which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to establish a program to provide grants to eligible recipients for eligible operating support costs of public transportation, and for other purposes.</official-title></form><legis-body id="HD7ADBC10241842F6974494222D7FC087" style="OLC"><section id="H18803FE1A98F4BA89E9A10568D768187" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stronger Communities through Better Transit Act</short-title></quote>.</text></section><section id="H4B9D7933A96041F791106F194C6B413B"><enum>2.</enum><header>High quality transit operating support program</header><subsection id="H28317C24DCE247D285CC404E4D3F4529"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">Chapter 53</external-xref> of title 49, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/49/5307">section 5307</external-xref> the following:</text><quoted-block id="H3FF507C3FE1140BDA5E19CC7C91BC762" style="USC"><section id="H7469392A85DB40C6AF854DA50E09355F"><enum>5308.</enum><header>High quality transit operating support program</header><subsection id="H608F09C64F234178B00BA4A9916B6B57"><enum>(a)</enum><header>In general</header><text>The Secretary of Transportation shall establish a program under which the Secretary may make grants to eligible recipients to enhance mobility and improve environmental sustainability through investing in public transportation service improvements.</text></subsection><subsection id="HA983374D8F9B4E4F97D46DBFB187B54C"><enum>(b)</enum><header>Allocation of funding</header><text>For each fiscal year, the Secretary shall allocate funding as follows:</text><paragraph id="H35AB0DF7F7D041A8B53870F576B43E33"><enum>(1)</enum><text>Each urbanized area, State, and Indian Tribe that is an eligible recipient shall receive an apportionment based on data contained in the National Transit Database such that—</text><subparagraph id="H111A42625E5146929934E5C508B41480"><enum>(A)</enum><text>each urbanized area shall receive an amount equal to 50 percent of the urbanized area’s average annual operating costs over the 3-year period preceding such fiscal year;</text></subparagraph><subparagraph id="H26982E25C6F9414C9978E8994715E943"><enum>(B)</enum><text display-inline="yes-display-inline">each State shall receive an amount equal to 50 percent of the subrecipients in such State under section 5311 average operating costs over the 3-year period preceding such fiscal year; and</text></subparagraph><subparagraph id="H5B5F3A9470FB4BA2B58FEBBCDA16A513"><enum>(C)</enum><text display-inline="yes-display-inline">each Indian Tribe shall receive an amount equal to 50 percent of the Indian Tribe’s average operating costs over the 3-year period preceding such fiscal year.</text></subparagraph></paragraph><paragraph id="H4E7F40B2B3444F6F877E6BD4770657C0"><enum>(2)</enum><text display-inline="yes-display-inline">For funds remaining after the apportionment described in paragraph (1), such funds shall be apportioned such that each urbanized area, State, and Indian Tribe that is an eligible recipient shall receive an apportionment equal to the proportion of all operating costs reported to the National Transit Database over the 3-year period preceding the fiscal year in which such funds are apportioned.</text></paragraph><paragraph id="H63EB9EFCC46B45FC887DF032E23AC5BA"><enum>(3)</enum><text display-inline="yes-display-inline">In any given year, no urbanized area, State, or Indian Tribe may receive an apportionment under this subsection that is greater than 80 percent of the average operating costs over the 3-year period preceding the fiscal year in which such funds are apportioned. </text></paragraph></subsection><subsection id="HC10EAC627C024C1AB4F6AAACF236542F"><enum>(c)</enum><header>Eligible projects</header><paragraph id="H41EC0D9FC9A74D418778349C4759FB93"><enum>(1)</enum><header>In general</header><text>Eligible recipients may use funding provided under this section for operating costs associated with projects eligible under this chapter and title 23 that improve public transportation service for transit dependent populations and support increased transit ridership, including—</text><subparagraph id="HE6EE2A57F4C14BDAAC4E421F65AA7ED9"><enum>(A)</enum><text>projects that decrease headways;</text></subparagraph><subparagraph id="H3CE61110A5D0458BB84800B30310CA11"><enum>(B)</enum><text>projects for new or expanded service area, hours, or days;</text></subparagraph><subparagraph id="HD537E0434F4E46D1A300B40902550642"><enum>(C)</enum><text>projects to improve transit reliability or travel time savings, including transit prioritization;</text></subparagraph><subparagraph id="H3517BAEB46554DD99858EEBA18E6AD35"><enum>(D)</enum><text>IT enhancements to improve customer information and customer and employee safety such as implementation