which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Homeland Security and Secretary of State to require aliens applying for certain visas to disclose if they receive funds from the Government of the People’s Republic of China or the Chinese Communist Party, and for other purposes.</official-title></form><legis-body id="H558DFE7E5ACE4F68948F22F0F3518868" style="OLC"><section id="H1FDCD21BC56F459182D5504AAE7701E8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chinese Communist Party Visa Disclosure Act of 2023</short-title></quote> or the <quote><short-title>CCP Visa Disclosure Act of 2023</short-title></quote>. </text></section><section id="H04D2438CFC5346F89FECEC2179C7FF47"><enum>2.</enum><header>Disclosure on certain visa applications</header><subsection id="H3734D3CDD1474E3AAE276F65FEC4CA65"><enum>(a)</enum><header>Disclosure requirement for F and M visas</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall update Form I–20, or a successor form with respect to eligibility for nonimmigrant student status, to require an alien submitting such form to report—</text><paragraph id="H2819D2DE48DF4FE4AB2619B6E501CB4E"><enum>(1)</enum><text>whether the alien has received or plans to receive certain funds; </text></paragraph><paragraph id="H6850A83267824674B0A67C4DE49B9A91"><enum>(2)</enum><text display-inline="yes-display-inline">the amount of any certain funds received by the alien; and</text></paragraph><paragraph id="HB4688C71BD1C405F805BE3F724EAA586"><enum>(3)</enum><text>a description of the entity providing any certain funds to the alien. </text></paragraph></subsection><subsection id="H5EC813289ADA445CABAE755177E9AA0E"><enum>(b)</enum><header>Disclosure requirement for J visas</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall update Form DS–2019, or a successor form with respect to eligibility for an exchange visitor status, to require an alien submitting such form to report—</text><paragraph id="H909CDAC1D5D44660866B5F34B2F20A01"><enum>(1)</enum><text>whether the alien has received or plans to receive certain funds; </text></paragraph><paragraph id="HF947A27818D34F728C93ACE1B076E0A7"><enum>(2)</enum><text display-inline="yes-display-inline">the amount of any certain funds received by the alien; and</text></paragraph><paragraph id="HB4652B45984A4037B817921B5EFE0B0F"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the entity providing any certain funds to the alien. </text></paragraph></subsection><subsection id="H47B04E343C2E4696B27C69E86E2E7D0A" commented="no"><enum>(c)</enum><header>Updated disclosure requirement</header><paragraph id="H5C127FFEDD1D47E2A862020E3E512E91"><enum>(1)</enum><header>In general</header><text>An alien who receives certain funds after receiving a visa under subparagraph (F), (J), or (M) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) shall report to the Secretary of Homeland Security and the Secretary of State the receipt of such funds not more than 90 days after the date on which such funds are received.</text></paragraph><paragraph id="H6AF352807DD14F47847E43EC3F7FB434"><enum>(2)</enum><header>Provisional revocation based on failure to comply with disclosure requirement</header><text display-inline="yes-display-inline">An alien who receives certain funds and does not report such receipt pursuant to paragraph (1) is subject to revocation of any visa or other entry documentation regardless of when the visa or other entry documentation was issued. </text></paragraph></subsection><subsection id="H439E05D8A54741D4B30DFBF27E2F6F8A"><enum>(d)</enum><header>Disclosure for alien spouse and minor children</header><text display-inline="yes-display-inline">The disclosure requirements under subsections (a) through (c) shall apply to an alien spouse or any minor children applying for or receiving a visa under subparagraph (F), (J), or (M) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>).</text></subsection><subsection id="H37E816C4F451468B8CA209E68EBD07E1"><enum>(e)</enum><header>Applicability</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, an alien, alien spouse, or any minor children who have a valid visa under subparagraph (F), (J), or (M) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) on the date of the enactment of this Act, shall report to the Secretary of Homeland Security—</text><paragraph id="H41155473C3F040598196A61D8ED13B10"><enum>(1)</enum><text>whether such alien has received or plans to receive certain funds; </text></paragraph><paragraph id="H90AC2C9FFB9E472AA602A000676920FB"><enum>(2)</enum><text display-inline="yes-display-inline">the amount of any certain funds received by the alien; and</text></paragraph><paragraph id="H9B90972F73AE4DB19E2CACAE286BBA30"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the entity providing any certain funds to the alien. </text></paragraph></subsection><subsection id="HED6B0CFF78434FF18E6C759B05FE96AC"><enum>(f)</enum><header>Certain funds defined</header><text>In this section, the term <term>certain funds</term> includes any amount of money provided to an alien from—</text><paragraph id="H5B247143B70D48BD9F62CEBB285513A2"><enum>(1)</enum><text display-inline="yes-display-inline">the Government of the People's Republic of China;</text></paragraph><paragraph id="HE5C8F2562FF3499CAA37FCA8FA52C703"><enum>(2)</enum><text>the Chinese Communist Party; or</text></paragraph><paragraph id="H1B358CC725194702AEB1AB7D6DD72ACD"><enum>(3)</enum><text display-inline="yes-display-inline">any entity owned or controlled by the Government of the People's Republic of China or the Chinese Communist Party. </text></paragraph></subsection></section></legis-body></bill>
