<section id="H39729C1DF9B749B4A381791D526B2BB8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Space Act of 2023</short-title></quote>.</text></section> <section id="H210F8A9B97674394A42399678B36A9AE"><enum>2.</enum><header>Prohibition on grant of certain satellite licenses or United States market access</header> <subsection id="H07CF88F3D5AA4FDF9B9F239DF90FAB1E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1601">47 U.S.C. 1601 et seq.</external-xref>) is amended—</text> 
<paragraph id="H0BBA760B055E432E94F141EB3352B837"><enum>(1)</enum><text>by redesignating sections 10 and 11 as sections 11 and 12, respectively; and</text></paragraph> <paragraph id="HAFFBB9A62F4641A78E5D8BCDFE723A8C"><enum>(2)</enum><text>by inserting after section 9 the following:</text>

<section id="H5AF03AA5818F4E6BABA8322624AFE915"><enum>10.</enum><header>Prohibition on grant of certain satellite licenses or United States market access</header><text display-inline="no-display-inline">The Commission may not grant a license for, or a petition for a declaratory ruling to access the United States market using, a non-geostationary orbit satellite system (as defined in section 25.103 of title 47, Code of Federal Regulations (or any successor regulation)), if such license or grant of market access would be held or controlled by—</text> <paragraph id="H7F0269E6DE6C464882DB805BB55F92B4"><enum>(1)</enum><text>an entity that produces or provides any covered communications equipment or service; or</text></paragraph> 
<paragraph id="H60517D5181E148A99BC1CC7C2BFF53CA"><enum>(2)</enum><text display-inline="yes-display-inline">an affiliate (as defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>)) of an entity described in paragraph (1).</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HB75AECE8FAEE4D289127FEC6A62D1CF9"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Section 10 of the Secure and Trusted Communications Networks Act of 2019, as added by subsection (a), shall apply with respect to the grant of a license or petition on or after the date of the enactment of this Act.</text></subsection></section>