of real-time transit data;</text></subparagraph><subparagraph id="HD388D567D4C74F7A914DF23D79842353"><enum>(E)</enum><text>projects to support seamless complete trips, including—</text><clause id="H723511448CC64F79B7FE3314C6C8DAC4"><enum>(i)</enum><text>projects to improve transit network connectivity;</text></clause><clause id="H2E1DD1E256C644BC9C0523B952B96B9E"><enum>(ii)</enum><text>signage and wayfinding;</text></clause><clause id="HA716EAF5FFE742A282F631C714A896E4"><enum>(iii)</enum><text>fare coordination; and</text></clause><clause id="H090DB4238E3740CB9EBFCBCF4AF1D49F"><enum>(iv)</enum><text>multimodal payment integration;</text></clause></subparagraph><subparagraph id="H03D3F40D944E4D0B990D07A8DF0E9959"><enum>(F)</enum><text>service planning related to funding provided under this section, including planning to address changing demographics, changing travel movement, network redesign (including the implementation of a plan that results in a net increase in service hours across a region, subregion, or study area), and accommodating essential service trips (including service trips for employment, healthcare facilities, child care, education and workforce training, food sources, banking and other financial institutions, and other retail shopping establishments);</text></subparagraph><subparagraph id="H331A29C8F6F8453E9E46379F5ECFEF2A"><enum>(G)</enum><text>measuring access to work and essential services, particularly for non-drivers, for the purpose of developing projects to be funded under this section, including data acquisition and acquiring outside support for conducting analysis of such data;</text></subparagraph><subparagraph id="H6C55280017C74B308E65D986E66D96CC"><enum>(H)</enum><text>measures to enhance customer sense of safety and security, including public safety measures and outreach to unhoused persons in the transit system;</text></subparagraph><subparagraph id="H5E603926A8CC449D91BBD050D5CADF86"><enum>(I)</enum><text>initiatives to improve the transit environment, such as additional or enhanced cleaning; and</text></subparagraph><subparagraph id="H39EE10A9406442309637C37C5BE1B153"><enum>(J)</enum><text>workforce development initiatives necessary to improve or maintain service.</text></subparagraph></paragraph><paragraph id="HF89320398176419C98823841807B4CED"><enum>(2)</enum><header>No effect on other laws</header><text>The use of funds from this section for operating costs of projects described in paragraph (1) may not affect the eligibility of such projects to receive funding from other sections of this chapter or title 23.</text></paragraph></subsection><subsection id="H25FD06E59A70490D81A7B54102900389"><enum>(d)</enum><header>Requirement</header><text>A preponderance of a grant received by a recipient under this section in a fiscal year shall be used for projects that benefit underserved communities or areas of persistent poverty.</text></subsection><subsection id="H10D4738DD8E5495F9A147709AAA670B4"><enum>(e)</enum><header>Federal share</header><paragraph id="HF14762612A9E44A59C77E36BE8F04607"><enum>(1)</enum><header>In general</header><text>The Federal share of a project or program carried out using a grant awarded under this section shall be not greater than 50 percent.</text></paragraph><paragraph id="H3E87D577DA4641A883B318BA7E309105" commented="no"><enum>(2)</enum><header>Federal share for operating expenses</header><text>In the case that a project includes both operating components funded from this section and non-operating components, the Federal share for operating components shall be 50 percent and for non-operating components shall be consistent with the requirements of the funding source for those components. </text></paragraph><paragraph id="H6CB199A18AE242E09F81F603D3CBEAE0"><enum>(3)</enum><header>Increased federal share for certain areas</header><text>Notwithstanding paragraph (2), the Federal share of an operating assistance component of a project or program carried out in an area of persistent poverty or an underserved community using a grant awarded under this section shall be not greater than 80 percent.</text></paragraph><paragraph id="HEE3191638AE846218576C03BADC6E57C"><enum>(4)</enum><header>Federal share for Indian Tribes</header><text>Notwithstanding paragraphs (1) through (3), for Indian Tribes receiving funding allocated under subsection (b)(1)(C), the Federal share of a project or program carried out using a grant awarded under this section shall be 100 percent.</text></paragraph><paragraph id="H56E8BAAE2E094DD9A2EC170D9CF26D79"><enum>(5)</enum><header>In kind match</header><text>Of the non-Federal share required under this subsection, 25 percent may be derived from amounts (other than amounts received from the Federal Transit Administration) expended for associated capital improvements related to a project or program carried out using a grant awarded under this section.