which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide loans and other financial assistance to small businesses affected by the wildfires on Maui, and for other purpose.</official-title></form><legis-body id="H39F7D73AA35B4A02895861BB0C23119A" style="OLC"><section id="HC098C9CE18044C99B56A5BE6DED755AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healing and Economic Advancement for Local businesses in Maui Act</short-title></quote> or the <quote><short-title>HEAL Maui Act</short-title></quote>.</text></section><section id="H0FAF31F504094D0EA1C0833C56E6C942"><enum>2.</enum><header>Emergency EIDL grants</header><subsection id="HED55417C80B64CBF853F4D500E9757D8"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="HC8F1BBC8F1CE40DB966D520B20DC4C0B"><enum>(1)</enum><text>the term <term>covered entity</term> means—</text><subparagraph id="H552B1A7CB34A44178FB26F8FCA8F9D01"><enum>(A)</enum><text>a business with not more than 500 employees;</text></subparagraph><subparagraph id="H2E0F38CAD0F14CFD8A2B3A6F902A9A5A"><enum>(B)</enum><text>any individual who operates under a sole proprietorship, with or without employees, or as an independent contractor;</text></subparagraph><subparagraph id="HD749D2F956AF4CBDA57ECEA29E93EA4A"><enum>(C)</enum><text>a cooperative with not more than 500 employees;</text></subparagraph><subparagraph id="H81560F14FFEB429FB778C418FEB707DE"><enum>(D)</enum><text>an ESOP (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)) with not more than 500 employees; or</text></subparagraph><subparagraph id="HE23999CC525A4E6A865C911384BA74AC"><enum>(E)</enum><text>a tribal small business concern, as described in section 31(b)(2)(C) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657a">15 U.S.C. 657a(b)(2)(C)</external-xref>), with not more than 500 employees;</text></subparagraph></paragraph><paragraph id="HD030348AB6124DEEAE00D00EC58C56D2"><enum>(2)</enum><text>the term <term>covered period</term> means the period beginning on August 8, 2023, and ending on May 10, 2024;</text></paragraph><paragraph id="H98D7A50CAAB547B1AB8FAFB00190EA15"><enum>(3)</enum><text>the term <term>eligible entity</term> means a covered entity the principal office of which is located on Maui and not fewer than 35 percent of the employees of which reside on Maui; and</text></paragraph><paragraph id="H626889A802A64246AE2950250303586A" commented="no"><enum>(4)</enum><text>the term <term>Hawai’i Wildfires</term> means wildfires occurring in Hawai’i during the period beginning on August 1, 2023, and ending on September 30, 2023.</text></paragraph></subsection><subsection id="HBCD14E53EB0449D0A841CAAE8453B67E"><enum>(b)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">During the covered period, in addition to small business concerns, private nonprofit organizations, and small agricultural cooperatives, an eligible entity shall be eligible for a loan made under section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>).</text></subsection><subsection id="H0C3407F5CA564E89B182E2C317A60C8A"><enum>(c)</enum><header>Terms; credit elsewhere</header><text display-inline="yes-display-inline">With respect to a loan made under section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>) during the covered period in response to the Hawai‘i Wildfires, the Administrator shall waive—</text><paragraph id="H5FDC5FDD185847E1B88617A4DE11999D"><enum>(1)</enum><text display-inline="yes-display-inline">any rules related to personal guarantee on advances and loans of not more than $200,000 during the covered period for all applicants;</text></paragraph><paragraph id="H3E99E955CAFA4774B080847FA08558D9"><enum>(2)</enum><text display-inline="yes-display-inline">the requirement that an applicant needs to be in business for the 1-year period before the disaster, except that no waiver may be made for a business that was not in operation on August 8, 2023; and</text></paragraph><paragraph id="H42A5D23DF1AE4F89A04FC58C5AB253BE"><enum>(3)</enum><text display-inline="yes-display-inline">the requirement in the flush matter following subparagraph (E) of section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>) that an applicant be unable to obtain credit elsewhere.</text></paragraph></subsection><subsection id="H6944CC1162BF435BBBCA012182420FB1"><enum>(d)</enum><header>Approval and Ability To Repay for Small Dollar Loans</header><text display-inline="yes-display-inline">With respect to a loan made under section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>) during the covered period in response to the Hawai‘i Wildfires, the Administrator may—</text><paragraph id="H528BB458F58C4D089E8C5E8718897C51"><enum>(1)</enum><text display-inline="yes-display-inline">approve an applicant based solely on the credit score of the applicant and shall not require an applicant to submit a tax return or a tax return transcript for such approval; or</text></paragraph><paragraph id="HDF23D0A80EF64D3DB67963FA6DA71F70"><enum>(2)</enum><text>use alternative appropriate methods to determine an applicant's ability to repay.</text></paragraph></subsection><subsection id="H6B1809D200394AE8A81E083A6E25D91B"><enum>(e)</enum><header>Emergency grant</header><paragraph id="H3E56ACD1BE5A4200BF1B412B2239D707"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">During the covered period, an entity made eligible for a loan under section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>) by subsection (b) of this Act, including small business concerns, private nonprofit organizations, and small agricultural cooperatives, that applies for a loan under such section 7(b)(2) in response to the Hawai‘i Wildfires may request that the Administrator provide to such entity an advance that is, subject to paragraph (4), in the amount requested by such entity.</text></paragraph><paragraph id="H918D932552ED49E4B0F5617265778B30"><enum>(2)</enum><header>Timing</header><text display-inline="yes-display-inline">The Administrator shall provide an advance under this subsection to the entity requesting such advance not later than three days after the Administrator receives from such entity an application for a loan under section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>) in response to the Hawai‘i Wildfires, a request for such advance, and the self-certification required by paragraph (3).</text></paragraph><paragraph id="H179BD4A8BE7843D8B0DDE4AA09E908AA"><enum>(3)</enum><header>Verification</header><subparagraph id="H1DF53DAB8AD84C618B2505E05435FEFD"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An entity seeking an advance under this subsection shall submit to the Administrator, under penalty of perjury pursuant to section 1746 of title 28, United States Code, a self-certification that such entity is an eligible entity.</text></subparagraph><subparagraph id="HBA85FE5D075D4B62808CD64B97FAF747"><enum>(B)</enum><header>Timing</header><text>The Administrator may not disburse any amounts under this subsection to an entity before such entity submits a self-certification under subparagraph (A).</text></subparagraph></paragraph><paragraph id="HD14AEE20C6DE4F8DA95D68299857C06D"><enum>(4)</enum><header>Amount</header><text display-inline="yes-display-inline">The amount of an advance provided under this subsection shall be not more than $15,000.</text></paragraph><paragraph id="H50289E28C5DD4F43A365AF4CC1123DBC"><enum>(5)</enum><header>Prioritization</header><subparagraph id="H72B54C617BF841F99FA1A12D0786F6BA"><enum>(A)</enum><header>In general</header><text>The Administrator shall prioritize providing advances under this subsection to eligible entities that experienced economic loss of not less than 30 percent.</text></subparagraph><subparagraph id="HCFF2731369374AA59300228E4725334E"><enum>(B)</enum><header>Economic loss defined</header><text>In this paragraph, the term <term>economic loss</term> means, with respect to an eligible entity—</text><clause id="H489858E67CC04F3AB48E7B5DA27B4D07"><enum>(i)</enum><text display-inline="yes-display-inline">the amount by which the gross receipts of the eligible entity declined during an 8-week period between August 8, 2023, and May 10, 2024, relative to a comparable 8-week period between January 1, 2022, and August 7, 2023; or</text></clause><clause id="HA2A6CAF00DFA47D29808E91CAF9C7F11"><enum>(ii)</enum><text display-inline="yes-display-inline">if the eligible entity is a seasonal business concern, such other amount determined appropriate by the Administrator.