, in clause (iv) by striking the period at the end and inserting <quote>, and</quote>, and by adding at the end the following new clause:</text><quoted-block style="OLC" id="H67C5B301AD3F418A98233C178A1EF5C2" display-inline="no-display-inline"><clause id="H3E300BBC03544C14A11B8601DC66B85F"><enum>(v)</enum><text display-inline="yes-display-inline">the building meets the requirements of applicable local, State, Federal, and Tribal laws relating to safety, habitability, or environment protection, as certified by an appropriately licensed professional during the credit period.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H963738AD139045D29B9722D9CF40FBC0"><enum>(b)</enum><header>Required annual reports</header><text>Section 42(l)(2) of such Code is amended by striking <quote>may require taxpayers</quote> and inserting <quote>shall require each taxpayer that owns a qualified low-income building</quote>.</text></subsection><subsection id="H32A5893AF71F46E1B27ED60F6883F4BD"><enum>(c)</enum><header>Physical condition assessment required</header><text>Section 42(l)(2) of such Code is amended by redesignating subparagraph (C) as subparagraph (D) and by inserting after subparagraph (B) the following new subparagraph:</text><quoted-block style="OLC" id="H0B42582075814C84B9766DDDFF548950" display-inline="no-display-inline"><subparagraph id="H41295E5CA92441B3BC72910286F2BED9"><enum>(B)</enum><text display-inline="yes-display-inline">a physical condition assessment including photographs and a detailed narrative of the interior and exterior of the structure completed by an appropriately licensed professional—</text><clause id="H97A3799FD18B4DDA942E30975CA50770"><enum>(i)</enum><text>evaluating the structural, physical, and health and safety conditions of the structural and mechanical systems of each such building, and</text></clause><clause id="H777845C535014E459E8329059B7F2DA6"><enum>(ii)</enum><text>providing cost estimates for maintaining the building and any necessary rehabilitation or remediation work.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD08F31F0F97743168B79E82DAF6E172E"><enum>(d)</enum><header>Report to Congress</header><text>Section 42 of such Code is amended by redesignating subsection (n) as subsection (o) and by inserting after subsection (m) the following new subsection:</text><quoted-block style="OLC" id="H3F5A110EA32B4BB484FD66F724CB8944" display-inline="no-display-inline"><subsection id="H8E10452355D04BC1A452AB68ACAE72BA"><enum>(n)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">The Secretary shall annually submit a report to Congress summarizing the contents of returns submitted to the Secretary under subsection (l)(2) during the preceding calendar year.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H98C3ADAEFB614E8EABC8AF8262E23858"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
