Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to allow for a credit against tax for rent paid on the personal residence of the taxpayer.</official-title></form><legis-body id="H48DCB76316CA443B898A68772829C97E" style="OLC"><section id="H4A42CA61BE3C47F484D0B412E2D53AE5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rent Relief Act of 2023</short-title></quote>.</text></section><section id="HDFEA7DA300954D62A908D9C03D7BC2F2"><enum>2.</enum><header>Refundable credit for rent paid for principal residence</header><subsection id="HB55178443F964D169019D8C441FB5E8C"><enum>(a)</enum><header>In general</header><text>Subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 36B the following new section:</text><quoted-block id="H38E81F11609D486CBDCB40D6CF721406" style="OLC"><section id="HCEDC64A4368C4C9986F409F9F6E51322"><enum>36C.</enum><header>Renter tax credit</header><subsection id="H71FEC572C4C54AC2966D7A439AFA7BC4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of an individual who leases the individual’s principal residence (within the meaning of section 121) during the taxable year and who pays rent with respect to such residence in excess of 30 percent of the taxpayer’s adjusted gross income for such taxable year, there shall be allowed as a credit against the tax imposed by this subtitle for such taxable year an amount equal to the applicable percentage of such excess.</text></subsection><subsection id="H0CB34D3D4B704E62BBBA21D00F3FC9AA"><enum>(b)</enum><header>Credit limited by 100 percent of small area fair market rent</header><text display-inline="yes-display-inline">Solely for purposes of determining the amount of the credit allowed under subsection (a) with respect to a residence for the taxable year, there shall not be taken into account rent in excess of an amount equal to 100 percent of the small area fair market rent (including the utility allowance) applicable to the residence involved (as most recently published, as of the beginning of the taxable year, by the Department of Housing and Urban Development).</text></subsection><subsection id="H6B3DC563E35F47678C8CD242277E644A"><enum>(c)</enum><header>Definitions and special rules</header><text display-inline="yes-display-inline">For purposes of this section—</text><paragraph id="HE1A1A7E7EB1942DBBDE0D2CA375AB335"><enum>(1)</enum><header>Applicable percentage</header><text>The term <quote>applicable percentage</quote> means the percentage determined in accordance with the following table:</text><table align-to-level="section" blank-lines-before="1" colsep="0" frame="none" line-rules="no-gen" rowsep="0" rule-weights="0.0.0.0.0.0" subformat="S6211" table-template-name="Flush/hang, 1 text, 1 num, bold hds" table-type="Leaderwork"><tgroup cols="2" rowsep="0" thead-tbody-ldg-size="10.10.12"><colspec coldef="txt" colname="column1" colwidth="335pts" min-data-value="225"></colspec><colspec coldef="fig" colname="column2" colwidth="168pts" min-data-value="10"></colspec><thead><row><entry align="left" colname="column1" morerows="0" namest="column1" rowsep="0"></entry><entry align="right" colname="column2" morerows="0" namest="column2" rowsep="0"><bold>The applicable</bold></entry></row><row><entry align="left" colname="column1" morerows="0" namest="column1" rowsep="0">If the taxpayer’s adjusted gross income is:</entry><entry $75,000, but not over $100,000</entry><entry align="right" colname="column2" leader-modify="clr-ldr" rowsep="0">25 percent</entry></row><row><entry colname="column1" leader-modify="force-ldr" rowsep="0" stub-definition="txt-ldr" stub-hierarchy="1">Over $100,000</entry><entry align="right" colname="column2" leader-modify="clr-ldr" rowsep="0">0 percent.</entry></row></tbody></tgroup></table></paragraph><paragraph id="HA740B5394129490DA51B22263A55EDE5"><enum>(2)</enum><header>Partial year residence</header><text>The Secretary shall prescribe such rules as are necessary to carry out the purposes of this section for taxpayers with respect to whom a residence is a principal residence for only a portion of the taxable year.</text></paragraph><paragraph id="H3D6643EE1911458489E78755BCE339E2"><enum>(3)</enum><header>Rent</header><text>The term <term>rent</term> includes any amount paid for utilities of a type taken into account for purposes of determining the utility allowance under section 42(g)(2)(B)(ii).</text></paragraph><paragraph id="HD2329411586244F8B40C4D0D4D8F13E6"><enum>(4)</enum><header>Married individuals filing separate returns</header><text>In the case of individuals who are married to each other, have the same principal residence, and do not file a joint return for the taxable year, the credit determined under this section with respect to each such individual shall be 50 percent of the amount of the credit which would be determined under this section if such individuals filed a joint return, unless such individuals agree on a different division of such credit (in such manner as the Secretary may provide) which does not aggregate to more 100 percent of such amount. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7B86E099C35D4CDEAF96ADA1B17CD597"><enum>(d)</enum><header display-inline="yes-display-inline">Reconciliation of credit and advance payments</header><text display-inline="yes-display-inline">The amount of the credit allowed under this section for any taxable year shall be reduced (but not below zero) by the aggregate amount of any advance payments of such credit under section 7527B for such taxable year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H94A63FF551B841A2A3656398142B6ED6"><enum>(b)</enum><header>Advance payment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/77">Chapter 77</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 7527A the following new section:</text><quoted-block display-inline="no-display-inline" id="H332E17F969A546D9B90694DC99A9E6A3" style="OLC"><section id="H26469072122B4C4594657F2DD1E21EAD"><enum>7527B.