</text></clause></subparagraph></paragraph><paragraph id="H3D4D40D04FCB4F12B9ACAD867E190577"><enum>(6)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An advance provided under this subsection may be used to address any allowable purpose for a loan made under section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>), including—</text><subparagraph id="HC4AC984318DB44808E9F3D2ED102CB78"><enum>(A)</enum><text>maintaining payroll to retain employees during business disruptions or substantial slowdowns;</text></subparagraph><subparagraph id="H6F79E86E912440A9ADBE106807287902"><enum>(B)</enum><text>paying increased costs to obtain materials due to disruptions to supply chains;</text></subparagraph><subparagraph id="H9E1A10FCDC9F425EA92A49AE50DFD451"><enum>(C)</enum><text>making rent or mortgage payments; and</text></subparagraph><subparagraph id="H81690A4C258E4747AA2978D80777AB15"><enum>(D)</enum><text>repaying obligations that cannot be met due to revenue losses.</text></subparagraph></paragraph><paragraph id="H2E9A026113C543DC97B44129B77FC328"><enum>(7)</enum><header>Repayment</header><subparagraph id="HE7D4AFA314FF402AB92255400CE7BB43"><enum>(A)</enum><header>In general</header><text>An entity shall not be required to repay any amounts of an advance provided under this subsection, even if subsequently denied a loan under section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>).</text></subparagraph><subparagraph id="HC444D503669445FD90FF4B2A4A02DAE5"><enum>(B)</enum><header>Tax treatment</header><text display-inline="yes-display-inline">For purposes of the Internal Revenue Code of 1986—</text><clause id="HCBAAAC6589BD4886A78AF140C402FA9C"><enum>(i)</enum><text>no amount shall be included in the gross income of the eligible recipient by reason of subparagraph (A),</text></clause><clause id="H7E5D147E322245208DFADD78699D6C2F"><enum>(ii)</enum><text>no deduction shall be denied, no tax attribute shall be reduced, and no basis increase shall be denied, by reason of the exclusion from gross income provided by clause (i), and</text></clause><clause id="HA61DFD55B0D541768B8F81EABF865F6B"><enum>(iii)</enum><text>in the case of an eligible recipient that is a partnership or S corporation—</text><subclause id="HDCBAE7A5C67847AE990104AC4A1C588F"><enum>(I)</enum><text>any amount excluded from income by reason of clause (i) shall be treated as tax exempt income for purposes of sections 705 and 1366 of title 26, and</text></subclause><subclause id="HD1B0972296C349B6A174516C5278AECD"><enum>(II)</enum><text>except as provided by the Secretary of the Treasury (or the Secretary's delegate), any increase in the adjusted basis of a partner's interest in a partnership under section 705 of title 26 with respect to any amount described in subclause (I) shall equal the partner's distributive share of deductions resulting from costs paid in accordance with paragraph (6) using amounts from an advance provided under this section.</text></subclause></clause></subparagraph></paragraph><paragraph id="H5B1473CA6AC8489AA945497FB177486C"><enum>(8)</enum><header>Subsequent loan grant</header><text display-inline="yes-display-inline">If an entity that receives an advance under this subsection transfers into, or is approved for, the loan program under paragraph (38) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>), the advance amount shall be reduced from the loan forgiveness amount for a loan for payroll costs made under such paragraph (38).</text></paragraph><paragraph id="H7A9CB369C5574FB48F14111567586DDC"><enum>(9)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Administration $1,000,000,000 to carry out this subsection.</text></paragraph><paragraph id="H25C607AC48D4437FBB379FF2CE742ED1"><enum>(10)</enum><header>Termination</header><text display-inline="yes-display-inline">The authority to make advances under this subsection shall terminate on May 10, 2024.</text></paragraph></subsection><subsection id="HD42FA204566249F9A7938B2A1F7932BE"><enum>(f)</enum><header>Appropriations</header><text display-inline="yes-display-inline">There is appropriated, out of amounts in the Treasury not otherwise appropriated, for the fiscal year ending September 30, 2023, to remain available until September 30, 2024, for additional amounts $1,000,000,000 under the heading <quote>Small Business Administration—Emergency EIDL Grants</quote> for carrying out this section.</text></subsection></section><section id="H13ECA215F7894D14AE4AA8CF92A40F10"><enum>3.</enum><header>Maui Wildfire Paycheck Protection Program</header><subsection id="HBAEA8B05BF274F918E5FA6F3F1E2F7CF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7(a) of the small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) is amended—</text><paragraph id="H090067FCBE3A459FB3D873694E5BF5D7"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="HC7BC5DB6B72946F7A2FA35D4ACCEB527"><enum>(A)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>and (F)</quote> and inserting <quote>(F), and (G)</quote>; and</text></subparagraph><subparagraph id="HFC908338B11742E595A2B14073EEDBAA"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H605715BBD24D4CA897D450E9876B49E1" display-inline="no-display-inline"><subparagraph id="HBCE52D117D75410AB42A1A0F28AE922C"><enum>(G)</enum><header>Participation in the Maui wildfire paycheck protection program</header><text display-inline="yes-display-inline">In an agreement to participate in a loan on a deferred basis under paragraph (38), the participation by the Administration shall be 100 percent.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H91F2633796684506AB7931FD487173EC"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HC9FBF6BDEFF14550994A627AD08C3F12" display-inline="no-display-inline"><paragraph id="HC20DE5BDB0EA4C5DB9E1CE588E098C09"><enum>(38)</enum><header>Maui wildfire paycheck protection program</header><subparagraph id="HB34C5FA9FD594397B28FEF74CD4CB9BD"><enum>(A)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph—</text><clause id="H9822A55D07ED4DF79F87BCE9C3BCD578"><enum>(i)</enum><text display-inline="yes-display-inline">the terms <term>appropriate Federal banking agency</term>, <term>insured depository institution</term>, <term>eligible self-employed individual</term>, <term>insured credit union</term>, <term>nonprofit organization</term>, <term>payroll costs</term> and <term>veterans organization</term> have the meanings given such terms under paragraph (36)(A);</text></clause><clause id="HAEFFD30125B441AE9F7DC25D444D1596"><enum>(ii)</enum><text display-inline="yes-display-inline">the term <term>covered loan</term> means a loan made under this paragraph during the covered period;</text></clause><clause id="H53AA0DA976AB4F3281B6FA04DBE7689C"><enum>(iii)</enum><text>the term <term>covered period</term> means the period beginning on August 8, 2023, and ending on May 10, 2024; and</text></clause><clause id="H506DE8716FC74DB8B46B6688F1192279"><enum>(iv)</enum><text display-inline="yes-display-inline">the term <term>eligible recipient</term> means an individual or entity that is eligible to receive a covered loan.</text></clause></subparagraph><subparagraph id="HCFD39367183D48ED911A043D69B9D9C8"><enum>(B)</enum><header>Maui wildfire paycheck protection program</header><text display-inline="yes-display-inline">Except as otherwise provided in this paragraph, the Administrator may guarantee covered loans under the same terms, conditions, and processes as a loan made under this subsection.</text></subparagraph><subparagraph id="H031E832D73DA4791AEFB7099F67C9106"><enum>(C)</enum><header>Registration of loans</header><text display-inline="yes-display-inline">Not later than 15 days after the date on which a loan is made under this paragraph, the Administration shall register the loan using the TIN (as defined in section 7701 of title 26) assigned to the borrower.</text></subparagraph><subparagraph id="H7447345A603A41338894CEFF162EE458" commented="no"><enum>(D)</enum><header>Increased eligibility for certain small business and organizations</header><clause id="H5018528967FD4541ADD87D41357E91CD" commented="no"><enum>(i)</enum><header>Inclusion of sole proprietors, independent contractors, and eligible self-employed individuals</header><subclause id="H092D5DEA054F475D8C6CE8A5949251EC" commented="no"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">During the covered period, individuals who operate under a sole proprietorship or as an independent contractor and eligible self-employed individuals shall be eligible to receive a covered loan.