</text></paragraph></subsection><subsection id="HC3C6AC4E78F240A6BF4E6EA3E1B7941F"><enum>(f)</enum><header>Period of availability</header><text>An amount apportioned under this section may be obligated by the recipient for 2 years after the fiscal year in which the amount is apportioned. Not later than 30 days after the end of the 2-year period, an amount that is not obligated at the end of that period shall be added to the amount that may be apportioned under this section in the following fiscal year.</text></subsection><subsection id="H4B29F2AB01BD463FBC549F29469C65E1"><enum>(g)</enum><header>Conditions for operating assistance</header><text>As a condition of receiving a grant under this section, an eligible recipient shall—</text><paragraph id="H845AD37C9EA24432ABD39944B3DA7002"><enum>(1)</enum><text>in the case of a recipient in an urbanized area—</text><subparagraph id="H4FA1B2206ED146C7A1EED3DBCE90F4FD"><enum>(A)</enum><text>agree to report to the Federal Transit Administration, for inclusion in the National Transit Database—</text><clause id="H6C50AE97E66C4FA4842D3E7A691CDDF2"><enum>(i)</enum><text>service frequency and revenue vehicle hours, including revenue vehicle hours and unlinked passenger trips originating and terminating in areas of persistent poverty and underserved communities, together with such other specific data as the Secretary shall find necessary and appropriate; and</text></clause><clause id="H0AC3C8C6D065472F9428CFFE42ACF71B"><enum>(ii)</enum><text>the number of jobs and essential services accessible by transit, and improvement in such access, including specific reporting on access by transit for areas of persistent poverty and underserved communities; and</text></clause></subparagraph><subparagraph id="HC233AAC43A3C4BB2899EFDD33A3DE020"><enum>(B)</enum><text>demonstrate that such recipient has surveyed, within the past year and at least every 2 years thereafter, current transit riders as well as non-riding residents of areas of persistent poverty and underserved communities regarding transit service improvements, using means designed to maximize participation from both riders and non-riders, and has published the survey in an online format;</text></subparagraph></paragraph><paragraph id="H168C56C9E4EC4F25B12E9AA424FF56F4"><enum>(2)</enum><text>in the case of a recipient that is an Indian Tribe—</text><subparagraph id="H8BF94C24633441C2B92F24254EB28A32"><enum>(A)</enum><text>agree to report to the Federal Transit Administration, for inclusion in the National Transit Database, revenue vehicle hours and unlinked passenger trips, together with such other specific data as the Secretary shall find necessary and appropriate; and</text></subparagraph><subparagraph id="H26AC95C59BE548E0B424A03D2CD01A93"><enum>(B)</enum><text>demonstrate that such recipient has surveyed, within the past year and at least every 2 years thereafter, current transit riders as well as non-riding residents of the Tribe’s service area regarding transit service improvements, using means designed to maximize participation from both riders and non-riders, and has published the survey in an online format; and</text></subparagraph></paragraph><paragraph id="H3342A7A423C74B5EB4924F26385B76C0"><enum>(3)</enum><text>in the case of a recipient that is a State or other possession receiving assistance under section 5311—</text><subparagraph id="H11E900113A3E427EA18514E14FA68F79"><enum>(A)</enum><text>agree to report to the Federal Transit Administration, for inclusion in the National Transit Database, revenue vehicle hours for each subrecipient receiving assistance under this section, including revenue vehicle hours and unlinked passenger trips originating and terminating in areas of persistent poverty and under-served communities, together with such other specific data as the Secretary shall find necessary and appropriate;</text></subparagraph><subparagraph id="HE5636E85E5364086AF5E01504456FE7B"><enum>(B)</enum><text>provide an annually updated report to the Secretary identifying those underserved communities and areas of persistent poverty in the non-urbanized areas of the State or possession that do not have any reported public transit services, or in which either the availability or utilization of rural public transit is in the bottom quintile as compared to all rural public transit services in the United States, using such measurements as shall be identified by the Secretary, together with annually updated progress toward achieving the State’s or possession’s strategy for establishing high-quality transit service in these unserved and underserved communities and areas of persistent poverty; and</text></subparagraph><subparagraph id="HC1E0E33604E549C19E1458C7E5A24E04"><enum>(C)</enum><text>demonstrate that every subrecipient of the State or possession has surveyed, within the past year and at least every 2 years thereafter, current transit riders as well as non-riding residents of areas of persistent poverty and underserved communities within the sub-recipient’s service area regarding transit service improvements, using means designed to maximize participation from both riders and non-riders, and has published the survey in an online format.