R. 7000</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240116">January 16, 2024</action-date><action-desc><sponsor name-id="S001213">Mr. Steil</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Consumer Financial Protection Act of 2010 to clarify the authority of the Bureau of Consumer Financial Protection with respect to persons regulated by a State insurance regulator, and for other purposes.</official-title></form><legis-body id="H68AE4CDE6110462AA3B7CF8DB927B885" style="OLC"><section id="HE9BF3FE4BBAE4033B87E777DC24DA810" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Business of Insurance Regulatory Reform Act of 2024</short-title></quote>.</text></section><section id="HB22A45C3828441A79274FA12E2BF9E82" section-type="subsequent-section"><enum>2.</enum><header>Clarification to the authority of the Bureau with respect to persons regulated by a State insurance regulator</header><text display-inline="no-display-inline">Section 1027(f) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5517">12 U.S.C. 5517(f)</external-xref>) is amended—</text><paragraph id="H8ADC7A8698864927A63953FC065143B6"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="HE85ED4BE64F94517AC373BE343EF01D3"><enum>(A)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">Description of activities.—</header-in-text>Paragraph (1)</quote> and inserting: </text><quoted-block display-inline="yes-display-inline" id="H8D83FD36954A4DF9BBFE8D32296B03A8" style="OLC"><text><header-in-text level="paragraph" style="OLC">Exceptions.—</header-in-text></text><subparagraph id="H24FDB39CCBA74FE9AA4BB27A9337AABD" indent="up2"><enum>(A)</enum><header>Authority</header><text display-inline="yes-display-inline">Paragraph (1)</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H281D1D26C29E4F199C16D47E9FB2997E"><enum>(B)</enum><text>by inserting after subparagraph (A) (as added by this Act) the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="HA91ADDE138C04AC18E712B209AE26A90" style="OLC"><subparagraph id="HD3D7795569CC4986B738F398CA570C51"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">With respect to a person regulated by a State insurance regulator—</text><clause id="HEB3D47D7C3D144518A7C0F59752BD825"><enum>(i)</enum><text display-inline="yes-display-inline">and if such person is offering or providing a consumer financial product or service, the Bureau may not enforce this title with respect to such person to the extent such person is engaged in the business of insurance; or</text></clause><clause id="H7398E4E8BAAF42AEAA301FB06125FA0C"><enum>(ii)</enum><text display-inline="yes-display-inline">and if such person is subject to any enumerated consumer law or any law for which authorities are transferred under subtitle F or H, the authority of the Bureau to enforce such law with respect to such person shall be narrowly construed to the extent such person is engaged in the business of insurance.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF99F35116DB14B89B8C4FCD1CA854C77"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HE6735186BF7241208BE1AB0A14CD0C88" style="OLC"><paragraph id="H1B984A6F908146FC80AC84163AE85C25"><enum>(4)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">The enforcement of this title shall be broadly construed in favor of the authority of a State insurance regulator with respect to a person regulated by a State insurance regulator.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