</text></subclause><subclause id="H84AA187AD179492AA29C94F713219441" commented="no"><enum>(II)</enum><header>Documentation</header><text display-inline="yes-display-inline">An eligible self-employed individual, independent contractor, or sole proprietorship seeking a covered loan shall submit such documentation as determined necessary by the Administrator and the Secretary, to establish the applicant as eligible.</text></subclause></clause><clause id="H6965FD38993A47DAA132D97BCBE0489A" commented="no"><enum>(ii)</enum><header>Business concerns with more than 1 physical location</header><text display-inline="yes-display-inline">During the covered period, any business concern that employs not more than 500 employees per physical location of the business concern and that is assigned a North American Industry Classification System code beginning with 72 at the time of disbursal shall be eligible to receive a covered loan.</text></clause><clause id="H1FFF6A46188D4C64B207DDC76106375F" commented="no"><enum>(iii)</enum><header>Waiver of affiliation rules</header><text display-inline="yes-display-inline">During the covered period, the provisions applicable to affiliations under section 121.103 of title 13, Code of Federal Regulations, or any successor regulation, are waived with respect to eligibility for a covered loan for—</text><subclause id="HEC9FDE7EF73A42E0B6CC9152D69F5A2F" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">any business concern with not more than 500 employees that, as of the date on which the covered loan is disbursed, is assigned a North American Industry Classification System code beginning with 72;</text></subclause><subclause id="H22FD8C558C7F4F86B877FCB688E6BA81" commented="no"><enum>(II)</enum><text>any business concern operating as a franchise that is assigned a franchise identifier code by the Administration; and</text></subclause><subclause id="H492F7C25244F45FD995568F496863ED5" commented="no"><enum>(III)</enum><text>any business concern that receives financial assistance from a company licensed under section 301 of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/681">15 U.S.C. 681</external-xref>).</text></subclause></clause><clause id="H552400423E0B4AC1B791E12AD0BAC795" commented="no"><enum>(iv)</enum><header>Affiliation</header><text display-inline="yes-display-inline">The provisions applicable to affiliations under section 121.103 of title 13, Code of Federal Regulations, or any successor thereto, shall apply with respect to a nonprofit organization and a veterans organization in the same manner as with respect to a small business concern.</text></clause></subparagraph><subparagraph id="H3529E361158C4A6297EFB8797CC08C99"><enum>(E)</enum><header>Maximum loan amount</header><text display-inline="yes-display-inline">During the covered period, with respect to a covered loan, the maximum loan amount shall be the lesser of—</text><clause id="H364036E5B5A84C8793EBF232B62CBF76"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H4D616308B2CD4B65A02AE0B23E5C6BAB"><enum>(I)</enum><text>the sum of—</text><item id="H311B0A9727EF43249575F312684BBB58" indent="up1"><enum>(aa)</enum><text display-inline="yes-display-inline">the product obtained by multiplying—</text><subitem id="H339D5B3B32C74E188D09559036DC676F"><enum>(AA)</enum><text display-inline="yes-display-inline">the average total monthly payments by the applicant for payroll costs incurred during the 1-year period before the date on which the loan is made, except that, in the case of an applicant that is seasonal employer, as determined by the Administrator, the average total monthly payments for payroll shall be for any 12-week period selected by the seasonal employer that is between August 8, 2023, and May 10, 2024 and ends before the date on which the loan is made; by</text></subitem><subitem id="HE9B00FB95A144FF08AC14A38052AD5D3"><enum>(BB)</enum><text>2.5; and</text></subitem></item><item id="H0AA6BF0636BC4799A5E1F14F8FF711FC" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">the outstanding amount of a loan under subsection (b)(2) that was made during the period beginning on August 8, 2023, and ending on the date on which covered loans are made available to be refinanced under the covered loan; or</text></item></subclause><subclause id="H11B7233EDAF94631959E958A7D58EE65" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">if requested by an otherwise eligible recipient that was not in business during the period beginning on August 8, 2022, and ending on May 10, 2023, the sum of—</text><item id="H59C4F5B368D54979A58B0E07F27F06D1"><enum>(aa)</enum><text display-inline="yes-display-inline">the product obtained by multiplying—</text><subitem id="H0901FDF09FE847C99F744AD3173AEB09"><enum>(AA)</enum><text display-inline="yes-display-inline">the average total monthly payments by the applicant for payroll costs incurred during the period beginning on May 11, 2023, and ending on August 8, 2023; by</text></subitem><subitem id="H94A0B95D00734ABAAD1CACD3575E567E"><enum>(BB)</enum><text>2.5; and</text></subitem></item><item id="HB4155FC135A24236B119B27D0D077B2E"><enum>(bb)</enum><text display-inline="yes-display-inline">the outstanding amount of a loan under subsection (b)(2) that was made during the period beginning on August 8, 2023, and ending on the date on which covered loans are made available to be refinanced under the covered loan; or</text></item></subclause></clause><clause id="HB8C30303B97E42A9991D911A0C2905FF"><enum>(ii)</enum><text>the costs, expenses, and expenditures described in subclauses (I) through (XI) of subparagraph (F)(i) that were incurred by the applicant during the covered period with respect to employees of the applicant on Maui, up to $10,000,000.</text></clause></subparagraph><subparagraph id="HEE0F47EFC1AC4495BF728595089644F6"><enum>(F)</enum><header>Allowable uses of covered loans</header><clause id="H773C7B7FA00541548E321A4C1DCA59BB"><enum>(i)</enum><header>In general</header><text>During the covered period, an eligible recipient may, in addition to the allowable uses of a loan made under this subsection, use the proceeds of the covered loan for any of the following costs, expenses, or expenditures incurred with respect to employees, property, or operations of the eligibility recipient on Maui:</text><subclause id="H2576B0365BBE47478FDBEDFBCF80F568"><enum>(I)</enum><text>Payroll costs.</text></subclause><subclause id="HE5DE7DC4F1FD4BE6A70492373E1627C5"><enum>(II)</enum><text>Costs related to the continuation of group health care benefits during periods of paid sick, medical, or family leave, and insurance premiums.</text></subclause><subclause id="H1713475C56834AD098927082E427AE30"><enum>(III)</enum><text>Employee salaries, commissions, or similar compensations.</text></subclause><subclause id="H9797BD7CC5D2486D9A720E4D8BC77641"><enum>(IV)</enum><text>Payments of interest on any mortgage obligation (which shall not include any prepayment of or payment of principal on a mortgage obligation).</text></subclause><subclause id="HC223AB5E57BB424584A2734B4F299C60"><enum>(V)</enum><text>Rent (including rent under a lease agreement).</text></subclause><subclause id="H6517BECE5E34443197CCAA3D98614172"><enum>(VI)</enum><text>Utilities.</text></subclause><subclause id="HD313F5DB70CB4CAA962853560DB9514F"><enum>(VII)</enum><text>Interest on any other debt obligations that were incurred before the covered period.</text></subclause><subclause id="H97E1A92AD9A641A9AD48AF5C51C45E2C"><enum>(VIII)</enum><text display-inline="yes-display-inline">Covered operations expenditures, as defined in section 4(a) of the Healing and Economic Advancement for Local businesses in Maui Act.</text></subclause><subclause id="HF18F1C0D65644326916492F421AA6D17"><enum>(IX)</enum><text>Covered property damage costs, as defined in such section.</text></subclause><subclause id="H8861C009E20249D2A3407F73B236F5C5"><enum>(X)</enum><text>Covered supplier costs, as defined in such section.</text></subclause><subclause id="H7EC6FF292A664AF3AAE30E43A6176C55"><enum>(XI)</enum><text>Covered worker protection expenditures, as defined in such section.</text></subclause></clause><clause id="H7D7BC88E3D744760AD2EF471EE03723D"><enum>(ii)</enum><header>Delegated authority</header><subclause id="H56B9A7F4DEB84766BCFA29847722BA03"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of making covered loans for the purposes described in clause (i), a lender approved to make loans under this subsection shall be deemed to have been delegated authority by the Administrator to make and approve covered loans, subject to the provisions of this paragraph.