<section id="H9BE32C6EE06140B0BE5320E6109F9AC0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defense Access Roads Improvement Act</short-title></quote>.</text></section> <section id="HDD0A9420AF734AB697B93535ED64DF16"><enum>2.</enum><header>Defense access road program enhancements to address transportation infrastructure in vicinity of military installations</header><text display-inline="no-display-inline">Section 2816 of the National Defense Authorization Act for Fiscal Year 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/81">Public Law 112–81</external-xref>) is amended—</text>
<paragraph id="H6D5E7978F62D4E6C81D1401983E98127"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="HB04D0D345A294DE8AAC9951E9EDA8536"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>this Act</quote> and inserting <quote>the Defense Access Roads Improvement Act</quote>; and</text></subparagraph>
<subparagraph id="HAFD741324BF44B7CAA1C035CBC35E077"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>this Act</quote> and inserting <quote>the Defense Access Roads Improvement Act</quote>; and</text></subparagraph></paragraph> <paragraph id="HEA15A11E38CA45A09FC709DACCC1C96D"><enum>(2)</enum><text>by adding at the end the following new subsections:</text>

<subsection id="HA980B66F13F442C5937801EF03F865A6"><enum>(d)</enum><header>Petition for certification of roads as defense access roads</header>
<paragraph id="HCDC14754D47841989FA6B152453524FD"><enum>(1)</enum><header>In general</header><text>Not later than October 1, 2024, the Secretary of Defense shall establish a formal mechanism under which—</text> <subparagraph id="HD843F34C6FE34FEE863E0BFB44485917"><enum>(A)</enum><text>a State, county, or municipality may petition the Secretary to certify roads as defense access roads under section 210 of title 23, United States Code; and</text></subparagraph>
<subparagraph id="HCF4CBF7927264E5AB5B9072DD5897641"><enum>(B)</enum><text>the Secretary shall respond, in writing, to any such petition.</text></subparagraph></paragraph> <paragraph id="H8734A2E7F0CC4AB290E480E6787EEF86"><enum>(2)</enum><header>State defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>State</quote> means any of the several States, the District of Columbia, American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, the Commonwealth of Puerto Rico, and the United States Virgin Islands.</text></paragraph></subsection>
<subsection id="H82BA6EE3A1BD415D9D4424C8EBB3EC14"><enum>(e)</enum><header>Public availability of information</header><text display-inline="yes-display-inline">The Secretary of Defense shall maintain and update regularly on an appropriate website of the Federal Government, a list of all roads certified as important to the national defense by the Secretary or by such other official as the President may designate. Such website shall include, for each such road, each of the following:</text> <paragraph id="H0BB1D4812DC74D8A8D8E5C5DF7055E4C"><enum>(1)</enum><text>The military installation (as such term is defined in section 2687(g)(1) of title 10, United States Code) that is in closest proximity to the road.</text></paragraph>
<paragraph id="H0501B460B09B45FCB14197198A5BB98D"><enum>(2)</enum><text>The date on which the road was so certified.</text></paragraph> <paragraph id="H99602A4F8C3942B9AE41203D8B0CFB87"><enum>(3)</enum><text>Any fiscal year for which the President transmitted to Congress under section 1105 of title 31, United States Code, a budget request that included an amount for such road.</text></paragraph>
<paragraph id="H821D2BE479EA45BE85E3FD87AED6CCE5"><enum>(4)</enum><text display-inline="yes-display-inline">Any fiscal year for which Congress appropriated an amount for such road.</text></paragraph></subsection> <subsection id="HCF851CBD0BA14323BFE7ADB1C160E7BB"><enum>(f)</enum><header>Treatment of classified information</header><text>Nothing in subsection (d) or (e) shall be construed as a requirement for the Secretary of Defense to make publicly available any classified information.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H2F69835943F14BDDBFD3812A7B86E126"><enum>3.</enum><header>Report on defense access roads</header><text display-inline="no-display-inline">Section 2814(b) of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/110/417">Public Law 110–417</external-xref>) is amended—</text> <paragraph id="HDC95046473154479B2470EB08E8317B0"><enum>(1)</enum><text>by striking <quote>April 1, 2009</quote> and inserting <quote>one year after the date of the enactment of the Defense Access Roads Improvement Act</quote>; and</text></paragraph>
<paragraph id="HF51F6DFAAD664E33AC29CDD77269512E"><enum>(2)</enum><text>by inserting before the period at the end the following: <quote>and name any road that the commander of a military installation (as such term is defined in section 2687(g)(1) of title 10, United States Code) or the Secretary of a military department has recommended that the Secretary of Defense certify as a defense access road during the period beginning on April 1, 2009, and ending on the date of the enactment of the Defense Roads Improvement Act</quote>.</text></paragraph></section> <section id="HA61420B8857A434C935AB1FA88D95A55"><enum>4.</enum><header>Improvement of defense access roads program</header><text display-inline="no-display-inline">Section 210 of title 23, United States Code, is amended—</text>
<paragraph id="H33281A0E9103401BBF2B3BE174D6CC0E"><enum>(1)</enum><text>in subsection (a)(1)—</text> <subparagraph id="HE783F5E46A5944F3A327E913647F6BA2"><enum>(A)</enum><text>in subparagraph (A)—</text>
<clause id="HA1B47736728A4D27A4449D0F13A038EA"><enum>(i)</enum><text>in clause (i), by inserting <quote>or military installations</quote> after <quote>reservations</quote>; and</text></clause> <clause id="H8A1D1FC73450438ABFBC37A774E00EAA"><enum>(ii)</enum><text>in clause (iii), by inserting <quote>or commercial shipyards</quote> after <quote>sea ports</quote>;</text></clause></subparagraph>
<subparagraph id="H3F6A980485AF43A7B5B0E2E53D7E66D5"><enum>(B)</enum><text>in subparagraph (C)—</text> <clause id="H54F7517C38C64737850095A8D18A3313"><enum>(i)</enum><text>in clause (i), by inserting <quote>or military installations</quote> after <quote>reservations</quote>; and</text></clause>
<clause id="HC23BDA9D554845058F7C434C45809615"><enum>(ii)</enum><text>in clause (ii), by inserting <quote>or commercial shipyards</quote> after <quote>sea ports</quote>;</text></clause></subparagraph></paragraph> <paragraph id="HC6FC6372210F4C9497FC6E722E6C5B51"><enum>(2)</enum><text>in subsection (f), by striking <quote>section 112</quote> and inserting <quote>sections 112, 113, and 313</quote>;</text></paragraph>
<paragraph id="HCE9056F65F3843F894312DB5AA7C19DE"><enum>(3)</enum><text>in subsection (i), by inserting <quote>, or commercial shipyard</quote> after <quote>sea port</quote>; and</text></paragraph> <paragraph id="HF205D4F3F9184F8E9E0B482EEB781B61"><enum>(4)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="HEB0DEA367F0E45A8A28DAABF71BB85BE"><enum>(j)</enum><header>Military installation defined</header><text display-inline="yes-display-inline">In this section, the term <quote>military installation</quote> has the meaning given that term in section 2801 of title 10, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body> </bill>