</text></subparagraph></paragraph></subsection><subsection id="H44F3EF33248E46A1B18EAFD2DB38C578"><enum>(h)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this section, the Secretary shall issue such regulations as are necessary to carry out the program established under subsection (a), including defining the terms <quote>preponderance of a grant</quote>, and <quote>access to jobs and essential service</quote> for purposes of this section and taking into account any necessary difference in the definition of such terms required for urbanized areas, rural areas located near urbanized areas, and remote rural areas.</text></subsection><subsection id="HEE940650F448403683AD7798D47E2391"><enum>(i)</enum><header>Access measurement</header><paragraph id="H5B43D15959C8449FA7F1CAE2E52236CE"><enum>(1)</enum><header>In general</header><text>In carrying out the program under this section, the Secretary shall set up a multimodal access measurement interface that is open to any public agency through the program under section 5505 to aid transit agencies in determining and reporting on access to jobs and essential services.</text></paragraph><paragraph id="H2DECA243145B43E1942FB9DE1177A40B"><enum>(2)</enum><header>Interim data</header><text>Until the access measurement interface under paragraph (1) is established, an eligible recipient may use other data sources to determine and report on access to jobs and essential services.</text></paragraph></subsection><subsection id="H0AF48D55C76F45FB86DF889F9923D133"><enum>(j)</enum><header>Maintenance of effort</header><paragraph id="H6B4B2E8E3D0A4EA99B056EF51B66B3FF"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the beginning of each fiscal year, recipients of funds under this section shall certify to the Secretary that such recipients will, with funding pledged by all sources, maintain effort with regard to transit service. As part of such certification, the transit agency shall submit to the Secretary a statement identifying the amount of funds from all sources (other than funds provided under this section and related non-Federal match) expended on transit operations during the prior fiscal year, and the amount expected to be expended on transit operations from all sources during the current fiscal year.</text></paragraph><paragraph id="HC6C39E791965476584E12AD184B9E82C"><enum>(2)</enum><header>Failure to maintain effort</header><text>If a recipient of funds under this section is unable to maintain the level of effort certified pursuant to paragraph (1) for any fiscal year, the amount such recipient would have received under this section in the following fiscal year shall be reduced by one-third.</text></paragraph></subsection><subsection id="H82A616A2DAE3486E9F95BEFE7789FEEC"><enum>(k)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to prevent an eligible recipient from increasing service through the use of any other Federal or non-Federal funds.</text></subsection><subsection id="H0393C73570344C799A874E69A8522F49"><enum>(l)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $20,000,000,000 for each of fiscal years 2024 through 2027.</text></subsection><subsection id="H9C336004F0EE4FB68CEB56238B213FAD"><enum>(m)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H85D4175E2CBD4EECAA2655A751A817E9"><enum>(1)</enum><header>Areas of persistent poverty</header><text>The term <quote>area of persistent poverty</quote> means—</text><subparagraph id="H8C0E58997A414B849FEE29CCC797D426"><enum>(A)</enum><text>a county that has consistently had greater than or equal to 20 percent of the population of such county living in poverty during the most recent 30-year period for which data is available, as measured by the 1990 and 2000 decennial censuses; or</text></subparagraph><subparagraph id="H29ED6AB840704230B2B990C3AC8E7062"><enum>(B)</enum><text>a census tract with a poverty rate of at least 20 percent as measured by the 2014 through 2018 5-year data series available from the American Community Survey of the Bureau of the Census.</text></subparagraph></paragraph><paragraph id="HDF48D6D1F73641FF8D00D746B00391BC"><enum>(2)</enum><header>Associated capital improvements</header><text>The term <quote>associated capital improvements</quote> means a capital project described in subparagraphs (B) through (G) of section 5302(4).