</text></subclause><subclause id="H4BD2BAAFD96F43A893B7FFB7FF717E92"><enum>(II)</enum><header>Considerations</header><text display-inline="yes-display-inline">In evaluating the eligibility of a borrower for a covered loan with the terms described in this paragraph, a lender shall consider whether the borrower—</text><item id="H88F418A27A844389AA16868AE7528C2F"><enum>(aa)</enum><text display-inline="yes-display-inline">was in operation on August 8, 2023; and</text></item><item id="H965506E3439B469C92537F9FD07230D2"><enum>(bb)</enum><subitem commented="no" display-inline="yes-display-inline" id="H99A370BC4B814C198EA237E49C595B9B"><enum>(AA)</enum><text>had employees for whom the borrower paid salaries and payroll taxes; or</text></subitem><subitem id="H7653CEE000A545C5AEBC94B892638216" indent="up1"><enum>(BB)</enum><text>paid independent contractors, as reported on a Form 1099–MISC.</text></subitem></item></subclause></clause><clause id="HE9A12B5B8E984E3E81A363DECDE289E3"><enum>(iii)</enum><header>Additional lenders</header><text display-inline="yes-display-inline">The authority to make loans under this paragraph shall be extended to additional lenders determined by the Administrator and the Secretary of the Treasury to have the necessary qualifications to process, close, disburse and service loans made with the guarantee of the Administration.</text></clause><clause id="HB1814C94582540A4B86B8E7F53D5C89C"><enum>(iv)</enum><header>Refinance</header><text display-inline="yes-display-inline">A loan made under subsection (b)(2) during the period beginning on August 8, 2023, and ending on the date on which covered loans are made available may be refinanced as part of a covered loan.</text></clause><clause id="HD2F590206ADB463C97688324930B5F89"><enum>(v)</enum><header>Nonrecourse</header><text display-inline="yes-display-inline">Notwithstanding the waiver of the personal guarantee requirement or collateral under subparagraph (J), the Administrator shall have no recourse against any individual shareholder, member, or partner of an eligible recipient of a covered loan for nonpayment of any covered loan, except to the extent that such shareholder, member, or partner uses the covered loan proceeds for a purpose not authorized under clause (i) or (iv).</text></clause></subparagraph><subparagraph id="H0BE4E193641547828DCAD08F8D9C55BA"><enum>(G)</enum><header>Certification</header><text>An eligible recipient applying for a covered loan shall make a good faith certification—</text><clause id="HD61D1556B6574B80808BEB45342B2652"><enum>(i)</enum><text display-inline="yes-display-inline">that the uncertainty of current economic conditions makes necessary the loan request to support the ongoing operations of the eligible recipient;</text></clause><clause id="HA99F2D75E6844FC88AC72D112C72091F"><enum>(ii)</enum><text>acknowledging that funds will be used to retain workers and maintain payroll or make mortgage payments, lease payments, and utility payments;</text></clause><clause id="HCD79490F81254C74B21B58B7826B436B"><enum>(iii)</enum><text>that the eligible recipient does not have an application pending for a loan under this subsection for the same purpose and duplicative of amounts applied for or received under a covered loan; and</text></clause><clause id="H2BE0B27CF1A641B8922D1E67BDD51DB6"><enum>(iv)</enum><text>during the covered period, that the eligible recipient has not received amounts under this subsection for the same purpose and duplicative of amounts applied for or received under a covered loan.</text></clause></subparagraph><subparagraph id="HA65D6BD06BB345D6BC471D4A158C2786"><enum>(H)</enum><header>Fee waiver</header><text>With respect to a covered loan—</text><clause id="HC2E5103F77824A689087EF2B05BAF34D"><enum>(i)</enum><text display-inline="yes-display-inline">in lieu of the fee otherwise applicable under paragraph (23)(A), the Administrator shall collect no fee; and</text></clause><clause id="HD48F6E09FFB448BFBA9CC54CB581324D"><enum>(ii)</enum><text>in lieu of the fee otherwise applicable under paragraph (18)(A), the Administrator shall collect no fee.</text></clause></subparagraph><subparagraph id="H2531A423AC8F42D5A8B551CB658A2114"><enum>(I)</enum><header>Credit elsewhere</header><text display-inline="yes-display-inline">During the covered period, the requirement that a small business concern is unable to obtain credit elsewhere, as defined in section 3(h), shall not apply to a covered loan.</text></subparagraph><subparagraph id="H5F493328CC7E4C8C8FA891530E13E6B6"><enum>(J)</enum><header>Waiver of personal guarantee requirement</header><text>With respect to a covered loan—</text><clause id="HE5E6072566C44E35A277DA9A1E5C3DC5"><enum>(i)</enum><text display-inline="yes-display-inline">no personal guarantee shall be required for the covered loan; and</text></clause><clause id="HD6B6417885F94113ACCCCEFBEEE9F5D0"><enum>(ii)</enum><text>no collateral shall be required for the covered loan.</text></clause></subparagraph><subparagraph id="HA4252997AFD445628B1C4342C069A19D"><enum>(K)</enum><header>Maturity for loans with remaining balance after application of forgiveness</header><text display-inline="yes-display-inline">With respect to a covered loan that has a remaining balance after reduction based on the loan forgiveness amount under section 4 of the Healing and Economic Advancement for Local businesses in Maui Act—</text><clause id="HE23E390E68404B6AA884555B5B2F9F5A"><enum>(i)</enum><text display-inline="yes-display-inline">the remaining balance shall continue to be guaranteed by the Administration under this subsection; and</text></clause><clause id="HE5AAC791888D4045B513E1B187C24C5E"><enum>(ii)</enum><text>the covered loan shall have a maximum maturity of 10 years from the date on which the borrower applies for loan forgiveness under that section.</text></clause></subparagraph><subparagraph id="H44B6264E6C15437DBD3BFE30F59C7487"><enum>(L)</enum><header>Interest rate requirements</header><text display-inline="yes-display-inline">A covered loan shall bear an interest rate not to exceed 4 percent, calculated on a non-compounding, non-adjustable basis.</text></subparagraph><subparagraph id="H634B6EB5DC8E4F85892AEAA6839C3E87"><enum>(M)</enum><header>Loan deferment</header><clause id="HC03A6DFD33AA4080B1F8810DC1780254"><enum>(i)</enum><header>Definition of impacted borrower</header><subclause id="H9C4C44D458CD43F7A36E737276982D50"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>impacted borrower</term> means an eligible recipient that—</text><item id="H87A695C0282F44ACA268E17A98540283"><enum>(aa)</enum><text>was in operation on August 8, 2023; and</text></item><item id="HBDEE04750E134B909D237011F971B8E2"><enum>(bb)</enum><text>has an application for a covered loan that is approved or pending approval on or after the date of the enactment of this paragraph.</text></item></subclause><subclause id="HE12DBFB744E44F20AC919D19C99E03A3"><enum>(II)</enum><header>Presumption</header><text display-inline="yes-display-inline">For purposes of this subparagraph, an impacted borrower is presumed to have been adversely impacted by the Hawai’i Wildfires.</text></subclause></clause><clause id="H10E37DC58AF74C35894DE480B69F0F4D"><enum>(ii)</enum><header>Deferral</header><text>During the covered period, the Administrator shall—</text><subclause id="H75AC6D06445F4FC1AB2B742CC8B596E0"><enum>(I)</enum><text display-inline="yes-display-inline">consider each eligible recipient that applies for a covered loan to be an impacted borrower; and</text></subclause><subclause id="H58369EBD93E849AEA3BF37326B03B7B0"><enum>(II)</enum><text display-inline="yes-display-inline">require lenders under this subsection to provide complete payment deferment relief for impacted borrowers with covered loans for a period of not less than 6 months, including payment of principal, interest, and fees, and not more than 1 year.</text></subclause></clause><clause id="HC9C61710205D4200B947B8F01CAB2431"><enum>(iii)</enum><header>Secondary market</header><text display-inline="yes-display-inline">During the covered period, with respect to a covered loan that is sold on the secondary market, if an investor declines to approve a deferral requested by a lender under clause (ii), the Administrator shall exercise the authority to purchase the loan so that the impacted borrower may receive a deferral for a period of not less than 6 months, including payment of principal, interest, and fees, and not more than 1 year.</text></clause><clause id="HD88C5BCEC00D408CA7344C0EC4779227"><enum>(iv)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this paragraph, the Administrator shall provide guidance to lenders under this paragraph on the deferment process described in this subparagraph.