which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Energy to remove carbon dioxide directly from ambient air or seawater, and for other purposes.</official-title></form><legis-body id="HB9481B4B90424D94BE9EC3E398D1C78A" style="OLC"><section id="H87C8D1CD64F4413E8E3E335F0C375B19" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Carbon Dioxide Removal Leadership Act of 2024</short-title></quote>.</text></section><section id="H2CB7F495A303494EA41260CF0CE58574"><enum>2.</enum><header>Federal requirement to remove carbon dioxide</header><subsection id="H84B76EBEDDD24F309BD13418C4F54EC8"><enum>(a)</enum><header>Required amounts</header><text>The Secretary shall, to the extent economically feasible as provided in subsection (d), remove—</text><paragraph id="HD923454798E849E9B75174A29878D188"><enum>(1)</enum><text>50,000 net metric tons of carbon dioxide, calculated on a lifecycle basis, for each of fiscal years 2024 through 2025;</text></paragraph><paragraph id="HC50BC54D0D52430FBAD14CBA631F6B2A"><enum>(2)</enum><text>500,000 net metric tons of carbon dioxide, calculated on a lifecycle basis, for each of fiscal years 2026 through 2028;</text></paragraph><paragraph id="HEE8F9FD7628549EC806E23655F9D7112"><enum>(3)</enum><text>5,000,000 net metric tons of carbon dioxide, calculated on a lifecycle basis, for each of fiscal years 2029 through 2034; and</text></paragraph><paragraph id="HEDE42F7ECB164CA5901E45C2701DFF74"><enum>(4)</enum><text>10,000,000 net metric tons of carbon dioxide, calculated on a lifecycle basis, for fiscal year 2035 and each fiscal year thereafter.</text></paragraph></subsection><subsection id="H63CBF35DE247416881E4330AE56431C5"><enum>(b)</enum><header>Timing</header><text>The Secretary shall remove each amount of carbon dioxide required under subsection (a) by not later than 3 years after the beginning of the fiscal year for which such removal is required.</text></subsection><subsection id="H97D851FC1FC948239FD0ACFDBF397744"><enum>(c)</enum><header>Small removal project set-Aside</header><text>To the extent practicable, at least 20 percent of the net metric tons of carbon dioxide required to be removed for each of fiscal years 2024 through 2034 under subsection (a) shall be removed by small removal projects.</text></subsection><subsection id="H1DC628742E0C4AA196A5EFAC83AB5B14"><enum>(d)</enum><header>Economic feasibility</header><paragraph id="HE178CDFF3FA0430DA9770FBC06848A82"><enum>(1)</enum><header>In general</header><text>The removal of carbon dioxide under this section shall be considered economically feasible if such removal can be accomplished or, in the case of a contract, purchased—</text><subparagraph id="H8E800EE9A90C4340B6BB19D06648CB1E"><enum>(A)</enum><text>with respect to such removal carried out for any of fiscal years 2024 through 2025, at a price per metric ton of carbon dioxide of not more than $750 (which the Secretary may adjust for inflation);</text></subparagraph><subparagraph id="H3C6449377E164D39AF1B4EFC0545F161"><enum>(B)</enum><text>with respect to such removal carried out for any of fiscal years 2026 through 2028, at a price per metric ton of carbon dioxide of not more than $500 (which the Secretary may adjust for inflation);</text></subparagraph><subparagraph id="H551AE615B92B49FAA99E1B8F9A7CDDAD"><enum>(C)</enum><text>with respect to such removal carried out for any of fiscal years 2029 through 2031, at a price per metric ton of carbon dioxide of not more than $300 (which the Secretary may adjust for inflation);</text></subparagraph><subparagraph id="HCF8259A3501C4418BA44FDE5A7675714"><enum>(D)</enum><text>with respect to such removal carried out for any of fiscal years 2032 through 2034, at a price per metric ton of carbon dioxide of not more than $200 (which the Secretary may adjust for inflation); and</text></subparagraph><subparagraph id="HE428F280EE4B46C3AF107DD8DB2AE868"><enum>(E)</enum><text>with respect to such removal carried out for fiscal year 2035 and each fiscal year thereafter, at a price per metric ton of carbon dioxide of not more than $150 (which the Secretary may adjust for inflation).</text></subparagraph></paragraph><paragraph id="HE86314A22E394B04A4FFDF2353E9AB3F"><enum>(2)</enum><header>Inclusion of monitoring, reporting, and verification costs</header><text>In determining whether the removal of carbon dioxide is considered economically feasible under paragraph (1), the price for such removal shall include any costs associated with the monitoring, reporting, and verification required under subsection (f)(1).