</text></paragraph><paragraph id="HD37C241FA08E4741BD1B21BB43B4044F"><enum>(3)</enum><header>Eligible recipient</header><text>The term <quote>eligible recipient</quote> means a recipient or subrecipient of funds under section 5307 or 5311.</text></paragraph><paragraph id="H03AAD4B5ABB04711906C3026A669F262"><enum>(4)</enum><header>Underserved community</header><text>The term <quote>underserved community</quote> means—</text><subparagraph id="H7DA8FDAA32ED43398E5A8702F20907B5"><enum>(A)</enum><text>a census tract or block numbering area in which the median income does not exceed 80 percent of the area median income;</text></subparagraph><subparagraph id="HE96BD0D125E74AC2B4B2237E53669FE3"><enum>(B)</enum><text>families with income not greater than 100 percent of the area median income that reside in minority census tracts;</text></subparagraph><subparagraph id="HFA6274A00C2748068325F57392829048"><enum>(C)</enum><text>families with income not greater than 100 percent of the area median income that reside in areas affected by disasters, as determined by the Administrator of the Federal Transit Administration;</text></subparagraph><subparagraph id="HC349BFAD4E094D26BB5F3B2A1BAD404B"><enum>(D)</enum><text>a census tract that has a minority population of at least 30 percent or a median income of less than 100 percent of the area median income;</text></subparagraph><subparagraph id="HB15B8CDE51024295A4C2281D2EF8520C"><enum>(E)</enum><text>a community that has low access to jobs and essential services, as determined by the Secretary; or</text></subparagraph><subparagraph id="H5EB1429DB45D4BB3BBD15502E59DBDCE"><enum>(F)</enum><text>a census block or group of geographically contiguous census blocks in which the population of any racial or ethnic minority individuals, individually or in combination, comprises 30 percent or more of the population of persons in the census block or group of geographically contiguous census blocks.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9A3A7930F24F4003940B92B451C0983C"><enum>(b)</enum><header>Federal transit program general purposes</header><text display-inline="yes-display-inline">Section 5301(b) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block id="HB0AFEA109E6B45089035D2CF6448F02F" style="OLC"><paragraph id="H799A2ED8CC7C41A5AA5C0E8C8B7BCF8E"><enum>(9)</enum><text>support public transportation’s role in combating climate change through growing/retaining transit ridership.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB7B3FF704CF74D1C9F128954FB18A748" commented="no"><enum>(c)</enum><header>Applicability of law</header><text>The Secretary of Transportation shall ensure that the requirements of section 5333 of title 49, United States Code, are applied to section 5308 of such title (as added by subsection (a)). </text></subsection><subsection id="H8BD6EEB8169843418E33BAE1F5692AB8"><enum>(d)</enum><header>GAO report</header><text>Not later than 4 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate a report that reviews the outcomes of the program established under section 5308 of title 49, United States Code, as added by subsection (a), including new service produced and improvements in access to work and essential services, particularly for areas of persistent poverty and underserved communities.</text></subsection><subsection id="H014B70EDAA444927A64FD9AD6A727433"><enum>(e)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/5307">section 5307</external-xref> the following:</text><quoted-block style="USC" id="H1F93496B2D4147A08ADDA4782D829553" display-inline="no-display-inline"><toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="H3FF507C3FE1140BDA5E19CC7C91BC762" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry idref="H7469392A85DB40C6AF854DA50E09355F" level="section">5308. High quality transit operating support program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2E7308E6E71A4E9DB738C9488F73C2AA"><enum>(f)</enum><header>Sense of congress</header><text>It is the sense of Congress that capital funding for transit should be increased.</text></subsection></section><section id="H7EDB40B5759448709A46926723E0F0A8"><enum>3.</enum><header>Increased Federal share of operating costs for rural areas</header><text display-inline="no-display-inline">Section 5311(g)(2) of title 49, United States Code, is amended to read as follows:</text><quoted-block id="H84485436EF984529A8438223A6391CC6" style="OLC"><paragraph id="H4E6DBCCD9F134A2F83E67A7C5C41E63D"><enum>(2)</enum><header>Operating assistance</header><text>A grant made under this section for operating assistance may not exceed 80 percent of the net operating costs of the project, as determined by the Secretary.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></section></legis-body></bill>