</text></clause></subparagraph><subparagraph id="HC77C70FCF55141179B65BCE659413971"><enum>(N)</enum><header>Secondary market sales</header><text display-inline="yes-display-inline">A covered loan shall be eligible to be sold in the secondary market consistent with this subsection. The Administrator may not collect any fee for any guarantee sold into the secondary market under this subparagraph.</text></subparagraph><subparagraph id="H8DAC1B38E79A4E889F91A26DD07908BA"><enum>(O)</enum><header>Regulatory capital requirements</header><clause id="HD4D9B144495B4874B923456A5200D911"><enum>(i)</enum><header>Risk weight</header><text display-inline="yes-display-inline">With respect to the appropriate Federal banking agencies or the National Credit Union Administration Board applying capital requirements under their respective risk-based capital requirements, a covered loan shall receive a risk weight of zero percent.</text></clause><clause id="H28877FBB00F04BCDB327E0D9C5061AD9"><enum>(ii)</enum><header>Temporary relief from TDR disclosures</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an insured depository institution or an insured credit union that modifies a covered loan in relation to Hawai‘i Wildfire-related difficulties in a troubled debt restructuring on or after August 8, 2023, shall not be required to comply with the Financial Accounting Standards Board Accounting Standards Codification Subtopic 310–40 (<quote>Receivables - Troubled Debt Restructurings by Creditors</quote>) for purposes of compliance with the requirements of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1811">12 U.S.C. 1811 et seq.</external-xref>), until such time and under such circumstances as the appropriate Federal banking agency or the National Credit Union Administration Board, as applicable, determines appropriate.</text></clause></subparagraph><subparagraph id="HE6EB5EB8E3F34633A02570C668EC63C0"><enum>(P)</enum><header>Reimbursement for processing</header><clause id="HD46E2D5FCAF74EFBAC97B1A41BE18D69"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall reimburse a lender authorized to make a covered loan at a rate, based on the balance of the financing outstanding at the time of disbursement of the covered loan, of—</text><subclause id="HADC680DE298A465DBBCF539E3E9DF087"><enum>(I)</enum><text display-inline="yes-display-inline">the lesser of 50 percent of such balance or $2,500 for a covered loan of not more than $50,000;</text></subclause><subclause id="H93A6F869E0D04E23B3DD80BC69F7CA21"><enum>(II)</enum><text display-inline="yes-display-inline">5 percent for a covered loan of more than $50,000 and not more than $350,000;</text></subclause><subclause id="H360CC1AC03DB4020B0552B4C546DC45C"><enum>(III)</enum><text>3 percent for a covered loan of more than $350,000 and less than $2,000,000; and</text></subclause><subclause id="HA2D3E5C59855475B9E3141F5CCF44B7A"><enum>(IV)</enum><text>1 percent for a covered loan of not less than $2,000,000.</text></subclause></clause><clause id="HA1CB35DF1D0E4D0F94FB1BDC70660887"><enum>(ii)</enum><header>Fee limits</header><text display-inline="yes-display-inline">An agent that assists an eligible recipient to prepare an application for a covered loan may not collect a fee in excess of the limits established by the Administrator. If an eligible recipient has knowingly retained an agent, such fees shall be paid by the eligible recipient and may not be paid out of the proceeds of a covered loan. A lender shall only be responsible for paying fees to an agent for services for which the lender directly contracts with the agent.</text></clause><clause id="HD012FF7A1C694E0CB4A7082D54A4C0CA"><enum>(iii)</enum><header>Timing</header><text display-inline="yes-display-inline">A reimbursement described in clause (i) shall be made not later than 5 days after the disbursement of the covered loan.</text></clause></subparagraph><subparagraph id="HE2D9D1A44F184213A10D468FAA0A5C17"><enum>(Q)</enum><header>Duplication</header><text display-inline="yes-display-inline">Nothing in this paragraph shall prohibit a recipient of an economic injury disaster loan made under subsection (b)(2) during the period beginning on August 8, 2023, and ending on the date on which covered loans are made available that is for a purpose other than paying payroll costs or any other purpose described in subparagraph (F) from receiving assistance under this paragraph.</text></subparagraph><subparagraph id="HC48674BA59E04EC8814392E96D4B0A2C"><enum>(R)</enum><header>Waiver of prepayment penalty</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, there shall be no prepayment penalty for any payment made on a covered loan.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC4B5C8D2EC6941E19EB7C5910DCA9673"><enum>(b)</enum><header>Set-Asides for insured depository institutions, credit unions, and community financial institutions</header><paragraph id="HE22416000BFB495FAF3EDCBDECA50C43"><enum>(1)</enum><header>Insured depository institutions and credit unions</header><text display-inline="yes-display-inline">In making loan guarantees under paragraph (38) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>), the Administrator of the Small Business Administration shall guarantee not less than $30,000,000,000 in loans made by—</text><subparagraph id="H5B79217AAAB8400ABBE292A037FCA927"><enum>(A)</enum><text display-inline="yes-display-inline">insured depository institutions with consolidated assets of not less than $10,000,000,000 and less than $50,000,000,000; and</text></subparagraph><subparagraph id="H0234B58A46B74C0CA56F7F30E8D7A6BB"><enum>(B)</enum><text>credit unions with consolidated assets of not less than $10,000,000,000 and less than $50,000,000,000.</text></subparagraph></paragraph><paragraph id="H3743DF13DFAC4F1AACD9418217CF157E"><enum>(2)</enum><header>Community financial institutions, small insured depository institutions, and credit unions</header><text display-inline="yes-display-inline">In making loan guarantees under paragraph (38) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>), the Administrator of the Small Business Administration shall guarantee not less than $30,000,000,000 in loans made by—</text><subparagraph id="HC889F10E93D04DA7946D03705DDDE8EF"><enum>(A)</enum><text display-inline="yes-display-inline">community financial institutions;</text></subparagraph><subparagraph id="H4B84929AD1DE41D5938C29C56E0AD81A"><enum>(B)</enum><text>insured depository institutions with consolidated assets of less than $10,000,000,000; and</text></subparagraph><subparagraph id="H2BAB1472F91540269CAAF725594B0B77"><enum>(C)</enum><text>credit unions with consolidated assets of less than $10,000,000,000.</text></subparagraph></paragraph><paragraph id="HEA1FAEB703754B2AA23ECE1C00656334"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection, the terms <term>community financial institution</term>, <term>credit union</term>, and <term>insured depository institution</term> have the meanings given such terms in section 7(a)(36)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)(A)</external-xref>).</text></paragraph></subsection><subsection id="HFFE9F3C2D3BE4E2C98803EABAA9047D0"><enum>(c)</enum><header>Commitments for 7(a) loans</header><text display-inline="yes-display-inline">During the period beginning on August 8, 2023, and ending on May 10, 2024—</text><paragraph id="H9BA94E74C1384419B57D08E3DCEAC641"><enum>(1)</enum><text display-inline="yes-display-inline">the amount authorized for commitments for loans authorized under paragraph (38) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>), as added by subsection (a) of this section, shall be $400,000,000,000; and</text></paragraph><paragraph id="H7DEE824966724D239EF02AA7A745ED3E"><enum>(2)</enum><text>the amount authorized for commitments for general business loans under the heading <quote>Business Loans Program Account</quote> in title V of the Financial Services and General Government Appropriations Act, 2023 (division E of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) shall not apply with respect to the loans described in paragraph (1).</text></paragraph></subsection><subsection id="H133D529DE6C3466BA4245E3C6D096428"><enum>(d)</enum><header>Express loans</header><text>Section 7(a)(31)(D) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(31)(D)</external-xref>) is amended by striking <quote>$500,000</quote> and inserting <quote>$1,000,000</quote>.</text></subsection></section><section id="H3ED75D3655804107A155F39E14EBC9D4"><enum>4.