</text></paragraph><paragraph id="HEB2F21E7D3454AABA6AE1A9AC023B747"><enum>(3)</enum><header>Multi-year contracts</header><text>Notwithstanding paragraph (1), the removal of carbon dioxide carried out pursuant to a multi-year contract entered into under subsection (h) shall be considered economically feasible if such removal can be accomplished at the applicable dollar amount for the first fiscal year of the contract, as provided in paragraph (1), through the entire length of such contract.</text></paragraph></subsection><subsection id="H1C06121709714510A4FAF7E9995A9C8F"><enum>(e)</enum><header>Federal assistance</header><text>Funds received pursuant to a contract entered into under subsection (h) shall not be considered Federal assistance or otherwise affect eligibility for any Federal assistance, including tax incentives.</text></subsection><subsection id="H07BD05B99C7746859563E0B5AC4D9D13"><enum>(f)</enum><header>Monitoring, reporting, and verification</header><paragraph id="HD02EC8F504F64757BF80AE3936F2D3B2"><enum>(1)</enum><header>In general</header><text>The Secretary, or an entity the Secretary enters into a contract with under subsection (h), shall monitor, report, and verify the net metric tons of carbon dioxide the Secretary or such entity, as applicable, removed for purposes of this section.</text></paragraph><paragraph id="HD5BC0E730A164E649E1A2CAC3EAB2D94"><enum>(2)</enum><header>Standards</header><text>Not later than 1 year after the date of enactment of this section, the Secretary, in consultation with the Administrator of the National Oceanic and Atmospheric Administration, the Administrator of the Environmental Protection Agency, the Secretary of the Department of Agriculture, and other relevant Federal agencies as determined appropriate by the Secretary, shall establish standards for the monitoring, reporting, and verification of net metric tons of carbon dioxide removed pursuant to this section. Such standards shall—</text><subparagraph id="H4B7D35DA24BE4D8AA394A53C81CF323C"><enum>(A)</enum><text>require the use of the best available practices used by similar carbon dioxide removal projects;</text></subparagraph><subparagraph id="H21258ED760B4458299B719A6B44B0337"><enum>(B)</enum><text>ensure safe, effective, and efficient removal of carbon dioxide;</text></subparagraph><subparagraph id="H15BEE5183025490788CC427D2D300535"><enum>(C)</enum><text>require independent, third-party verification of carbon dioxide removal;</text></subparagraph><subparagraph id="HC3D42379AC644BD5931F13C551B00D7E"><enum>(D)</enum><text>ensure additionality, permanence, and net-negativity of carbon dioxide removal;</text></subparagraph><subparagraph id="H024E88BC289C44B28BA45E479ECE3E8B"><enum>(E)</enum><text>include criteria to determine whether the storage of captured carbon dioxide is permanent;</text></subparagraph><subparagraph id="H2EC975ACC5034F9F93A99DBBA27ACD2F"><enum>(F)</enum><text>ensure scientifically rigorous and transparent methods for monitoring, reporting, and verifying under paragraph (1); and</text></subparagraph><subparagraph id="HD8F3950AC2A7491A84581655AACF48D5"><enum>(G)</enum><text>be regularly reviewed and, as necessary, updated to account for scientific and technological advancements.</text></subparagraph></paragraph><paragraph id="HC7CFAA25514747E9A82E17B8E91D2FB1"><enum>(3)</enum><header>Prohibition on double counting</header><text>Carbon dioxide that is removed for the purposes of compliance with any other greenhouse gas emissions management program, including any foreign, Federal, State, local, or private greenhouse gas emissions management program, as determined by the Secretary, may not be considered removed under subsection (a) for purposes of meeting the requirements of such subsection.