R. 6700</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20231211">December 11, 2023</action-date><action-desc><sponsor name-id="L000564">Mr. Lamborn</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Children’s Bureau to collect and maintain information regarding all private adoptions, and for other purposes.</official-title></form><legis-body id="HACEE6495136A4CEAA3EFD3A73D3D2341" style="OLC"><section id="H047B5CC60B184DDAA0C28C3E24FCAD24" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Adoption Counts Act</short-title></quote>.</text></section><section id="HD45F30C0D8D24088A1E3A16D505DE2EF"><enum>2.</enum><header>Adoption statistics</header><subsection id="H8A82E574E9E14490BD8A25EBC9CC52E0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 473A(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/673b">42 U.S.C. 673b(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC06966BD78684A0A89D0959ED5FA5A28" display-inline="no-display-inline"><paragraph id="H70CEF51EF1D04B73B38CB9EA1B0B8B33"><enum>(4)</enum><header>Additional requirement</header><subparagraph id="HF5344EA532BB407491781B2D6AF4A060"><enum>(A)</enum><header>In general</header><text>Notwithstanding paragraph (1), a State shall not be considered to be in compliance with this subsection for a fiscal year if any court of the State that finalized the adoption of a person pursuant to a voluntary consent or relinquishment in the calendar year ending in the preceding fiscal year has not submitted to the Children’s Bureau of the Department of Health and Human Services the report described in subparagraph (B) for the calendar year.</text></subparagraph><subparagraph id="H0E3EDC128E634096A76B73B59466C623"><enum>(B)</enum><header>Report</header><text>The report described in this subparagraph for a calendar year is a report that contains the following information about each adoption referred to in subparagraph (A) finalized by the court in the calendar year:</text><clause id="HB9ADA794B7EC48A3A1A33094203FA69E"><enum>(i)</enum><text>Whether the person at the time of the adoption was less than 1 year of age, not less than 1 year of age and less than 3 years of age, not less than 3 years of age and less than 18 years of age, or not less than 18 years of age.</text></clause><clause id="HCC9808696EFF490ABAB7E6A49F34CDBC"><enum>(ii)</enum><text>In the case that the person at the time of the adoption was less than 18 years of age—</text><subclause id="HB9ECFC32CCB14F0D83FD9C23830D32A1"><enum>(I)</enum><text>Whether the person was adopted by a step-parent, relative, or legal guardian of the child, or none of the foregoing.</text></subclause><subclause id="HB744B3D3BE534099906CB1F8E15C72F1"><enum>(II)</enum><text display-inline="yes-display-inline">Whether the person was born as a result of gestational surrogacy.</text></subclause><subclause id="H92CAD6B8D64F463AAA7D2E5D5677416D"><enum>(III)</enum><text>Whether the adoptive parents of the person had been given custody of the child through an international adoption placement or international guardianship.</text></subclause><subclause id="HC2FB32C857E844758341558F1A625411"><enum>(IV)</enum><text>At the option of the court, the race of the person.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDCA5FBC674234CD8984360962059ED32"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the 1st day of the 1st calendar year that begins after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