</enum><header>Loan forgiveness</header><subsection id="H688B2547C6A147B4857A8F8C6EE74F33"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4C978AA0B7934813824E390F030A2962"><enum>(1)</enum><header>Administration</header><text>The term <term>Administration</term> means the Small Business Administration.</text></paragraph><paragraph id="HFD14F531C6B146CCB6E7F072CC94868B"><enum>(2)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Small Business Administration.</text></paragraph><paragraph id="HFBC6460D57B8447583DE4758F96BBD01"><enum>(3)</enum><header>Covered Loan</header><text>The term <term>covered loan</term> means—</text><subparagraph id="H7F592D33234F4F4B9546C37E299B5BFF"><enum>(A)</enum><text display-inline="yes-display-inline">a loan of more than $500 made under paragraph (1) or (2) of section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) during the period beginning on August 8, 2023, and ending on May 10, 2024 in response to the Hawai’i Wildfires; or</text></subparagraph><subparagraph id="H7EB95E188058482187975FCD0AE4301F"><enum>(B)</enum><text>a loan guaranteed under paragraph (38) of section 7(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>), as added by section 3(a).</text></subparagraph></paragraph><paragraph id="H46422F7F5A504E1CAF63D81B685F7CF5"><enum>(4)</enum><header>Covered mortgage obligation</header><text display-inline="yes-display-inline">The term <term>covered mortgage obligation</term> means any indebtedness or debt instrument incurred in the ordinary course of business that—</text><subparagraph id="H4D23DB6D93CA440781404F1B7189F6BA"><enum>(A)</enum><text>is a liability of the borrower;</text></subparagraph><subparagraph id="HAACF77B3E4414763995CA4DAEF96EF70"><enum>(B)</enum><text>is a mortgage on real or personal property; and</text></subparagraph><subparagraph id="HD55E56AA51514B30B9BDDA0CBE3A8FB1"><enum>(C)</enum><text>was incurred before August 8, 2023.</text></subparagraph></paragraph><paragraph id="H44496A2F09264DA69F6868609D4F568F"><enum>(5)</enum><header>Covered operations expenditure</header><text display-inline="yes-display-inline">The term <term>covered operations expenditure</term> has the meaning given such term in section 7A(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636m">15 U.S.C. 636m(a)</external-xref>).</text></paragraph><paragraph id="H102F3D7F8C944945A57FE34FBF0888D7"><enum>(6)</enum><header>Covered period</header><text display-inline="yes-display-inline">The term <term>covered period</term> means the period—</text><subparagraph id="HC409450810384480A87810016B261CFC"><enum>(A)</enum><text>beginning on the date of the origination of a covered loan; and</text></subparagraph><subparagraph id="H01FD9D38E4274196BD2DB515F9B6AE2E"><enum>(B)</enum><text>ending on a date selected by the eligible recipient of the covered loan that occurs during the period—</text><clause id="H92A5983DC8164D138752C5829E95B706"><enum>(i)</enum><text>beginning on the date that is 8 weeks after such date of origination; and</text></clause><clause id="HAD428F5457674EE7AA6B34D5C6FC6F93"><enum>(ii)</enum><text>ending on the date that is 24 weeks after such date of origination.</text></clause></subparagraph></paragraph><paragraph id="H8F8C214D92174CC5800AA3C805278E9D"><enum>(7)</enum><header>Covered property damage cost</header><text display-inline="yes-display-inline">The term <term>covered property damage cost</term> means a cost related to property damage and vandalism or looting due to public disturbances that occurred during the period beginning on August 8, 2023, and ending on May 10, 2024 that was not covered by insurance or other compensation.</text></paragraph><paragraph id="HCFD84B8F77AA4E9992CF2E52B07120C7"><enum>(8)</enum><header>Covered rent obligation</header><text display-inline="yes-display-inline">The term <term>covered rent obligation</term> means rent obligated under a leasing agreement in force before August 8, 2023.</text></paragraph><paragraph id="H8CFFA895C6F643C3B26AD6B1937B0F12"><enum>(9)</enum><header>Covered supplier cost</header><text>The term <term>covered supplier cost</term> means an expenditure made by an entity to a supplier of goods for the supply of goods that—</text><subparagraph id="HB6DBB915F26E4FFFBE192C8B3188EED5"><enum>(A)</enum><text>are essential to the operations of the entity at the time at which the expenditure is made; and</text></subparagraph><subparagraph id="HCE855D1C63B04250BAC82121CC9B3F14"><enum>(B)</enum><text>is made pursuant to a contract, order, or purchase order—</text><clause id="HA61509FCF0A947289C4051A62D4182F7"><enum>(i)</enum><text>in effect at any time before the covered period with respect to the applicable covered loan; or</text></clause><clause id="H46AD175BAF0D499EB506BACF1F538D25"><enum>(ii)</enum><text>with respect to perishable goods, in effect before or at any time during the covered period with respect to the applicable covered loan.</text></clause></subparagraph></paragraph><paragraph id="H3FB25EBF95E5424F863C62ADED7F6AFF"><enum>(10)</enum><header>Covered utility payment</header><text display-inline="yes-display-inline">The term <term>covered utility payment</term> means payment for a service for the distribution of electricity, gas, water, transportation, telephone, or internet access for which service began before August 8, 2023.</text></paragraph><paragraph id="HBB4ACF6B57DE403996A71E371E2DCB74"><enum>(11)</enum><header>Eligible recipient</header><text>The term <term>eligible recipient</term> means the recipient of a covered loan.</text></paragraph><paragraph id="HE57CB78531DE4760ADC03912D403F6D9"><enum>(12)</enum><header>Expected forgiveness amount</header><text>The term <term>expected forgiveness amount</term> means—</text><subparagraph id="H899FD73868C44F31B2C0A5C8D0E467C1"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to a covered loan described in paragraph (3)(A), the amount of principal of such loan that a lender reasonably expects a borrower to expend during the covered period on costs payable using such covered loan under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>); and</text></subparagraph><subparagraph id="HA718A513BC0848489E1E36B15C55F051"><enum>(B)</enum><text>with respect to a covered loan described in paragraph (3)(B), the amount of principal of such covered loan that a lender reasonably expects a borrower to expend during the covered period on the sum of any—</text><clause id="H040BB75C33C64BC29D0A74930BE73868"><enum>(i)</enum><text>payroll costs;</text></clause><clause id="HECC85CA6AFA34DC582F5F962E68CFFA1"><enum>(ii)</enum><text>payments of interest on any covered mortgage obligation (which shall not include any prepayment of or payment of principal on a covered mortgage obligation);</text></clause><clause id="HE1B34E927E1D48D69007BC1A72EF9DF1"><enum>(iii)</enum><text>payments on any covered rent obligation;</text></clause><clause id="HFC02D3023C414D9AAA0505850464324B"><enum>(iv)</enum><text>covered utility payments;</text></clause><clause id="H68132EFD165547349E4E1F48D4DD7B03"><enum>(v)</enum><text>covered operations expenditures;</text></clause><clause id="H73C60DAF2E9349E4B9C83B3F73B8D326"><enum>(vi)</enum><text>covered property damage costs; and</text></clause><clause id="H9D157D6E967341D886845344C59E7384"><enum>(vii)</enum><text>covered supplier costs.</text></clause></subparagraph></paragraph><paragraph id="H0CFA5E4967B94FC69F0DC7124AA7210B"><enum>(13)</enum><header>Hawai’i Wildfires</header><text>The term <term>Hawai’i Wildfires</term> has the meanings given such term in section 2(a).</text></paragraph><paragraph id="H8C60A9BD0D9E41A4AE39D784064E5CB9"><enum>(14)</enum><header>Payroll costs; seasonal employer</header><subparagraph id="H51F6A5F5DE124682A794423A0C31E41D"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the terms <term>payroll costs</term> and <term>seasonal employer</term> have the meanings given those terms in section 7(a)(36)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)(A)</external-xref>).