</text></paragraph></subsection><subsection id="HEAACFAD310B24352B3A3659ED0897291" commented="no"><enum>(g)</enum><header>Priorities</header><text>In carrying out this section, the Secretary shall give priority to a project for the removal of carbon dioxide based on the degree to which the project—</text><paragraph id="H4C00090386F443C8B42531D918398DDB" commented="no"><enum>(1)</enum><text>minimizes the amount of greenhouse gas emissions released by carrying out such project;</text></paragraph><paragraph id="HB7B9C85C4C3246E2AA0130FF8B0A75AA" commented="no"><enum>(2)</enum><text>supports the commercialization of innovative removal technologies;</text></paragraph><paragraph id="H8739CBAA099A43208BDFAF076EB39625" commented="no"><enum>(3)</enum><text>increases the diversity of commercially available eligible technologies;</text></paragraph><paragraph id="H62F1A682D47E47CABC3D19B5B14282EC" commented="no"><enum>(4)</enum><text>may provide for domestic job creation, with a further preference for partnerships with labor organizations, small businesses, minority-owned businesses, and women-owned businesses across value chains;</text></paragraph><paragraph id="HA8A44D808F944795B2A467BF9A828311" commented="no"><enum>(5)</enum><text>results in economic development or economic diversification in regions or localities that have historically generated significant economic activity from the production, processing, transportation, or combustion of fossil fuels, including through the use of coal mines, fossil fuel-fired electricity generating units, and petroleum refining facilities;</text></paragraph><paragraph id="H1783381913C6468CAB25808BA39D8F79" commented="no"><enum>(6)</enum><text>quantifies and mitigates risks from carbon dioxide removal activities on, and provides measurable co-benefits to, environmental justice communities, the environment, agriculture, and public health, including by—</text><subparagraph id="HD8AA3AE1EC9144DBBFC64A568FD2E75B" commented="no"><enum>(A)</enum><text>improving local air quality, water quality, and soil quality;</text></subparagraph><subparagraph id="H1BF5F5388A9B4B938E5BC0D9E741ED50" commented="no"><enum>(B)</enum><text>minimizing land, water, and energy footprints; and</text></subparagraph><subparagraph id="HF8F58FE38DD64B29A62ADEE3884D2847" commented="no"><enum>(C)</enum><text>using zero-emission energy; and</text></subparagraph></paragraph><paragraph id="H682EF018DF164DBDB7B5D1F1A97E6FB2" commented="no"><enum>(7)</enum><text>includes robust public engagement and community benefits.</text></paragraph></subsection><subsection id="H16671E526F5B498FB084A8047B9BB7A9"><enum>(h)</enum><header>Contracts</header><paragraph id="H43E12114E1AA46A5A086D5992A7E4D0C"><enum>(1)</enum><header>In general</header><text>After a transparent and competitive process, the Secretary may enter into a contract to meet the requirements of subsection (a).</text></paragraph><paragraph id="H8A3B1D5A423C4383A3F75892784AAC32"><enum>(2)</enum><header>Length</header><text>A contract entered into under this subsection may not be for a term of more than 15 years.</text></paragraph><paragraph id="HAEB5A326EE834772B9B99DC7D687F710" commented="no"><enum>(3)</enum><header>Maintenance of removal commitments</header><text>The Secretary shall include as a term or condition in each contract entered into under this subsection that the entity that enters into the contract shall permanently store an additional amount of carbon dioxide that is equal to any amount of carbon dioxide that is released after permanent storage by such entity.</text></paragraph><paragraph id="H46B1690250614A91BD9A92F5ACEBF53E" commented="no"><enum>(4)</enum><header>Limitation</header><text>To the extent that there is a sufficient number of entities capable of removing carbon dioxide in a manner that meets the standards and requirements of this section under a contract entered into pursuant to this subsection, the Secretary shall ensure that no one entity is responsible for removing more than 25 percent of the net metric tons of carbon dioxide required under subsection (a) in any fiscal year.</text></paragraph></subsection><subsection id="H7421A26F1DFA41EAA36314CA8DDC77C4"><enum>(i)</enum><header>Report</header><text>Not later than January 1, 2027, and every 2 years thereafter, the Secretary shall submit to Congress, and release to the public, a report on the progress of carrying out the requirements of this section, which such report shall include—</text><paragraph id="H9D4FC9A4B2D24605BF586C566843EA1F" commented="no"><enum>(1)</enum><text>the amounts verified under subsection (f)(1) and the corresponding names of each entity that provided such verified amount;</text></paragraph><paragraph id="H6C4D62FE0D8440B09C9A904EFC544623"><enum>(2)</enum><text>the total price, and price per metric ton, to remove