<section id="H4EB72BF22AC54FA990B0E729758049E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Flexibility Act</short-title></quote>.</text></section> <section id="HD52179B00978480B8BCCAC00DA64AA21" section-type="subsequent-section"><enum>2.</enum><header>Tip pooling</header><text display-inline="no-display-inline">Section 3(m)(2) of the Fair Labor Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(m)(2)</external-xref>) is amended—</text> 
<paragraph id="H42ABF9EA725C4C9D9B32772CD12AED40"><enum>(1)</enum><text>in subparagraph (A)(ii), by striking <quote>employees who customarily and regularly receive tips</quote> and inserting <quote>pools of employees described in subparagraph (C)</quote>; and</text></paragraph> <paragraph id="H2E8CE672B07E4EEBBDFA3A3243EF9E6D"><enum>(2)</enum><text>by adding at the end the following:</text>

<subparagraph id="H772EFA4479414F7E968D7DF3A306DCCE" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">The pools of employees described in this subparagraph are as follows:</text> <clause id="H3FFC84A882AC423086701427E6BA3257"><enum>(i)</enum><text>Employees who customarily and regularly receive tips.</text></clause> 
<clause id="H720715E401F8400D975A9C6057300B66"><enum>(ii)</enum><text display-inline="yes-display-inline">Employees who—</text> <subclause id="HFB16C92A11554653A8E3A9E5F1F97F7D"><enum>(I)</enum><text>customarily and regularly receive tips and receive a cash wage paid by the employer that is not less than the wage in effect under section 6(a)(1); and</text></subclause> 
<subclause id="H74376D14460E4DEC8EADB2CDFF70981E"><enum>(II)</enum><text>do not customarily and regularly receive tips.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