</text></subparagraph><subparagraph id="H62B6973E9AC94C71945B7FECF1462847"><enum>(B)</enum><header>Payroll costs exclusions</header><text>The term <term>payroll costs</term> shall not include qualified wages taken into account in determining the credit allowed under section 2301 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/26/3111">26 U.S.C. 3111</external-xref> note), qualified wages taken into account in determining the credit allowed under subsection (a) or (d) of section 303 of the Taxpayer Certainty and Disaster Relief Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 3075), or premiums taken into account in determining the credit allowed under <external-xref legal-doc="usc" parsable-cite="usc/26/6432">section 6432</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph><paragraph id="H5B146547BEE7477884BDBC1A8DE224A5"><enum>(15)</enum><header>Private school</header><text display-inline="yes-display-inline">The term <term>private school</term> means an institution of higher education (as such term is defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>) that is not a public institution.</text></paragraph></subsection><subsection id="H4568F70B640146998B7195E854937D33"><enum>(b)</enum><header>Forgiveness and waivers</header><paragraph id="H69FFFBB8E3074C4BB2CF13AAF91B05D0"><enum>(1)</enum><header>Payroll loans</header><text display-inline="yes-display-inline">A recipient of a covered loan described in subsection (a)(3)(B) shall be eligible for forgiveness of indebtedness on such covered loan in an amount equal to the sum of the following costs incurred and payments made during the covered period:</text><subparagraph id="H16A80824B7D74187AA4933F52C2B9B2D"><enum>(A)</enum><text>Payroll costs.</text></subparagraph><subparagraph id="HA27EF320716242C3BC4183C1F18EF1AB"><enum>(B)</enum><text>Any payment of interest on any covered mortgage obligation (which shall not include any prepayment of or payment of principal on a covered mortgage obligation).</text></subparagraph><subparagraph id="H04FC637C4E7E4AA2B338259F8C874B94"><enum>(C)</enum><text>Any payment on any covered rent obligation.</text></subparagraph><subparagraph id="HABAB461D23FB4429BCF5422E9BD00E7A"><enum>(D)</enum><text>Any covered utility payment.</text></subparagraph><subparagraph id="H0584F453F79D4B82B2D22FB5D66558D4"><enum>(E)</enum><text>Any covered operations expenditure.</text></subparagraph><subparagraph id="H761C66CEBA5747EA9656C90FC5CEF5F8"><enum>(F)</enum><text>Any covered property damage cost.</text></subparagraph><subparagraph id="H541DA5CE4E79468AB0C4A58951E46219"><enum>(G)</enum><text>Any covered supplier cost.</text></subparagraph></paragraph><paragraph id="H4510B29B32F6472DAECBABC10F7DF9C1"><enum>(2)</enum><header>Disaster loans</header><subparagraph id="HF37E140E6EEB4BA6A0B355BF04AA8A50"><enum>(A)</enum><header>In general</header><text>Except as provided by subparagraph (B), a recipient of a covered loan described in subsection (a)(3)(A) shall, at the election of the recipient, be eligible for—</text><clause id="H97B29140453C420A8F7339EEA0211339"><enum>(i)</enum><text>forgiveness of indebtedness on such covered loan in amount equal to the lesser of—</text><subclause id="HB6EF523F46A040A580195FCC162E0D0A"><enum>(I)</enum><text>the amount by which such covered loan exceeds $500; and</text></subclause><subclause id="HD1F013E6D1AA414B8F21796F60AD3808"><enum>(II)</enum><text>$1800; or</text></subclause></clause><clause id="H95CBD15E512A4DE78C74805BF6AFA49C"><enum>(ii)</enum><text>a waiver of interest charges on such covered loan, except that—</text><subclause id="H564D2FDF1DDD442691D144A950DFBC44"><enum>(I)</enum><text>the total amount of interest waived under such waiver may not exceed $1800; and</text></subclause><subclause id="H4EB0F28D4AA84D9C98FB559B3225232F"><enum>(II)</enum><text>such waiver may last not more than three years.</text></subclause></clause></subparagraph><subparagraph id="HC768988B9D97407BA61F013795C30DD1"><enum>(B)</enum><header>Private schools</header><text display-inline="yes-display-inline">A recipient of a covered loan described in subsection (a)(3)(A) that is a private school shall, at the election of the recipient, be eligible for—</text><clause id="HD7799DEFF4AF4103825FEDE1DBB11FB6"><enum>(i)</enum><text>forgiveness of indebtedness on such covered loan as described in subparagraph (A)(i); or</text></clause><clause id="H602FC98519C04803821965929B86C73A"><enum>(ii)</enum><text>a waiver of interest and principal charges on such covered.</text></clause></subparagraph></paragraph></subsection><subsection id="HD679B1CB40BE4112A5CE2D76FDA3616E"><enum>(c)</enum><header>Treatment of amounts forgiven and waived</header><paragraph id="H7C3FF0FF264D410189DB9F3DAC1739D2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts which have been forgiven under this section shall be considered canceled indebtedness by the lender.</text></paragraph><paragraph id="HDF32BDA18D964FFAAB8D3B858B675186"><enum>(2)</enum><header>Purchase of guarantees</header><text display-inline="yes-display-inline">For purposes of the purchase of the guarantee for a covered loan by the Administrator, amounts which are forgiven under this section shall be treated in accordance with the procedures that are otherwise applicable to a loan guaranteed under section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>).</text></paragraph><paragraph id="H73E3F16FEBC24C809D3F39CC3140A26E"><enum>(3)</enum><header>Remittances</header><subparagraph id="HA2A7611037AF4655B95B048C39538714"><enum>(A)</enum><header>Forgiven amounts</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the amount of forgiveness under this section is determined with respect to a covered loan described in subsection (a)(3)(B), and not later the two weeks after the date on which the amount of forgiveness under this section is determined with respect to a covered loan described in subsection (a)(3)(A), the Administrator shall remit to the lender an amount equal to the amount of forgiveness, plus any interest accrued through the date of payment.</text></subparagraph><subparagraph id="H6CAE881323A744FF9F59E0986FE1D913"><enum>(B)</enum><header>Interest waived</header><text display-inline="yes-display-inline">During the period interest charges are waived under subparagraphs (A)(ii) or (B)(ii) of subsection (b)(2) on a covered loan in which any individual or entity other than the Administrator is participating, the Administrator shall pay to each individual and entity participating in the covered loan the interest that, but for such subsection, would be owed to such individual or entity at the time such interest would be due.</text></subparagraph></paragraph><paragraph id="HC293F084D9DD4061B7758E650B2DE733"><enum>(4)</enum><header>Advance purchase of covered loans</header><subparagraph id="HA27008741C7F40F9934E13C0A1E246A6"><enum>(A)</enum><header>Report</header><text>A lender authorized under subsections (a) or (b) of section 7 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636</external-xref>), or, at the discretion of the Administrator, a third party participant in the secondary market, may, report to the Administrator an expected forgiveness amount on a covered loan or on a pool of covered loans of up to 100 percent of the principal on the covered loan or pool of covered loans, respectively.</text></subparagraph><subparagraph id="HBFC541D0C4264A8C81897BE1E95FBAFB"><enum>(B)</enum><header>Purchase</header><text display-inline="yes-display-inline">The Administrator shall purchase the expected forgiveness amount described in subparagraph (A) as if the amount were the principal amount of a loan guaranteed under section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>).</text></subparagraph><subparagraph id="HC5DED3D020384F9F8C77ABD060D69690"><enum>(C)</enum><header>Timing</header><text>Not later than 15 days after the date on which the Administrator receives a report under subparagraph (A), the Administrator shall purchase the expected forgiveness amount under subparagraph (B) with respect to each covered loan to which the report relates.