carbon dioxide for the applicable fiscal year as required under subsection (a);</text></paragraph><paragraph id="HE8CBE2A37520457B89813A98B22CF971"><enum>(3)</enum><text>the methods associated with the monitoring, reporting, and verification required under subsection (f)(1);</text></paragraph><paragraph id="HB29FD19DF946430D86ABFF4A4BE4CDF2"><enum>(4)</enum><text>an estimate of how removing carbon dioxide under this section affects environmental justice communities, the environment, agriculture, and public health;</text></paragraph><paragraph id="H7292BFFE523A4B25992C02009F1CA32B"><enum>(5)</enum><text>information on potential labor impacts and job creation resulting from fulfilling the requirements of subsection (a); and</text></paragraph><paragraph id="H85C4FAAFFBC749729E43AFCEF4F0B2DC" commented="no"><enum>(6)</enum><text>an explanation of how the Secretary prioritized projects under subsection (g).</text></paragraph></subsection><subsection id="H9CD47996C49049B991E9D0147A426FE7"><enum>(j)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection><subsection id="HE78DD6025E264C25B0B8080FEBE9E5E7"><enum>(k)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HA8DC1DF405F145DC9D17731897ECAF38"><enum>(1)</enum><header>Eligible technology</header><subparagraph id="H132D649D8AB84C8A897D6A9D82B70702" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>eligible technology</term> means, as determined by the Secretary, any equipment, technique, or technology that—</text><clause id="HE6160C24D8624F6583A3AB7DAA850EA5" commented="no"><enum>(i)</enum><text>was placed into service after January 1, 2022; and</text></clause><clause id="H663527D32C2B47A4B9B6E64B9C53C2E9" commented="no"><enum>(ii)</enum><text>removes carbon dioxide directly from ambient air or seawater.</text></clause></subparagraph><subparagraph id="H5BCC98FA0AAC432382A39CEA70891136"><enum>(B)</enum><header>Exclusion</header><text>The term <term>eligible technology</term> does not include any equipment, technique, or technology that—</text><clause id="HD8C93E04D1624BC8AE8167CC4FD39E30"><enum>(i)</enum><text>removes carbon dioxide which is deliberately released from naturally occurring subsurface springs;</text></clause><clause id="H3B729CE31DA54D319748D54531E2CA5F"><enum>(ii)</enum><text>removes carbon dioxide using natural photosynthesis, except as provided in subparagraph (C); or</text></clause><clause id="H4E2A0176CDAA49CE80E6935D1698FC72"><enum>(iii)</enum><text>uses captured carbon dioxide in enhanced oil recovery.</text></clause></subparagraph><subparagraph id="HA0836D5F0E2D48B39BFBB2D4CC3517B4" commented="no"><enum>(C)</enum><header>Expansion of eligible technology</header><text>Notwithstanding subparagraph (B)(ii), any equipment, technique, or technology that removes carbon dioxide using gasification, pyrolysis, or sequestration of solid, nonhazardous, and cellulosic waste materials may be considered an eligible technology under this section if the Secretary, by rule—</text><clause id="HE66632D3458C4C21BDBEC20FD0CF0B3C" commented="no"><enum>(i)</enum><text>determines an entity that carries out a removal project under this section is able to adequately monitor, report, and verify the amount of greenhouse gas emissions, calculated on a lifecycle basis (including direct emissions and significant indirect emissions), removed using such equipment, technique, or technology;</text></clause><clause id="HC218B095243C433C88B701E6DC2E24F8" commented="no"><enum>(ii)</enum><text>determines an entity that carries out a removal project under this section is able to adequately mitigate the environmental impacts (including impacts on biodiversity, land use, and air and water quality) associated with such equipment, technique, or technology; and</text></clause><clause id="H7FF9E79E328B41CFBDA4EFFBA3E05860" commented="no"><enum>(iii)</enum><text>requires an entity carrying out a removal project under this section to—</text><subclause id="H073400F58D734CCCB6B5FB7F41D31456" commented="no"><enum>(I)</enum><text>adequately monitor, report, and verify the amount and storage permanence of greenhouse gas emissions, calculated on a lifecycle basis (including direct emissions and significant indirect emissions), associated with using such equipment, technique, or technology; and</text></subclause><subclause id="H02C547B85AD0471BBFB1D5B5217E1DA3" commented="no"><enum>(II)</enum><text>adequately mitigate the environmental impacts (including impacts on biodiversity, land use, and air, soil, and water quality) associated with using such equipment, technique, or technology.