which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to ensure that remote physiologic monitoring services are not subject to cost sharing under the Medicare program.</official-title></form><legis-body id="H56BAD8B582A743209147CBC4118618A3" style="OLC"><section id="HC2CE2C3EBBF04ED69C207FB3959B1301" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>RPM Cost Sharing Elimination Study Act of 2023</short-title></quote>.</text></section><section id="H65E8C2C63DE0418A8A902D33D80A0A38"><enum>2.</enum><header>Ensuring that remote physiologic monitoring services are not subject to cost sharing under the Medicare program</header><subsection id="HAE76812F3DE04CAEB5A37AC2533333F8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1833 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l</external-xref>) is amended—</text><paragraph id="HDC918AB2E5394BCCBF2D618B5DBAAC6C"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph id="H321B04D9A6EB4ADDA8B17F2AB06430DD"><enum>(A)</enum><text>by striking <quote>and (HH)</quote> and inserting <quote>(HH)</quote>; and</text></subparagraph><subparagraph id="H3A69FBAE53B949FB892B5CC2235E1409"><enum>(B)</enum><text>by inserting before the semicolon at the end the following <quote>, and (II) with respect to remote physiologic monitoring services, the amounts paid shall be 100 percent of the lesser of the actual charge for the services or the amount determined under the payment basis established under section 1848</quote>; and</text></subparagraph></paragraph><paragraph id="HAC20C726C8A044C48581B2DE7D3E16A0"><enum>(2)</enum><text>in subsection (b), in the first sentence—</text><subparagraph id="H9710326B42174B08A5E27215145BBEBD"><enum>(A)</enum><text>by striking <quote>, and (13)</quote> and inserting <quote>(13)</quote>; and</text></subparagraph><subparagraph id="HABD4460528884F0EA85AC968752CC8FE"><enum>(B)</enum><text>by striking the first period at the end and inserting <quote>, and (14) such deductible shall not apply with respect to remote physiologic monitoring services</quote>.</text></subparagraph></paragraph></subsection><subsection id="H6192A514CF3F47F4811FE17D8C468D8A"><enum>(b)</enum><header>Medicare Advantage</header><text>Section 1852(a)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-22">42 U.S.C. 1395w–22(a)(1)(B)</external-xref>) is amended—</text><paragraph id="H9C8A3DF6AF844E7EB72CD931E3DCD531"><enum>(1)</enum><text>in clause (iv)—</text><subparagraph id="HF377A6E8375B4417927F24D20A59BF6A"><enum>(A)</enum><text>by redesignating subclause (VIII) as subclause (IX); and</text></subparagraph><subparagraph id="HB0D1FA1129B34A06ADDFCEC8C72C8D40"><enum>(B)</enum><text>by inserting after subclause (VII) the following new subclause:</text></subparagraph><subparagraph id="H48C93E806631403C9832578B862C65F2"><enum>(C)</enum><text>by adding at the end the following new subclause:</text><quoted-block style="OLC" id="H19D9F6A61CA14DAAA8A7DAF244869746" display-inline="no-display-inline"><subclause id="HA0B3838CE6F847BB80E8CBA85CA2A79C"><enum>(VIII)</enum><text display-inline="yes-display-inline">Remote physiologic monitoring services.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5A314D476C0D4531B48D2BD1026C96E0"><enum>(2)</enum><text>in clause (v), by striking <quote>and (VI)</quote> and inserting <quote>(VI), and (VIII)</quote>.</text></paragraph></subsection><subsection id="H2D0B0F7D10AF49F09BFFAC6ACA3E6EC8"><enum>(c)</enum><header>Report</header><text>Not later than June 30, 2026, the Secretary of Health and Human Services shall submit to Congress a report on the effects eliminating cost sharing for remote physiologic monitoring services under Medicare had on patient health outcomes and on any cost savings attributable so such elimination.</text></subsection><subsection id="H51C6D5FEDD7E46E9873B669AC1282FE2"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to items and services furnished on or after January 1, 2024, and before January 1, 2026.</text></subsection></section></legis-body></bill>