</text></subparagraph></paragraph></subsection><subsection id="HAC766DB1775246E59D6E919736BEF97E"><enum>(d)</enum><header>Application</header><paragraph id="HEA0A1BFC9EA44E4583C88F2480027BEA"><enum>(1)</enum><header>7(a) loans</header><text>An eligible recipient seeking loan forgiveness with respect to a covered loan described in subsection (a)(3)(B) under this section shall submit to the lender that is servicing the covered loan an application, which shall include—</text><subparagraph id="H9440CDB2ECB64798A674770E2EE0BF3A"><enum>(A)</enum><text>documentation verifying the number of full-time equivalent employees on payroll and pay rates to support such loan forgiveness, including—</text><clause id="H0C78D7CBA3D5479C9C4A0DCCCEE409BD"><enum>(i)</enum><text>payroll tax filings reported to the Internal Revenue Service; and</text></clause><clause id="HF6CF3C2A4F0D4085968E29231DE235C9"><enum>(ii)</enum><text>State income, payroll, and unemployment insurance filings;</text></clause></subparagraph><subparagraph id="HE8DAEDDBB23F4C50B20A6C8F66144310"><enum>(B)</enum><text>documentation, including cancelled checks, payment receipts, transcripts of accounts, purchase orders, orders, invoices, or other documents verifying payments on covered mortgage obligations, payments on covered rent obligations, payments on covered operations expenditures, payments on covered property damage costs, payments on covered supplier costs, payments on covered worker protection expenditures, and covered utility payments;</text></subparagraph><subparagraph id="H2C6C1E7D709544A1BF31CBF5C6D26F53"><enum>(C)</enum><text>a certification from a representative of the eligible recipient authorized to make such certifications that—</text><clause id="H5082F979D2EC4DB99B067CBF26CFB388"><enum>(i)</enum><text>the documentation presented is true and correct; and</text></clause><clause id="H8EB1EF5C4BD144ACB1E8BA594519E66E"><enum>(ii)</enum><text>the amount for which forgiveness is requested was used to retain employees, make interest payments on a covered mortgage obligation, make payments on a covered rent obligation, make payments on covered operations expenditures, make payments on covered property damage costs, make payments on covered supplier costs, make payments on covered worker protection expenditures, or make covered utility payments; and</text></clause></subparagraph><subparagraph id="H854356F4BD534E25BC58215730386C84"><enum>(D)</enum><text>any other documentation the Administrator determines necessary.</text></subparagraph></paragraph><paragraph id="HD2B3855F36F940EABFDD402A7BF83D2E"><enum>(2)</enum><header>Disaster loans</header><subparagraph id="H4E267FB354F64DB69B2480BC42FC8948"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible recipient seeking loan forgiveness with respect to a covered loan described in subsection (a)(3)(A) under this section shall submit to the appropriate entity an application at such time, in such manner, and containing such information as the Administrator determines appropriate.</text></subparagraph><subparagraph id="H4B858B5F804344E0A2C4F84B6E8B7649"><enum>(B)</enum><header>Appropriate entity defined</header><text display-inline="yes-display-inline">In this paragraph, the term <term>appropriate entity</term> means—</text><clause id="HA0BAA949B83841BEADB74ADEB8E30C54"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to a covered loan described in subsection (a)(3)(A) in which the Administrator is participating on a guaranteed basis, the lender that is servicing the covered loan; and</text></clause><clause id="H506EEDF87C8E45D8AF97E5895B113411"><enum>(ii)</enum><text>in all other cases, the Administrator.</text></clause></subparagraph></paragraph></subsection><subsection id="HA37D5ECAE34343E6A8EDBC06C5EBDBB1"><enum>(e)</enum><header>Prohibition on forgiveness without documentation</header><text>No eligible recipient shall receive forgiveness under this section without submitting the documentation required under subsection (d).</text></subsection><subsection id="H7F2FFDDC21294402900A0192DB8BCE53"><enum>(f)</enum><header>Decision</header><text>Not later than 60 days after the date on which a lender or the Administrator receives an application under subsection (e) for loan forgiveness under this section from an eligible recipient, the lender or the Administrator, as applicable, shall issue a decision on the application.</text></subsection><subsection id="H161B16BEC1B441D1A44E4B24C9F2DDE8"><enum>(g)</enum><header>Hold harmless</header><paragraph id="H709A9AD02A7947C88FCC78BBC2A3F1DA"><enum>(1)</enum><header>Reliance</header><text>A lender may rely on any certification or documentation submitted by an applicant for a covered loan or an eligible recipient or eligible entity receiving a covered loan that—</text><subparagraph id="H9D26E0B1B8084FFCA41EDCF5ED98286C"><enum>(A)</enum><text>is submitted pursuant to all applicable statutory requirements, regulations, and guidance related to such covered loan, including under subsections (a)(38), as added by section 3(a) of this Act, and (b) section 7 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636</external-xref>) and under this section; and</text></subparagraph><subparagraph id="HF59E84B5187C4EA38FCC9ACC66AD96CD"><enum>(B)</enum><text>attests that the applicant, eligible recipient, or eligible entity, as applicable, has accurately provided the certification or documentation to the lender in accordance with the statutory requirements, regulations, and guidance described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="H8D6CFC71B63F4730A6A149BAD4BB98DA"><enum>(2)</enum><header>No enforcement action</header><text>With respect to a lender that relies on a certification or documentation described in paragraph (1) related to covered loan, an enforcement action may not be taken against the lender, and the lender shall not be subject to any penalties relating to loan origination or forgiveness of the covered loan, if—</text><subparagraph id="HA0276C3925244EB8BA970B411B710824"><enum>(A)</enum><text>the lender acts in good faith relating to loan origination or forgiveness of the covered loan based on that reliance; and</text></subparagraph><subparagraph id="HEB67B69D88204DADB05F64FC505B5D2C"><enum>(B)</enum><text>all other relevant Federal, State, local, and other statutory and regulatory requirements applicable to the lender are satisfied with respect to the covered loan.</text></subparagraph></paragraph></subsection><subsection id="H90C6CAD13C744D1F9F98F07EF4DFF131"><enum>(h)</enum><header>Tax treatment</header><text>For purposes of the Internal Revenue Code of 1986—</text><paragraph id="H854673493803458EAA971798D0F0FE71"><enum>(1)</enum><text>no amount shall be included in the gross income of the eligible recipient by reason of forgiveness of indebtedness or waivers described in subsection (b),</text></paragraph><paragraph id="H084520D230604B1FAD1C4E85F72A92DF"><enum>(2)</enum><text>no deduction shall be denied, no tax attribute shall be reduced, and no basis increase shall be denied, by reason of the exclusion from gross income provided by paragraph (1), and</text></paragraph><paragraph id="HDD2D6EEA46A9496F95E4EA16B0FD03F2"><enum>(3)</enum><text>in the case of an eligible recipient that is a partnership or S corporation—</text><subparagraph id="H84B691A2B68E429BAC6A840E3A542CBC"><enum>(A)</enum><text>any amount excluded from income by reason of paragraph (1) shall be treated as tax exempt income for purposes of sections 705 and 1366 of the Internal Revenue Code of 1986, and</text></subparagraph><subparagraph id="H57D01D73CC3845CCB0DF46C6877DC556"><enum>(B)</enum><text>except as provided by the Secretary of the Treasury (or the Secretary’s delegate), any increase in the adjusted basis of a partner’s interest in a partnership under <external-xref legal-doc="usc" parsable-cite="usc/26/705">section 705</external-xref> of the Internal Revenue Code of 1986 with respect to any amount described in subparagraph (A) shall equal the partner’s distributive share of deductions resulting from costs giving rise to forgiveness described in subsection (b) or from charges waived as described in such subsection.</text></subparagraph></paragraph></subsection><subsection id="H9811B564BC284B9C8F1C5CACCCED921A"><enum>(i)</enum><header>Rule of Construction</header><text display-inline="yes-display-inline">The cancellation of indebtedness on a covered loan under this section shall not otherwise modify the terms and conditions of the covered loan.</text></subsection><subsection id="H331BA9C93BF246318DADABAB7E6CA2F9"><enum>(j)</enum><header>Regulations</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator shall issue guidance and regulations implementing this section.</text></subsection></section><section id="H8B081E665546447F9C2B0F8F73F8A3FA" commented="no"><enum>5.</enum><header>Maui wildfire paycheck protection program loan facility</header><text display-inline="no-display-inline">The Board of Governors of the Federal Reserve System shall, under section 13(3) of the Federal Reserve Act (<external-xref legal-doc="usc" parsable-cite="usc/12/343">12 U.S.C. 343(3)</external-xref>), establish a Maui Wildfire Paycheck Protection Program Liquidity Facility to provide loans to entities making loans guaranteed under the Maui Wildfire Paycheck Protection Program. In establishing the requirements for the Maui Wildfire Paycheck Protection Program, the Board of Governors shall make the requirements as close as practicable to the requirements applicable to the Paycheck Protection Program Liquidity Facility.</text></section></legis-body></bill>