</text></subclause></clause></subparagraph></paragraph><paragraph id="H10A514347A3D41A5AA110FBF10F0F649" commented="no"><enum>(2)</enum><header>Lifecycle basis</header><text>The term <term>lifecycle basis</term> means the net sum of all greenhouse gas emissions (using mass values for all greenhouse gases that are adjusted to account for their relative global warming potential, in consultation with the Administrator of the Environmental Protection Agency) and removals associated with carbon dioxide removal activity from cradle to grave, including any emissions associated with—</text><subparagraph id="H9623A9326E87435E98167C499DF583ED" commented="no"><enum>(A)</enum><text>energy and feedstock inputs;</text></subparagraph><subparagraph id="H30FCBC2B10314D59B7B63D5CFE5F35FC" commented="no"><enum>(B)</enum><text>the carbon dioxide removal process;</text></subparagraph><subparagraph id="H05301C3217744FAD9E754FAF0A63B09B" commented="no"><enum>(C)</enum><text>carbon dioxide storage, including use and disposal of any materials or products associated with carbon dioxide storage; and</text></subparagraph><subparagraph id="H13DFBB886042474796948E8CDCAAD9C2" commented="no"><enum>(D)</enum><text>embodied emissions of the equipment.</text></subparagraph></paragraph><paragraph id="H02531B10AA0E450E9EB8C63A31EC1907"><enum>(3)</enum><header>Remove</header><text>The term <term>remove</term> means to—</text><subparagraph id="H6208A50087C542429D5EAC2E3F48198E"><enum>(A)</enum><text>capture carbon dioxide using eligible technology; and</text></subparagraph><subparagraph id="HF7B9A87C99904F1EA902C1468355B971"><enum>(B)</enum><text>permanently store such captured carbon dioxide—</text><clause id="HED3CA5FFF91E4BC58F532A9165EC8FAA" commented="no"><enum>(i)</enum><text>in dedicated subsurface geologic storage reported under sections 98.440 and 146.91(e) of title 40, Code of Federal Regulations (or successor regulations);</text></clause><clause id="H81B8563A19BC4801B77E164284BA66E2"><enum>(ii)</enum><text>in building materials and mineralized carbon materials; or</text></clause><clause id="H00DD9BE6325B48BCA74B619CA63B92F8"><enum>(iii)</enum><text>using other permanent storage methods, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="HF763B5C05A6E4D6E9514803F12DB44CB"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="HCCD46C1B6F1A40D9B11B909FD2762C90"><enum>(5)</enum><header>Small removal project</header><text>The term <term>small removal project</term> means a project for the removal of carbon dioxide that does not remove more than 5 percent of the net metric tons of carbon dioxide required to be removed for the applicable fiscal year under subsection (a).</text></paragraph></subsection></section><section id="H6CC6145FEEF04961A32D450A62DAAE0C"><enum>3.</enum><header>Study on the long-term future of Federal carbon dioxide removal management</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Energy, in consultation with the Administrator of the National Oceanic and Atmospheric Administration, the Administrator of the Environmental Protection Agency, the Secretary of the Department of Agriculture, and other relevant Federal agencies, shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report that evaluates and makes recommendations for potential program design elements and financing options for a Federal carbon dioxide removal offtake program that can be scaled to achieve carbon dioxide removal from the atmosphere and the oceans at a gigaton scale annually by 2050. Such report shall include consideration of potential management and organizational structures for the program, including—</text><paragraph id="H24693F4FF2E741EEBCA6CC4B1FB25BF0"><enum>(1)</enum><text>a government sponsored enterprise;</text></paragraph><paragraph id="HD570DCF8BC544A3A9F58F04F9C0D861C"><enum>(2)</enum><text>a government corporation;</text></paragraph><paragraph id="HBAB0D42DA7604D34BD32E8020DA79753"><enum>(3)</enum><text>a program office with the Department of Energy or other Federal agency; and</text></paragraph><paragraph id="HAC91DD7EC7BF4A15BFA5EFF26140D34C"><enum>(4)</enum><text>a contracted service provider.</text></paragraph></section></legis-body></bill>