</enum><header>Advance payment of renter tax credit</header><subsection id="H556CBBAFFA134EA8BC8729B4451A589C"><enum>(a)</enum><header>In general</header><text>Not later than 6 months after the date of the enactment of the <short-title>Rent Relief Act of 2023</short-title>, the Secretary shall establish a program for making advance payments of the credit allowed under section 36C on a monthly basis to any taxpayer who—</text><paragraph id="H8A41B03414AE4ECB8C4EA2ED0EA6B6C7"><enum>(1)</enum><text>the Secretary has determined will be allowed such credit for the taxable year, and</text></paragraph><paragraph id="H6E7C453B76BC419A8F8E39B99C4B0BFF"><enum>(2)</enum><text>has made an election under subsection (c).</text></paragraph></subsection><subsection id="H70630032F625431C892F7DD5C56E714E"><enum>(b)</enum><header>Amount of advance payment</header><paragraph id="HBBF8CEDC62A94D95991C8E91A42921ED"><enum>(1)</enum><header>In general</header><text>For purposes of subsection (a), the amount of the monthly advance payment of the credit provided to a taxpayer during the applicable period shall be equal to the lesser of—</text><subparagraph id="HF9953054B20A4C8AAD6CC458DB6509CA"><enum>(A)</enum><text>an amount equal to—</text><clause id="HC0C841E93941415B9678C34741D86ECD"><enum>(i)</enum><text>the amount of the credit which the Secretary has determined will be allowed to such taxpayer under section 36C for the taxable year ending in such applicable period, divided by</text></clause><clause id="H9FB60B7434DE4A12BD90C64B640B7231"><enum>(ii)</enum><text>12, or</text></clause></subparagraph><subparagraph id="H3B9EAE3D8050447AA86ECE3E71F9C243"><enum>(B)</enum><text>such other amount as is elected by the taxpayer.</text></subparagraph></paragraph><paragraph id="HC9077099AB7D480A93E75A390BA8F743"><enum>(2)</enum><header>Applicable period</header><text>For purposes of this section, the term <term>applicable period</term> means the 12-month period from the month of July of the taxable year through the month of June of the subsequent taxable year.</text></paragraph></subsection><subsection id="H3236A7BAB9F24407945065D4856BFF4F"><enum>(c)</enum><header>Election of advance payment</header><text>A taxpayer may elect to receive an advance payment of the credit allowed under section 36C for any taxable year by including such election on a timely filed return for the preceding taxable year.</text></subsection><subsection id="HFC652B2C98644F17920439AF7ECCC6AC"><enum>(d)</enum><header>Internal Revenue Service notification</header><text>The Internal Revenue Service shall take such steps as may be appropriate to ensure that taxpayers who are eligible to receive the credit under section 36C are aware of the availability of the advance payment of such credit under this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H12E8D78BA0E242D88C55016E69336535"><enum>(e)</enum><header>Regulations</header><text>The Secretary may prescribe such regulations or other guidance as may be necessary or appropriate to carry out the purposes this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H986BD34FCF84453A8E4CB6E04D887801"><enum>(c)</enum><header>Clerical amendments</header><paragraph id="H325B6934CF6B4A05A8B7A0D8D6759D1E"><enum>(1)</enum><header>In general</header><text>The table of sections for subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after the item relating to section 36B the following new item:</text><quoted-block id="H60B62F4721484595A4E6C837A112F818" style="OLC"><toc><toc-entry idref="HCEDC64A4368C4C9986F409F9F6E51322" level="section">Sec. 36C. Renter tax credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HF13F4F2E79144E57838D2D4778926C54"><enum>(2)</enum><header>Advance payment</header><text>The table of sections for chapter 77 of such Code is amended by inserting after the item relating to section 7527A the following new item:</text><quoted-block style="OLC" id="H99A4E37C55DC489BA70441CA0AA9FE53" display-inline="no-display-inline"><toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="H332E17F969A546D9B90694DC99A9E6A3" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry idref="H26469072122B4C4594657F2DD1E21EAD" level="section">Sec. 7527B. Advance payment of renter tax credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6C56190BF2334DAA9B8C11E571C185B6"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to taxable years beginning after December 31, 2023.</text></subsection><subsection id="HE43FD7D923EE4E338DF5E16F6BF4081A"><enum>(e)</enum><header>Community outreach</header><text display-inline="yes-display-inline">Immediately upon the enactment of this Act, in addition to amounts otherwise available, there are appropriated out of any money in the Treasury not otherwise appropriated $50,000,000 to remain available until 5 years after the enactment of this Act for necessary expenses for the Internal Revenue Service to support efforts to increase enrollment of eligible households in the Renter Tax Credit allowed under <external-xref legal-doc="usc" parsable-cite="usc/26/36C">section 36C</external-xref> of the Internal Revenue Code of 1986 (including the advance payment of such credit under section 7527B of such Code), including but not limited to program outreach, costs of data sharing arrangements, systems changes, forms changes, and related efforts, and efforts by Federal agencies to facilitate the cross-enrollment of beneficiaries of other programs in such Renter Tax Credit, including by establishing intergovernmental cooperative agreements with States and local governments, tribal governments, and possessions of the United States: Provided, that such amount shall be available in addition to any amounts otherwise available: Provided further, that these funds may be awarded by Federal agencies to State and local governments, tribal governments, and possessions of the United States, and private entities, including organizations dedicated to free tax return preparation.</text></subsection></section></legis-body></bill>
